ccm197811282MMON COUNCIL ITY OF MUSKEGO IINUTES OF MEETING HELD NOVEMBER 28. 1978 The meeting was called to order at 7:52 P.M. by Mayor Gottfried. present were Aldermen Cumke, Ford, Tomczyk, Pienkos.. Van Lanen, Wallner and Schaumberg, City Attorney John Buckley and Deputy Clerk June Elger. Ald. Pienkos moved to approve the minutes of the neeting held 11/14/78 and moved that same be accepted and placed on file. Tomczyk. Motion carried. OMMITTEE REPORTS Ald. Ford presented the report of the Finance Committee meeting held on 11/28/78 and moved that same be accepted and placed on file. Seconded by Ald. Tomczyk. Motion carried. Ald. Tomczyk presented the report of the Public Works Committee meetir held on 11/22/78 and moved that same be accepted and placed on file. Seconded by Ald. Dumke. Motion carried. Ald. Tomczyk presented the report of the Public Sewer Committee meetr held on 11/20/78 and moved that same be accepted and placed on file. Seconded by Ald. Dimke. Motion carried. The minutes of the Plan Commission meeting held 11/21/78 were receix and placed on file. UNFINISHED BUSINESS Resolution #221-78 - The Deputy Clerk read same, entitled, Denial Legal Status (Wilrard E. Anderson). The Deputy Clerk read a commu cation from Mr. Anderson, directed to the Common Council, urging t aldermen to vote "no" on the denial of determining legal status of Lot 9, Block 2, Meadowdale Subdivision. The Deputy Clerk also re a covenant which had been recorded by the previous owners of Lots 9, Block 2, Meadowdale Subdivision. In answer to a question from Dumke, Mr. Anderson who was present in the audience, advised that l was aware of the covenant, As this resolution is on the floor, I a roll call vote on the motion to adopt, Aldermen Dumke, Pienkos Schaumberg voted "aye". Aldermen Ford, Tomczyk, Van Lanen and W voted "no". The motion to adopt Resolution #221-78 was defeatec At this time, several members of the Senior Citizens Study Corm appeared at the meeting. Chairman Henry Wolf introduced the me present to the Council. A written report, dated 11/14/78. indi the results of the committee's findings, was reviewed and commr Mayor Gottfried thanked the members of the committee for their efforts to serve their community. Ald. Pienkos moved to accep report of the Senior Citizens Study Committee and moved to ref the the Public Welfare Committee to begin evaluation of the rf tions submitted. Seconded by Ald. Schaumberg. Motion Carrie Ordinance 8364 - The Deputy Clerk gave the second reading of entitled, An Ordinance to Amend the Zoning District Map of tl of Muskego (Sec. 9 - RSM and RS3 to RS2) (Portion of Pufall a Property and proposed Valley Square). Seconded by Ald. Tomczyk. Upon a roll call vote the motion carried I unanimously. Resolution #231-78 - The Deputy Clerk read same, entitled, Renewal of Permit for Portable AsDhalt Plant for Pane & Dolan of Wisconsin. Ald , Dumke moved for adoptibn. Seconded by Alh. Wallner. Upon a roll call vote the motion carried unanimously. Resolution #232-78 - The Deputy Clerk read same, entitled, Granting Permission for Driving Skill Contest on Little Muskego Lake (Event to be held January 14, 1979). Ald. Schaumberg moved for adoption. Sec- onded by Ald. Ford. Upon roll call the motion carried unanimously. Resolution 11233-78 - The Deputy Clerk read same, entitled, Approval of Agreement Between City of Muskego and Washington, Ozaukee and Waukesha Tri-County Nutrition Program for the Elderly. Ald. Pienkos moved for adoption. Seconded by Ald. Van Lanen. Upon roll call vote the motion to adopt carried unanimously. Resolution 8234-78 - The Deputy Clerk read same, entitled, Extending Deadline Date for Partial Payment of 1978 Real Estate Taxes. Dumke moved for adoption, seconded by Ald. Ford. Upon a voice vote the motion carried. Resolution #235-78 - Ald. Pienkos moved to suspend the rules that would interfere with the adoption of this resolution, entitled, Settlement of Claim - J. Kelly ($64.50). Seconded by Ald. Wallner. Upon a roll call vote the motion to suspend the rules carried unanimously. Ald. Dumke moved for adoption. Seconded by P.ld. Wallner. Upon a roll call vote the motion to adopt Resolution 8235-78 carried with Ald. Schaumberg voting "no" . Ordinance #365 - The Deputy Clerk gave the first reading of same, entitled, An Ordinance to Create Sub-chapter 13 of Ch. 30 of the Mun- icipal Code (Bldg. Code) Which sub-chapter Establishes a Code for One and Two Family Dwellings and Manufactured Buildings For Dwellings by Adoption of the Wis. Admin. Code, Ch. Inc. 20-25, Uniform Dwelling Code. Ordinance 11366 - The Deputy Clerk gave the first reading of same, entitled, An Ordinance to Amend Table No. 1, Schedule of Permit Fees, Contained in Ch. 30 of the Building Code of the Municipal Code of the City LICENSE APPROVAL - Ald. Dumke moved to approve Operators License for beborah Rick, Gail Kearney, Mike Tobianski subject to favorable Police Reports. Seconded by Ald. Ford, motion carried. VOUCHER APPROVAL - Ald. Dumke moved to ap rove payment of vouchers in the amount of $31 1,339.91, payable 11/28/?8. Upon roll call the motion carried unanimously. COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Deputy Clerk read a communication dated 11/24/18 , directed to Mayor Gottfried, from D. J. Cunningham, Milbrew, Inc. regarding Plan Cotmission Resolutions 8208-78 and #209-78. Communication referred to Plan Commission. ADJOURNMENT - Ald. Pienkos moved to adjourn. Seconded by Ald.
