ccm198401100 COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD TUESDAY, JANUARY 10, 1984 were Aldermen Penovich, DeAngelis, Dumke, Gaetzke, Nilsson and Called to order by Chairman Salentine at 7:54 P.M. Also present Tomczyk, City Attorney Molter and City Clerk Stewart. Ald. Colburn was absent. held December 13, 1983. Carried. Penovich moved, Gaetzke seconded, to approve minutes of meeting COMMITTEE REPORTS Penovich presented Finance Committee minutes of meetings held 1/4/84 and 1/10/84 and moved same be accepted. Dumke seconded, carried. held 12/15/83 and moved same be accepted. Gaetzke seconded, DeAngelis presented Public Sewer Committee minutes of meeting carried. Dumke presented Public Works Committee minutes of meeting held 1/5/84 and moved same be accepted. Penovich seconded, carried. The minutes of the Plan Commission meeting held 1/3/84 were received and placed on file. 0 J \ 1 PERSONAL APPEARANCE - Jackie St. Mary appeared to present the plan proposed for the Lake Meadows Area Park. LAWCON funds will be applied for. Park Board will review plans and request final plan to be prepared by HNTB. Mayor Salentine requested a written statement be obtained from the DNR stating the proposed public access to Lake Denoon meets their requirements. Anticipate completion date of 0ct.-Nov., 1984. Penovich requested the roads be graveled and not asphalted due to cost difference. UNFINISHED BUSINESS Ord.fl477 - An Ordinance to Amend Chapter 17, Section 8.01(7)A.3.b. of the Municipal Code (Livestock in an RCE District). Clerk gave second reading. Dumke moved for adoption. Tomczyk seconded, carried unanimously. NEW BUSINESS Reso.f/l-84 - Approval of Contract Between Waukesha County Department of Aging and City of Muskego. Penovich moved for adoption. Penovich seconded. Funds from TID #l to provide better equipment to serve expanded growth area in southern part of City. Carried unanimously. 0 Reso.#3-84 - Authorizing the Purchase of Parcel of Land for Glenbrook Drainage Project (Vanden Plas-TID #2-$4,850). Penovich moved for adoption. Nilsson seconded, carried unanimously. Reso.84-84 - Denial of Grievance-Neubauer. Dumke moved for adoption. Gaetzke seconded, carried unanimously. Reso.#5-84 - Preliminary Resolution Declaring Intent to Exercise Special Assessment Police Powers Under Sec. 66.60, Wis. Stats. as DeAngelis moved for adoption. Gaetzke seconded, carried to Sanitary Sewer Assessment Area for Kurtze Lane Project. unanimously. Reso.#6-84 - Preliminary Resolution Declaring Intent to Exercise Special Assessment Police Powers Under Sec. 66.60, Wis. Stats. as to Sanitary Sewer Assessment Area for Woods Road Project. DeAngelis moved for adoption. Penovich seconded, carried unanimously. ,. Reso.#7-84 - A Resolution Refusing Consent to Milwaukee Metropolitan Sewerage District to Redefine its Boundaries to Include the City of Pluskego Service Area. Nilsson moved for adoption. Tomczyk seconded, carried Unanimously. Reso.#8-84 - Authorizing Execution of Maintenance Agreement - City Hall Copy Machine (COS Copiers-$325/yr.plus .Ol/copy over 30,000.) Dumke moved for adoption. Penovich seconded, carried unanimously. , Ord.#479 - An Ordinance to Amend Chapter 13, Section 13.016 of the Municipal Code (Cats). 1st reading by title only. Ord.ft480 - An Ordinance to Amend Chapter 3, Section 3.10(4)(a) of the Municipal Code (Outhouses). 1st reading by title only. Ord.#481 - An Ordinance to Amend Chapter 3, Section 3.10 of the Municipal Code (Sewer Service District and Rates for Holding Tanks). 1st reading by title only. Dumke moved to suspend rules Clerk gave second reading. Dumke moved for adoption. Gaetzke to allow second reading. Gaetzke seconded, carried unanimously. seconded. Nilsson moved to amend Section 3 to add: "and the approval of any other governmental agencies." Atty. Molter advised against this ordinance. Upon roll,Ord.#48l(As Amended) was adopted unanimously. Common Council 1/10/84-Page Three LICENSE APPROVAL - Penovich moved for approval of operators Mary Rozek, Brian Williams, Georgia Wilson, Debbie Schaumberg and licenses for Elizabeth Trapman, Marguerite Ingold, James Dimond, Debra Oleck. Nilsson seconded, carried unanimously. Penovich moved to Table request for operator's license from Bryan Berg because he failed to appear before Finance Committee as requested. Gaetzke seconded, carried unanimously. 3 Penovich moved for approval of Gathering Permit for Land '0 Lakes for February 4-5, 1984 at Idle Isle. Tomczyk seconded. Gaetzke moved that the motion be amended to require the posting of a $200 bond to be returned upon satisfactory policing of the area by the Parks Department. Dumke seconded, carried. Motion as amended carried unanimously. VOUCHER APPROVAL - Penovich moved for approval of payment of General Vouchers in the amount of $294,939.21. Tomczyk seconded, carried unanimously. Nilsson moved for approval of payment of Sewer Utility Vouchers in the amount of $38,253.86. Tomczyk seconded, carried unanimously. CITY OFFICIAL'S REPORTS - The Clerk read the Building Report for November, 1983 $518,095, and December, 1983 showing 2 dwelling units and total showing 8 dwelling units and total construction of construction of $147,850. Clerk reported Public Hearings would be held on January 23, 1984 at 7:OO P.M. on the Special Assessments for Sanitary Sewer and Assessment District "P" (Woods Road Project). Installation for Assessment District "0" (Kurtze Lane Project) Clerk reported a Public Hearing would be held on February 14, 1984 at 7:OO P.M. to consider amending the Zoning Ordinance text and district map to provide for Exclusive Agriculture zoning. Clerk acknowledged receipt of a lawsuit filed against the City by Title Insurance Co. of Minnesota regarding the former R.Ford property and referred same to city's attorneys and insurance co.
