ccm19760914?a, COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 14, 1976 The meeting was called to order at 8:35 P.M. by Mayor Gottfried. Also present were Aldermen Colbum, Dumke, Ford, Schaumberg, Pienkos and Wallner, Deputy Clerk June Elger and City Attorney John Buckley. City Clerk Bowyer arrived at 9:15 P.M. and Ald. Constantineau was absent. Ald. Schaumberg moved for the approval of minutes of the previous meeting held August 24, 1976. Seconded by Ald. Dumke, motion carried. Ald. Schaumberg presented the report of the Finance Committee meeting held September 9, 1976, and moved that it be accepted and placed on file. Seconded by Ald. Dumke, motion carried. He also presented the minutes of the meeting held g/14/76 and moved that they be approved and placed on file. Seconded by Ald. Dumke, motion carried. Ald. Dumke presented the report of the Public Works Committee meeting held on September 8, 1976, and moved that it be accepted and placed on file. Seconded by Ald. Pienkos, motion carried. Ald. Pienkos presented the report of the Public Welfare Committee meeting held on 8/25/76 and moved that it be accepted and placed on file. Seconded by Ald. Wallner, motion carried. Ald. Pienkos presented the report of the Rules, Laws & Ordinance Committee meeting held 8/25/?6 and moved that it be accepted and placed on file. Seconded by Ald. Wallner, motion carried. The minutes of the Plan Commission meeting held g/7/76 were received and placed on file. UNFINISHED BUSINESS Resolution #151-76 - Denial of Legal Status (Koepsel). This resolution was on the floor and had been deferred and referred back to Plan Commis- sion. Ald. Colbum and Mayor Gottfried reviewed the reasons for the denial in the recommendation from the Plan Conrnission. Ald. Wallner requested permission of his fellow aldermen to have Mr. Kenneth Koepsel speak, As there were no objections Mr. Koepsel reviewed portions of the Board of Appeals meeting held in October, 1970 regarding the Mill Valley Heights Subdivision. Upon a roll call vote to adopt Resolution i/151-76 the motion carried with Ald. Wallner voting "no". Resolution #171-76 - Approval of Deed Restrictions and Open Space Agreement for Kristin Down Subdivision. This resolution had been refer- red to the Public Welfare Committee for clarification from the developer. Upon a roll call vote to adopt Resolution 8171-76 the motion carried with Ald. Ford casting a dissenting vote. Ordinance $1316 - The Deputy Clerk gave the second reading of Ordinance #316, entitled, An Ordinance to Create Set, 1.06(10) of the Municipal Code Providing for Issuance of Citations in Non-traffic Ordinance Violations. Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon a roll call vote the motion to adopt carried unanimhisly. Common Council September 14, 1976 Page 2. Unfinished business - cont'd. - l Ordinance #317 - The Deputy Clerk gave the second reading of same, entitled, An Ordinance to Amend Sec. 18.28 (2) of the Municipal Code Regarding Determination of Ownership. Ald. Schaumberg moved for adoption, seconded by Aid. Dumke. Upon a roll call vote the motion to adopt carried with Ald. Wallner voting "no". Resolution $1148-76 - Granting Sewer Connections to Wildflower (Action was deferred on this resolution to be further considered by the Sewer Committee) Ald. Dumke moved to again defer action on Resolution i/148-76 until the next Council meeting. Seconded by Ald. Schaumberg, motion carried. NEW BUSINESS Resolution 8172-76 - The Deputy Clerk read same, entitled, Transfer of Funds (Federal Revenue Trust Funds to 1976 Budget) Ald. Schaumberg moved for adoption, seconded by Ald. Colburn. Upon a roll call vote the motion carried unanimously. Resolution #174 - The Deputy Clerk read same, entitled, Transfer of Funds. (Contingency Fund to various salary accounts) Ald. Schaumberg moved for adoption, seconded by Ald. Colbum. Upon a roll call vote the motion carried unanimously. Resolution $1175-76 - The Deputy Clerk read same, entitled, Extending Retirement Date of Police Chief Ervin Kraus (To December 1, 1978). Ald. Colbum moved for adoption, seconded by Ald. Schaumberg. Upon a roll call vote the motion carried unanimously, Resolution j/176-76 - The Deputy Clerk read same, entitled, Accepting Bid for Sewer Installation for Forced Hookups (J. Lang). Ald. Dumke moved for adoption, seconded by Ald. Wallner. Upon a roll call vote the motion carried unanimously. Resolution #177-76 - The Deputy Clerk read same, entitled, Authorizing Release of $500.00 Payment for Highway 24 Sewer Project (Leo Dretzka) Ald. Schaumberg moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution i/178-76 - The Deputy Clerk read same, entitled, Approval of Documents for Lake Lore Estates. Ald. Schaumberg moved for adoption, seconded by Ald. Wallner. Upon a roll call vote the motion carried. Resolution $1179-76 - The Deputy Clerk read same, entitled, Authorizing the Advertising of Bids for 1977 Model Highway Truck. Ald. Schaumberg moved for adoption, seconded by Ald. Pienkos. Upon a voice vote the motion carried. Resolution #18C-76 - Initial Resolution Authorizing $400,000.00 bonds of the City of Muskego: Ald. Pienkos moved to suspend the rules in order that this resolution could be discussed at this meeting. Seconded by Ald. Wallner. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon a roll call vote the motion to adopt carried unanimously. LICENSE APPROVAL - Ald. Schaumberg moved to approve Operators Licenses for Jeffrey Grzesiak, Gary Fleming and Roberta Tobianski. Also for Jeff Bosanic, Allen Wegner and Ray Salla suject to receipt of favorable Finger- print and Medical Reports. Seconded by Ald. Ford, motion carried. Aid. Schaumberg moved for the approval of Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Charles Morin for S78 W16355 Woods Road (formerly Budishs). Seconded by Ald. Dun&e, motion carried. Ald. Schamberg moved to approve an Auction Permit for Michael Mitten for S7G W16483 Martin Dr. for g/18/76. Seconded by Ald. Dumke, motion carried. Ald. Schaumberg moved for the approval of a "Gathering" Permit for the Ladies Auxiliary of the Muskego Volunteer Fire Department for October 30, 1976. Seconded by Ald. Colbum, motion carried, VOUCHER APPROVAL - Ald. Schaumberg moved for the approval of general vouchers in the amount of $151,123.44. Seconded by Ald. Dumke, motion carried. Ald. Schaumberg moved for the approval of sewer utility voucher in the amoun of $840.56. Seconded by Ald. Wallner. Upon roll call the motion carried. CITY OFFICIAL'S REPORTS - The Clerk gave the Building Report for the month of August, 1976, indicating total construction in the amount of $1,231,318.10 and 63 dwellings for that month. The following Aldermen were present: Colburn, Dumke, Ford, Schaumberg, Pienkos and Wallner I- ? b The following Aldermen were absent: Constantineau (Here occurred business not pertinent to the bond issue.) The following resolution was offered and read by Alder- man Initial Resolution No. 180-76 INITIAL RESOLUTION Authorizing $ 400,000.ClObonds of the City of Muskego: RESOLVED that the City of Muskeyo, Waukesha County, Wisconsin, borrow an amount not to exceed $ 400,OOO.OO by issuing its general obligation coupon bonds for the purpose of constructing police facilities in and for the City. For the purpose of paying the princi- pal of and interest on said bonds, there is hereby 'levied on all the taxable property in said City a direct, annual irrepealable tax sufficient for that purpose. It wa=Fd by Alderman Schaumberg seconded by Alderman to adopt Resolution NO: publication of notice a; follows: directing Resolution No. 180-76 RESOLUTION DIRECTING PUBLICATION OF NOTICE WHEREAS an initial resolution has been offered and read to the Common Council of the City and it is now necessary that said initial resolution.be published to afford notice to the residents of the City of its pendency; _ NOW, THEREFORE, BE IT RESOLVED that the City Clerk shall publish a notice to the electors in substan- tially the following form in the official City news- paper, the Muskeyo--S&&Jr twice one week apart, the last insertion of which shail be at least one week prior to the date set therein for considera- tion of said initial resolution: NOTICE IS IIElIEBY GIVEN that the follob:ing initial resolu- tion has been offered and read at the regular meeting of the Common Council of the City of Muskego, held September 14, 1976, and is now pending before the Common Council; said resolution I will be considered for adoption at the regular meeting of the Common Council to be held October 12, 1976, at 8:OO P.M. in the Council Chambers, City Ball: Initial Resolution No. 180-76 INITIAL RESOLUTION Authorizing $ 400,000.OBonds of the City of Muskego: RESOLVED that the City of Muskego, Waukesha Count Wisconsin, borrow an amount not to exceed $ 400,O 8' 0.00 by issuing its general obligation coupon bonds for the purpose of constructing police facilities in and for the City.
