MINUTES OF MEETING HELD AUGUST 10, 1976
The meeting was called to order at 7~47 P.M. by Mayor Gottfried. Also
present were Aldermen Constantineau, Colburn, Dumke, Ford, Schaumberg,
Pienkos and Wallner, City Clerk Bette J. Bowyer and City Attorney
John Buckley.
Ald. Schaumberg moved for the approval of minutes of the previous
meeting held July 27, 1976. Seconded by Ald. Pienkos, motion carried.
Ald. Schaumberg presented the reports of the Finance Committee meetings
held August 6 and August 10, 1976, and moved that they be accepted and
placed on file. Seconded by Ald. Dumke, motion carried.
Ald. Dumke presented the report of the Public Works Committee meeting
held on August 5, 1976, and moved that it be accepted and placed on
file. Seconded by Ald. Pienkos, motion carried.
Ald. Constantineau presented the report of the Rules, Laws & Ordinance
Committee meeting held July 28, 1976, and moved that the report be
accepted and placed on file. Seconded by Ald. Pienkos, motion carried.
Ald. Pienkos presented the report of the Public Welfare Committee
meeting held July 28, 1976, and moved that it be accepted and placed
on file. Seconded by Ald. Constantineau, motion carried.
Ald. Pienkos presented the report of the Public Welfare Committee
meeting held August 9, 1976, and moved that it be accepted and placed
on file.

UNFINISHED BUSINESS
Resolution 8122-76 - Approval of Guidelines for Procedures of Wastewater
Residue on Agricultural Lands (This resolution is on the floor and had
been deferred for further review by Public Welfare Committee and DNR
officials). Ald. Colbum moved to amend Resolution i/122-76 and the
guidelines as follows: By adding the words "for a trial period of
one year" at the end of the third paragraph and by hauin@No.6 of the
guidelines read "Permit will be limited to a one (1) year'periob'and No.
7 read "There shall be a $25.00 minimum permit fee"and No. 8, "Each
permit shall require Common Council approval." Seconded by Ald. Con-
stantineau. Upon a roll call vote the motion to amend carried with
Ald. Wallner voting "no". Aid. Wallner moved to defer action on
Resolution 9122-76 and his motion lost for lack of a second. Upon a
roll call vote to adopt Resolution i/122-76, As Amended, the motion
carried with Ald. Wallner voting "no".
Resolution f/132-76 - Approval of Renewal of Extractive Permit for
Carl Wauer (This resolution is on the floor and had been deferred from
the last Council meeting). Upon a roll call vote to adopt same, the
motion carried with Aid. Wallner voting "no".

Resolution i/134-76 - Approval of Final Plat of Lake Lore Estates (This
resolution is on the floor and had been deferred from meeting of
7/27/76) Upon a roll call vote the motion to adopt carried unanimouslyb
NEW BUSINESS
Resolution j/151-76 - The Clerk read same, entitled, Denial of Legal
Status (Koepsel) Ald. Colbum moved for adoption, seconded by Ald.
Pienkos. Ald. Constantineau moved to defer action on Resolution
$1151-76 and refer same back to Plan Commission tocclarify a possible
discrepancy as to square footage of the lot. Seconded by Ald. Pienkos.
Upon a voice vote the motion carried.
Resolution 8152-76 - Ahe Clerk read same, entitled, Approval of
Certified Survey Map (Kapke). Ald. Colburn moved for adoption,
seconded by Ald. Pienkos. Upon roll call the motion carried
unanimously.
Resolution 8153-76 - The Clerk read same, entitled, Approval of
Legal Status (Zickert) 1TAldC?Colburndmoved for adoption, seconded
by Ald. Dumke. Upon roll call the motion carried unanimously.
Resolution 8154-76 - The Clerk read same, entitled, Authorizing
Execution of Contract Between Teamsters Union Local a695 and City of
Muskego (Police Department). Ald. Schaumberg moved for adoption,
seconded by Ald. Pienkos. Mayor Gottfried reviewed for the aldermen
the changes in the 1976 police contract.
Resolution 8156-76 - The Clerk read same, entitled, Amending the
City of Muskego Capital Improvement Program for 1976. Ald. Schaumberg
moved for adoption, seconded by Ald. Colbum. Ald. Constantineau
requested to go on record as stating that in the future he would like
to see no capital expenditure until capital funds are available.
Following a discussion by several of the aldermen regarding thekpark and
recreation prpposeducapital improvement program for 1976 and the recent
referendum, upon a roll call vote to adopt Resolution i/156-76 the
motion carried with Ald. Wallner casting a dissenting vote.
Resolution i/157-76 - The Clerk read same, entitled, Establishing
Sewer Inspection Fee ($12.00 per hr.). Ald. Dumke moved for adopti6n,
seconded by Ald. Constantineau. Upon roll call the motion carried
unanimously.
Resolution 8158-76 - The Clerk read same, entitled, Establishing
Traffic Regulations (Re: Martin Dr.) Ald. Schaumberg moved for
adoption, seconded by Ald. Pienkos. Ald. Ford moved to amend this
resolution by having the speed zone established read " 25 mph speed
limit on Martin Drive from College Avenue east to Ranch Drive".
Seconded by Ald. Schaumberg. Following considerable discussion,
Upon a roll call vote to amend Resolution j/158-76, Aldermen Dumke
Ford, Pienkos and Schaumberg. The motion to amend carried. Ald.
Colburn moved to further amend Resolution 8158-76 by having the
speed zone established read "30 mph speed limit on Martin Drive
from College Avenue east to Ranch Drive". Seconded by Ald. Dumke.

Upon a roll call vote on Ald. Colburn's amendment, Aldermen Colbum,
Dumke and Schaumberg voted "aye". Aldermen Constantineau, Ford,
Pienkos and Wallner voted "no". The motion to further amend did not
carry. Ald. Schaumberg moved to defer action on Resolution 8158-76
and refer same back to Safety Committee. Following discussion,
upon a roll call vote to defer Alderman Colbum, Dumke and Schaumberg
voted "aye". Aldermen Constantineau, Ford, Pienkos and Wallner voted
"no" . The motion to defer did not carry. Upon a roll call vote to
adopt Resolution #158-76, As Amended, 4~25-mph~.seeedtlimitponjM~,~t;i;n
Drive from College Ave. east to Ranch Dr.), Aldermen Constantineau,
Ford, Pienkos, Schaumberg and Wallner voted "aye". Aldermen Colbum
and Dumke voted "no". The motion carried.
Resolution $1159-76 - The Clerk read same, entitled Creating Position
and Establishing Salary for Assistant Foreman of the Public Works
Department (Roy Ackerman $6.16 per hr.) Ald. Schaumberg moved for
adoption, seconded by Ald. Pienkos. Ald. Dumke moved to amend Res-
olution $1159-76 by adding the following paragraph "BE IT FURTHER
RESOLVED that the position and salary as stated above be retroactive
to January 1, 1976. Seconded by Ald. Schaumberg. Upon a voice vote
the motion carried. Upon a roll call vote the motion to adopt Res-
olution 8159-76 carried unanimously.
At this time, 9:25 P.M., Mr. Robert Lyons, a representative of the
Wisconsin Council of County and Municipal Employees - Local 2414,
presented the grievance of Mrs. Marvelyn Pufall regarding vacation
pay, to the aldermen (step 3 of the grievance procedure).
Resolution W160-76 - The Clerk read same, entitled, Denial of Claim
(L. Pashkewitz, Sr.) Ald. Schaumberg moved for adoption, seconded
by Ald. Dumke. Upon roll call the motion carried unanimously.
Resolution $1161-76 - The Clerk read same, entitled, Transfer of Funds
(Contingency to Park & Recreation) ($1500). Ald. Schaumberg moved for
adoption, seconded by Ald. Colbum. Upon roll call the motion carried
unanimously.
Resolution $1162-76 - The Clerk read same, entitled, Approval of Tempor-
ary Mobile Office for St. Francis Savings & Loan (Hwy 24 & Lannon Dr.)
Ald. Colbum moved for adoption, seconded by Ald. Schaumberg. Upon
roll call the motion carried unanimously.
Resolution 8164-76 - Xld. Dumke moved to suspend the rules that would
interfere with the adoption of this resolution, entitled, Transfer of
Funds (($l,OOO.OO from Contingency for the purpose of offsetting a
portion of the cost for the VFW parade). The Clerk read the resolution.
Ald. Schaumberg moved for adoption, seconded by Ald. Colbum. Upon
roll call the motion to adopt carried unanimously.
LICENSE APPROVAL - Ald. Schaumberg moved for the approval of Operators
License for James Giesegh, Allen Wood and Dennis McLaughlin. Seconded
by Ald. Pienkos, motion carried.

Ald. Dumke moved for the approval of "Gathering" Permit for V.F.W.
Post 88171 for August 27, 28 and 29th (Country Fair Days). Seconded
by Ald. Pienkos, motion carried.
Ald. Schaumberg moved for the approval of a Class "A" Fermented Malt
Beverage and Intoxicating Liquor Lic~ense for Irene Ellie (former
Betty Ashby - Merkt's). Seconded by Ald. Pienkos, motion carried.
CITY OFFICIAL'S REPORTS - The Clerk presented the Building Report for
the month of Su~~;~~~9%6i.nerid~C~t~ng nine new dwellings and total
construction in the amount of $388,455.00 for that month. Report
placed on file. l The Clerk acknowledged receipt of 36 additional+gignatures~submitted byAld.
Wallner to his original petition opposing the application of waste-
water residue on agricultural lands. Same placed on file.
ADJOURNMENT - Ald. Schaumberg moved to adjourn, seconded by Ald.
Colbum, motion carried. The meeting adjourned at lo:20 P.M.
