ccm197908140 CITY OF MUSKEG0 COMMON COUNCIL MINUTES OF MEETING HELD AUGWST14, 1979 The meeting was called to order at 7:50 P.M. by Mayor Gottfried. Also present were Aldermen Dumke, Tomczyk, Weed, Van Lanen and Salentine, at 8:30 P.M. Ald. Dwnke moved for the approval of the minutes of the meeting held July 24, 1979. Seconded by Ald Tomczyk. Motion carried. COMMITTEE REPORTS Ald. Tomczyk presented the reports of the Finance Comittee meetings held 8/8/79 and 8/14/79 and moved that same be accepted and placed on file Seconded by Ald. Dumke. Motion carried. Ald. Weed presented the report of the Public Works Comittee meeting held 8/9/79 and moved that same be accepted and placed on file. Seconded by Ald. Tomczyk. Ald. Van Lanen requested permission of his fellow aldermen to have Mr. Richard Hamann, W179 S7859 Kristin Drive, speak. As there were no objections, Mr. Hamann expressed his concern Drive in Kristin Downs Subdivision. The motion to accept the report to the Council regarding the conditions of the ditches along Kristin of the Public Works Committee carried. Ald Van Lanen presented the report of the Public Welfare Committee meeting held July 25, 1979 and moved that same be accepted and placed on file. Seconded by Ald. Saientine. Ald. Van Lanen questioned whether or not the city could become involved in the problems of Covenant Living Center and Mayor Gottfried advised the city could not. The minutes of the Plan Comission meeting.held August 7, 1979 were accepted and placed on file. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried advised that effective on this day (8114179) Mark E. because he will be moving out of the city. Mayor Gottfried commended Pienkos had tendered his resignation as Alderman of the First District Mark Pienkos on his duties as an alderman and wished him the best of luck in his new challenge. He further advised that Ald. Edwin Dumke as President of the Common Council will accept applications to fill the vacancy of alderman of the first district until September 1, 1979. City Attorney Richard Hippenmeyer, City Clerk Bower. Ald. Ford arrived NEW BUSINESS Resolution 8153-79 - The Clerk read same, entitled, Approval of Certified Survey Map - H. Scholbe. Ald. Salentine moved for adoption. Seconded by Ald. Tomczyk. Upon a roll call vote the motion carried unanimously. Tank Agreement - H. Albrecht. Ald. Van Lanen moved for adoption. Resolution 11154-79 - The Clerk read same, entitled, Approval of Holding Seconded by Ald. Dde. Upon a roll call vote the motion carried unanimously. Resolution #155-79 - The Clerk read same, entitled, Re-approval of Final Plan - Lake Brittany Estates Add. ill. Ald. Dumke moved for adoption. Seconded by Ald. Salentine. Salentine moved for adoption. Seconded by Ald. Tomczyk. Upon Hearing for Rezoning Request (Sec. 18 - Zangerle - R-1 and R-2 to 1-2) be September 11, 1979 at 7:15 P.M.) a roll call vote the motion carried unanimously. (Public Hearing to Resolution #157-79 - The Clerk read same, entitled, Urging the DNR Board to Grant a Waiver From Current Wetland Policy (Dredging Disposal Sites). Ald. Tomczyk moved for adoption. Seconded by Ald. Weed. Following a short discussion, upon a roll call vote the motion to adopt carried with Ald. Van Lanen voting "no". Ald; Ford arrived at 8:33 P.M. At this time the Clerk read Mayor Gottfried's veto message of Resolution #148-79, entitled, Approval of Legal~Lot Status - Ted Lane. of the Mayor's suggestion of a revision of the lot line by certified Several questions were raised by the -a-ldermen-regarding the legality survey map and the clarification of the status of the lot in question in the event his lending institution took the lot back. Ald. Ford requested permission of his fellow aldermen to have Mr. Ted Lane speak. In answer to a question--from several-aldermen-Mr. Lane indicated he did not agree and would not pursue the MayorI~s. suggestion to make the lot more conforming. In answer to a question Attorney Hippenmeyer indicated that the movement of the lot lines could be done by certified survey map. Ald. Van Lanen moved to override the Mayor's veto. Seconded by Ald. Salentine. Upon a roll call vote on the motion to voted "aye". Aldermen Dumke, Ford and Weed voted "no". As a two-thirds override the Mayor's veto, Aldermen Salentine, Tomczyk and Van Lanen vote of the entire Council is needed to override the veto (5 votes) the motion to override did not carry and the veto was' sustained. Resolut'ion 8159-79 - The Clerk read same,-entitled, Authorizing Ald. Weed moved for adoption. Seconded by Ald. Dumke. Upon a roll Revision of Street Lighting on Highway 24 in the Tess Corners area. call vote the motion to adopt carried unanimously. Resolution 8160-79 - The Clerk read same, entitled, Approval of @ lib5ary complex and $450 .OO for police building). Ald. Dumke moved Contract with J & J's Cleaning Service CS450.00 per mo. for city hall - for adoption. Seconded by Ald. Tomczyk. Upon a roll call vote the motion carried unanimously. Transfer of Funds from Joe Love Recycling Fund to the Muskego Lake Resolution #161-79 - The Clerk read same, entitled, Authorizing Reclamation Charitable Trust (.$l,OOO.OO). Ald. Tomczyk moved for adoption. Seconded by Ald. Ford. Upon a roll call vote the motion carried unanimously. j Resolution #162-79 - The Clerk read same, entitled, Assuring State Department of Natural Resources of the City's Intent to Provide Public Access to Big Muskego Lake. Ald. Weed moved for adoption. Seconded by Ald. Dumke. Mayor Gottfried reviewed for members of the Council the DNR's efforts to provide a public access to Big possible site, Ald. Ford moved to amend Resolution #162-79, the sixth paragraph, by changing the word "and" to "or" in the 4th line, by removing the words "one Bass Bay" in the 5th line and by removing the words "capable of parking 25 to 30 car-trailer units" in the 0 last line. Motion seconded by Ald. Salentine. Ald. Dumke requested permission to have Mr. Gary Stewart, Deputy Commissioner of the Big Muskego Lake-Bass Bay District, speak. Mr. Stewart spoke briefly facilities such as a park. Upon a roll call vote the motion to amend about the need for a public access and perhaps additional recreational Resolution #162-79 carried unanimously. Upon a roll call vote the motion to adopt Resolution #162-79, As Amended, carried unanimously. Muskego Lake or Bass Bay. Following discussion relating to a 0 August 17, 1979 Common Council Page 3. VOUCHER APPROVAL - Ald. Tomczyk moved for the approval of payment of vouchers in the amount of $214.861.36 payable 8/14/79. Seconded by - e Ald Dumke. Motion carried. " LICENSE APPROVAL - Ald. Tomczyk moved for the approval of a Gathering Permit for Muskego VFW Post 88171 for August. 24, 25 €X 26, 1979 (corner of Lannon Dr. and S.T.H. 24). Seconded by Ald. Ford. Motion carried. Ald. Tomczyk moved for the approval of Operators License to Shelley Spangler, David Salla, Adrienne Hansen, Christine Kupfer, Lynn Oschmann, Charlene Budish and Daniel Bohrer. Seconded by Ald. Dumke. Motion carried. Waterbugs Waterski Club to be installed in the area of Dandilion Ald. Tomczyk moved for the approval of a waterski ramp for the Park from August 15 to August 30, 1979, subject to the condition that (1) the ramp would not be used on weekends or holidays after 12 P.M. (2) the ski ramp would have chained tires as before, locked in place when not in use and would also be lighted, and (3) only members of the club would be allowed to use the ramp. Seconded by Ald. Weed. Motion carried. CITY OFFICIAL'S REPORTS - The Clerk read the Building Report for the month of July, 1979 indicating nine new dwelling units and total placed on file. construction in the amount of $605,651.71 for that month. Same e COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Clerk acknowledged receipt of a petition submitted by Arthur Zangerle requesting his p;operty bn Janesville Rd., in Sec. 18 be-rezoned -from R-1 and R-2 to 1-2.
