ccm19801014COMMON COUNCIL CITY OF EWSKEGO MINUTES OF MEETING HELD OCTOBER 14, 1980 The meeting was called to order by Mayor Jerome Gottfried at 7:52 P.M. Also present were Aldermen Steinberg, Weed, radtke, van Lanen, Knudsen, Salentine and Dumke, City Attorney Molter and City Clerk Stewart. Ald Dumke moved to approve the minutes of the previous meeting held Motion carried. At this time Mayor Gottfried requested permission of the Aldermen to have Waukesha County Board Supervisor Frank Narlock speak As there were no objections Mr Narlock reviewed the proposed Waukesha County Federated Library System to the Alderinen. Ald. Van Lanen, Council Representative to the Library Board, urged his fellow aldermen to vote in favor of the proposed system. v 9/23/80 and that same be placed on file. Seconded by Ald. Steinberg. COMMITTEE REPORTS Ald. Weed presented the reports of the Finance Committee meeting held by Ald. Radtke. Upon a roll call vote Aldermen Dumke, Radtke, Salentine 10/8/80 and moved that same be accepted and placed on file. Seconded and Weed voted "aye". Aldermen Knudsen, Steinberg and Van Lanen voted "no". The motion to accept the minutes carried. Ald. Weed presented the report of the Finance Committee meeting held October 14, 1980 and moved that same be accepted and placed on file Seconded by Ald. Dumke. Upon a voice vote the motion carried. Ald. Salentine presented the report of the Public Works Committee meeting held 10/9/80 and moved that same be accepted and placed on file. Seconded by Ald. Steinberg Motion carried Ald Knudsen presented the report of the Rules, Laws & Ordinance Committee meeting held 9/24/80 and moved that same be accepted and placed on file. Seconded by Ald Radtke Motion carried. Ald. Van Lanen presented the report of the Public Welfare Committee meeting held 9/24/80 and moved that same be accepted and placed on file. Seconded by Ald. Steinberg. Motion carried. The minutes of the Plan Commission meeting held 10/7/80 were received and placed on file NEW BUSINESS Resolution #166-80 - The Clerk read same, entitled, Approval of Certified Survey Map (Steven Schuler) Ald. Salentine moved for adoption. Seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Resolution 11176-80 - The Clerk read same, entitled, Approval of Agreement Between Boldt-DeAngelis and the City of Muskego. Ald Dumke moved for adoption. Seconded by Ald. Salentine. Mayor Gottfried briefly reviewed the past history of events leading to the development of this resolution. Ald Salentine indicated all parties involved would like to see the matter resolved He urged his fellow aldermen to vote in favor of the resolution. Upon a roll call vote the motion to adopt Resolution 11176-80 carried unanimously. Final Plat (Harbor Point - Town of Norway). Ald. Salentine moved for Resolution 11167-80 - The Clerk read same, entitled, Re-approval of unanimously. adoption Seconded by Ald. Knudsen. Resolution $1169-80 - The Clerk read same, entitled, Re-approval of Final Plat - Whispering Hills of Lake Waubeesee). Ald. Salentine moved for adoptioi Seconded by Ald. Weed. Motion carried unanimously Resolution $1170-80 - Directing the Attorney to Draft the Implementing Ordinance to Amend the Zoning District Map of the City (R3 to R3 (OA) Section 24 (Blattner) Ald. Salentine moved for adoption Seconded by Ald. Dumke. Motion carried unanimously. Resolution $1171-80 - Approval of Holding Tank Agreement (Beach House at Waukesha County Park) Ald Weed moved for adoption. Seconded by Ald. Dumke Upon roll call the motion carried bnanimously. Resolution $1172-80 - The Clerk read same, entitled, Providing Bus Service to Senior Citizens of the City of Muskego. Ald. Weed moved for adoption. Seconded by Ald. Steinberg. Upon roll call the motion carried unanimously. Resolution #173-80 - Approving a Proposed Division of Land Owned by moved for adoption Seconded by Ald. Radtke. Motion carried unan- the City of Muskego (Area of McShane Drive - 3 lots). Ald. Weed imously . Resolution $1174-80 - The Clerk read same, entitled, Accepting the Low Bid tor Pavine (Parkine Lot and Walkways at Bluhm Park) Wolf Paving Co. Ald Weed moved for adgption. Secondeh by Ald. Steinberg. Motion- carried unanimously (Bid amount is $21,505.00). u. Resolution $1175-80 - Denying Petition to Rezone Parcel of Land RS-3 to RS-3 00s - John Schaal. Janesville Rd. Ald. Salentine moved for adoption. Seconded by Ald. Radtke. Following discussion regard- ing the Plan Commission's recommendation to deny the proposed re- zoning, Ald. Salentine moved to amend Resolution $1175-80 by adding the following paragraph "BE IT FURTHER RESOLVED the reasons for denial are based on the following: 1. The area is predominately residential in nature. 2 The comprehensive plan of the city does not 3. The Planning Consultant has reviewed this request anticipate business in this area. and has recommended denial. Motion seconded by Ald. Van Lanen. Upon a roll call vote on the motion to amend, the motion carried with Ald. Knudsen voting "no". Upon a roll call vote on the motion to adopt Resolution #175-80 the motion carried with Ald. Steinberg voting "no". Resolution $1177-80 - Setting Public Hearing for Zoning Ordinance Amend- ments (Accessory Buildings, Temporary Signs, Quarrying and Accessory Use Fees) Ald Salentine moved for adoption. Seconded by Ald. Knudsen. Public hearing to be November 11, 1980 - 7:15 P.H Motion carried. Resolution $1178-80 - Acceptance of Low Quote of General Landscaping (John Hein) for Work on Police Dept. Property. Ald. Steinberg moved for adoption. Seconded by Ald. Dumke. Arrmnt of quote was $4,840.00) Discussion was held regarding procedure for which quotes were acquired as well as whether or not the landscaping needs to be completed immed- iately because of a drainage problem on the west side of the police Gottfried after which upon a roll call vote on the motion to adopt of the aldermen voting "no". Upon roll call the motion carried unanimously. * Ordinance 8399 - ?he Clerk gave the first reading of same, entitled, An Ordinance to Amend Ch. 16 of the Municipal Code (Re: Plumbing Code Amendments) An Ordinance to Amend Ch 12 Sec. 12 01 (2) (f) (Re: The raising of Ordinance #400 - The Clerk gave the first reading of same, entitled, Operator fees from $5 00 to $10.00) VOUCHER APPROVAL - Ald Weed moved for the approval of payment of general vouchers in the amount of $201,777.81. Seconded by Ald. Dumke. Upon roll call the motion carried unanimously. LICENSE APPROVAL Ald. Weed moved for the approval of Operator's Licenses for Robert Just, Margaret Just, Lois Gerstmann, Rici Schuler, Allen Bollhagen, Ronald Bonich, Jeffrey Socher, John Knapp and Christine 0 Ald Dumke. Upon a roll call vote the motion carried with Ald Stein- Bennett, subject to receipt of favorable police report. Seconded by berg voting "no". Ald Weed moved for the approval of a Class "B" Fermented Malt Beverage License for Heidi Herzberg (Cafe Europa) subject to the expiration of the 15-day waiting period. Seconded by Ald Salentine. Motion carried. Ald. Weed moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Patricia Serkowski (Denoon Beach) Ald. Dumke. Motion carried. subject to the expiration of the 15-day waiting period Seconded by Ald Weed moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Helen Just (Racine Ave. and Kelsey Dr ). Seconded by Ald Dumke Motion carried. Ald Weed moved for the approval of a Gathering Permit for the Muskego Volunteer Fire Company Ladies Auxiliary for 11/8/80 at the Muskego Fire Co. Station #2. Seconded by Ald. Steinberg. Motion carried. Homecoming for 10/18/80. Seconded by Ald. Dumke. Motion carried. Ald. Weed moved to grant a Parade Permit for Muskego High School CITY OFFICIAL REPORTS - The Clerk gave the September, 1980 Building Report, indicating 5 new dwellings and total construction in the amount of $386,622.92. Same placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Clerk read a communi- cation from Thomas and Nancv Berken requesting amend their rezoning petition from RS-2 (OLR) to- RSA to RS-2 (0LR)-to RS-2 (OD) (Overla; for duplex. (Area of Briargate and Lannon Dr.). Ald.Dumke advised his fellow aldermen of the forthcoming special Rules, Laws & Ordinance Committee meeting to be held on Monday, October 27, 1980 at 7 30 P.M. for the purpose of discussing the Majority and Minority Reports prepared by members of the Citizens Government Structure Committee.
