ccm19751014- . i l COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD OCTOBER 14, 1975 The meeting was called to order at 7~50 P,M. by Mayor Gottfried. Also present were Aldermen Colburn, Dumke, Foldy, Ford, Knudsen, Schaumberg and Wallner, Acting City Attorney Joseph Wimmer and City Clerk Bette J. Bowyer . Ald, Schaumberg moved to approve the minutes of the meeting held g/23/75 and that they be accepted and placed on file. Seconded by Ald. Colbum, motion carried. Ald. Schaumberg presented the reports of the Finance Committee meetings held on 10/g/75 and 10/14/75 and moved that they be accepted and plae,ed on file. Discussion took place regarding city policies as they relate to forced hookups. and carried. The motion to accept the reports was seconded 'by Ald. Dumke Ald. Ford presented the report of the Public Works Committee meeting held on 10/g/75 and moved that it be accepted and placed on file. Seconded by Ald. Schaumberg. Considerable discussion took place regarding that section of the minutes relative to needed restoration work in the Parkland Subdivision, Ald. Knudsen moved to delete that portion of the minutes regarding the Parkland area. Seconded by Aid. Wallner. Upon a roll call vote to delete the paragraph, Aldermen Colbum, Dumke, Foldy, Ford and S&u: b-voted LnO'!A.ldermenKnudsen and Wallner voted "aye". The motion did not carried. Upon a voice vote the motion to accept the minutes and place them on file carried. Mayor Gottfried advised that the Rules, Laws & Ordinance Committee had continued their discussion of the proposed Sign Ordinance on September 25, 1975. Ald. Colbum presented the report of the Public Sewer Comittee meeting held on 1016175 and moved that it be accepted and placed on file. Sec- onded by Ald. Ford, motion carried. The minutes of the Plan Commission meeting held on 10/7/75 were received and placed on file. UNFINISHED BUSINESS Resolution ,#205-75 - Renewal of Extractive Permit for State Sand & Gravel, Aid. Knudsen moved to defer action on same until the next Council meeting, Seconded by Ald. Foldy. Upon a voice vote the motion to defer carried. Resolution #168-75 - Establishing Traffic Regulations ("No Parking " on CoLlege Avenue between Racine Ave. and Lentini Dr,) This resolution is on the floor and had been deferred from a previous meeting, Aid. Colburn moved to amend the resolution by changing the traffic regulation to read, "No Parking to Comer" sign approximately 100 feet west of Martin Drive on the south side of College Avenue. Seconded by Ald. Ford, Upon a roll call vote to adopt Resolution j/168-75, As Amended, the motion carried unanimously. COMMUNICATIONS FROM THE MAYOR'S OFFICE The Clerk read Mayor Gottfried's proclamation proclaiming October 23rd to be "UNITED STAT'ES DAY" and the week of October 23rd thru 29th to be UNITED STATES WEEK" in the City of Muskego, Conmlon Council m/14/75 Page 2. Commurrications from the. Mayor's Office - cont'd. i Mayor Gottfried reviewed the alternate bids of the Lembezeder sewer project. Mayor Gottfried reviewed past actions by the Council relating to Lot 7, Krogman's 1st Add. Subdivision, the last of which was the adoption of a resolution authoriztng the sale of same to John 'Lang in the amount of $1,100.00. Because the c$ty at this time cannot get clear title to the lot, Alderman Foldy moved to reconsider Resolution 11226-75. Secon,ded, by Ald. Knudsen, Upon a roll call vote on the motion to reconsider, Aldermen Colburn, Foldy, Knudsen, Schaumberg and Wallner voted "aye". Aldermen Dumke and Ford voted "no". The motion carried. 'Following further dis- cussion, upoe a roll call vote to adopt Resolution i/226-75, Aldermen Colburn, ,Foldy, Knudsen and Wallner voted "no". Aldermen Dumke, Ford, and Schaumberg voted "aye". The motion to adopt Resolution 8226-75 was defeated. NEW BUSINESS . Resolution j/232-75 - The Clerk read same, entitled, Accepting Low Bid for Installation of Sewer Connections in "G" and "H" Districts (J. 'Lang). Aid, Dumke moved for adoption, seconded by Ald, Colbum. Ald. Foldy moved to amend the amount of $861.00 to be $715.O@j;(5&p:-) 'Sec"d by Ald. Knudgen motion carried. Upon a roll call vote to adopt Resolution l/232-75, As Amended, the motion carried unanimously. Resolution 11233-75 - The Clerk read same, entitled, Designating Halloween Trick of Treat Hours. (Hours to be 4:30 - 6:30 P.M. on Thursday, October 30th). ALd. Schaumberg moved for adoption, seconded by Ald. Colbum. Upon a roll call vote the motion carried unanimously. Resolution l/234-75 - The Clerk read same, entitled, Approving an Amend- ment to the Subdivision Agreement' for Durham Meadows Subdivision D Alderman Dumke moved for adoption, seconded by Ald. Foldy. Following discussion relating to the remaining sewage capacity in the northwest and northeast districts, Ald. Schaumberg moved to defer action on Resolution i/234,-75, Seconded by Aldd Knudsen. Upon a roll call vote to defer, Aldermen Colburn, Dumke, Ford, Knudsen, Schaumberg and Wallner voted "aye". Ald. Foldy voted "'no". .The motion to defer action on Resolution #234-75 for two weeks carried. Resolution f/235-75 - The Clerk read same, entitled, Declaring a Moratorium on Major Developments in the Northeast and Northwest Sewer Districts. Aid. Dumke moved for adoption, seconded by Ald. Ford. Aldi Ford moved to defer action on Resolution 8235-75 until the next Council meeting. Seconded by Ald. Wallner. Upon roll call the motion to defer carried unanimously, Resolutjon 8236-75 - The Clerk read same, entitled, Appointment to Electrica Licensing Board (M. Zlnner). Ald. Schaumberg moved for adoption, seconded by Ald. Wallner (appointment to fill the unexpired term of Werner Bierbach). Upon roll call the motion carried unanimously. l Resolution 8237-75 - The Clerk read same, entitled Establishdng Mileage Allowance for City Employees (From 10~ to 12~ per mile). Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Ald. Schaumberg moved for adoption, seconded by Ald. Wallner. A lengthy discussion took place regarding the lowering of the sewer main in Lembezeder Drive near Hillen- dale Drive in order that at some future time a portion of Hillendale Drive could connect into the city's sewer system. Ald. Knudsen requested permission of his fellow aldermen to abstain from voting on Resolution i/238-75 and upon a roll call vote the motion to adopt Resolution f/238-75 carried unanimouslywith Ald. Knudsen abstaining from the voting. Resolution #228: 75, - The Clerk read same, entitled, Authorizing Refund to William Schultz (Fountainwood Lot). Ald. Schaumberg moved for adoption. Seconded by Ald. Knudsen. Ald. Knudsen moved to amend Resolution $1228-75 by adding the following to the fourth paragraph "upon receipt by the city of warranty deed by the purchaser". Seconded by Ald. Wallner. Motion carried. Upon a roll call vote to adopt Resolution #228-75, As Amended, the motion carried unanimously. Ordinance #307 - The Clerk gave the first reading of same, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Agenten, Katzfey & Koeferl Properties.) VOUCHER APPROVAL - Ald. Schaumberg moved to approve payment of general vouchers in the amount of $236,444.07 payable 10114175. Seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Ald. Schaumberg moved to approve payment of sewer utility vouchers in the amount of $17,182.79. Seconded by Ald. Dun&e, Upon.roll.:caIl the motion carried unanimously. LICENSE APPROVAL - Ald. Schaumberg moved for the approval of Operators Licenses for Jean Lancin, Mary Tidball, John Kaczmarek, Harold DeFoljiW, Jr., and George Broadwick. Seconded by Ald. Dumke, motion carried. Aid. Schaumberg moved for the approval of Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Donald Miller and Naomi Miller, as partners, for S80 W18700 Apollo Drive (bowling alley). Seconded by Ald. Knudsen, motion carried. Ald. Schaumberg moved for the approval of "Gathering" License for Icetronauts Snowmobile Club (October 18 and 19th at the corner of Racine and Woods Rd. - Milton Muehl farm). Seconded by Ald. Dumke, motion carried. CITY OFFICIAL'S REPORTS - The Clerk read the September, 1975, Building Report indicating 13 new dwellings and total construction in the amount of $461,970,00 for that month, Report placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Clerk acknowledged receipt of a letter from the Waukesha Blood Don.or Club expressing appreciation to the city for assistance given them during the recent visit of the blood mobile unit. Same placed on file, The Clerk read a petition dated 10/11/75, from Eldred Jensen, owner of Lot 1, Blk 1, Jewel Crest Subdivision, requesting abandonment of Crest Drive right-of-way south of Pearl Drive. Petition referred to City Attorney Buckley, Public Works Committee and Plan Commission. Al,d..Dumkei;moved that following adjournment of this meeting the Council -.. .' go into executive session for the purpose of discussing negotiating procedures. Seconded by Aid.
