ccm19751028COMMON COUNCIL CITY OF MUSREGO MINUTES OF MEETING HELD OCTOBER 28, 1975 The meeting was called to order at 7:45 P.M. by Mayor Gottfried. Also present were Aldermen Colbum, Dumke, Foldy, Ford, Knudsen, Schaumberg and Wallner, City Attorney John P. Buckley and City Clerk Bette Bowyer. Ald. Schaumberg moved to approve the minutes of the meeting held 10/14/75 and to have them placed on file. Seconded by Ald. Dumke, motion carried. Ald. Schaumberg presented the reports of the Finance Committee meetings held on 10/22/75 and 10/28/75 and moved that they be accepted and placed on file. Seconded by Ald. Dumke, motion carried. Ald. Ford presented the Public Works report of meeting held 10/23/75 and moved that it be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. Ald. Knudsen presented the report of the Rules, Laws & Ordinance meeting held 10/20/75 and moved that it be accepted and placed on file. Seconded by Ald. Colbum, motion carried. Ald. Colbum presented the report of the Public Safety Committee meeting held on 10/23/75 and moved that it be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. Ald, Colbum presented the report of the Public Sewer Committee meeting held 10/20/75 and moved that it be accepted and placed on file. Seconded by Ald. Dumke, motion carried. Ald. Foldy presented the report of the Public Welfare Committee meeting held on 10/20/75 and moved that it be accepted and placed on file. Sec- onded by Ald. Wallner, motion carried. The minutes of the Police Building Committee meeting were received and accepted. (Meeting held 10/16/75) The minutes of the Plan Commission meeting held 10/28/75 were received and placed on file. The minutes of the Industrial Development Committee meeting were received and placed on file. (Meeting held 10/28/75). UNFINISHED BUSINESS .l. Resolution 8205-75 - Renewal of Extractive Permit for State Sand & Grave This resolution had been deferred from previous meetings. Ald. Knudsen moved to amend same by adding the following paragraph: BE IT FURTHER RESOLVED that this approval is given with the understanding that an up- dated restoration plan would be required prior to approval in 1976.". Seconded by Ald. Schaumberg. Upon a voice vote the motion carried. Upon a roll call vote to adopt Resolution i/205-75, As Amended, the motion carried unanimously. Resolution 11234-75 - Approving an Amendment to the Subdivision Agreement for Durham Meadows Subdivision. (This resolution is on the floor and had been deferred for two weeks at meeting of 10/14/75). Following a short discussion, upon a roll call vote on the motion to adopt Resolution $1234-75 the motion carried with Ald. Schaumberg casting a dissenting vote. Resolution #235-75 - Declaring a Moratorium on Major Developments in the Northeast and Northwest Sewer Districts (This resolution is on the floor and had been deferred for two weeks at meeting of 10/14/75.) A lengthy discussion took place during which the aldermen expressed their views regarding capacity of the treatment plants and approved and proposed @ developments in the two sewer districts. Ald. Wallner moved to again defer action on Resolution i/235-75 for two weeks. Seconded by Ald. Knudsen. Upon a roll call vote to defer, Aldermen Colbum and Wallner voted "aye". Aldermen Dumke, Foldy, Ford, Knudsen and Schaumberg voted "no" . The motion to defer did not carry. Upon a roll call vote to adopt Resolution i/235-75, Aldermen Colbum, Dumke, Ford and Schaumberg voted "aye". Aldermen Foldy, Knudsen and Wallner voted "no". The motion to adopt Resolution $1235-75 carried. Ordinance i/307 - The Clerk gave the second reading of same, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the @, City of Muskego (Agenten, Katzfey 6. Koeferl properties). Ald. Foldy moved for adoption, seconded by Ald. Schaumberg. Upon roll call the motion carried unanimously. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried reviewed the status of Phase II of the city's industrial park and the promotional brochures pertaining to the park for the aldermen. NEW BUSINESS Resolution 8239-75 - The Clerk read same, entitled, Approval of Certified Survey Map (W. Koenig). Ald. Ford moved for adoption, seconded by Ald. Foldy. Upon a roll call vote the motion carried unandimously. Resolution #240-75 - The Clerk read same, entitled, Authorizing Transfer of Funds. Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Resolution #241-75 - The Clerk read same, entitled, Approval of Oper- ational and Development Plans of Wauer Sanitary Landfill Site. Ald. i) Foldy moved for adoption, seconded by Ald. Knudsen. Ald. Knudsen moved to refer this resolution to the Public Welfare Committee. Ald. Foldy. Ford moved for adoption, ried. seconded by Ald. Knudsen. Upon a voice vote the motion car- Resolution #243-75 - The Clerk read same, entitled, Authorizing the Filing of an Application for Aids for Preparing Waste Water Treatment and Convey- ance Facility Plans. Wallner, Ald. Schaumberg moved for adoption, seconded by Ald. Upon roll call the motion to adopt carried unanimously. Resolution #244-75 - The Clerk read same, lation of Street Lights. entitled, Authorizing the Instal- Ald. Colbum. Ald. Schaumberg moved for adoption, seconded by Upon roll call the motion carried unanimously. a Resolution 8245-75 Regulations (25 - The Clerk read same, entitled, Establishing Traffic h on Priegel Dr. and Stop sign on High Bluff at Tans Dr.) Ald. Schaumberg %ved for adoption, seconded by Ald. Colburn. Upon roll 4 call the motion carried. Resolution $1246-75 - The Clerk read same, entitled, Authorization to Ex- ecute Documents Relating to Receipt of Lands from Kristin Downs. Ald. Knudsen moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. -. . Common Council ml28175 - P. 3 New business - cont'd. Ordinance #308 - An Ordinance to Amend Section Section 3.13 of the Municipal Code of the City of Muskego, Wisconsin. (Re : Establishing sewer service areas to be served by the city - Highway 24 and Emerson Drive District). AId. Foldy moved to suspend the rules in order that this ordinance could be acted upon at this meeting. Seconded by Ald. Schaumberg. Upon a roll call vote to suspend the rules the motion carried with Ald. Knudsen casting a dissenting vote. The Clerk gave the first reading of Ordinance #308. Ald. Schaumberg moved to suspend the rules to have the second reading of the ordinance in order that it cou'ld be adopted at this meeting, therefore, it could be included in the new printing of the city's municipal code. Motion seconded by Ald. Foldy. Upon roll call the motion carried with Ald. Knudsen casting a dissenting vote. The Clerk gave the second reading of Ordinance 9308. Ald. Schaumberg moved for adoption, seconded 'by Ald. Foldy. Upon a roll call vote the motion to adopt Ordinance #308 carried unanimously. VOUCHER A'PPROVAL - Ald. Schaumberg moved for the approval of payment of general voucher in the amount of $15,102.00 payable 10/28/75. Seconded by Ald. Dumke. Upon a roll call 'vote the motion carried unanimously. LIC'ENSE APPROVAL - Ald. Schaumberg moved for the approval of Operators Licenses for Norbert Gressle, Bradley Birchbauer, Thomas Schwinn and Ann Marie Schimke. Also for Yvonne Windorski subject to receipt of favorable Fingerprint and Medical Reports. Seconded 'by Ald. Colbum, motion carried. Ald. Schaumberg moved for the approval of Lakeriders Snowmobile Club to serve fermented malt 'beverage a,t Jensen Center (11/l/75). Seconded by Ald. Knudsen, motion carried. Ald. Schaumbe,rg moved for the approval of a "Gathering" 'License for Muskego Moose Lodge at Idle Isle on January 6, 1976. Seconded by Ald. Knudsen. Motion carried. C?Z4MUNICATIONS AND MISCELLANEOUS BUSINESS Mayor Cottfried advised the aldermen that the proposed 1976 city budget is being prepared and will be submitted to them as soon as possible for their review. He further advised that the Council Meeting of the Whole on the proposed budget will take place on Tuesday, November 11, 1975, at 8:30 P.M. ADJOURNMENT - Ald.
