ccm19770712COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD JULY 12, 1977 The meeting was called to order at 8 05 P.M. by Mayor Gottfried. Also present were Aldermen Dumke, Ford, Pienkos, Van Lanen and Wallner, City Clerk Bowyer and City Attorney Buckley. Ald. Schaumberg was absent. Ald. Pienkos moved to approve the minutes of the previous meeting held on June 28, 1977, as mailed. Seconded by Ald. Dumke, motion carried. Ald. Ford presented the report of the Finance Committee meeting held on July 12, 1977, and moved that the report be accepted and placed on file. Seconded by Ald. Dumke, motion carried. , Ald. Dumke presented the report of the Public Works Committee meeting held on July 7, ,1977, and moved that it be accepted and placed on file. Seconded by Ald Ford, motion carried. Ald Van Lanen presented the report of the Public Welfare Committee meeting held on June 29, 1977, and moved that it be accepted and placed on file. Second'.by Ald. Pienkos, motion carried. Committee meeting held on June 29, 1977, andmoved that it be accepted Ald. Van Laneri presented the report of the Rules, Laws & Ordinance and placed on file. Seconded by Ald. Wallner, motion carried. The-minutes of the Plan Commission meeting held July 5, 1977, were received and placed on file. .. . UNFINISHED BUSINESS Ordinance #328 - The Clerk gave the seconded reading of same, entitled, An Ordinance to Repeal and Recreate Various Provisions of the Zoning Regulations of Ch 17 of the Municipal Code of the City (Re. Accessory buildings). Since this ordinance was on the floor, Ald. Ford moved to amend same by having Section 3 (B)(2) read as follows "0)(2) On lots of at least 120,000 square feet and up to and including 400,000 square feet, stables, barns and poultry houses, sheds and other similar structures are permitted, however, all such buildings exceeding 240 sq. feet are subject to Plan Commission approval and the total floor area of all outbuildings combined shall not exceed 1% of the lot area, and the buildings housing domestic livestock or poultry shall not be closer thz.n 50 feet to the lct line. The height of these buildings shall not exceed 25 feet " Seconded by Ald, Dumke: lqotion carried. Upon a roll call voteto adopt Ordinance #328, As Amended, the motion carried unanimously. Ordinance #329 - The Clerk gave the second reading of same, enTltled, An Ordinance to Repeal Section 12.01(3)(d) of the Municipal Code Ford moved for adoption, seconded by Ald Dumke. Upon roll call the (Re. Waiving of medical report to obtain Operator's License ) Ald. motion carried unanimously. Ordinance #33 - The Clerk gave the seconded reading of same, entitled, An Ordinance to Create Chapter 14 of the Municipal Code of the City of Muskego (Muskego Flood Plain Ordinance). Ald Ford moved for adoption, seconded by Ald. Dumke. Upon a roll call vote to adopt Ordinance iy330, Aldermen Dumke, Ford and Pienkos voted "aye". Alder- men Van Lanen and Wallner voted "no". The motion to adopt Ordinance #330 carried. Common Council July 12, 1977 Page 2. COMMUNICATIONS FROM THE MAYOR'S OFFICE - At this time the Clerk read a communication from Ald. Leslie J. Constan- tineau, dated July 11, 1977, directed to the Honorable Mayor Gottfried and Members of the Common Council, tendering his resignation as Alderman of District V, effective imnediately. Mayor Gottfried expressed his gratitude to Ald. Constantineau for his dedicated service to the city and he advised that applications to fill the unexpired term for the Fifth District Alderman would be taken, the applicants would be interviewed and the members of the Common Council, by secret ballot, would choose the person they felt would be the most qualified for the position. NEW BUSINESS Resolution #122-77 - The Clerk read same, entitled, Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate a Part of Forest Drive in the City of Muskego, Wisconsin. Ald. Ford moved for adoption, seconded by Ald. Van Lanen. Upon a roll call vote the motion carried unanimously . Resolution 11149-77 - The Clerk read same, entitled, Denial of Legal Status (Lots 7 and 8, Block 8, Muskego Shores Subdivision - Lovald) Ald. Dumke moved for adoption, seconded by Ald. Pienkos. Ald. Ford moved to defer action on Resolution #149-77 for further review. Seconded by Ald. Pienkos. Upon a roll call vote the motion carried with Ald. Wallner casting a dissenting vote. Resolution #150-77 - The Clerk read same, entitled, Setting Public Hear- Store). Ald. Pienkos moved for adoption, seconded by Ald. Resolution #151-77 - The Clerk read same, entitled, Approval of Certified Queen Store). Ald. Dumke moved for adoption, seconded by Ald. Wallner. Resolution #152-77 - The Clerk read same, entitled, Reversing the Public Works Committee Decision Not to Reconstruct Drainage Ditch in Parkland Planned Unit Development. Ald. Van Lanen moved for adoption, seconded by Ald. Wallner. Ald. Van Lanen moved to defer action on same for the purpose of discussing various alternatives with Superintendent of Public Works Willard Bertram such as installation of inverts, storm sewering and terracing of the ditch. Seconded by Ald, Ford. Upon a roll call vote to defer action on Resolution #152-77 the motion carried with Ald. Dumke voting "no". With Marvelyn Pufall. Ald. Ford moved for adoption, seconded by Ald. Resolution #153-77 - The Clerk read same, entitled, Settlement of Grievance Van Lanen. Upon a roll call vote the motion carried unanimously. At 8 47 P.M. Mayor Gottfried declared a recess and the meeting reconvened at 8 57 P.M. Ordinance #331 - The Clerk gave the first reading of same, entitled, An Ordinance to Create an O.D. CITY OFFICIAL'S REPORTS - The Clerk presented the Building Report for for that month. Report placed on fine. ADJOURNMENT - Ald. Pienkos moved to adjourn, seconded by Ald. Dumke, motion carried.
