ccm19791211COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF MEETING HELD DECEMBER 11, 1979 Also present were Aldermen Dumke, Ford, Pietruszynski, Tomczyk, Van Lane The meeting was called to order at 7:35 P.M. by Mayor Jerome Gottfried. Salentine and Weed, City Clerk Bowyer and Attorney Don Molter. Ald. Dude moved for the approval of the minutes of the previous meeting held November 27, 1979 and that same be placed on file. Seconded by )I Ald. Tomczyk. Motion carried. Ald. Tomczyk presented the report of the Finance Committee meeting held December 5, 1979 and moved that same.be accepted and placed on file. Seconded by Ald. Dumke. Motion carried. Ald. Weed presented the report of the .Publ.ic. Works Comittee .meeting file Seconded by Ald. Pietruszynski speaking as being opposed having Section 26.02(w) read as follows: "The director, subject to to the ordinance. Ald. Van Lanen moved to amend Ordinance 9378 by approval of the Park and Recreation Board, may from time to time establish areas on city-owned property'upon which fishing is prohibited; said areas shall be clearly marked by signs indicating that fishing is prohibited". Seconded by Ald. Salentine. Upon a roll call vote to amend Ordinance 11378 the motion carried with Ald. Pietruszynski voting "no". On the motion to adopt Ordinance #378, As Amended, the motion carried with Ald. Pietruszynski voting "no". COMMUNICATIONS FROM THE MAYOR'S'OFFICE - Mayor Gottfried advised that Resolution a222 - I9 , Transfer ofTunds and Resolution #223-79-. Denial of Claim of Thomas Weber, will not be acted upon at this meeting. @ NEW BUSINESS Resolution 8221-79 - The Clerk read same, entitled, Recognizing the Services of George Trepanier, Sr. Ald Ford moved for adoption. Mr Trepanier with a placque in appreciaton of his work as Assistant Seconded by Ald. Tomczyk. At this time Mayor Gottfried presented Civil Defense Director of the City since 1963 and he publicly thanked him for his services. Upon a roll call vote the motion to adopt Resolution #221-79 carried unanimously. Resolution 8224-79 - The Clerk read same, entitled, Approval of Permit for Portable Asphalt Plant for Payne & Dolan of Wisconsin. Ald. Sal- entine moved for adoption. Seconded by Ald. Tomczyk. Upon a roll call a- vote the motion to adopt carried unanimously. Resolution 11225-79 - The Clerk read same, entitled, Approval of Fire Protection Contract With Muskego Volunteer Fire Company for 1980. Ald. Weed moved for adoption. Seconded by Ald. Tomczyk. Upon a roll call vote the motion carried unanimously. Common Council December 11, 1979 Page 2. 8 Resolution #226-79 - The Clerk read same, entitled, Approval of Fire Protection Contract with Muskego Volunteer Fire Company for 1980. Ald. Tomczyk moved for adoption Seconded by Ald. Weed. Upon a roll call vote the motion carried unanimously. At this time the city's Financial Consultant, Mr. Seegar Swanson of Ehlers & Associates, and who was present this evening, reviewed for 0. the aldermen the steps that had been taken earlier by the Plan Commission and the Common Council to have the Eity of Muskego participate in tax increment financing. Mr. Swanson responded to questions from the or not the projects can be deleted or changed and the advantages of aldermen regarding the city's responsibility regarding debts, whether recapturing monies previous borrowed for capital budgeting. At 9:12 P.M. Mayor Gottfried declared a recess and the meeting recon- vened at 9:20 P.M. Resolution #227-79 - The Clerk read same, entitled, Resolution Approving a Pro~ject Plan for Tax Increment District 91 - City of Musketzo Ald Salentine moved for adoption. Seconded by~~Ald. Tomczyk. Ala. Piet- of the Council. His motion lost for lack of a second. Ald Salentine ruszynski moved to defer action on this resolution until the next meeting moved to amend Section P of the Project Plan for Tax Increment District as follows: "In the event the Town of Norway Sanitary District's sewer NO. 1 by deleting the words "or expanded" therefore having Sec. P read treatment plant is modified and the city is required to contribute to project cost of this district.".Seconded by Ald. Tomczyk. Upon a voice the capital cost of such a project, then the Muskego share shall be a vote the motion to amend carried. Upon a roll call vote the motion Ald. Pietruszynski voting "no". to adopt Resolution 8227-79, with.the amended project plan, carried with Resolution #228-79 - The Clerk read same by title only as follows: Resolution Approving a Project Plan for Tax Increment District #2 - Tomczyk. Ald. Pietruszynski moved to defer action on Resolution 11228-79 City of Muskego Ald. Weed moved for adoption, Seconded by Ald. until the next Council meeting. His motion lost for lack of a second. Upon a roll call vote to adopt Resolution #228-79 the motion carried with Ald. Pietruszynski voting no':. Resolution #229-79 - The Clerk read same by title only as follows Resolution Approving a Project Plan for Tax Increment District 113 - City of Muskego. Ald. Dumke moved for adoption Seconded by Ald. Salentine. Ald Pietruszynsky moved to defer Resolution 11229-79 second. Ald. Ford moved to amend Section D of the Project Plan to add the following sentence to Section D "Said improvements will not therefore read as follows: "Muskego Drive improvement and storm water include the unnecessary widening of Muskego Drive". Section D. will and within the district. Said improvements will not include the drainage necessary to provide emergency vehicle access to the district unnecessary widening of Muskego Drive". Seconded by Ald. Tomczyk. Upon a voice vote on the motion to amend the motion carried with Ald. Pietruszynski voting "no". Upon a roll call vote on the motion to adopt Resolution #229-79 with the amended project plan, carried with Ald Pietruszynski voting "no". Resolution Approving a Project Plan for Tax Increment Dist. 87 - City Tomczyk. Ald. Pietruszynski moved to defer action on Resolution 8233-75 until the next meeting of the Council. Weed moved to suspend the rules that would interfere Ald Tomczyk. Upon a roll call vote to suspend the rules the motion carried with Ald. Pietruszynski voting "no"; The Clerk read the resolution. Tomczyk moved for the approval of Operator's Licenses for Garry Schroeder and James Baglinski subject to receipt of favorable police reports. Seconded by Ald Dumke. Motion carried. Ald. Tomczyk moved for the approval of a "Gathering" Permit for St. Leonard's Home & School for December 31, 1979. Seconded by Ald. Ford. Upon a voice vote the motion carried. CITY OFFICIAL'S REPORTS - The Clerk read the November, 1979 Building Report indicated 5 new dwelling units and total contraction in the amount of $392,803.00 for that month Same placed on file. Attorney Don Molter reported to the aldermen the city has been served with a complaint from Stan Potrykus concerning the denial of the preliminary plat of a proposed subdivision, Oak Meadows Estates. ,I .. COMMLTNICATIONS & MISCELLANEOUS BUSINESS The Clerk read a petition for determination of status of Lot 1 Blk 1, Ladwig's Sub. from Dean Oschmann. Same referred to Plan Commission .. Discussion was held between the aldermen regarding the reason for cancelling the Public Safety Committee in December, 1979. ADJOURNMENT - Ald. Dumke moved to adjourn. Seconded by Ald. Salentine.
