ccm19770726COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD .JULY 26, 1977 The meeting was called to order at 7:40 P.M. by Mayor Gottfried. Also City Attorney Buckley and City Clerk Bowyer. Ald. Ford arrived at 8:55 P.M. present were Aldermen Dumke, Pienkos, Van Lanen, Schaumberg and Wallner, e Aid. Schaumberg moved to approve the minutes of the previous meeting held on July 12, 1977, and moved that they be accepted and placed on file. Seconded by Ald. hmke, motion carried. COMMITTEE REPORTS - Ald. Schaumberg presented the report of the Finance Cmittee meetings held July 21st and July 26t11, 1977, and moved that they be accepted and placed on file. Seconded by Ald. Dumke, motion carried, Ald. Dumke presented the report of thelmeeting held 7/21/77 and moved that same be accepted and placed on file. Seconded by Ald. Pienkos, motion carried. Ald. Van Lanen presented the report of thelmeeting held 7/13/77 and moved that same be accepted and placed on file. Seconded by Ald. Public Works Public Welfare @Pienkos, motion carried. Ald. Van Lanen presented the report of the meeting of the Rules, Laws and Ordinance Conmittee held 7/13/77 and moved that same be accepted and placed on file. Seconded by Ald. Wallner, motion carried. Ald. Dumke presented the report of the Public Sewer Committee meeting held on 7/18/77 and moved that same be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. Ald. Pienkos presented the report of the Public Safety Comrnj:ttee meeting held on 7/27 and moved that same be accepted and placed on file. Seconded by Ald. Van Lanen, motion carried. The minutes of the Plan Commission meeting held 7/19/77 were acknowledged, UNFINISHED BUSINESS Resolution #149-77 - Denial of Legal Status (Barbara Lovald). Because of a forthcoming resolution at this meeting ofzering a refund of sewer lateral In the amount of $225.00, Ald. Picnkos moved to table Resoluti.on #149-77. unanimously. Resolution #152-77 - Reversing tho Public Works Committee Decision Not to Reconstruct Drainage Ditch in Parkland PUD. (This resolutioll j.s on the floor and was deferred from the previous meeting to give the owner of the property involved an opportunity to discuss the matter with Public Works Supterintendent Bertram.) COMMUNICATIONS FROM THE MAYOR‘S OFFICE 0 The Clerk read a proclamation signed by Mayor Gottfried Proclaiming the week of August 1st thru 7th, ,1977, as “Muskego Clown week” (originated by the Milwaukee Metropolitan Clown Club). The Clerk read correspondence from Parks .ind Recreation Director Steven generous donation to the City of a lighted scoreboard at Horn Park. Mayor Gottfried publicly commended the employees of the city who donated their time and talents to help refurbish the lower level of city hall, resulting in the saving of a considerable amount of money. NEW BUSINESS Resolution #154-77 - The Clerk read same, entitled, Approval of Transfer of Funds (Federal Revenue Sharing). Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon a roll call vote the motion carried unanimously. Resolution #155-77 - The Clerk read same, entitled, Approval of Certified Survey Map (Bob Stack) Ald. Schaumberg moved for adoption, seconded by Pischke commending St. Francis Savings 2nd Loan Association for their Ald. Pienkos. Upon roll call the motion carried unanimously. Resolution #156-77 - The Clerk read same, entitled, Approval of Certified Survey Map Walter Vesbach). Ald. Schaumberg moved for adoption, seconded by Ald. Wallner. Upon roll call motion carried unanimously. Resolution #157-77 - The Clerk read same, entitled, Approval of Certified Survey Map (A. Schmidt) Ald. Schaumberg moved for adoption, seconded by Ald. Van Lanen. Upon roll call the motion carried unanimously. Resolution #158-77 - The Clerk read same, entitled, Approval of Preliminary and Final Plat of Heather Ridge Estates, Addition #1 (Town uf Vernon) Ald. Schaumberg moved for adoption, seconded by Ald. Wallner. Upon a roll call vote the motion carried unanimously. Resolution #159-77 - The Clerk read same, entitled, Approval of Payment of Fina.1 Disbursement For Road and Site Grading for Phase I1 of the Industrial Park. Ald. Dumke moved for adoption, seconded by Ald. Schaum- berg. Ald. Pienkos moved to defer action 011 Resolution #159-77 for two weeks, seconded by Ald. Van Lanen. Upon a voice vote the motion carried. Resolution #162-77 - The Clerk read same, entitled, Authorizing Refund for Sewer Lateral (Barbara Lovald). Ald. Dumke moved for adoption, Wallner voting ”no”. seconded by Ald. Pienkos. Upon roll call the motion carried with Ald. *Resolution #163-77 - The Clerk read same, entitled, Directing the City Attorney to Draft an Ordinance to Amend the Zoning District Map of the City (Sec. 5) (A portion of the A. Resolution #165-77 - The Clerk read same, entitled, Allthorizing Agree- ment Between David Schreiber & Associates and the City for Horn Field ~ ~~ ~ ~~ ~~ Project. Ald. Dumke moved for adoption, seconded by Ald. Pienkos. Upon a roll call vote on the motion to adopt, Aldermen Dumke, Schaum- berg, Pienkos voted "aye". Aldermen Van Lanen and Wallner voted "no". The motion to adopt carried. Resolution #166-77 - The Clerk read same, entitled, Authorizing Refund for Part of Earnest Money for Industrial Park Lot (Bennie Lane). Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. ($500.00 to be retained of which $250.00 will be paid to the city's industrial broker and the balance to the city to cover expenses involved in the transaction). Upon a roll call vote the motion to adopt carried unanimously. Resolution #167-77 - The Clerk read same, entitled, Authorizing Renewal Dumke moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution #168-77 - The Clerk read same, entitled, Approval of Payment of Claim of Gary Dake ($33.00 for alleged damage to the electrical system of his home by the Public Works Dept.). Ald. Schaumberg moved for adoption, seconded by Ald. Van Lanen. Upon roll call the motion carried unanimously. Resolution #169-77 - The Clerk read same, entitled, Approval of Payment of Claim of Jeanette Heckert ($6.00 for damage to clothing from newly painted bleachers). Ald. Van Lanen moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. At 8:55 P.M. Mayor Gottfried declared a recess and the meeting re- convened at 9: 00 P.M. of Contract with E. M. Boerke, Inc. as Industrial Park Broker. Ald. e Resolution #170-77 - The Clerk read same, entitled, Approval of Transfer of Funds (Re: Promotion of Industrial Park), Ald. Schaumberg moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution #171-77 The Clerk read same, entitled, Approval of Developer's Agreement for Lake Brittany Estates. Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Ald. Pienkos moved to defer acti.on of same in order to have more time to review the agreement. Seconded by Ald. Van Lanen. Upon a voice vote the motion to defer carried. Resolution #172-77 - Ald. Pienkos moved to suspend the rules that would interfere with the adoption of same, entitled, Designation of Local Agent for Federal Disaster Assistance (Office of the Mayor). Seconded by Ald. Schaumberg. Upon a roll call vote the motion to suspend the rules carried with Ald. Wallner voting "no" . The Clerk read the resolution. Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Ordinance #332- The Clerk gave the first reading of' same, entitled. Code (Building Code Amendments) Resolution #173-z - A1 Pienkos moved to suspend the I-ules that would interfere with the adoption of Resolution #173-'77, entitled, Authorizing ~e A Spec.in1 Election Be Held To Fill the Vacancy in tile Fifth Aldermanic District in Muskego. Seconded by Ald. Wallner. Ald. pj.enkos read the resolution. Upon a roll call vote to suspend .the rules, Aldermen Dllmke, Ford and Schaumberg voted "no" . Aldermen Pienlcos, Van Lane@. and Wallner voted "aye". In order to break the tie vote, Mayor Gottfried voted "no". Since a 2/3 vote of the aldermen is necessary to suspend the rules the motion did not carry. VOUCHER APPROVAL - Ald. Schaumberg moved to approve payment of the general vouchers in the amount of $280,650.40. Seconded by Ald.'Dumke. Upon roll call the motion carried. Ald. Schaumberg moved to approve payment of the sewer utility vouchers in the amount of $4,365.14. Seconded by Ald. Dumke. Upon roll Call the motion carried unanimously. LICENSE APPROVAL - Ald. Schaumberg moved for the approval of Operators Seconded by Ald. Dumke, motion carried. Ald. Schaumberg moved for the approval of a permit for a waterski Slalom Course for Jerry blaus for August 8, 9, 10, 11, 12 and 15, 16, 17, 18 and 19th, 1977, east of George's Island. Seconded by Ald. Pienkos. Motion carried. Ald. Schaumberg moved for the approval of a Junk and Salvage Permit upon roll call. for Jack Glockner. Seconded by Ald. Dumke, motion ca;.ried unanimously Ald. Schaumberg moved for the approval of Dump Refuse Hauling Permits motion carried. for Sanitary Disposal and Thomas Disposal. Seconded by A1.d. Dumke, 0 An Ordinance to Amend Various Sections of Chapter 30 of the Municipal Licenses for Jean Wolf, Patricia Pearson, Trudy hlayo and Edward Salb. COMMUNICATIONS AND MISCELLANEOUS BUSINESS " Ald. Dumke moved for the reconsideration of Resolution X152-77 entitled, Reversing the Public Works Committee Decision Not to Reconstruct Drainag Ditch in Parkland Planned Unit Development. Seconded by Ald. Schaumberg Upon a roll call vote to reconsider, Aldermen Dumke, Schnumberg, Ford and Pienkos voted "aye". Aldermen Van Lanen and Wallner voted "no". The motion to reconsider carried. Upon a roll call vote to adopt Res- olution #152-77, Aldsrmen Dumke, Ford, Pienko:; and Scha1lnlberg voted Resolution #152-77 did not carry. "no". Aldermen Van La.nen and Wallner voted "aye". The motion to adopt The Clerk read a communication from John Krahlirlg, Jr., President of the Little hluskego Lake Association, requesting permission of the Common Council to display the weed harvester (Cutty Shark) in ~1:he VFW Parade on August 28th. Same The Clerk read a petition from Jerome Mazurkiewicz requesting legal referred to Plan Commission. hlayor Gottfried advised that because the I:cderal and Sl:?te Governments Council be held regarding the Flood Plain Ordinance for the City.
