COMMON COUNCIL
CITY OF MUSKEGO
MINUTES OF MEETING HELD MAY 11, 1976
The meeting was called to order at 7:50 P.M. by Mayor Gottfried.
Also present were Aldermen Colbum, Constantineau, Dumke@rd,Scha*rg,
Pienkos and Wallner, City Attorney John P. Buckley and City Clerk
Bette Bowyer.
Ald. Schaumberg moved for the approval of the minutes of the meeting
held on April 27, 1976, and that they be accepted and placed on
file. Seconded by Aid. Constantineau, motion carried.
Ald. Schaumberg presented the reports of the Finance Committee
meetings held on May 6th and May 11, 1976, and moved that they be
accepted and placed on file. Seconded by Ald. Dumke, motion carried.
Ald. Ford presented the report of the Public Works Coannittee meeting
held on May 5 , 1976, and moved that it be accepted and placed on
file. Seconded by Ald. Schaumberg, motion carried.
Ald. Pienkos presented the report of the Public Welfare Committee
meeting held on April 29, 1976, and moved that it be accepted and
placed on file. Seconded by Ald. Colbum, motion carried.
Ald. Constantineau presented the report of the Rules, Laws & Ordinance
Committee meeting held on April 29, 1976, and moved that it be
accepted and placed on file, Seconded by Ald. Pienkos, motion carried.
The Plan Commission minutes of meeting held May 4, 1976, and Park and
Recreation Board minutes of meeting held April 12, 1976, were received
and placed on file.

UNFINISHED BUSINESS
Resolution $1241-75 - Approval of Operation & Development Plans of
Wauer Sanitary Landfill. This resolution is on the floor and had
been deferred from previous meetings. Ald. Colbum advised that
because approval of the Wauer Sanitary Landfill for the 1976-77
year would soon be necessary and an entirely new concept would be
forthcoming he moved to table Resolution 9241-76. Seconded by Ald.
Constantineau. Upon a roll call vote the motion to table carried
unanimously.
Resolution $159-76 - Approval of Final Plat of Kristin Downs Subdivision.
(This resolution is on the floor and was deferred for two weeks to have
Plan Commission and Public Works Committee review it again.) Ald.
Pienkos moved to amend Resolution 859-76 by adding the following
paragraph after the 8th paragraph of the resolution: 'BE IT FURTHER
RESOLVED that the financial guarantee as required in the City of
Muskego's Land Division Ordinance for completion of utilities,
amenities and landscaping plan shall be of a sufficient amount to
assure completion of the landscaping plans with its amenities
approved by the Plan Commission. Also that 12% of the amount of
the contract for grading of open spaces and the installation of
amenities shall not be released to the developer until such improve-
ments are approved by the city." Motion was seconded by Ald. Colbum. Upon roll call the motion to amend carried unanimously.

Unfinished business - cont'd. (Res. W59-76)
Ald. Colburn moved to further amend Resolution #59-76 by adding
the following paragraph after Ald. Pienkos's amendment: "BE IT
FURTHER RESOLVED that this approval is subject to acceptance of the
proposed water system by the city's engineering firm of Ruekert and
Mielke and the extension of lot lines by metes and bounds descriptions
in outlots 1 and 3 with the developer accepting the resonsibility to
complete the landscaping required in outlot 3 to protect adjacent
properties from inadequate drainage." Seconded by Ald. Pienkos.
Upon a roll call vote to further amend Resolution i/59-76, the motion
carried unanimously. Following a short discussion regarding the
increased traffic onto S.T.H. 24, the impact of the new development
on the schools in the area, the necessity of good communication
between the city and the developer, etc., upon a roll call vote to
adopt Resolution #59-76, As Amended, Aldermen Colbum, Constantineau,
Dumke, Schaumberg and Wallner voted "aye". Aldermen Ford and Pienkos
voted "no" . The motion to adopt Resolution l/59-76 carried.
COMMUNICATIONS FROM THE MAYOR'S OFFICE - Mayor Gottfried ~requested
that all aldermen use the microphone when speaking at the Council
table.
Mayor Gottfried advised the aldermen that he would be asking for a
suspension of rules in order that a resolution pertaining to the
city not being liable for possible injuries sustained by volunteers
during the razing and relocating of the J. Kohne barn in the city's
bi-centennial park could be acted on at this meeting.
NEW BUSINESS
Resolution 888-76 - The Clerk read same, entitled, Authorizing the
Harvesting of Weeds on Bass Bay During the 1976 Season. Ald. Con-
stantineau moved for adoption, seconded by Ald. Pienkos. Ald. Ford
moved to amend the resolution by having the last paragraph read
as follows: "BE IT FURTHER RESOLVED that the Common Council authorizes
the Public Works Department to have the weeds harvested twice during
the 1976 season at a cost not to exceed $1,500.00." Seconded by Ald.
Wallner. Upon a roll call vote to amendResolution #88-76 the motion
carried unanimously. Upon a roll call vote to adopt Resolution
$188-76, As Amended, the motion carried unanimously.
Resolution #89-76 - The Clerk read same, entitled, Setting Public
Hearing for Rezoning in Sec. 26 (Scott Krause) Ald. Colbum moved
for adoption, seconded by Ald. Constantineau. The Public Hearing to be June 8, 1976, at 7:15 P.M. Upon a roll call vote the motion
to adopt carried unanimously.
Resolution #90-76 - The Clerk read same, entitled, Denial of Pre-
liminary Plat of Lakewood Village (Town of Vernon). Ald. Colbum
moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously.

.e Resolution I/91-76 - The Clerk read same, entitled, Denial of Legal
Status (D. Beierle) Ald. Colbum moved for adoption, seconded by
Ald. Schaumberg. Lot in question is located on College Ave. Upon
a roll call vote the motion to adopt carried with Ald. Wallner casting
a dissenting vote.
Resolution #92-76 - The Clerk read same, entitled, Acceptance of Bid
for Official City Newspaper (Muskego Sun) Ald. Dumke moved for
adoption, seconded by Ald. Pienkos. Upon roll call the motion carried
unanimously.
Resolution #93-76 - The Clerk read same, entitled, Appointment of
Member to Board of Appeals (Patricia Miller). Ald. Dumke moved for
adoption, seconded by Ald. Wallner. Upon a roll call vote the motion
carried unanimously.
Resolution #94-76 - The Clerk read same, entitled, Authorizing Additional
'0
Compensation to Water Patrolmen. Ald. Dumke moved for adoption, sec-
onded by Ald. Wallner. (Additional compensation to help offset
insurance expense). Upon roll call the motion to adopt carried
unanimously.
Resolution #95-76 - The Clerk read same, entitled, Authorizing
Expenditure of $500.00 for Muskego High School Choir to Appear in
Washington D. C. Ald. Schaumberg moved for adoption, seconded by
Ald. Dumke. Upon roll call the motion carried unanimously.
1 Resolution 896-76 - The Clerk read same, entitled, Correcting Erroneous
Assessment. (F. Switala) Ald. Schaumberg moved for adoption, seconded
by Ald. Dumke. Upon roll call the motion carried unanimously.
Resolution 897-76 - Authorizing Acceptance of Gift of Barn to the City.
Ald Ford moved to suspend the rules that would interfere with the
adoption of same. Seconded by Ald. Schaumberg. Upon roll call the
motion to suspend the rules carried unanimously. City Attorney Buckley
read the resolution. Ald. Ford moved for adoption, seconded by Ald,
Schaumberg. Barn to be accepted is being donated to the Bi-centennial
Committee for use at the "Old Muskego Settlement Center" by the James Kohnes. Upon roll call the motion to adopt carried unanimously.
~ Ordinance #312 - The Clerk gave the first reading of same, entitled,
An Ordinance to Amend Section 20.13 (1) of the Municipal Code of
the City of Muskego (Re: Operation of Motor Vehicles on Ice - Bass
Bay)
LICENSE APPROVAL - Ald. Schaumberg moved for the approval of an
Operators License for Mark Kraus subject to receipt of favorable
Medical Report. Seconded by Ald. Colbum, motion carried.

Ald. Schaumberg moved for the approval of Robert Jurgilanis to
serve fermented malt beverage at Jensen Park on July 18, 1976.
Seconded by Ald, Colburn, motion carried.
VOUCHER APPROVAL - Ald. Schaumberg moved for the approval of
payment of general voucher in the amount of $3,469.50. Seconded
by Ald. Dumke, motion carried.
CITY OFFICIAL'S REPORTS - The Clerk read the Building Report for
the month of April indicating 20 new dwellings and total construction
in the amount of $841,543.70 for that month. Report placed on file.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Clerk read a
communication from the Waukesha Blood Bank expressing appreciation
for financial assistance. Same placed on file.
The Clerk read a claim from Attorneys Mum, Ferr & Gumina, in behalf
of Russell E. Reger regarding culvert installation on Lot 20, Ridges
Subdivision, in the amount of $265.00. Same referred to City Attorney
and Finance Committee.
Mayor Gottfried advised that two new appointments to the Advisory
Committee of the Little Muskego Lake Protection and Rehabilitation
District are Karen Castronova and William Schmidt.
ADJOURNMENT - Aid. Pienkos moved to adjourn, seconded by Ald.
Constantineau, motion carried. The meeting adjourned at 9:lO P.M.
