ccm19761012COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD OCTOBER 12, 1976 The meeting was called to order at 8:40 P.M. by Mayor Gottfried. Also present were Aldermen Constantineau, Ford, Dumke, Pienkos and Wallner, City Clerk Bette J. Bowyer. Aldermen Schaumberg and Colburn were absent. Ald. Pienkos moved for the approval of minutes of the previous meeting held 9128176 and moved that they be accepted and placed on file. Seconded by Ald. Dumke, motion carried. Ald. Dumke presented the report of the Finance Committee meeting held 1017176 and moved that it be accepted and placed on file. Seconded by Ald. Constantineau, motion carried. Ald. Ford presented the report of the Public Works Committee meeting held 10/6/76 and moved that it be accepted and placed on file. Seconded by Ald. Constantineau, motion carried. Ald. Pienkos presented the report of the Public Welfare Committee meeting held on g/29/76 and moved that it be accepted and placed on file. Seconded by Ald. Constantineau, motion carried. The minutes of the Plan Commission meeting held en 10/5/76 were received and placed on file. UNFINISHED BUSINESS Ordinance 8319 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Section 16.26 of the Municipal Code (Holding Tanks). Ald. Dumke moved for adoption, seconded by Ald. Wallner. Ald. Dumke moved to defer action on Ordinance #319 until the next meeting of the Council. Seconded by Ald. Wallner. Upon a roll call vote the motion to defer carried unanimously. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried advised that he has designated Hallqween "Trick or Treat" hours in Muskego to be Saturday, October 30, 1976, between the hours of 4:30 P.M. and 6:30 P.M. a Mayor Gottfried advised that the newly printed Municipal Code will be ready for distribution within a few weeks, NEW BUSINESS Resolution 8190-76 - The Clerk read same, entitled, Authorizing Expenditure of $500.00 for Halloween Festivities ($pookfest to be sponsored by the Muskego Jaycees on Sunday, October 31st). Ald. Pienkos moved for adoption, seconded by Ald. Wallner. Upon a roll call vote the motion carried unanimously. Resolution j/191-76 - The Clerk read same, entitled, Resolution Relating to Final Determination of Special Assessments (NE Dist. L-12 - Freedom Acres and Bay Lawn Area). Ald. Dumke moved for adoption, seconded by Ald. Pienkos. Upon a roll call vote the motion carried unanimously. a Resolution j/192-76 - The Clerk read same, entitled, Resolution Levying Special Assessments (L-12 Dist.) Ald. Dumke moved for adoption, seconded by Aid. Wallner. (Freedom Acres and Bay Lawn area). Upon a roll call vote the motion carried unanimously. Common Council 10/12/76 - I'. 2 New business - cont'd. Resolution #193-76 - The Clerk read same, entitled, Resolution Notice of Final Determination (L-12 Dist. - Bay Lawn & Freedom Ald. Dumke moved for adoption, seconded by Ald. Constantineau. roll call vote the motion carried unanimously. Directing Acres Area) Upon a Resolution l/194-76 - The Clerk read same, Authorizing Public Officials to Issue Non-traffic Citation in Accordance with Ordinance i/316. Ald. Dumke moved for adoption, seconded by Ald. Pienkos. (Public officials designated to issue citations are Building Inspector, Deputy Inspectors (3) and Supt. of Public Works). Upon a roll call vote the motion carried unanimously. Resolution #195-76 - The Clerk read same, entitled, Directing City Clerk to Place Police Department Building Referendum on November 2nd Ballot (Initial Resolution Authorizing $400,000.00 Bonds of the City of Muskego) Ald. Constantineau moved for adoption, seconded by Ald. Dumke. Following a short discussion, upon a roll call vote the motion carried unanimously. Resolution #196-76 - The Clerk read same, entitled, Authorizing Transfer of Funds. (From Contingency and Unappropriated Surplus to various accounts). Ald. Dumke moved for adoption, seconded by Ald. Wallner. Upon a roll call vote the motion carried unanimously. At 8:30 P.M.Mayor Gottfried declared a recess and the meeting reconvened at 8:45 P.M. Resolution i/197-76 - The Clerk read same, entitled, Acceptance of Offer to Purchase City-Owned Land on Durham Drive. Ald. Dumke moved for adoption, seconded by Ald. Ford. The land in question is 5.5 acres and the city had received and offer from William Bailey in the amount of $15,000.00 for same.) Ald. Wallner moved to defer action on Resolution f/197-76 in order to give him an opportunity to view the land. Seconded by Ald. Pienkos. Following a short discussion, upon a roll call vote the motion to defer carried with Ald. Ford voting "no". LICENSE APPROVAL - Ald. Dumke moved to recommend approval of Operators License for Nancy Stelter, Gene Scheiderer, Rene Steckel and Connie Schweitzer pending receipt of favorable fingerprint and medical reports. Seconded by Ald. Pienkos, motion carried. Ald. Dumke moved to recommend approval of "Gathering" License for Muskego Ictronauts for October 29, 30 and 31, 1976, for drag races to be held on Muehl farm at the corner of Woods Rd. and Racine Ave. Seconded by Ald. Pienkos, motion carried. VOUCHER APPROVAL - Ald. Dumke moved to recommend approval of payment of general vouchers in the amount of $205,254.81. Seconded by Ald. Wallner, motion carried upon roll call. Ald. Dumke moved to recommend approval of payment of sewer vouchers in the amount of $72.111.48. Seconded by Ald. Wallner. Upon roll call , the motion carried unanimously. CITY OFFICIAL'S REPORTS - The Clerk month of September indicating seven in the amount of $466,312.00. Same ADJOURNMENT - Ald. Pienkos moved to gave the Building Report for the new dwellings and total construction placed on file. adjourn, seconded by Ald. Wallner, motion carried. The meeting adjourned at 9:00 P.M. Bowyer, City Clerk Excerpts of Minutes of Regular Meeting of Common Council Held October 12, 1976 * A regular meeting of the Common Council of the City of Muskego, Waukesha County, Wisconsin, was held in open session on October 12, 1976 and called to order by His Honor, Mayor Gottfried at 7:30 P.M. in the Council Chambers, City Hall. The following Aldermen were present: Constantineau, Ford, Dumke, Pienkos and Wallner The following Aldermen were absent: Schaumberg and Colbum (Here occurred business not pertinent to the bond issue.) It was moved by Alderman Constantineau and seconded by Alderman Dumke to adopt the following initial resolu- tion which had been offered and read at this Council's regular meeting held September 14, 1976. Resolution No. 195.:-76 INITIAL RESOLUTION Authorizing $400,000.00 bonds of the City of Muskego: RESOLVED that the City of Muskego, Waukesha County, Wisconsin, borrow an amount not to exceed $400,000.00 by issuing its general obligation coupon bonds for the purpose of constructing police facilities in and for the City. For the purpose of paying the princi- pal of and interest on said bonds, there is hereby levied on all the taxable property in said City a direct, annual irrepealable tax sufficient for that .purpose. Upon roll call vote, the following voted aye: Constantineau, Ford, Dumke, Pienkos and Wallner and the following voted nay: None Whereupon, the initial resolution was declared adopted by Mayor Gottfried and immediately recorded by Clerk Bowyer. It was moved by Aldermanconstantineau and seconded by Alderman Dumlce to adopt the following resolution: . WHEREAS this Common Council has adopted an initial resolution to authorize general obligation bond fi- nancing in the amount of not to exceed $400,000.00; and WHEREAS the pertinent provisions of Chapter 67 of the Wisconsin Statutes permit such initial resolution to be submitted to the electorate for approval or re- jection: NOW, THEREFORE, BE IT RESOLVED that then City Clerk call a special election on the next succeeding regu- lar municipal election, to-wit: on November 2, 1976, for the purpose of submitting the question of,bonding the City to the electors thereof, in the following form: Shall the City of Muskego borrow an amount not in excess of $400,000 by issuing its general obligation bonds for the purpose of constructing police facilities in and for the City? with an opportunity for voters to vote either "For Bonds" Of "Against Bonds,* and the City Clerk shall place such question on the official voting machine ballot a.nd on the sample ballots applicable thereto; FURTHER RESOLVED that the City Clerk is herewith in- structed to publish a notice of said special election at least twice, one week apart, in the Muskego SAM; the official City newspaper, such publications to be 1 t least accomplished in the issues of the newspaper published in the weeks of October 18 and 25, 1976, in substantially the following form: NOTICE OF BOND REFERENDUM l TO THE ELECTORS OF: THE CITY OF MUSKEGO PLEASE TAKE NOTICE that a referendum will be held in conjunction with the General Election on November 2, 1976, upon the following question: Shall the City of Muskego borrow an amount not in excess of $400,000 by issuing its general obligation bonds for the purpose of constructing police facilities in and for'the City? EXPLANATION The answer to be given to such question shall be either "For Bonds" or "Against Bonds." A "For Bonds" vote shall in- dicate the voter's approval of the borrowing of money by the City in an amount not in excess of $400,000 for the purpose of constructing police facilities and the voter's approval of such purpose. An "Against Bonds" vote shall indicate the voter's rejection of such borrowing and such purpose. In the event a majority of the voters at referendum vote "For Bonds", the City of Muskego will be authorized to con- struct police facilities and to finance such construction by issuing bonds in an amount not in excess of $400,000. In the event a majority vote "Against Bonds," the City will not be so authorized. POLLING PLACES The qualified e1ector.s of the City of Muskego shall vote upon such question at the regular polling places of the several precincts as follows: . , Each of said polling places shall open at 7;oo A.M. and close at 8,‘o-o P.M. on said November 2, 1976. a SPECIAL NOTE Complete instructions for the information and guidance of the voters and a voting machine facsimile ballot, showing a re- duced diagram of the front of the voting machine, and for in- structions to electors on how to vote on the machine, may be found in the "Facsimile Ballot-Notice of General Election" ap- pearing on this page of this newspaper.
