ccm19760928COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 28, 1976 The meeting was called to order at 8:45 P.M. by Mayor Gottfrid AlSo present were Aldermen Colburn, Constantineau, Ford, Pienkos, Dumke and Wallner, City Clerk Bette J. Bowyer and City Attorney John Buckley. Ald. Schaumberg was absent. Ald. Colbum moved for the approval of minutes of the previous meeting held September 14, 1976. Seconded by Ald. Dumke, motion carried. Ald. Colburn presented the reports of the Finance Committee meetings held on September 23 and 28, 1976, and moved that they be accepted and placed on file. Seconded by Aid. Dumke, motion carried. Aid. Colbum presented the report of the Public Sewer Committee meeting held g/20/76 and moved that it be accepted and placed on file. Seconded by Ald. Constantineau, motion carried. Ald. Pienkos presented the report of the Public Welfare Committee meeting held on g/15/76 and moved that it be accepted and placed on file. Seconded by Ald. Constantineau, motion carried. 8 f- Ald. Pienkos presented the report of the Public Safety Committee meeting held g/22/76 and moved that it be accepted and placed on file. Seconded by Ald. Constantineau, motion carried. Ald. Pienkos presented the report of the Rules, Laws & Ordinance Committee meeting held on g/15/76 and moved that it be accepted and placed on file. Seconded by Ald. Wallner, motion carried. Plan Commission minutes of meeting held g/21/76 - Ald. Pienkos questioned why the action taken on the Boxhorn Big Muskego Gun Club was not included on the Common Council agenda for this meeting. Mayor Gottfried explained that it was not necessary for the Counciltoacton the matter of approving the sound barrier to be built at the Gun Club. Discussion took place by several of the aldermen and the Mayor after which the.minutes of the Plan Commission meeting were received and placed on file. . _ _ _. .- UNFINISHED BUSINESS l Resolution f/148-76 - Granting Sewer Commections to Wildflower Planned Unit Development. Since this resolution is on the floor, Ald. Colburn moved to amend same by changing the 5th and 6th paragraphs to read "that municipal sewers be granted for forty (40) single family lots, 42 apartments and 44 zero lot line units." Seconded by Ald. Du&e. Upon a roll call vote to amend Resolution i/148-76 the motion carried unan- imously. UPon a roll call vote to adopt Resolution i/148-76, As Amended, the motion carried unanimously. (Total units granted, 126) Resolution 8110-76 - Denying Application of the Muskego Volunteer Fire Company to Rezone Parcel of Land in Section 5. This resolution was deferred and referred to Plan Commission on 6/8/76 and never finally acted upon by the Council. Upon a roll call vote to adopt Resolution #llC-76 the motion carried with Ald. Dumke casting a dissenting vote. . Common Council September 28, 1976 Page 2. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried reminded the aldermen that Halloween is just a month off and he asked that they discuss the matter of "trick or treat" with as many as their constituents as possible to determine their feelings on the matter. The Clerk read a proclamation by Mayor Gottfried designating the week of October 1 through 7 as "Share a Song Week" in recognition of the singing groups and the "Sweet Adelines, Inc." Mayor Gottfried advised that Miss Joan Kaminski was the recipient of the citizenship-leadership award in the 1976 Miss Wisconsin National Teenager pageant held recently. In behalf of the aldermen, himself and all of the citizens of Muskego he extended congratulations to her. NEW BUSINESS Resolution j/183-76 - The Clerk read same, entitled, Authorizing the Advertising of Bids for Installation of Sanitary Sewers (Bay Lawn and Freedom Acres Subdivision area). Ald. Dumke moved for adoption, seconded by Ald. Constantineau. Upon a roll call vote the motion carried unanimously. Resolution #184-76 - The Clerk read same, entitled, Establishing Traffic Regulations (45 mph speed limit on Kelsey Dr. from Racine Ave. to west city limits, a "stop" sign on the NW corner of Poe's Pl and Sherwood Cir. and "No Parking" on the west side of Hillside Dr. from Hillview Dr. to Lochcrest Blvd. Ald. Pienkos moved for adoption, seconded by Ald. Constantineau. Upon roll call the motion carried unanimously. Resolution 11185-76 - The Clerk read same, entitled, Authorizing the Execution of Agreement with Engineering Firm of Ruekert & Mielke for Engineering Services for the City of Muskego. Aid. Dumke moved for adoption, seconded by Ald. Colburn. Upon roll call the motion to adopt carried unanimously. Resolution #186-76 - The Clerk read same, entitled, Directing the City Attorney to Draft an Ordinance Providing for Sewer Connection Charge for All New Buildings in the City. Ald. Dumke moved for adoption, seconded by Ald. Colburn. Following a short discussion Ald. Wallner moved to defer action on Resolution f/186-76. Seconded by Ald. Pienkos. Ald. Dumke advised that the sewer connection fee being proposed is only for newly constructed buildings in the city and not existing buildings. Following further discussion, upon a roll call vote to defer action on Resolution 8186-76 the motion didnotcarry with Ald.Wallner voting ",ye?'. motion Upon a roll call yote to adopt Resolution l/186-76 the carried with Ald. Wallner voting "no". 8.J - Page 3. Resolution #la?-76 - The Clerk read same, entitled, Authorizing Execution of Lease Agreement Between Richard Schaumberg and Muskego Park and Recreation Board (15 acres of land in proposed Freedom Square - Phase IV). Ald. Ford moved for adoption, seconded by Ald. Constantineau. Upon roll call vote the motion to adopt carried unanimously. Resolution #188-76 - The Clerk read same, entitled, Granting Sewer Service to Elmer Tinti for a Four Parcel Division of Land Adjacent to Hillendale Heights Subdivision. Ald. Dumke moved for adoption, seconded by Ald. Constantineau. Upon roll call the motion to adopt carried unanimously. Resolution $1189-76 - The Clerk read same, entitled, Approval of the Continuation of the City's Remonumenting Program. Ald. Constantineau moved for adoption, seconded by Ald. Dumke. Upon roll call the motion to adopt carried unanimously. Ordinance #319 - The Clerk gave the first reading of same, entitled, An Ordinance to Amend Ordinance 8315 (Re: Holding Tanks) LICENSE APPROVAL - Ald. Colburn moved for the approval of Operators Licenses for Judy Commungs, Cherie DuLac, William Statter and Iver Meyers subject to receipt of favorable fingerprint report and for the approval of Operators License for Rosann Glynn, Sharon Smukowski, Daniel and Gladys Posielenzny. Seconded by Ald. Dumke, motion carried. VOUCHER APPROVAL - Ald. Colbum moved to recommend approval of sewer utility voucher in the amount of $2,610.00 to the Illingworth Co. Seconded by Aid. Dumke. Upon a roll call the motion carried unanimously. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk acknowledged receipt of a petition signed by Richard M. Knudsen requesting rezoning of a parcel of land containing an existing building from RS-2 to RSA. Ald. Constantineau moved to set the public hearing date on the petition for November 9, 1976. Sec- onded by Ald. Pienkos. Following discussion by several of the alder- men and the Mayor as to whether or not the public hearing needed to be held prior to a recommendation from the Plan Commission, upon a roll call vote on the motion to set the public hearing for November 9th, Aldermen Constantineau, Pienkos and Wallner voted "aye". Aldermen Colburn, Dumke and ford voted "no". The vote:,being a tie Mayor Gottfried voted "no". The motion did not carry and the petition was referred to Plan Commission. Ald. Constantineau again requested that the aldermen and city clerk use microphones when speaking during a Council meeting. Ald. Constantineau discussed the possibility of bringing the matter of the construction of the sound barrier at Big Muskego Gun Club to the Public Welfare Committee. ADJOURNMENT - Ald.
