ccm19790327COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD MARCH 27, 1979 The meeting was called to order by Mayor Jerome Gottfried at 7:55 P.M. Also present were Aldermen Ford,Pienkos, Tomczyk, Van Lanen,, Schaumberg, and Wallner, City Clerk Bowyer and City Attorney Buckley. Ald. Dumke was absent Ald. Schaumberg moved to approve the minutes of the meeting held 3/13/79 and moved that same be accepted and placed on file. Seconded by Ald. Pienkos. Motion carried. COMMITTEE REPORTS meeting held 3/21/79 and the meeting held 3/27/79 and moved that Ald. Ford presented the report of the informal Finance Comittee same be accepted and placed on file. Seconded by Ald. Schaumberg. Motion carried. Ald. Van Lanen presented the report of the Public Safety Committee meeting held 3/14/79 and moved that same be approved and placed on file. Seconded by Ald. Tomczyk. Motion carried Ald. Tomczyk presented the report of the Public Works Committee meeting held 3/22/79 and moved that same be accepted and placed on file. Seconded by Ald. Tomczyk Motion carried. Ald. Tomczyk presented the report of the Rules, Laws & Ordinance Committee meeting held 3/14/79 and moved that same be accepted and placed on file. Seconded by Ald. Wallner. Tomczyk presented the report of the informal Sever Committee meeting held 3/19/79. me Plan Comission minutes of meeting held 3/20/79 were received and placed on file UNFINISHED BUSINESS Ordinance 8368 - An Ordinance Creating Chapter 12 03 of the Municipal Code of the City of Muskego, Regulating Direct Sellers. This ordinance was on the floor. A lengthy discussim took place regarding the sinp.ling out out of various local organizations such as Boy Scouts and Girl Scouts. Ald. Ford spoke as being opposed to the proposed ordinance and moved to table Ordinance #368. Seconded by Ald. Van Lanen. Upon a roll call vote on the motion to table Ordinance 8368, the motion carried with Ald. Pienkos voting 'ho" Resolution 1/48-79 - Approval of Final Plat - The Meadows. This resolution was on the floor and upon a roll call vote Aldermen Pienkos, Lanen voted "no". The motion to adopt Resolution #48-79 carried. Schaumberg, Tomczyk and Wallner vbted "aye". Aldermen Ford and Van Resolution #52-79 - Directing the City Attorney to Draft an Ordinance to Amend the Zoning Pistrict Map of the City of Muskego (Lake Denoon area) - R-1 and R-2 to PS-2 and A. This resolution is on the floor. At this time the Clerk acknowledged a petition from Mr Henry Herdeman dated 3/19/79 requesting his property (19.953) to be rezoned from R-2 to A. She also read a letter from Attorney Jack Moertl, directed to the Common Council, dated 3/27/79, urging the Council to eliminate the Northwest 114 of Sec:tion 32 from their rezoning RS-2 considerEtions. She also acknowledged a communication from John Spoden Associates, Inc. Ald.~ Ford spoke as being opposed to Resolution 852-79 indicating he woula like to see z. public hearing on each parcel of land as it would come up for development. Following further discussion, upon a roll call vote on the motion to adopt Resolution 852-79, Aldermen Schaumberg, Tomczyk and Wallner voted "aye". Aldermen Ford, Pienkos and Van Lanen voted the tie. The motion to adopt Resolution 1/52-79 carried. * I, no". There being a tie vote, Mayor Gottfried voted "aye" thus breaking March 27, 1979 Common Council 0 Page 2 Unfinished business - Cont‘d. Tomczyk moved to defer action on Resolution 1/32-79 for further review. Seconded by Ald. Ford. Upon a voice vote the motion carried. @ (This resolution was introduced 2/13/79 and following publicstions and COMMUNICATIONS FROM THE MAYOR’S OFFICE - Mayor Gottfried reported on his attendance of the seminar on T a x Increment Financing held in Madison on March 21 and 22, 1979. Mayor Gottfried advised thosepresent that a recent study conducted by the Citizen’s Governmental Research Bureau indicated Muskego’s tax rate being the lowest of 30 neighboring municipalities At 8 58 P.M. Mayor Gottfried declared a recess and the meeting recon- vened at 9:04 P.M. At this time Ald. Tomczyk moved to reconsider the action of ‘the Council on Resolution 1/32-79. Seconded by Ald Schaumberg. Upon a roll call vote the motion to reconsider carried unanimously Ald Tomczyk moved to adopt Resolution 1/32-79. Seconded by Ald. Schaumberg. Upon a roll call vote to adopt the motion carried unanimously. - NEW BUSINESS Resolution 1/53-79 - Initial Resolution Relating to Industrial Revenue Bond Financing on Behalf of Peerless Gear & Engineering, Inc. Ald Ford moved for adoption. Seconded by P.ld Tomczyk. As there were no objections to having Mr. Robert Agenten, President of Peerless Gear & Engineering Co., speak, Mr. Agenten advised his company would employ approximately 125 persons and if construction could begin immediately the building could be occupied approximately six months from now Upon a roll call vote the motion to adopt Resolution #53-79 carried unan- imously. Attorney to Draft an Ordinance to Amend the Zoning District Map of Resolution 1/54-79 - The Clerk read same, entitled, Directing the City the City (Wiesner - Racine Ave. and S T H 24). Ald. Ford moved for adoption. Seconded by Ald. Tomczyk. Upon roll call the motion carried unanimously.. Resolution 1/55-79 - The Clerk rea& same, entitled, Approval of Legal Lot Status (Wittbrot). Ald. Ald. Ford moved for adoption. Seconded k,y Ald. Tomczyk. Ald. Ford moved to amen?, Resolution 1/59-79 by changing the amount cf money in the third paragraph from $42,006 00 to $40,146.00. Seconded by Ald. Tomczyk. Upon a voice vote the motion to amend carried. Upon a roll call vote the motion to adopt Resolution #59-79, As Amended, carried unanimously Resolution 860-79 - The Clerk rea6 same, entitled, Approval of Mainten- ance Agreement for Offset Machine. Ald. Schaumberg moved for adoption. Seconded by Ald. Tomczyk. ($378.00 per year). Upon roll call the motion to adopt csrried uanimously. Resolution #61-79 - The Clerk read same, entitled, Acceptance of Low Bid Schaumberg moved for adoption. Seconded by Ald. Tcmczyk. ($30,248.50 -. Tor New Highway Truck (With. snowp!.ow and material spreader). Ald. had expressed tin interest in the truck being replaced, Ald. Ford moved Badger Ford Truck Sal.es, Inc.) Because the Muskego-Norway School Dist. FURTHER RESOLVED that. in the event the Muskego-Norway School District wishes to purchase the truck being replaced at the cost of the allow- ance provided by Badger Ford Truck Sales, Inc. through an agreement, Supt. Bertram is authorized to approve such an arrangement." Motion seconded by Ald. Pienkcs. Upon a voice vote the motion to amend carried. Brodell. Ald. Tomczyk moved for adoption. Seconded by Ald. Schaumberg. Upon a roll call vote the motion tc, adopt carried unanimously.(4/17/79) Ordinance #369 - An Ordinance to Amend Section 25.01(l)(a) Of the Municipal Code of the City of Muskego (Re Drunk Driving Law of Wis. Statutes). The Clerk gave the first reading of same. Ald. Pienkos moved to suspend the rules thht would allow the second reading of Ordinance W369. Seconded by Ald. Tomczyk. Upon a roll call vote the motion to suspend the rules carried unanimously. The Clerk gave the second reading of Ordinance $1369. Ald. Pienkos moved for adoption. Seconded by Ald. Wallner. Upon a roll call vote the motion to adopt carried unanimously. VOUCHER APPROVAL - Ald. Ford moved to approve payment of general vouchers in the amount of $700,891.43. Seconded by Ald. Schaumberg. Upon a roll call vote the motion tct pay the vouchers carried unanimously. LICENSE APPROVAL - Ald. Schaumberg moved for the approval of Operator's Licenses tor Jeanette Heckert, Harry Chic, Jr. Keith Filter, Sr., Keith Filter, Jr. and Janet Lass. Seconded by Ald.1 Pienkos.
