MINUTES OF MEETING HELD DECEMBER 14, 1982
Called to order by Mayor Salentine at 7:55 P.M. Present, Aldermen
Klenz, Colburn, Dumke, Nilsson, Penovich and Tomczyk, City Clerk
Stewart and Attorney Molter.
Klenz moved to approve 11/23/82, 11/29/82 and 12/8/82 minutes. Penovich
seconded. Carried.
COMMITTEE REPORTS
Finance - Penovich presented, Klenz seconded to accept reports of
12/8/82 and 12/14/82. Carried.
Public Sewer - Nilsson presented and moved, Tomczyk seconded, to
accept report of 12/6/82. Carried.
The minutes of Plan Commission meeting of 12/7/82 were accepted and
placed on file.
UNFINISHED BUSINESS
Resolution #203-82 - Extension of Contract and Landfill Site (On floor)
Ald. Tomczyk moved to amend Sec. 2.1 by inserting 12/7/82 and 80 acres
into blank portion of the Sec. and to have "Exhibit "B" read "Exhibit "A"
indicating payment per year. Also, Sec. 3.7, Hours of Operation to
. Also,Section 3.1, to insert the figure $15,000.00 into the blank

Ald. Colburn pointed out the contract is for a two-year approval, with
annual review by the Plan Commission. Ald. Tomczyk requested pernlission
to have Mr. Richard Knudsen speak. As there were no objections; Mr.
Knudsen stated his reasons as to why the Council should deny the
permit for the sanitary landfill. Upon roll call on-the mo'tion to
Treba and Colburn voted "aye". Aldermen Nilsson and Penovich voted adopt.Resolution #203-82, As Amended, Aldermen Dumke, Klenz, Tomczyk,
. The motion carried.
Resolution #213-82 - Authorizing the Filling of Vacant Cadet Position
Nilsson, Treba voted "aye". Aldermen Dumke, Penovich, Colburn and
(On the floor). Upon roll call on the motion to adopt, Aldermen Klenz,
Tomczyk voted "no". The motion to adopt did not carry.
NEW BUSINESS
The following resolutions were acted upon:

#229-82 - Approval of Certified Survey Map (E & M Krause). Colburn
Condemnation). Klenz moved, Nilsson seconded, to adopt. Dumke moved
#230-82 - Relocation Order of the City of Muskego (Re: Sanitary Sewer
to amend by adding the wording "With the approval of the Lake Brittany
Homeowner's Association. Seconded by Colburn. Upon the advice of
the city attorney, Dumke requested, with the permission of his second,
to withdraw his motion. He suggested the resolution be adopted, as is,
however it would be contingent upon notification by Ald. Dumke that
the Lake Brittany Homeowner's Association approve of the resolution.
Upon roll call the motion to adopt carried unanimously.
#231-82 - Authorizing the Hiring of an Appraiser and Relocation Expert
to Carry Out the Relocation Order Known as Resolution #330-82. Ald.
Dumke moved, Tomczyk seconded, to adopt. Unanimously carried.
Primary Transit Plan for the Milwaukee Area. Colburn moved, Treba
#232-82 - Recommending Denial of SEIVRPC's Planning Report No. 33,
Commission has an opportunity to review the matter further. Unanimously
seconded, to adopt. Colburn moved to defer action until the Plan
carried.
Common Council - 12/14/82
Employees Penovich moved, Colburn seconded, to adopt. Motjon
#234-82 - Authorizing Execution of Labor Agreement With Public Works
carried with Ald. Dumke voting "no"
6235-82 - Authorizing Execution of Labor Agreement Between the
City and hluskego Police Association. Ald Treba moved, Penovich
seconded, to adopt. Motion carried unanimously.
#236-82 - Clarifying the City's Policy Regarding the Refilling
of any Vacant Positions in the City. Ni lsson moved. IJcnuvicIi
seconded, to adopt. (Filling 01 vacancies to be approved by Conunon
Council). Unanimously carried
Tomczyk seconded, to adopt. Ald. Klenz requested permission to have ,4237-82 - Denial of Zoning Request (Tara Land Corp. ). Col l)u~,n moved,
Mr. Marvin Tarachou, Designer for Tara Land Corp., speak. Mr.
Tarachou, owner of the property in question, stated he had been
ill and unable to attend the public hearing. He reviewed his plans
for a colonial type building valued at approximately $400,000.00
to be used as a small medical clinic. Upon roll call on the motion
to adopt e237-82, Ald. Klenz voted "aye". Aldermen Colburn, Dumke,
Treba seconded, to refer #237-82 back to Plan Commission for further
Nilsson, Tomczyk, Penovich and Treba voted "no". Colburn moved,
contact the persons who signed the petition opposing the proposed
review. He stated Mr. Tarachou will now have an opportunity to
rezoning. Upon roll call the motion to refer carried unanimously.
3238-82 - Approval of Agreement Between the City of hluskego and
Associated Hospital Service, Inc. (Blue Cross-Blue Shield). Klcnz
moved, Penovich seconded, to adopt. ($172.22 Family rate and $62.22
Single rate). Unanimously carried.

Volunteer Fire Dept. for 1983. Nilsson moved, 'I'omczyk seconded, to
adopt. Unanimously carried.
$241-82 - Approval ol' Fire Protection Contract With Muskego Volunteer
Fire Co. for 1983. Nilsson moved, Tomczyk seconded, to adopt.
Unanimously carried.

VOUCHER APPROVAL - Ald. Klenz moved for the approval of payment of
vouchers in the amount of $377,274.91. Seconded by Penovich. Unan-
imously carried.
Klenz moved, Tomczyk seconded, to approve sewer utility vouchers in
the amount of $4,418.76. Unanimously carried.
LICENSE APPROVAL - Penovich moved, Treba seconded, to approve Operator's
License for Beth Kosir, Ted Johnson, Ralph Kachelmeier, Alan Sackman
and Bryan Goetsch subject to receipt of favorable police report.
