ccm19770222COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD FEBRUARY 22, 1977 The meeting was called to order at 7:39 P.M. by Mayor Jerome J. Gottfried. Also present were Aldermen Constantineau, Colburn, Ford, Dumke, Pienkos. Schaumberg and Wallner, City Attorney John Buckley and City Clerk Bette J. Bowyer. Ald. Pienkos moved for the approval of the minutes of the previous meeting, as mailed. Seconded by Ald. Dumke, motion carried. Ald. Schaumberg presented the-report of the Finance Committee meeting held -2122177 -and moved that it be approved and placed on file. Constantineau presented the report of the Rules, Laws & Ordinance Committee meeting :held 2/9/.7~7Tand moved-that it .be -accepted and placed on file. Seconded by Ald. Colburn, motion carried. The minutes of the Parks and Recreation Board meeting held 1/10/77 wereracknowledged-and~wi3.1 be:pla~ced=on-f~ile.;-. 0 e' UNFINISHED BUSINESS Resolution nY22-77 - Denial of Legal Status (Lots 3 and 4, Muskego Shores Subdivision - W. Anderson) Because Plan Commission did not have its regular meeting Ald. Colburn again moved to defer action on same for two.weeks. Seconded by Ald. Constantineau-. Upon a roll call vote the motion to defer carried unanimously. Resolution #23-77 - Approval of Preliminary Plat (Wildflower) This resolution is on the floor and had been deferred for two weeks until the matter of the right-of-way to Prospect Drive and the dedication of Outlot #1 clarified. Discussion followed regarding the two by adding the following conditions: (5) That Outlot #1 be deeded to reasons for deferral and Ald. Ford moved to amend Resolution $23-77 abutting property owner Thomas J. Roswicz and (6) That Prospect Drive be developed as a one-way south street. Motion seconded by Ald. Constantineau. Upon the advice of City Attorney Buckley that the condition regarding a one-way south street was a traffic reg- Ald. Ford moved to call for the question. Seconded by Ald. Constantineau. Upon a roll call vote to call for the question, Aldermen Colburn, Pienkos and Wallner voted "no". Motion carried: On the motion to Constantineau, Ford and Schaumberg voted "aye". Aldermen Dumke, further amend Resolution $23-77 by Ald. Colburn, Aldermen Colburn Pienkos and Wallner voted "aye". Aldermen Constantineau, Dumke, Ford and Schaumberg voted "no". The motion to further amend did not carry. Proper garbage receptacles). Ald. Schaumberg moved for adoption, seconded by Ald. Pienkos. Upon a roll call vote Aldermen Colburn, Dumke, Ford, Schaumberg and Wallner voted "aye". Aldermen Constantineau and Pienkos voted "no". The motion to adopt carried. Resolution #41-77 - The Clerk read same, .entitled, Setting Public Hearing Dates for Revised Westlake Estates PUD and Amending Ch. 17, Sec. 8.11, 8.12, 8.13 and 8.14 of the Zoning Ordinance. (Hearing date March 22, 1977, at 7 00 P.M. and 7:15 P.M. respectively). Ald. Colburn moved for adoption, seconded by Ald. Pienkos. Upon a roll call vote the motion carried with Ald. Wallner casting a dissenting vote. Ordinance 322 - The Clerk gave the first reading of same, entitled, An Ordinance to Amend Various Provisions of the Basic Regulations of the Zoning Ordinance Ch. 17 of the Municipal Code (Reference to by municipal sewer) minimum lot size in Business Districts in the city that are served VOUCHER APPROVAL -Ald.
