CITY OF MUSKEGO
MINUTES OF MEETING HELD JANUARY 13, 1976
The meeting was called to order at 7:40 P.M. by Mayor Gottfried. Also
present were Aldermen CoTburn, Dumke, Foldy, Ford, Knudsen, Schaumberg and
Wallner, City Attorney John P. 'Bue'kley and City Clerk Bette Bowyer.
Ald. Schaumberg moved for the approval of the minutes of the meeting held
December 23, 1975, and to have them placed on file. Seconded by Aid.
Knudsen, motion carried.
Ald. Schaumberg presented the report of the Finance Committee meeting
held January 7, 1976, and moved that it be accepted and placed on file.
Seconded by Ald. Foldy, motion carried.
Ald. Dumke presented the report of the Public Works Committee meeting
held January 8, 1976, and moved that it be accepted and placed on file.
Seconded by Ald. Schaumberg, motion carried.
The Plan Commission minutes of January 6, 1976, were received and placed
on file, l UNFINISHED BUSINESS
~ Resolution i/268-75 _ Denial of Rezoning Request (S. Krause). Ald.
Schaumberg moved to table this resolution. Seconded 'by Ald. Wallner.
Upon a roll call vote the motion to table carried with Ald. Ford casting
a dissenting 'vote.
COMMUNICATIONS FROM THE MAYOR'S OFFICE '- Mayor Gottfried advised the
aldermen that just prior to the adj&%nent of this meeting it was his
intent to discuss the city's insurance p'rogram with all of the aldermen.
Mayor Gottfried requested that the aldermen suspend the rules in order
that a resolution accepting an offe~r to purchase a parcel of land in the
industrial park by E. Tinti could be acted upon at this meeting.

Resolution #1-76 - The Clerk read same, entitled, Acceptance of Low Bid
for Squad Cars. Aid. Schaumberg moved for adoption, seconded by Ald.
Wallner (low biddelf-being 'E. J. Salentine) Upon roll call the motion
carried unanimously.
Resolution $12-76 - The Clerk read same, entitled: App,roval of Certified
Survey Map (Tom Keith Co., Industrial Park). Ald. 'Ford moved for adoption,
seconded by Ald. Knudsen. Upon roll call the motion carried unanimously.
Resolution #3-76 - The C'lerk read same, entitled3 Establishing Fee for
Rescue Service ($SO,OO for each individual served). A'ld. Schaumberg
moved for adoption, seconded by Aid. Foldy. Upon roll call the motion
carried unanimous'ly.
Resolution i/4-76 - The Clerk read same, entitled, Authorizing Purchase
of Compactor for Pu'blic Works Department. Aid. Schaumberg moved for
adoption, seconded by Ald. Dumke. Ald. Foldy moved to defer action on
this resolution ,until Mr. Bertram could report back on negotiations with
other firms for a comparable machine. Seconded by Ald. Schaumberg.

llowing discussion, upon a roll call 'vote to de,fer, Aldermen Foldy and
Idsen voted "aye". Aldermen Colburn, Dumke, 'Ford, Schaumberg and
dllner voted "no!'. The motion to defer did not carry. Upon a roll call
vote to adopt Resolution j/4,-76 the motion carried unanimously.

Resolution #S-76 - The C'lerk read same, entitled, Authorizing Refund to
Kenneth Larsen for Culvert Cost. (Introduced by Ald. Foldy) e Aid. Foldy
moved for adoption, seconded 'by Ald. Wallner. Ald. Foldy urged h,is fellow
aldermen to 'vote in favor of this resolution and the members of the Public
Works Committee provided the Council with some of the background regarding
the matter and their reasons for not recommend:ing .the refund. Following
considerable discussion, with the permission of the Council, Mr. Kenneth
Larsen who was present at the meeting, indicated he would be willing to
share the $1,300.00 installation cost of the culvert. Ald. Foldy moved
to amend Resolution #S-76 by having the last paragraph read as follows:
"THEREFORE, BE IT RESOLVED that the City of Muskego shall share the cost of
oversized culvert in the amount o,f $650.00. Sec'd by KXidsen. Upon roll call
to amend Res.#5-J6,'Ald. Colburn, :Foldy, Knudsen and Wa:llner voted "aye".
Aldermen Dumke, Ford and Schaumberg voted “no”. The motion to amend carried.
Following more discussion as to whe,ther 0'1: not legal opinion should be
sought on this matter Ald. Colbum moved to defer action on Resolution #5-76
for two weeks. Seconded by Aid. Ford. Upon a roll call vote to adopt
Resolution #5-76 Aldermen Colbum, Dunike, Ford and Schaumberg voted "aye".
Aldermen Foldy, Knudsen and Wallner voted "no". The motion to defer
Resolution #5-76 for two weeks carried.
l Resolution #b-76 - The Clerk read same, entitled, Approval of Contract for
Rescue Service Between the City of Muskego and the Tess Comers Volunteer
Fire Department. Aid. Schaumberg .moved for adoption, seconded by Ald.
Colbum. Upon roll call the motion carried unanimously.
Resolution a7-76 - Ald. Foldy moved to suspend the rules in order that
this resolution entitled, Acceptance of Offer to Purchase Parcel of Land
in the Muskego Business/Industrial Park - E. Tinti, could be acted upon
at this meeting. Seconded by Ald. Wallner. Upon a roll call vote to
suspend the rules, Aldermen Colbum, Dumke, 'Foldy, Ford and Schaumberg
voted "'aye". Aldermen Knudsen and Wallner voted "no"'. The motion to
suspend the rules carried. The Clerk read the resolution. Ald. Knudsen moved for adoptioa, seconded by Ald. Foldy. Discussion followed regarding
the possibility that the parcel of land in question overlaps unto the
proposed park area of the industrial park. At this point Mayor Gottfried declared a recess (8:40 P.M.) in order that topo maps of the area could
be reviewed. The meeting reconvened at 8:50 P.M. Ald. Ford moved to
defer action on Resolution #7-76 for two weeks. Secon,ded by Aid. Colburn.
Upon a roll call vote to defer, Aldermen Colburn, Dumke, Foldy, Ford l Knudsen and Schaumberg voted "aye"'. Aid. Wallner voted "no"'. The mAtion
to defer carried. Mayor Gottfried indicated that he would contact the
industrial park broker, Michael Mooney regarding the matter.
LICENSE APPROVAL '- Aid. Schaumberg moved for the approval of Operators
License for David Saari, seconded 'by Ald. Dumke, motion carried.
CITY OFFICIAL’S 'REPORTS - City Cle.rk Bowyer reminded the candidates present
that nomination papers needed to be filed by Tuesday, January 20th at, 5~00
P.M.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS - City Clerk ,Bowyer acknowledged a claim from Haro'ld Scholbe in the amount of $360.00 claiming poor drainage
from the city's industrial park. She also acknowledged a claim from Raymond
R. Wallner in the amount of $170,000.00 claiming improper drainage and
diversion of water unto lands owned by Muskego Industrial Park, Inc., Ray-
mund R. Wallner, Agent. Both claims referred to City Attorney and Finance
Committee.
Mayor Gottfried discussed with the aldermen the problems involved in renewing

the city's insurance program ,for 1976. He invited all of the aldermen to
meet with the Finance Committee as soon as possible to make a decision.
