ccm19781212\ COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD DECEMBER 12, 1978 The meeting was called to order at 7.52 P.M. by Mayor Gottfried. Also present were Aldermen Dumke, Ford,Pienkos, Tomczyk, Van Lanen and Wallner, City Clerk Bowyer and City Attorney Buckley. Ald. Schaumberg was absent. Ald. Dumke moved to approve the minutes of the previous meeting held 11/28/78,as mailed. Seconded by Ald. Ford. Motion carried Committee Reports Ald. Ford presented the minutes of Finance Committee meetings held 12/6/78 and 12/12/78 and moved that same be accepted and placed on on file. Seconded by Ald. Dumke. Upon a voice vote motion carried. Ald. Tomczyk presented the report of the Public Works Committee meeting held 12/7/78 and moved that same be accepted and placed on file. Seconded by Ald. Pienkos. Motion carried. Ald. Ford presented the report of the Public Welfare Committee meeting held 12/7/78 and moved that same be accepted and placed on file. Seconded by Ald. Wallner, motion carried. The minutes of the Plan Commission meeting held 12/5/78 were received and placed on file. UNFINISHED BUSINESS Ordinance #365 - The Clerk gave the second reading of same, entitled, An Ordinance to Create Sub-chapter 13 of Ch. 30 of the Municipal Code Family Dwellings and Manufactured Buildings for Dwellings by Adoption (Bldg. Code) Which Sub-chapter Establishes a Code for One and Two of the Wisconsin Admin. Code. Inc.. Ch. Inc. 20-25. I Ordinance #366 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Table No. 1, Schedule of Permit Fees, Contained in Ch. 30 of the Bldg. Code of the Municipal Code of the City. Ald. Pienkos moved for adoption. Seconded by Ald. Tomczyk. Upon a roll call vote the motion to adopt carried unanimously. Ordinance #358 - An Ordinance to Amend the Zoning District Map of the City of Muskego (Sec. 8 - B-2 to RS-2 - D. Cunningham). The Clerk read the ordinance. Mayor Gottfried explained that at their meeting held on 10/10/78 the Council had reconsidered this ordinance and referred it back to Plan Commission for further study. Since the Council had never taken final action on same it would be necessary to Tomczyk, Van Lanen and Wallner voted "no". Ald. Pienkos voted "aye". do so. On the motion to adopt Ordinance #358, Aldermen Dumke, Ford, Ordinance #358 was defeated. Ordinance #357 - An Ordinance to Amend the Zoning District Map of the City (Re Rezoning of former Nettesheim Farm in the area of Lake Denoon - S. Potrykus) Ald. Wallner moved to defer action on this ordinance for two weeks because of a request by the developer, Stan Potrykus). Seconded by Ald. Tomczyk. The Clerk read a communication from Mr. Potrykus, dated 12/12/78, requesting that action be deferred on Ordinance #357 to give him time to study theposshibilityof corporating comments made at the Plan Commission meeting held 12/5/78 into the plan. Ald. Ford spoke as being opposed to the deferral of the ordinance, Upon a roll call vote on the motion to defer for two weeks the motion carried with Ald. Ford casting a dissenting vote. Common Council 12/12/78 NEW BUSINESS Resolution #237-78 - The Clerk read same, entitled, Authorizing the Advertising of Bids for Six New Squad Cars. Ald. Dumke moved for adoption, seconded by Ald. Tomczyk. Upon roll call the motion carried unanimously. Resolution #238-78 - The Clerk read same, entitled, Determining Personal Property Taxes for 1971, 1972, 1973 and 1974 Uncollectible. Ald. Pienkos moved for adoption. Seconded by Ald. Tomczyk. Upon roll call the motion carried unanimously. Resolution #239-78 - The Clerk read same, .entitled, Authorizing Exten- Ald. Dumke moved for adoption. Seconded by Ald. Ford. Upon a roll call sion of Time for Rental of Former Police Building. (Two-month extension) vote the motion carried unanimously. Resolution #240-78 - The Clerk read same, entitled, Approval of Pre- adoption. Seconded by Ald. Tomczyk. Upon roll call the motion carried unanimously. Resolution #341-78 - The Clerk read same, entitled, Approval of Fire Protection Contract With Tess Corners Fire Department. Ald. Tomczyk moved for adoption. Seconded by Ald. Pienkos Upon roll call the motion unanimously. Resolution #242-78 - The Clerk read same, entitled, Approval of Fire Protection Contract With Muskego Volunteer Fire Company. Ald. Tomczyk moved for adoption. Seconded by Ald.'Pienkos. Upon roll call the motion to adopt carried unanimously. Resolution#243-78 - The Clerk read same, entitled, Authorizing the Police Department to Install a New Radio Tower. Ald. Dumke moved for adoption seconded by Ald. Wallner. (Cost not to exceed $9,000.00). Upon a roll call vote the motion carried unanimously. Resolution #244-78 - The Clerk read same, entitled, Assurances to Ralph Martin (Re. Martin Drive Reconstruction Project). Ald. Ford the motion to adopt carried unanimously. Resolution #245-78 - Approving Project Agreement for Martin Drive Re- construction Project. As this resolution had not appeared on the agenda, Ald. Pienkos moved to suspend the rules that would interfere with the adoption of same. Seconded by Ald. Tomczyk. Upon roll call the motion to suspend the rules carried unanimoualy. The Clerk read the resolution. Ald. Tomczyk moved for adoption. Seconded by Ald. Wallner. Upon a roll call vote the motion carried unanimously. LICENSE APPROVAL - Ald. Ford moved for the approval of Operators Licenses Backhaus. Seconded by Ald. Tomczyk. Motion carried. for William Garland, Day Ehnert, Denise Lancour, Kathy Sands and Mark Ald. Ford moved for the approval of a "Gathering" Permit for St. Leonards Home & School for 12/31/78 and for the Muskego Moose Lodge for 1/14/78 for 1/14/79 at I~dle Isle. Seconded by Ald. (Ditch bond) Upon a roll call vote the motion carried unanimously. CITY OFFICIAL'S REPORTS - The Clerk read the Building Report for the month of November, 1978, indicating three new dwelling units and total construction for that month in the amount of $219,404.00. Same placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a communication dated December 8, 1978, from Wayne M. Thielke and Thomas A. Ferguson, directed to the Common Council, request- ing abandonment of roadway 60' x 335' extending west off Gold Drive. Same referred to Plan Commission. Mayor Gottfried reported he had met with DNR officials in Madison on Monday, along with the City Attorney and City Engineer, regarding the 1 D > moratorium placed on sewers. ADJOURNMENT - Ald.
