ccm19770927COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 27, 1977 The meeting was called to order at 7:46 P.M. by Mayor Gottfried. Also present were Aldermen Dumke, Ford, Pienkos, Van Lanen, Tornczyk, Schaum berg and Wallner, City Clerk Bette Bowyer and City Attorney John Buck1 Ald. Schaumberg moved to approve the minutes of the previous meeting held 9/13/77, as mailed. Seconded by Ald. Tomczyk, motion carried. Committee meetings held on 9/2/77 and 9/27/77 and moved that they COMMITTEE REPORTS - Ald. Schaumberg presented the. reports of the Finan be accepted and placed on file. Seconded by Ald. Ford, motion carried Ald. Tomczyk presented the report of the Public Works Committee meetin held 9/22/77 and moved it be accepted and placed on file. Seconded by Ald. Scbaumberg, motion carried. Aid. Van Lanen presented the report of the Public Welfare Committee meeting held 9/14/77 and moved that same be accepted and placed on file. Seconded by Ald. Tomczyk, motion carried. Ald. Van Lanen presented the report of the Rules, Laws & Ordinance Committee meeting held 9/15/77 and moved that same be accepted and placed on file. Seconded by Ald. Wallner. Ald. Van Lanen read a pre- pared statement in answer to Mayor Gottfried's communication to the to accept the report.of the Rules, Laws & Ordinance Committee meeting aldermen regarding the contents of the report. Upon a roll call vote held on 9/15/77, Aldermen Dumke, Ford, Pienkos, Schaumberg and Tomczyk voted "no". Aldermen Van Lanen and Wallner v.oted "aye". The motion to accept the report did not carry. .. meeting.held on 9/22/77 and moved .that same. be -accepted and placed Ald. Pienkos presented the report of the Police Building Committee on file. Seconded by Ald. Tornczyk, motion carried. The minutes of the Plan Commission meeting held 9/20/77 were ack- nowledged and placed on file. 0 :e UNFINISHED BUSlNESS Ordinance $333 - The Clerk gave the second reading of same, entitled, An Ordinance to Repeal and Recreate Section 13.01 (1) of the Municipal seconded by Dumke. Upon a roll call vote the motion carried unanimously Ordinance #334 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Ch. 18, Section 8.9 of the Municipal Code (Re Water Meters) Ald. Ford moved for adoption, seconded by Ald. Pienkos. In answer to a auestion from Ald. Pienkos. Mavor Gottfried advised @ Code (Re: Number of Dogs Limited) Ald. Ford moved for adoption, that this ordinance is for the intent of iuture subdivisons. Upon a roll call vote the motion to adopt carried unanimouslv. " ~ ~~. ~~ ~ Ordinance #335 - Thd'Clerk gave the second reading of same, entitled, An Ordinance to Amend Chapter 16, Section 08 (2)(b) of the Municipal Code (Re Water Meter $2 00 Permit Fee) Ald. Ford moved for adoption, seconded by Ald. Tomczyk. Upon a roll call vote the motion to adopt carried unanimously. COhlMUNICATIONS FROM THE MAYOR'S OFFICE - The Clerk read a proclamation from Mayor Gottfried declaring October 1st thru 7th as "Share a Song ~ Week". Same placed on file. NEW BUSINESS - Resolution #197-77 - The Clerk read same, entitled, Establishing moved for adoption, seconded by Ald. Dumke. Upon a roll call vote the Vacation Benefits for Non-represented City Employees. Ald Schaumberg motion carried unanimously. Dumke moved for adoption, seconded by Ald. Schaumberg. Upon a roll call vote the 0 motion carried unanimously. - Preliminary Plat of Guernsey Meadows - Addition #l. Ald. Dumke moved Resolution #214-77 - The Clerk read same, entitled, Approval of for adoption, seconded by Ald. Schaumberg. Ald. Ford requested a recess in order to review the plat. Mayor Gottfried declared a recess at 8:45 P.M and the meeting reconvened at 8.53 P.M. Ald. Ford advised that he had no objections to the preliminary plat, however, he requested that the final plat show sight corners on S.T.H. 24 and motion with Aldermen Pienkos and Van Lanen voting "no". landscape centers on the cul de sacs. Upon a roll call vote the Resolution #215-77 - The Clerk read same, entitled, Approval of Developer's Agreement for Adrian Heights. Ald. Schaumberg moved for adoption, seconded by Ald. Tomczyk. Upon a roll call vote the motion carried unanimously. 0 Resolution #216-77 - The Clerk read same, entitled Approval of Extractive Permit for State Sand and Gravel. Ald. Dumke moved for adoption, seconded by Ald. Schaumberg. Ald. Wallner moved to defer Lanen. Upon a roll call vote on the motion to defer, Aldermen Dumke, action on this resolution for further review. Seconded by Ald Van Pienkos, Van Lanen and Wallner voted "aye". Aldermen Ford, Schaumberg and Tomczyk voted "no". The motion to defer carried. Resolution #217-77 - The Clerk read same, entitled, Setting Public Hearing Date for Proposed Rezoning in Lake Denoon Area (R3 to RS2). Ald. Dumke moved for adoption, seconded by Ald. Schaumberg. (Public Hearing date to be November 8, 1977, at 7 00 P.M ) Upon a roll call vote the motion to adopt carried unanimously. Resolution #218-77 - The Clerk read same, entitled, Approval of Permit for the Application of Wastewater Residue on the Alvin Basse Property. Ald. Ford moved for adoption, seconded by Ald. Schaumberg. Ald. Wallner moved to defer action on this resolution for two weeks Seconded by Ald. Van Lanen. Upon a roll call vote to defer action, Aldermen Dumke, Ford, Schaumberg and Tomczyk voted "no". Aldermen Pienkos, Van Lanen and Wallner voted "'aye". The motion to defer did 0 not carry. Upon a roll call vote to adopt Resolution #218-77, Alder- men Dumke, Ford, Schaumberg and Tomczyk voted "aye". Aldermen Pienkos, Van Lanen and Wallner voted "no". The motion to adopt carried. Resolution #219-77 - The Clerk read same, entitled, Establishing Sick Leave Benefits for Non-Represented Employees. Ald. Schaumberg moved for adoption, seconded by Ald. Tomczyk. Upon a roll call vote the motion to adopt carried unanimously. Resolution #220-77 -.The Clerk read same, entitled, Resolution De- Denoon Area - Arthur Bostater (Land to be deferred is open land on ferring Special Assessments Against Farm Lands (SW District M-13) Lake the west side of Racine Ave.) Ald. Dumke moved for adoption, seconded by Ald. Schaumberg Upon a roll call vote the motion to adopt carried a unanimously. Resolution #221-77 - The Clerk read same, entitled, Directing the City Attorney to Draft An Ordinance to Amend the Zoning District Map of the City of Muskego (RS2 to RS2 O.D. - Knudsen). Ald. Dumke moved for the third paragraph by adding the following "from RS2 to RS2 O.D." adoption, seconded by Ald. Tomczyk. Ald. Schaumberg moved to amend Motion seconded by Ald. Tomczyk. Upon a voice vote the motion to amend carried. Upon a roll call vote the motion to adopt Resolution #221-77, As Amended, carried unanimously. Attorney to Begin Condemnation Procedures (Lake Denoon Sewer Project) Resolution #222-77 - The Clerk read same, entitled, Directing the City Aid. Dumke moved' for adoption, seconded by Ald. Resolution #223-77 - Directing the City Attorney to Begin Condemnation Procedures (V. Kurtze property). Ald. Dumke moved to suspend the meeting. Seconded by Ald. Schaumberg. Upon a roll call vote the motion rules in order that Resolution #223-77 could be acted upon at this carried with Ald. Wallner voting "no". The Clerk read the resolution. Ald. Dumke moved for adoption, seconded by Ald. Schaumberg. Ald. Dumke moved to amend the fourth paragraph of the resolution by adding the following after the word "instituted" "against the Viola Kurtze property." Upon a voice vote the motion to amend carried. Upon a roll call vote the motion to adopt Resolution #223-As-Amended, the motion carried with Ald. Wallner voting "no". Resolution #210-77 - Authorizing Additional Expenditures for S.T.H. 24 Reconstruction Project. Ald. Pienkos moved for the reconsideration of this resolution. Seconded by Ald. Schaumberg. Upon a roll call vote the motion to reconsider carried unanimously. Ald. Pienkos moved to amend the resolution by changing the amount of money in all places shown in the resolution from $400.00 to $800.00. Seconded by Ald. Tomczyk. Upon a voice vote the motion to amend carried. Upon a roll call vote to adopt Resolution #210-77, As Amended, the motion carried unanimously. Ordinance #336 - The Clerk gave the first reading of same, entitled, An Ordinanceto Amend the Zoning District Map of the City of Muskego (Sec. 5 (Re: Adrian Schmidt property). Ald. Tomczyk moved to suspend the rules that would interfere with the adoption .of this ordinance. Clerk gave the second reading of Ordinance #336.~ Ald. Tomczyk moved Seconded by Ald. Ford. Upon a roll call vote the motion carried. The for adoption, seconded by Ald. Wallner. Upon a roll call vote the motion to adopt carried unanimously. i Ordinance #337 - The Clark gave the first reading of same, entitled, City of Muskego Relating to Regulation of Emergency Alarm Systems. An Ordinance Creating Chapter 12 18 of the Municipal Code of the Ordinance #338 - An Ordinance Amending Section 11.04(c) of the Mun- hauling refuse through the city). The Clerk gave the first reading icipal Code of the City of Muskego Re. Display of permits on tr.ucks - - of the ordinance. _. VOUCHER APPROVAL - Ald. Schaumberg moved to approve payment of general vouchers in the amount of $265,440 31 payable 9/27/77. Seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Ald. Schaumberg moved to approve payment of sewer utility vouchers in the amount of $62,811 98 payable 9/27/77. Seconded by Ald. Dumke Upon roll call the motion carried unanimously __- LICENSE APPROVAL - Ald. Schaumberg moved for the approval of Operator's License for Pamela DeCoto, Sandra Hoffman and Peggy Kearney and for Grace Kwasigroch Seconded by Ald. Ford, motion carried. Ald. Schaumberg moved for the approval of a "Gathering" Permit for St. Leonard's Holy Name Society for October 2 and 16, November 6 and Tomczyk. Motion carried. 20th, December 4th and 18th and for January 15, 1978. Seconded by Ald. Milwaukee, Inc. for W16720 Janesville Rd. for a Class "B" Fermented Ald. Ford moved to approve the request of Pizza Hut of Suburban hlalt Beverage License such as the one which had prev'iously been Pienkos. Upon a roll call vote, Aldermen Ford, Pienkos, Tomczyk, Van committed to the restaurant in the Parkland hlall. Seconded by Ald. Lannen and Wallner voted "aye". Ald. Dumke voted "no". Ald. Schaumberg abstained from voting with permission of his fellow aldermen. The motion carried. e Common Council September 27, 1977 CITY OFFICIAL'S REPORTS - City Attorney Buckley reviewed for the aldermen current pending litigation of the city. COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Clerk read a petition to the Zoning District Map of the City to rezone a parcel of land in Sec. from Donald Miller, dated September 23, 1977, requesting an amendment building Same referred to Plan Commission. 10 from RS2 to RSM for the purpose of constructing a 16-unit apartment The Clerk read a petition with 416 signatures of persons requesting the Common Council to form a public inland lake protection and rehab- Muskego Lake. Petition referred to Public Welfare Committee. ilitation district formed of properties on and/or adjacent to Big Ald. Dumke advised of destruction of official signs in the area of Highways 36 and 45. Public Safety Committee will give consideration to the matter. ADJOURNMENT - Ald. Pienkos moved to adjourn, seconded by Ald. Van Lanen. Motion carried. The meeting adjourned at 1O:OO P.M.
