MINUTES OF MEETING HELD SEPTEMBER 23, 1975
The meeting was called to order at 7:&O P.M. by Mayor Gottfried. Also
present were Aldermen Colbum, Dumke, Foldy, Ford, Knudsen, Schaumberg
and Wallner, City Attorney John P. Buckley and City Clerk Bette Bowyer.
Ald. Schaumberg moved to approve the minutes of the meeting held g/9/75
a and that they be accepted and placed on file. Seconded by Ald. Foldy,
motion carried.
Ald. Schaumberg presented the reports of the Finance Committee meetings
held on g/17/75 and g/23/75 and moved that they be accepted and placed en
file. Seconded by Ald. Dumke, motion carrked. /
Aid. Ford presented the report of the Public Works Committee meeting held
on g/19/75 and moved that it be accepted and placed on file. Seconded
by Ald. Schaumberg, motion carried.
Ald. Foldy presented the report of the Public Welfare Committee meeting
heldseptember 11, 1975, and moved that it be accepted and placed on
file. Seconded by Ald. Wallner, motion carried.
1 Ald. Knudsen presented the report of the Rules, Laws & Ordinance Committee
meeting held on September 11, 1975, and moved that it be accepted and
placed on file. Seconded by Aid. Colbum, motion carried.

Resolution #205-75 - ~enew&~&Extractiv~ermit for State Sand & Gravel?
Ald. Knudsen again moved to defer action on same until the next meeting
to give city's consulting engineers an opportunity to determine whether
or not the present restoration bond is adequate. Seconded by Ald.
Wallner. Upon a voice vote the motion to defer carried,
Resolution #212-75,As Amended - Approval of Final Plat (Guernsey Meadows)
This resolution is on the tloor and had been deferred from the meeting of
919175. Ald. Foldymoved to furtheranend Resolution j/212-75, As Amended,
by deleting the word "water capacity" in the last paragraph and inserting the words "DNR flow requirements". Seconded by Ald. Ford. Upon roll call
the motion carried unanimously. Considerable discussion took place re-
garding the 10' 'easement between Lots 38 and 39 (entrance to the park off
of Linda Court) and the need for vision corners -in the proposed subd$vieion. Ald. Colburnmoved to add the. following' paragraph to theresolut$on ,!‘BE IT FURTHER RESOLVED that Lots 7 and 66 and 30 and 58 show viston.cohers on
,the' final plat map". Seconded by Aid., Knudsen, motion carried. Ald.
Colbum moved to further amend the resolution by having his previous
amendment read, "BE IT FURTHER RESOLVED that all comers within the sub?
division shown vision comers on the final plat." Seconded by Ald. Qumke,
Upon a roll call vote on Ald. Colbum's second amendment, the motion carried
with Ald. Ford casting a "No" vote.
Discussion resumed regarding the 10' easement to the proposed park rer
lating to maintenance, etc., and Ald. Knudsen moved to add the follow$ng
to the resolution, "BE IT FURTHER RESOLVED that on the final plat the l 10' easement be changed to indicate‘dedication to-be owned and maintained
by the city. Seconded by Ald. Colbum. Following further discussion as
to whether or not the 10' easement should be,an outlot and maintained by
the homeowners, Ald. Foldy called for the question, Upon a roll call vote

on Ald. Knudsen's motion, Aldermen Dumke, Foldy, Ford, Wallner .and
Schaumberg voted "no". Ald. Knudsen and Colbum voted "yes". The motion
did not carry.
c Ald. Foldy moved to further amend Resolution 212-75, AS Amended, as
follows: "BE IT FURTHER RESOLVED that the final plat of Guernsey
Meadows shall show the presently de&ad 10' easement as an outlot."
Seconded by Ald. Schaumberg. Upon a roll call vote to further amend
Resolution i/212-75, As Amended, the motion carried unanimously. Upon
a roll call vote to adopt Resolution f/212-75, As Amended, the motion
carried unanimously.
Resolution W224-75 - Authorizing Repair of Jewel Creek Dam. (This res-
olution is on the floor and was deferred for two weeks). Ald. Schaumberg
moved to table Resolution i/224-75. Seconded by Ald. Wallner. Upon a
roll call vote on the motion to table Resolution i/224-75, Aldermen
Dumke, Foldy, Knudsen, Schaumberg and Wallner voted "aye". Aldermen
Colbum and Ford voted "no"'. The motion to table carried.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried advised that the Finance Committee will be meeting with
the Bicentennial Committee on Monday, September 29th at 7:30 P.M. to
try to determine the best location for the proposed Bicentennial Park,
He invited all aldermen to attend.
NEW BUSINESS
Resolution ,#226-75 - The Clerk read same, entitled, Acceptance of Offer
to Purchase City-Owned Lot (Tax delinquent lot in Krogman's Add. #l Sub'n.)

Ald. Colbum moved to defer action on Resolution #226-75 for two weeks.
Seconded by Ald. Wallner. Upon a roll call vote to defer, Aldermen
Colbum, Knudsen and Wallner voted "aye". Aldermen Dumke, Foldy,Ford
.and Schaumberg voted "no". The motion to defer did not carry.
Ald. Ford moved to amend Resolution i/226-75, by adding the following
.paragraph: BE IT FURTHER RESOLVED that this acceptance is predicated
upon Lots 7 and 6 being joined. Seconded by Ald. Schaumberg. Upon a
roll call vote on the motion to amend, Aldermen Dumke, Foldy, Ford,
Knudsen and Schaumberg voted "aye". Alde.nnenCe&uzn-and Wallner voted
"no" . The motion to amend Resolution #226;75Lcarried. Considerable ‘gis-
cussion followed regarding the.city"s desire to upgrade the.area, the
conditions upon which the lot is being sold, etc. Upon a roll call vote
to adopt Resolution i/226-75, As Amended, the motion carried unanimously.
Ald. Colbum moved for the reconsideration of Resolution $1226-75, AS
Amended. Seconded by Ald. Dumke. Upon a roll call vote on the the motion
to reconsider, the motion carried with Ald. Schaumberg casting a dis-
senting vote. Ald. Colbum moved to further amend Resolution #226-75, l As Amended, by adding the following paragraph: BE IT FURTHER RESOLVED
that there will be no lateral refundmade on this property. Seconded by
Ald. Knudsen. Upon a roll call to further amend the resolution, the
motion carried with Ald. Wallner voting "no". Upon a roll call vote on
the motion to adopt Resolution #226-75, As Amended, the motion carried
with Aldermen Knudsen and Wallner voting "no".
