ccm19801028CONMON COUNCIL CITY OF MUSKEG0 YINGTES OF MEETING HELD OCTOBER 28, 1980 Also present were Aldermen Steinberg, Weed, Radtke, Van Lanen, Knudsen, The meeting was called to order by Mayor Jerome Gottfried at 7:45 P.M Salentine and Dumke, City Attorney Molter and City Clerk Stewart. Ald. Dumke moved to approve the minutes of the meeting held 10/14/SO and moved that same be accepted and placed on file. Seconded by Ald. Weed. Motion carried. COMMITTEE REPORTS Ald. Weed presented the reports of the Finance Committee meetings held 10/22/80 and 10/28/60 and moved that same be accepted and placed on file. Seconded by Ald. Radtke. Motion carried. Ald. Salentine presented the report of the Public Works Committee meeting held 10/23/80 and moved that same be accepted and placed wr file. Seconded by Ald. Need. Motion carried. Ald. Radtke presented the report of the Public Sewer Committee meeting held 10/20/80 and moved that same be accepted and placed on file. Seconded by Ald. Steinberg. Following discussion regarding procedures used in seeking quotes for forced hookups, P.ld, Knudsen moved to delete the 1st paragraph on page 2 of the report and to act on said paragraph separately. (Re: authorizing the Building Inspection Department to seek quotes for forced hookups in the Lake Denoon area) Upon a roll call vote on Ald. Knudsen's motion, Aldermen Dumke, Knudsen, Salentine and Van Lanen voted "aye". Aldermen Radtke, Steinberg and Weed voted "no". On the motion to accept the Public Sewer Report minus the 1st paragraph on page 2, the motion carried unanimously. On the matter of whether or not the Building Inspection Department should take the necessary action to complete the forced hookups in the Lake Denoon area, Aldermen Dumke, Radtke, Salentine, Steinberg and lJeed voted "aye" Aldermen Knudsen and Van Lanen voted "no". The paragraph was approved Ald. Van Lanen presented the report of the Public Welfare Committee meeting held 10/21/80 and moved that same be accepted and placed on file. Seconded by Ald. Steinberg, Upon roll- call the motion carried unanimously. The minutes of the Plan Commission meeting held 10/21/80 were received and placed on file. UNFINISHED BUSINESS Ordinance #399 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Ch. 16 of the Municipal Code (Re: Plumbing Code amendments) Ald. Dumke moved for adoption. Seconded by Ald. Need. Ald. Knudsen moved to refer Ordinance {:399 to the Rules, Laws Ald. Van Lanen. Upon a roll call vote the motion carried with Ald. €X Ordinance Committee to have them act on the ordinance. Seconded by Radtke voting "no". The motion to defer carried. Ordinance 8400 - The Clerk gave the second reading of same, entitled, Anrdinance to Amend Ch. 12, Sec. 12.01 (2) (f) of the Municipal Code (Re: Operator License Fees). Ald. Salentine moved for adoption. Seconded by Ald. Van Lanen. Upon a roll call vote the motion carried unanimously. " . Common Council October 28, 1980 - P 2 NEW BUSIXESS Resolution #180-80 - Directing the Attorney to Draft the Implementing RS-2 (OLR) to RS-2 (OD) - Berken). Ald. Salentine moved for adoption. Seconded by Ald. Van Lanen. Ald. Van Lanen moved to defer action on this resolution until the next meeting. Seconded by Ald. Knudsen. Following a short discussion, with the permission of his second, Ald. Van Lanen withdrew his motion to defer. Upon a roll call vote on the motion to adopt, the motion carried unanimously. Resolution #181-80 - Resolution Declining Participation in the Wauk- &a CountyFedfrZted Library System. Ald Knudsen moved for adoption Seconded by Ald. Dumke Ald. Knudsen moved to delete the last para- graph of the resolution. Seconded by Ald. Dumke. Notion carried. Considerable discussion follwded with Ald. Van Lanen urging his fellow aldermen to defeat Resolution #l81-80. Ald. Knudsen moved to change the word "decline" to "agree" in the resolution. Mayor Gottfried declared his notion out of order and Ald. Knudsen then moved to appeal the decision of the Chair. Seconded by Ald. Van Lanen. Upon a roll Dumke, Radtke, Salentine, Steinberg and Weed voted "no". Aldermen call vote on the motion to appeal the decision of the Chair, Aldelmen Knudsen and Van Lanen voted "yes". The motion did not carry. Upon a roll call vote on the motion to adopt Resolution #181-90, Aldermen men Dumke and Weed voted "aye". The motion to adopt did not carry. Knudsen, Radtke, Salentine, Steinberg and Van Lanen voted "no". Alder- the Zoning' District Map of the City (Sec. 10 - Resolution $1183-80 - - Authorizing Expansion of the City's Landfill Site. Ald. Weed moved for adoption. Seconded by Ald. Dumke. Ald. Knudsen moved to refer this resolution to the Weifare Comnittee for roll call vote on the motion to defer action Aldelmen Dumke, Knudsen, that comnitte's recommendation. Seconded by Ald Van Lanen. Upon a Salentine and Van Lanen voted "aye". Aldermen Radtke, Steinberg and Weed voted "no". The motion to defer and refer the resolution to the Welfare Committee carried. Resolution 0184-80 - The Clerk read same, entitled, Establishing Fee for Rescue Sel-vice. Ald. Weed moved for adoption. Seconded by Ald. Dumke. Rescue fee to be $85 00). Upon a roll call vote the motion to adopt carried unanimously. Zesolution $1185-80 - The Clerk read same, entitled, Acknowledging Reczipt of Waivers of Hearing (Re: North Shore Drive). Ald. Salentine moved for adoption. Seconded by Ald. Dumke. Upon roll call unanimously carried. - Resolution #186-80 - Accepting Low Bid of Do--Rite Plumbing and Ex- cavating Co. forateral Installation (North Shore Drive). Ald. Sal- entine moved for adoption. Seconded by Ald. Steinberg. s upon roll call the motion carried unanimously. Resolution #188-80 - Determining Sewer Usage Charge Under Section 5K of Ordinance #l55 (Re: Buildings with no or rarzly used plwhbing) Ald. Salentine moved for adoption. Seconded by Ald. Steinberg. Upon roll call the motion carried unanimously. - Resolution 3189-30 - Accepting Low Bid for Reconstruction of North Shore Drive. A1x Salentine moved to suspend the rules that would I,!eed. Upon a roll call vote the motion to suspend the rules carried Interfere with che adoption of this resolution. Seconded by Ald. with Ald. Knudsen votin "no". (The low bid being W.K. Fredericks & Son in the amount of 8 113,952.00) The Clerk read the resolution. Ald. Dude moved for adoption. Seconded by A.ld. Salentine. Upon a roll call vote the motion to adopt carried unanimously. kn Ordinance to Amend the Zoning District >lap of the City (Blattner) Ordinance 3401 - The Clerk gave the first reading of same, entitled, An Ordinance to Amend Section 11.04 (1) (a) of the ?.iunicipal Code Ordinance 8402 - The Clerk gave the first reading of same, entitled, (Re: Dump Refuse Permit Hauling Fees). - Conmon Council 10/26/80. Page 3 LICENSE APPROVAL - Ald. Weed moved for the approval of Operator’s Licenses for Kelley Mageske, Elizabeth Trapman, Ron Acker and Jerry Ziolecki subject to receipt of favorable police reports. Seconded by Ald. Radtke. Motion carried. VOUCHER APPROVAL - Ald Weed moved for the approval of payment of general vouchers in the amount of $626,963 58. Seconded by Ald. Dumke Motion carried MISCELLA.NEOUS BUSINESS - Mayor Cottfried requested the aldermen -ns for public access points on Big Muskego Lake and Bass Bay as per the request of the DNR. Aldermen Weed and Van Lanen requested Mayor Gottfried to contact tire dealers in the city to determine whether or not they have had a problem disposing of old tires. ADJOURNMENT - Ald Steinb,erg moved to adjourn. Seconded by Aid. Dmke. Upon a roll call vote on the motion to adjourn, Aldermen Dumke, Radtke, Steinberg and Weed voted “aye”.
