MINUTES OF MEETING HELD JUNE 8, 1976
The meeting was called to order at 7~35 P.M. by Mayor Gottfried.
Also present were Aldermen Colbum, Constantineau, Dumke, Ford,
Schaumberg, Pienkos and Wallner, City Attorney John Buckley and City
Clerk Bette Bowyer.
Ald. Schaumberg moved for the approval of the minutes of the
meeting held May 25, 1976, seconded by Ald. Dumke, motion carried.
Ald. Schaumberg presented the report of the Finance Committee
meeting held on June 3, 1976, and moved that it b'eeaccepted and
placed on file. Seconded by Ald. Dumke, motion carried.
Ald. Dumke presented the report of the Public Works Committee
meeting held June 2, 1976, and moved that it be accepted and placed
on file. Seconded by Ald. Schaumberg, motion carried.
Ald. Pienkos presented the report of the Public Welfare Committee
meeting held on May 26, 1976, and moved that it be accepted and
placed on file. Seconded by Ald. Constantineau, motion carried.
Ald. Constantineau presented the report of the Rules, Laws &
Ordinance Committee meeting&ieldaon May 26, 1976, and moved that
it be accepted and placed on file. Seconded by Ald. Pienkos,
motion carried.
UNFINISHED BUSINESS
Ordinance #313 - The Clerk gave the second reading of same, entitled,
An Ordinance to Amend Ch. 20 of the Municipal Code by Creating
Sections 20.17 and Section 20.18. (Re: Allowing Common Council to
adopt local regulations not contrary to or inconsistent with State
Statutes relative to equipment, use or operation of boats.) Ald.
Colbum moved for adoption, seconded by Ald.Ci%%ntineau.Upon roll
call vote the motion to adopt carried unanimously.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried read a communication from Mrs. Marlene Cronin, Sec'y.
of the Muskego High School Choir Booster, dated 614176, directed to
the Mayor and Common Council, expressing appreciation for donation
in the amount of $500.00 to help the choir defray expenses of their
forthcoming trip to Washington D. C. Communication placed on file.

Resolution 8108-76 - The Clerk read same, entitled, Approval of
Holding Tank Agreement (Wayne Hansen). Ald. Colbum moved for adopt-
ion, seconded by Ald. Wallner. Upon roll call the motion carried
unanimously.

Resolution #109-76 - The Clerk read same, entitled, Approval of
Holding Tank Agreement (Palokonis). Ald. Colbum moved for adoption,
seconded by Ald. Constantineau. Upon roll call the motion to adopt
carried unanimously.
Resolution 8110-76 - The Clerk read same, entitled, Denial of
Rezoning Request (Sec. 5 - Muskego Volunteer Fire Co.). Ald.
Colbum moved for adoption, seconded by Ald. Constantineau. Ald.
Ford moved to refer Resolution #llO-76 back to the Plan Commission
with the suggestion they refer same to the city planner. Seconded
by Ald. Constantineau. Ald. Ford urged the aldermen to adopt his
motion in order that the Plan Commission and planner can help
the Fire Company in their efforts to locate a sub-station in the , northwest part of the city. Following further discussion, upon a
a roll call vote on Ald. Ford's motion, Aldermen Colbum, Dumke, Ford,
Pienkos and Schaumberg voted "aye". Aldermen Constantineau and
Wallner voted "no". The motion to refer Resolution 8110-76 to
Plan Commission and city planner carried.

Resolution #ill-76 - The Clerk read same, entitled, Directing City
Attorney to Draft an Ordinance for the Rezoning of St. Paul's
Church Property (Sec. 2). Ald. Colbum moved for adoption, seconded
by Ald. Schaumberg. Ald. Schaumberg requested permission of his
fellow aldermen to have Mr. Melvin Rindfleisch speak. As there
were no objections, Mr. Rindfleisch advised the aldermen of a
willingness on the part of the church plan committee to delete
that portion of the master plan for the church property relating
to housing for teachers and elderly. Ald. Pienkos urged that the
matter be referred back to the Plan Commission so that the site
plan presented at the public hearing could be revised by the commission.
Following a lengthy discussion Ald. Constantineau called for the
question. Upon a roll call vote to adopt Resolution $1111-76 the
motion carriedtijilth Ald. Pienkos casting a dissenting vote.
Resolution 8112-76 - The Clerk read same, entitled, Acceptance of
Low Bid for Utility Van.. Ald. Schaumberg moved for adoption, seconded
by Ald. slFio3 rid r&-g The low bidder being Steffen-John Co. Upon a
roll call vote the motion carried unanimously.
Resolution #113-76 - The Clerk read same, entitled, Establishing
Traffic Regulations ("No Parking" signs on both sides of the
Pleasant View Drive extension from Lake Drive to Little Muskego Lake)
Ald. Schaumberg moved for adoption. Seconded by Ald. Pienkos. Upon
a roll call vote the motion carried unanimously.
Resolution 8114-76 - The Clerk read same, entitled, Resolution
Levying Special Assessments on Properties Located in Assessment
Dist. #K-11. (Three Muskego residences located in the Linnie Lac Area
Sewer District)- Brunette, Scherper and Millious). Ald. Dumke moved
for adoption, seconded by Ald. Constantineau. Upon roll call the ~ I motion carried unanimously.

Resolution j/115-76 - The Clerk read same, entitled, Requiring Payment
of Delinquent Withholding Taxes and State Sales Tax Prior to the
Issuance of Class "A" and Class "B" Fermented Malt Beverage and
Intoxicating Liquor Licenses. Ald. Schaumberg moved for adoption,
seconded by Ald. Wallner. Upon roll call the motion carried unanimously.
Resolution i/116-76 - The Clerk read same, entitled, Denial of Claim -
Foster. Ald. Schaumberg moved for adoption, seconded by Ald. Dumke.
Following a short discussion, upon a roll call vote on the motion
to adopt, Aldermen Colbum, Constantineau, Pienkos, Schaumberg
and!Dumke voted "aye". Aldermen Ford and Wallner voted "no". The
motion to adopt carried.
Resolution 11117-76 - The Clerk read same, entitled, Denial of Claim -
Hawes. Ald. Schaumberg moved for adoption, seconded by Ald. Colbum.
I Upon a roll call vote the motion carried with Ald. Constantineau
casting a dissenting vote. l Resolution i/118-76 - The Clerk read same, entitled, Correcting
Erroneous Assessment (Spieler). Ald. Dumke moved for adoption,
seconded by Ald. Ford. Upon roll call the motion carried unanimously.
Resolution 8119-76 - The Clerk read same, entitled, Transfer of Funds (
(Contingency to Park and Recreation)- $4,400.00). Ald. Dumke moved
for adoption, seconded by Ald. Schaumberg. Following a short dis-
cussion, upon a roll call vote Aldermen Colbum, Constantineau, Dumke,
Ford and Schaumberg voted "aye". Aldermen Pienkos and Wallner voted
"no". The motion to adopt carried.
Ordinance $1314 - The Clerk gave the first reading of same, entitled,
An Ordinance to Amend, Repeal and Recreate Certain Sections of Ch. 30
(Building Code) of the Municipal Code.
VOUCHER APPROVAL - Ald. Schaumberg moved for the approval of payment
of general vouchers in the amount of $1,548.79 payable 6/g/76. Sec-
c
onded by Ald. Wallner. Upon roll call the motion carried unanimously.
i LICENSE APPROVAL - Ald. Schaumberg moved for the approval of Class "A"
Fermented Malt Beverage License for A&P Store and Richard Plaides,
for a Wholesale Fermented Malt Beverage for Gumieny Distribu.tors, Inc.,
for Class "A" Fermented Malt Beverage and Intoxicating Liquor Licenses (5)
as per submitted list and for 38 Class "B" Fermented Malt Beverage and
Intoxic,ating Liquor Licenses as per submitted list. Seconded by Ald.
Dumke, motion carried.
Ald. Dumke moved for the approval of Operators License for Jeffrey
Petroviak subject to receipt of favorable Medical and Fingerprint
Reports. Seconded by Ald. Pienkos, motion carried.
Ald. Schaumberg moved for the approval of "Gathering" License for
MPPA for August 1, 1976 (Proceeds for muscular distrophy fund) at
Mill Valley and that the $2.00 fee be waived. Seconded by Ald. Ford,
motion carried.
CITY OFFICIAL'S REPORTS - The Clerk gave the Building Report for the
month of May indicating 24 new dwellings and total construction in the
amount of $984,471.95. Report placed on file.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Clerk acknowledged a
petition (47 signatures) requesting sewer studies in the Bass Bay Area.
Same referred to Public Sewer Committee.
ADJOURNMENT - Ald. Colbum moved to adjourn, seconded by Ald. Constant-
ineau, motion carried. Meeting adjourn at 9:26 P.M.
