MINUTES OF MEETING HELD JULY 24, 1979
present were Aldermen Ford, Dumke, Pienkos, Tomczyk, Weed, Van Lanen
The meeting was called to order at 7:43 P.M. by Mayor Gottfried. Also
and Salentine, City Attorney Richard Hippenmeyer and Deputy Clerk June
Elger.
Ald. Dumke moved for the approval of the minutes of the previous
meeting held July 10, 1979 and to have same placed on file. Seconded by Ald. Tomczyk. Motion carried.
COMMITTEE REPORTS
Ald. Tomczyk presented the reports of the Finance Committee meetings
held 7/18/79 and 7/24/79 and moved that same be accepted and placed on file. Seconded by Ald. Dumke. Motion carried.
Ald. Weed presented the report of the Public Works Committee meeting
held 7/19/79 and moved that same be accepted and placed on file.
Seconded by Ald. Tomczyk. -Motion carried.
Ald. Pienkos presented the report of the Public Safety Committee
meeting held 7/11/79 and moved that same be accepted and placed on
file. Seconded by Ald. Weed. Motion carried.
Ald. Pienkos presented the report of the Rules, Laws & Ordinance
Committee meeting held 7/11/79 and moved that same be accepted and
placed on file. Seconded by Ald. Salentine. Motion carried.
The minutes of the Plan Commission meeting held 7/17/79 were received
and placed on file.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
At this time the Deputy Clerk read a proclamation from Mayor Gottfried
proclaiming the week of August 1st through August 7, 1979, as "Muskego
Clown Week". The Mayol; presented a copy of the Prochnation to
"Whiskers the Clown" who was present at the meeting.
The Deputy Clerk read Mayor Gottfried's veto message of Resolution
11131-79, AS Amended, entitled, Declaring a Total Building Moratorium
in the Northwest Sewer District. She also read a communication from E. M. Boerke, Inc., the city's industrial broker, urging the aldermen
to defeat a total building moratorium in the city. A COmmunication
from City Attorney Hippenmeyer, dated July 24, 1979, indicating that
in his opinion Resolution #131-79 can be legally sustained in its
present form. Ald. Dumke strongly urged the aldermen to support the moratorium. He indicated it would show good faith if they indicated
their concern for the quality of water of Big Muskego Lake. He further
indicated that it would be his intent to limit the moratorium for a
Dumke then moved to override the Mayor's veto of Resolution #131-79,
single year until the completion of the inflow infiltration study. Ald.
As Amended. Seconded by Ald. Van Lanen. Ald. Ford expressed his reasons for opposing the moratorium. He indicated the legal opinion from the city attorneys, as well as that the action would not solve
and the residents of Big Muskego Lake - Bass Bay area to work towards the problem. Ald. Pienkos urged cooperative effort between the city
the solution of the problem. Ald. Salentine requested permission of
his fellow aldermen to have Ms. Judie White speak. Ms. White explained
the position of the communities downstream from Big Muskego Lake and
the reasons for wanting the moratorium. Upon a roll call on the motion to override the veto, Aldermen Dumke, Van Lanen, Salentine and Weed
voted "aye". Aldermen Ford, Pienkos and Tomczyk vote "no". Because
a two-thirds vote of the entire Council was necessary (5 votes) the
motion to override did not carry.

Resolution $1144-79 - The Deputy Clerk read same, entitled, Appr,oval
of Preliminary Plat - Town of Norway - (South Wind Oaks Addition).
Ald. Salentine moved for adoption -Seconded by Ald. Dumke. Upon
a roll call vote the motion carried unanimously.
Resolution $1145-79 - The Deputy Clerk read same, entitled, Approval
of Certified Survey Map (Ferguson/Thielke). Ald. Salentine moved
for adoption. Seconded by Aid. Pienkos . Ald. Ford moved to amend
the resolution by adding the following paragraph "BE IT FURTHER RESOLVED
that this approval is subject to the receipt of a $1,000.00 cash bond
Ald. Tomczyk. Upon a roll call vote the motion to amend carried
to assure proper restoration between parcels 1 and 2 Seconded by
unanimously Upon a roll call vote the motion to adopt Resolution
9145-79, As Amended, carried unanimously.
Resolution 8146-79 - The Deputy Clerk read same, entitled, Approval
of Certified Survey Map (Steskal - Muskego Industrial Park). Ald.
Salentine moved for adoption Seconded by Ald. Tomczyk. Ald. Pienkos
moved to amend same by having the description in the third paragraph
read "Lot 13 Block 3". Seconded by Ald. Weed. Motion carried. Upon
a roll call vote the motion to adopt Resolution $1146-79, As Amended,
the motion carried unanimously.
Resolution #147-79 - The Deputy Clerk read same, entitled, Renewal
of Extractive Permit for State Sand & Gravel. Ald Salentine moved
for adoption. Seconded by Ald. Tomczyk. Upon roll call the motion
carried unanimously.
Resolution j1148-79 - The Deputy Clerk read same, entitled, Approval
of Legal Lot Status-Ted Lane. Ald. Salentine moved for adoption.
Seconded by Ald Tomczyk Ald. Dumke moved to defer action on Res-
olution #148-79 until the next Council meeting. Seconded by Ald Weed
Upon a roll call vote to defer action, Ald. Ford, Pienkos, Tomczyk,
Motion to defer did not carry. Upon a roll call vote on the motion
Salentine and Van Lanen voted "no". Ald Dumke and Weed voted "aye"
and Van Lanen voted "aye". Ald Dumke and Ald Weed voted "no". The
to adopt Resolution $1148-79, Aldermen Ford, Pienkos, Tomczyk, Salentine
motion to adopt Resolution 8148-79 carried.
Resolution #149-79 - The Deputy Clerk read same, entitled, Establishing
Traffic Regulations (No Parking in area of Muskego Dr and Hardtke Dr.

Resolution #152-79 - Denial of Preliminary Plat - Oak Meadows Estates
Ald. Salentine moved to suspend the rules that would interfere with
the adoption of Resolution #152-79. Seconded by Ald. Ford. Upon
roll call the motion to suspend the rules carried unanimously. Ald.
requested permission of his fellow aldermen to have Mr. Thomas Herz, Salentine moved for adoption. Seconded by Ald. Ford. Ald. Salentine
Attorney for the developer of Oak Meadows Estates, speak. As there were no objections Mr. Herz indicated he felt the plat did conform
to the zoning ordinances of the city and requested the developers be
informed as to what further requirements would be needed. Upon a
Ald. Salentine voting "no".

VOUCHER APPROVAL - Ald. Tomczyk moved for the approval of payment
by Ald. Dumke. Upon roll call the motion carried unanimously. of vouchers in the amount of $132,190.50 payable 7/24/79. Seconded
a LICENSE APPROVAL - Ald. Tomczyk moved for the approval of Operator's
Licenses for Edward Rausch, Susan Zink, Bruce Hranicki and Neil
Harris. Seconded by Ald. Ford. Motion carried.
Ald Tomczyk moved for the approval of a Gathering Permit for Little
Muskego Lake Association for August 4, 1979 (area of Lannon and
Janesville). Seconded by Ald. Ford. Motion carried.
ADJOURNMENT - Ald. Tomczyk moved to adjourn. Seconded by Ald.
Pienkos Motion carried. The meeting adjourned at 10 25 P.M.
