COMMON COUNCIL
CITY OF MUSKEGO
MINUTES OF MEETING HELD FEBRUARY 24, 1976
The meeting was called to order at 7:40 P.M. by Mayor Gottfried. Also
present were Aldermen Colburn, Dumke, Foldy, Ford, Knudsen and Wallner,
City Attorney John P. Buckley and City Clerk Bette J. Bowyer. Ald.
Schaumberg was absent.
Ald. Foldy moved for the approval of the minutes of the meeting held
February 10, 1976, and moved that they be accepted and placed on file.
Seconded by Ald. Colburn, motion carried.
Ald. Foldy presented the report of the Finance Committee meeting held on
February 23, 1976, and moved that it be accepted and placed on file.
Seconded by Ald. Dumke, motion carried.
Ald. Dumke presented the report of the Public Works Cosunittee meeting
held on February 20, 1976, and moved that it be accepted and placed on
file. Seconded by Ald. Foldy, motion carried.
l Ald. Foldy presented the report of the Public Welfare Committee meeting
held on 2112176 and moved that it be accepted and placed on file. Seconded
by Ald. Wallner, motion carried.
Ald. Colbum presented the report of the Public Safety Committee meeting
held on 2119176 and moved that it be accepted and placed on file. Seconded
by Ald. Dumke, motion carried.
The minutes of the Plan Commission meeting held 2117176 was received and
1 placed on file.
UNFINISHED BUSINESS
Resolution $1241-75 - Approval of Operation & Development Plans of Wauer
Sanitary Landfill Ald. Knudsen again moved to defer action on same until
the matter can be further reviewed by the Public Welfare Committee.
Seconded by Ald. Foldy, motion carried.
l Resolution i/8-76 - Extending Hours for Special Shooting Contests for
Big Muskego Gun Club (This resolution is on the floor and was deferred unti
the owner of the Gun Club could be contacted). Ald. Dumke moved to amend
Resolution 88-76 by removing all of the dates listed in the resolution
except Saturday and Sunday, June 12th and 13th, 1976 and Sunday, September
12, 1976, seconded by Ald. 'Knudsen. Upon a roll call vote to amend Res-
olution $18-76, the motion carried unanimously. Upon a roll call vote to
adopt Resolution $18-76, As Amended, the motion carried unanimously,
Ordinance i/310 - The Clerk gave the second reading of same, entitled,
An Ordinance to Amend Sec. 18.28 (2) of the Municipal Code of the City of
Muskego (Re: Determination of Ownership). Ald. Foldy moved for adoption,
seconded by Ald. Colbum. Upon a roll call vote on the motion to adopt
Ordinance #310 the motion carried unanimously with Ald. Wallner casting
a dissenting vote.
Ordinance 8311 - The Clerk gave the second reading of same, entitled, An
Ordinance to Repeal and Recreate Sec. 21.03 of the Municipal Code of the
City of Muskego (Re: Transient Merchant's Ordinance). Ald. Colbum moved

for adoption, seconded by Ald. Foldy. Upon a roll call vote the motion
to adopt carried unanimously.

COMMUNICATIONS FROM THE MAYOR'S OFFICE oc .Mayor Gottfried advised the aldermen the city's financial consultant, Mr.
Seegar Swanson, representing Ehlers & Associates, would be appearing to
explain the proposed bonding that the city ,is contemplating.
Mayor Gottfried advised the aldermen that at the adjournment of this meeting
the Council would go into executive session to discuss the progress of
negotiations with the Union and the status of arbitration,
Mayor Gottfried requested permission of the aldermen to have Resolution
922-76, entitled, Authorizing the City"s Financial Consultant to Prepare
for the Borrowing of $1,400,000.00 General Obligation Bonds, acted upon
at the end of New Business. The aldermen granted his request.
NEW BUSINESS
' Resolution #23-76 - The Clerk read same, entitled, Authorizing the Advertising
of Bids for Needed Road Materials for the 1976 Road Improvement Program.
Ald. Ford moved for adoption, seconded by Ald. Wallner. Ald. Knudsen moved l ’ to delete the. fourth:paragraph of Resolution i/23-76 (relating to advertising
of bids when required for the repaving of certain streets). Seconded by
Aid. Foldy. Upon a roll call vote to amend Resolution i/23-76, Aldermen
Colbum, Dumke, Ford and Wallner voted "no". Aldermen Foldy and Knudsen
voted "aye". The motion to amend did not carry. Upon a roll call vote to
adopt Resolution $123-76 the motion carried unanimously,
Resolution B24-76 - The Clerk read same, entitled, Accepting the Report of
the Board of Canvassers for the February 17, 1976, Primary Election. Ald.
1 Colburn moved for adoption, seconded by Aid, Wallner. Upon roll call the
motion carried unanimously.
Resolution $125-76 - The Clerk read same, entitled, Approval of Final Plat
of Heather Ridge Estates (A subdivision in the Town of Vernon). Ald.
Ford moved for adoption, seconded by Aid. Wallner. Upon roll call the
motion carried unanimously.
Resolution l/26-76 - The Clerk read same, entitled, Approval of 'Legal Status

for Carl Posbrig. Ald. Ford moved for adoption, seconded by Ald. Wallner.
Upon roll call the motion carried unanimously.
Resolution #27-76 - The Clerk Read same, entitled, Authorizing Refund to
Kenneth Larsen for Culvert Cost (Re-dntrodueed by Aid, Foldy) Ald. Foldy
moved for adoption, seconded by Ald. Knudsen. Ald. Foldy read a prepared
statement signed by himself, dated February 24, 1976, requesting the Mayor
and Council to reexamine their position on this matter and vote in favor
of this resolution. Ald. Dumke moved to defer action on Resolution l/27-76
until the next Council meeting, seconded 'by Ald. Ford. Discussion followed
on the motion to defer and upon a roll call vote on the motion, Aldermen
Colburn, Foldy, Ford, Knudsen and Wallner voted "no". Ald. Ford voted "aye".
The motion to defer did not carry. Upon a roll call vote to adopt 'Resolution
j/27-76 Aldermen Colbum, Foldy, Knudsen and Wallner ,voted "aye". Aldermen
Dumke and Ford voted "no". The motion to adopt carried,
Resolution 828-76 - The Clerk read same, entitled, Deferring the Requirements
for Monumentation in the Kristin Downs Subdivision. Ald. Ford moved for
adoption, seconded by Ald. Colburn. Upon a roll call vote the motion to

Resolution #22-76 - The Clerk read same, entitled, Authorizing the City's
Financial Consultant to Prepare for the Borrowing of $1,400,000.00. (General

bligation Bonds). Ald. Foldy moved for adoption, seconded by Ald. Dumke.
ayor Gottfried reviewed for the aldermen the 1977 Capital Budget requests
of the various departments of the city. Following discussion between
several of the aldermen regarding the borrowing of funds for the approved
1976 and proposed 1977 capital budget at one time, Mayor Gottfried declared
a recess at 9:06 P.M. pending the arrival of the city's financial consultant.
At 9:20 P.M. Mr. Seegar Swanson, representing Ehlers & Associates, appeared
at the meeting to discuss Resolution 1122-76 as well as the following resoluk
tions being introduced at this meeting and acted upon at the Council meeting
to be held on March 23, 1976, at 7~30 P.M.
Resolution j/31-76, entitled, Initial Resolution Authorizing $745,000
Bond of the City of Muskego (Street Improvements)
Resolution j/32*76, entitled, Initial Resolution Authorizing $240,000 Bonds
of the City of Muskego (Parks & Public Grounds)

Resolution i/33-76, entitled, Initial Resolution Authorizing $385,000 Bonds
of theQCity of Muskego (Police Facilities)
Resolution f/34-76, entitled, Initial Resolution Authorizing $30,000 Bonds
of the City of Muskego (Library Improvements)
Upon a roll call vote to adopt Resolution f/22-76 the motion carried with
Ald. Knudsen casting a dissenting vote.
Resolution 1135-76 - Ald. Foldy moved to suspend the rules that would inter-
fere with Resolution i/35-76, entitled, Resolution Di'recting Publication of
Notice. Seconded by Ald. Wallner. Upon a roll call vote on the motion to suspend the rules the motion carried with Ald. Knudsen casting a dissenting
vote. The Clerk read the resolution. Ald. Foldy moved for adoption,
seconded by Ald. Wallner. Upon a roll call vote the,motion to adopt Res- olution 1136~76 carried unanimously.
LICENSE APPROVAL - Ald. Foldy moved for the approval of Operators Licenses
for Patricia Molkentin, Glen S&near and Jeff Kerber and for a Class "B"
Fermented Malt Beverage and Intoxicating Liquor License for Gordon Giese
(corner of Janesville Rd. and Pioneer Drive). Seconded by Ald. Dumke, motion carried.
@v OUCHER APPROVAL - Ald Foldy moved for the approval of the payment of
general vouchers in the amount of $105,134.34 payable 2124176. Seconded
by Ald. Wallner. Upon roll call the motion carried unanimously.
Ald. Foldy moved for the approval of payment of sewer utility vouchers
in the amount of $8,575.40. Seconded by Aid. Colbum. Upon roll call the
motion carried unanimously.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
Ald. Ron Ford, Director of the Park and Recreation Board, reviewed the
progress of the Board's selection of a Park and Recreation Director.
ADJOURNMENT - Ald. Ford moved to adjourn, seconded by Ald. Wallner. Motion
carried. The meeting adjourned at lo:30 P.M.
