ccm19750909:4 : COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 9, 1975 l The meeting was called to order at 7~44 P.M.! by Mayor Gottfried. Also present were Aldermen Colbum, Dumke, Foldy, Ford, Knudsen, Schaumberg and Wallner, City Attorney John P. Buckley and City Clerk Bette Bowyer. Ald. Foldy moved to approve the minutes of the meeting held g/26/75 * and that they be accepted and placed on file. Seconded by Ald. Dumke, motion carried. l Ald. Schaumberg presented the report of the Finance Committee meeting held on g/3/75 and moved that it be accepted and placed on file. Seconded by Ald. Dumke, motion carried. Ald. Ford presented the report of the Public Works Committee meeting held on g/4/75 and moved that it be accepted and placed on file. Sec- onded by Ald. Schaumberg, motion carried. Ald. Colbum presented the report of the Public Safety Committee and moved that it be accepted and placed on file. Seconded by Ald. Schaum- berg, motion carried. Ald. Colbum presented the report of the Public Sewer Conunittee meeting held on 9/S/75 and moved that it be accepted and placed on file. Sec- onded by Ald. 'Wallner, motion carried. The/minutes of the Plan Commission held g/2/75 were received and placf;zzeon UNFINISHED BUSINESS . Resolution 11205-75 -.Xenewallof-Ex~raE~ve Permit for State Sand and Gravel. Since this resolution had been referred to the Welfare Committee Ald. Knudsen moved to again defer action on same for two weeks (9123175). Seconded by Ald. Wallner, motion carried. NEW BUSINESS Resolution j/212-.75 - The Clerk read same, entitled, Approval of Final Plat (Guernsey Meadows). Ald. Ford moved for adoption, seconded by Ald. Foldy. Aid. Foldy moved to amend the last paragraph of the resolution by having it read, "BE IT FURTHER RESOLVED that this approval is con- ditioned upon and shall be affected only upon receipt of secured assurances.....". Seconded by Ald. Knudsen. Upon roll call the motion to amend carried unanimously. Considerable discussion took place re- garding adequate assurances that the well system would continue to produce sufficient water after the development has been completed. Ald. Knudsen moved to defer action on Resolution f/212-75 for two weeks and refer same to the Public Works Connnittee. Seconded by Ald. Colbum. Upon roll call on Ald. Knudsen's motion, Aldermen Colbum, Foldy, Ford, Knudsen and Wallner voted "aye". Aldermen Dumke and Schaumberg voted "no". The motion to defer carried. Resolution j/213-75 - The Clerk read same, entitled, Appointment of Alderman to Library Board (Charles Colbum). Ald. Dumke moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion carried unanimously. l Resolution #215-75 - The Clerk read same, entitled, Approving Expenditure of Funds for Spookfest Activities ($400.00). Ald. Foldy moved for adoption. Seconded by Ald. Schaumberg. Upon roll call the motion carried unanimously. Resolution i/216-75 - The Clerk read same, entitled, Creating Parttime Positior of Clerk in Inspection Department. Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Resolution Y/217-75 - The Clerk read same, entitled, Applying for Funds Under CETA Program. Ald. Foldy moved for adoption, seconded by Ald. Schaumberg (funds to be used for parttime position in Inspection Dept.) Upon roll call the motion carried unanimously. Resolution j/218-75 - The Clerk read same, entitled, Approval of Transfer l of Funds (Federal Revenue Sharing). Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Upon roll.call the motion carried unanimously. Resolution 8219-75 - The Clerk read same, entitled, Acceptance of Low Bid for Installation of Sewer Installations (Forced Hookups "G" District)J.Lang. Ald. Dumke moved for adoption, seconded by Ald. Colbum. Wld. Durike.moired .th:amend-the-resolution'by adding the following address to those already listed for forced hookup: "S67 W13803 Hardwick Place - $1,566.00". Sec- onded by Ald. Wallner. Upon roll call the motion carried. Upon roll call the motion to adopt Resolution f/219-75, As Amended, carried unanimously. Resolution #220-75 - Conmending the Muskego Volunteer Fire Company For Twenty Five years of Service. Ald. Knudsen moved for adoption, seconded by Ald. Ford. Upon roll call the motion carried unanimously. l Resolution $1221-75 - The Clerk read same, entitled, Establishing Traffic Regulations ( 45 mph speed limit on Muskego Dam Rd. and "No parking" on the east side of Lincoln Drive). Ald. Schaumberg moved for adoption, seconded by Ald. Colbum. Upon roll call the motion carried unanimously. Resolution i/222-75 - The Clerk read same, entitled, Urgin.g: Installation of Traffic Control Lights on S.T.H. 24. Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried with'A!LcLlzord casting a dissenting vote. Resolution l/223-75 - The Clerk read same, entitled, Authorizing the Purchase of Public Works Truck. Ald. Schaumberg moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution j/224-75 - The Clerk read same, entitled, Authorizing Repair of I Jewel Creek Dam. Ald. Schaumberg moved for adoption, seconded by Ald. Ford. Upon the advice of the legal counsel Ald. Knudsen moved to defer * action until the next meeting on Resolution i/224-75. Seconded by Ald. Ford. Upon roll call Aldermen Colbum, Dumke, Foldy, Knudsen and Wallner voted "aye". Aldermen Ford and Schaumberg voted "no". The motion to defer carried. i r 0 l 0 0 Common Council 919175 - P. 3 Resolution i/208-75 - Acceptance of Low Bid for Park Site Development (Kurth, Lions and Jensen Parks). Ald. Knudsen moved for the recon- sideration of this resolution. Seconded by Ald. Ford. Upon roll call the motion to reconsider carried unanimously. Ald. Ford moved to amend Resolution #208-75 by changing the A. T. Forseth Contractor's bid for Lions Park from $14,234.77 to $19,024.77, thus changing the total figure in the second last paragraph to $47,139.94, and by adding the following to the same paragraph, "subject to the necessary funds being available in the 1975 Park and Recreation Budget". Seconded by Ald. Knudsen. Considerable discussion following regarding the avail- ability of funds in the Park and Recreation 1975 capital budget. Ald. Dumke called for the question. Seconded by Ald. Colbum. Upon roll call the motion carried with Ald. Knudsen voting "no". Upon a roll call vote to amend Resolution #208-75, Aldermen Colbum, Foldy, Ford, Knudsen and Wallner voted "aye". Aldermen Dumke and Schaumberg voted "non. The motion to amend carried. Ald. Knudsen called for a point of order in that the previous call for the question affected only the amendment. The Chair advised the Council that when a member calls for the previous question which has an amendment pending a vote must be immediately taken on the amendment and upon the question to be amended without debate. Ald. Knudsen moved to override the decision of the Chair. His motion lost for lack of a second. Upon a roll call vote to adopt Resolution #208-75, As Amended, Aldermen Colburn, Ford, Foldy, Knudsen and Wallner voted "aye". Aldermen Dumke and Schaumberg voted "no". The motion to adopt Resolution i/208-75, As Amended, carried. LICENSE APPROVAL - Ald. Schaumberg moved for the approval of Operators License for Lee Toebe subject to receipt of favorable fingerprint report. Seconded by Ald. Dumke, motion carried. CITY OFFICIAL'S REPORTS - The Clerk gave the Building Report for the month of August which indicated 20 new dwelling units and total con- struction in the amount of $882,200.00 for that month. Report placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Clerk acknowledged receipt of a cormrmnication from Mrs. Esther Zenecke in which she en- closed statements for injuries to her child while swimming on city property. Same forwarded to City Attorney and city's insurance carrier. The Clerk acknowledge receipt of a notice of appeal of special assessment, dated September 9, 1975, from Edward and Eleanor Niezgoda and Clyde and Janice Heckert (Re: W. Tower Drive).
