ccm19780627COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD JUNE 27, 1978 The meeting was called to order at 7:50 P.M. by hlayor Gottfried. Also present were Aldermen Dumke, Ford, Pienkos, Van Lanen, Tomczyk and Wallner, City Clerk Bowyer and City Attorney Buckley. Ald. Schaumberg was absent. Ald. Pienkos moved to accept the minutes of the previous meeting with the correction that Ald. Tomczyk seconded the motion to adopt Resolution #114-78 and not Ald. Dumke. Seconded by Ald. Tomczyk. The motion to to accept the minutes, as corrected, carried. COMMITTEE REPORTS Ald. Dumke presented the report of the Finance Committee meeting held 6/13/78 and Ald. Ford presented the report of the meeting held 6/27/78. Ald. Dumke moved to have both reports accepted and placed on file. Seconded by Ald. Ford, motion carried. Ald. Tomczyk presented the report of the tour of the Public Works Committee taken on 6/22/78. Ald. Van Lanen reminded the committee that they did not view a problem in the area of the Clark Station on Highway 24 and Ald. Ford again requested that it be noted in the minutes on Muskego Drive. The report of the tour was received and placed on that he had asked the committee to view a guard rail on a sharp curve file. Ald. Pienkos presented the report of the meeting of the Public Safety Committee held on 6/14/78 and moved that it be accepted and placed on file. Seconded by Ald. Wallner. Ald. Ford requested that it be noted speeding problem in the area of Wildwood and Hiawatha Drives. The motion in the minutes that he had requeswdthepolice department to check a to accept the report carried. Ald. Tomczyk presented the report of the Rules, Laws & Ordinance placed on file. Seconded by Ald. Pienkos, motion carried. Committee meeting held 6/14/78 and moved the report be accepted and Ald. Van Lanen presented the report of the Public Welfare Committee meeting held 6/21/78 and moved that same be accepted and placed on file. Seconded by Ald. Wallner, motion carried. Ald. Tomczyk presented the report of the Public Sewer Committee meeting held 6/19/78 and moved that same be accepted and placed on file. Seconded by Ald. Dumke. Ald. Ford requested that the 3rd sentence of paragraph 5 regarding the treatment plant be stricken from the minutes. The motion to accept the report carried. . UNFINISHED BUSINESS Resolution #118-78 - Establishing Traffic Regulations (No Parking on the west side of a portion of Hillendale Drive.) This resolution is on the requested to go on record as being opposed to the adoption of said floor and was deferred for two weeks pending further review. Ald. Ford resolution. Upon a roll call vote on the motion to adopt, Aldermen Dumke, Pienkos, Tomczyk and Wallner voted "aye". Aldermen Ford and Van Lanen voted "no". The motion to adopt carried. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried acknowledgedthe request of the Muskego 4H Club to proclaim July 1 and 2nd as "Bottom of the Barrel Days". He urged all citizens to give financial help to the club and to attend their ice cream social and festivities at the Parkland Mall on those days. Common Council June 27, 1978 Page 2. NEW BUSINESS Resolution #125-78 - The Clerk read same, entitled, Honoring An AFS Student from South Africa (Tony Norton). Ald. Ford moved for adoption, seconded by Ald. Pienkos. Mayor Gottfried presented Mr. Norton a South Africa, commending the AFS Program and Tony on his representation America and he thanked the citizens and his American parents, Mr. and of his city and country. Tony expressed his opinion of the city and Mrs. James Kreuger, for a most rewarding year. ,The motion to adopt Resolution #125-78 carried unanimously. Years of Service to the Library Board. As there were no objections Resolution #139-78 - Recognizing Services of Betty Teisl for Eleven from the aldermen this resolution was acted on at this time. Ald. Pienkos moved for adoption, seconded by Ald. Tomczyk. Mayor Gottfried presented Mrs. Teisl with an engraved silver tray in recognition of her many years of service to the Library Board. Upon a roll call vote the motion to adopt Resolution #139-78 carried unanimously. Resolution #126-78 - The Clerk read same, entitled, Authorizing City of Muskego, Waukesha County, Wisconsin, Industrial Development Revenue Bonds (Surinak Engineering & hlfg. Co., Inc. Project). Ald. Dumke moved for adoption, seconded by Ald. Pienkos. Mr. Larry Dalton, Attorney representing Mr. and Mrs. Surinak, briefly reviewed the ments to the resolution. Ald. Dumke moved to amend Resolution #126-78 contents of the resolution and he submitted several pages of amend- by attaching the pages as submitted by Mr. Dalton. Seconded by Ald. Van Lanen. Upon a roll call vote the motion to adopt Resolution #126-78, As Amended, carried unanimously. Resolution #127-78 - The Clerk read same, entitled, Approval of Final Plat (Oaks of Norway.) Ald. pumke moved for adoption, sebonded by Ald. Tomczyk. Upon roll call the motion carried unanimously. "key to the city" along with a letter directed to the Mayor of Durban, 0 Resolution #128-78 - The Clerk read same, entitled, Denial of Legal Status (J. Van Skyhock - Lot 28, Mill Valley Heights (Unrecorded). Ald. Dumke moved for adoption, seconded by Ald. Ford. Mayor Gottfried explained why the Plan Commission had recommended denial and he 0 indicated that by re-division which would provide access to Gold Drive motion to adopt Resolution X128-78 carried unanimously. Mr. Van Skyhock would have a legal lot. Upon a roll call vote the Resolution #129-78 - The Clerk read same, entitled, Denial of Legal Status (Lot 18, Krogman's Subdivision - S. Peric). Ald. Dumke moved motion carried with Ald. Wallner voting "no". for adoption, seconded by Ald. Tomczyk. Upon a roll call vote the Resolution #130-78 - The Clerk read same, entitled, Denial of Legal Status-@.Hansen - Muskego Shores Subdivision). Ald. Durnke moved for adoption, seconded by Ald. Ford. Upon a roll call vote the motion carried with Ald. Wallner voting "no". Resolution #131-78 - The Clerk read same, entitled, Approval of Pre- liminary Plat - South Wind Oaks, Town of Norway. Ald. Dumke moved for adoption, seconded by Ald. Tomczyk. Upon roll call the motion carried unanimously. Resolution #132-78 - The Clerk read same, entitled, Approval of Pre- seconded by Ald. Tomczyk. Ald. Ford moved to defer action on this liminary Plat - Holiday Park, Inc. Ald. Dumke moved for adoption, resolution to provide him more time to review this revised plat. Seconded by Ald. Van Lanen. Following discussion regarding the legal ran- day period, Ald. Ford, with the consent of his second, withdrew his ifications of not approving a preliminary plat within the required 40 motion to defer. Resolution #133-78 - The Clerk read same, entitled, Approval of Sewer Connections to Sandy Knoll Subdivision. (John Paul property in the Tess Corners area). Ald. Dumke moved for adoption, seconded by Aid. Tomczyk. Upon a roll call vote the motion to adopt carried UnanimOuslY Resolution #134-78 - The Clerk read same, entitled, Extending the Moratorium in the Northeast District to July 1, 1979. Ald. Dumke moved for adoption, seconded by Ald. Tomczyk. Following extensive discussion during which Mayor Gottfried urged the Council not to renew the moratorium and he reviewed with the Council his letter directed to the Public Sewer Committee dated 6/21/78. Resolution $135-78 - The Clerk read same, entitled, Extending Moratoriul in the Northwest District to July 1, 1979. Ald. Dumke moved for adoptin seconded by Ald. Ford. Upon a roll call vote on the motion to adopt the motion carried with Aldermen Dumke, Ford, Pienkos, Tomczyk and Van Lenen voting "aye". Alderman Wallner voted "no". Resolution #136-78 - The Clerk read same, entitled, Acceptance of Low Bid for Second Well in the City's Industrial Park (Layne-Northwest Co.) Ald. Pienkos moved for adoption, seconded by Ald. Tomczyk, Upon roll call .the motion carried with Ald. Wallner voting "no". Citizen Member to Park and Recreation Board (Karen Wessell). Ald. Resolution $137-78 - The Clerk read same, entitled, Appointment of Tornczyk moved for adoption, seconded by Ald. Van Lanen. Upon a roll call vote the motion. carried with Ald. Wallner voting "no". of Recorder for Municipal Court. Ald. Dumke moved for adoption, secondc Resolution #138-78 - The Clerk read same, entitled, Authorizing Purchast by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution #140-78 - The Clerk read same, entitled, Establishing Public Hearing Date for Rezoning Request (Wisconsin Emporium Co., - David Cunningham - Sec. 8, B-2 to RS-2). Ald. Dumke moved for adoption. Seconded bv Ald. Pienkos. UDon a roll call vote the motion carried - -- with Ald. Tomczyk voting "no". (Public Hearing scheduled for August 8, 1978, at 7:15 P.M.) .: Resolution #141-78 - Approval of Agreement Between the City of Muskego and Moody's Investors Service, Inc. Ald. Ford moved to suspend the rule that would interfere with the adoption of this resolution. Seconded by Ald. Pienkos. The Clerk read the resolution. Ald. Dumke moved for adoption. Seconded by Ald. Ford. Upon roll call the motion to adopt carried unanimously. Resolution #142-78 - Approval of Agreement Between City of hluskego and \\'ashington, Ozaukee and Waukesha Tri-County Nutrition Program for the Elderly. Ald. Van Lanen moved to suspend the rules that would interferc with the adoption of this resolution. Seconded by Ald. Tomczyk. Upon roll call the motion carried unanimously. Dumke moved for the approval of Operators Licenses for Beverly Werry, Earl Meinen, Linda LeMaster, Elaine Meinen, Albert Meinen, Jr., Sandra Meinen and Dean Meinen, subject to receipt of favorable finger- print reports. Seconded by Ald. Ford, motion carried. Ald. Dumke moved for the approval of Special Class "B" Gathering License for Little Muskego Lake Association for the Little Muskego Festival for Julv 15. 1978 (Open field - corner of Lannon Dr. and Janesville Rd.) Secondeh by' Ald. Ford, motion carried. . COMMUNICATIONS AND MISCELLANEOUS BUSINESS . The Clerk read a communication from Waukesha County Park & Planning Commission, dated June 13, 1978, directed to herself, regarding the Ridges Subdivision. Same referred to the Plan Commission and the City Attorney. The Clerk read a communication from Rite Realty Corporation, dated 6/23/78, directed to the Mayor and Council regarding statements and preferential treatment in the allocation of sanitary sewer connection allegations in the newspapers that their corporation has received in the City of Muskego.
