ccm19811124r- .---- / r- f ,.-- COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD NOVEMBER 24, 1981 The meeting was called to order by Mayor Gottfried at 7:40 P.M. Also present were Aldermen Dumke, Penovich, Radtke, Steinberg and Salentine. Ald. Knudsen ar.rived at 8:05 P.M. and Ald. Klenz was absent. City Clerk Stewart and Acting City Attorney John Macey were also: present. Ald. Dumke moved for the approval of minutes of meeting held 11/10/81, . as mailed. Seconded by Ald. Penovich. Ald. Salentine moved to amend the minutes by changing the amount of $77.03 to $477.03 under New Business, Resolution #178-81. Seconded by Ald. Steinberg. Motion to accept the minutes of 11/10/81, as amended, carried. COlßIITTEE REPORTS Ald. Salentine presented the reports of the Finance Committee meetings held on 11/18/81 and 11/24/81 and moved that same be accepted and placed on file. Seconded by Ald. Radtke. Motion carried. ' Ald. Salentine presented the report of the Public Sewer Committee meeting held 11/16/81 and moved that same be accepted and placed on file. Seconded by Ald. Penovich. Motion carried. Ald. Penovich presented the report of the Public Works Committee meeting held 11/19/81 and moved that same be accepted and placed on file. Seconded by Ald. Dumke. D~scussion took place regarding fill supplied to St. Paul's Church from the Tess Corners Drainage Project. Matter to be discussed at the next Public Works Committee meeting. Ald. Penovich presented the report of the Public Welfare Committee meeting held 11/19/81 and moved that same be accepted and placed on file. Seconded by Ald. Steinberg. Motion carried. Ald. Radtke presented the report of the Rules, Laws & Ordinance Committee meeting held 11/12/81 and moved that same be accepted and placed on file. Seconded by Ald. Salentine. Motion carried. The minutes of the Plan Commission meeting held 11/17/81 were received and placed on file. NEW BUS INESS Resolution #182-81 - Recognizing the Services of Tom Raimann for His Services on the Parks & Recreation Board. With the permission of the aldermen, Mayor Gottfried requested this resolution be acted upon at this time. The Clerk read the resolution. AId, Dumke moved for adoption. Seconded by Ald. Steinberg, Upon roll call the motion carried unanimously. Mayor Gottfried presented Tom Raimann with a signed copy of the resolution and a placque, on behalf of the Parks and Recreation Board, in appreciation of Dr. Raimann's efforts while serving seven years on the Board. UNFINISHED BUSINESS Ordinance #418 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Section 3.10(6) of the Municipal Code (Re: Authorizing the City Clerk to assess sewer user charges on a monthly basis in advance). Ald. Salentine moved for adoption. Seconded by Ald. Dumke. Upon roll call the motion to adopt carried unanimously. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried advised those present the Muskego Lions Club will be donating a municipal Christmas tree in the area of City Hall and the lighting ceremony will be held on December 13th. Radtke moved for adoption. . Seconded by Ald. Knudsen. Upon roll call the motion carri~d unanimou~ly Resolution #181-81 - Acceptance of Low Bid for Forced Hookup (Mahoney) Ald. Salentine moved for adoption. Seconded by Ald. Steinberg. The low bid received from John Lang Trenching in the amount of $6,485.00 Upon roll call the motion carried unanimously. Resolution #183-81 - Granting permission for Driving Skill Contest on Big Muskego Lake (Badgerland TNT 4x4 Club) (February 7 and 2~st, 1982) Ald. Radtke moved for adoption. Seconded by Ald. Penovich. Upon roll call the motion carried with Ald. Steinberg voting "no". Resolution #184-81 - Granting Permission for Driving S~ill Contest - Muskego Corvette Club - Schubring Bay on Little Muskego Lake. Ald. Knudsen moved for adoption. Seconded by Ald. Radtke. Upon roll call the motion carried with Ald. Steinberg voting "no". (Contest to be held January 16, 1982.) Resolution #185-81 - Clarifying Sewer Usage Charge for Fahning Duple~ Ald. Salentine moved for adoption. Seconded by Ald. Dumke. Following discussion regarding past procedures of single billings of duplex dwellings, Ald. Knudsen moved to defer this resolution for two weeks. Seconded by Ald. Penovich. Upon a roll call vote on the motion to defer, Aldermen Dumke, Radtke and Steinberg voted "no". Aldermen Knudsen, Penovich and Salentine voted "aye". There being a tie vote, Mayor Gottfried voted "no". The motion to defer did not carry. Further discussion took place during which Mayor Gottfried advised the building has not been used as a duplex since 1976, however, the owner has stated they wish to retain the duplex status. Upon a roll call vote on the motion to adopt Resolution #185-81, Aldermen Dumke, Radtke, Salentine and Steinberg voted "aye". Aldermen Penovich and Knudsen voted "no". The motion to adopt carried. Resolution #186-81 - Authorizing Contribution for Cost of Litigation (MMSD). Ald. Salentine moved for adoption. Seconded by Ald. Dumke. (Payment due $2,834.00). Upon a roll call vote on the motion to adopt Resolution #186-81 the motion carried with Ald. Knudsen casting a dissenting vote. ~ Resolution #187-81 - Authorizing Service Agreement With Motorola. Ald. Radtke moved for adoption. Seconded by Ald. Dumke (Radio service for certain equipment in the Police Department - $336.50 per mo.) Upon a roll call vote the motion carried unanimously. Resolution #189-81 - Directing City Attorney to Appeal Little Muskego Lake Charge. Ald. Steinberg moved for adoption. Seconded by Ald. Salentine. Ald. Radtke urged the aldermen to defer action on this resolution in order to have the Board of Commissioners review the matter. He therefore moved to defer action on Resolution #189-81 until the next meeting. Seconded by Ald. Dumke. Ald. Salentine urged the aldermen not to defer action on this resolution. Upon a roll call vote on the motion to defer, Aldermen Dumke and Radtke voted "aye". Aldermen Knudsen, Penovich, Salentine and Steinberg voted "no". The motion to defer lost. Upon a roll call vote on the motion to adopt Resolution #189-81 the motion carried with Ald. Radtke voting "no". - Ordinance #417 - The Clerk gave the first reading of same, entitled, An Ordinance to Amend Ch. 20, Section 20.08 of the Municipal Code (Re: Skin Diving). ,-. r (' r " r (' " Common Council November 24, 1981 Page 3. LICENSE APPROVAL - Ald. Salentine moved for the approval of Operator's Licenses for Arden Millard, Sandra Hollencamp, Kim Kreuzer and Joseph Preiser. Seconded by Ald. Dumk~. Motion carried. VOUCHER APPROVAL - Ald. Dumke moved for the approval of payment of vouchers in the amount of $213,446.90. Seconded by Ald. Knudsen. Upon roll call the motion carried unanimously. COM1iUNICATIONS AND MISCELLANEOUS BUSINESS - The Clerk read a petition for determination of status of Lot 3 Block 13, Muskego Shore Subdivision submitted by Charles Colburn.
