ccm19750610COMMON COUNCIL CITY OFMUSKEGO MINUTES OF MEETING HELD JUNE 10, 1975 The meeting was called to order at 7~47 P.M. by Mayor Gottfried. Also present were Aldermen Colbum, Dumke, Ford, Foldy, Knudsen, Schaumberg and Wallner, Deputy City Clerk June Elger and City Attorney John Buckley. Ald. Foldy moved to approve the minutes of the previous meeting held on May 27, 1975, and that they be placed on file. Seconded by Ald. Colburn, motion carried. Ald. Dumke presented the report of the Finance Committee meeting held on June 4, 1975, and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. Ald. Ford presented the report of the Public Works Committee meeting held on June 5, 1975, and moved that it be accepted and placed on file. Seconded by Ald. Dumke, motion carried. Ald. Knudsen presented the report of the Rules, Laws & Ordinance Committee meeting held on May 29, 1975, and moved that it be accepted and placed on file. Seconded by Ald. Colbum, motion carried. Ald. Foldy presented the report of the Public Welfare Committee meeting held on May 29, 1975, and moved that it be accepted and placed on file. Seconded by Ald. Wallner, motion carried. Ald. Colbum presented the report of the Public Safety Committee meeting held on June 5, 1975, and moved that it be accepted and placed on file. Seconded by Ald. Wallner, motion carried. The minutes of the Plan Commission meeting held on June 3, 1975, were received and placed on file. Ald. Colbum presented the report of the Public Sewer Conrnittee meeting held on June 2, 1975, and moved that it be accepted and placed on file. Seconded by Ald. Ford, motion carried. Resolution j/157-75 - As the first order of business Mayor Gottfried requested permission of the aldermen to have Resolution #157-75, entitled, Honoring Muskego's AFS Student - Miss Alicia Nimis, acted upon at this time. As there were no objections the Deputy Clerk read the resolution. Ald. Schaumberg moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion carried unanimously. Mayor Gottfried then presented Alicia with several momentos from Muskego and Wisconsin in remembrance of your year long stay here in Muskego. Miss Nimis will return to her home country, Argentina at the end of June. UNFINISHED BUSINESS Resolution #152-75 - Establishing Traffic Regulations (Re: "Stop" signs at the intereection of Kelsey and Muskego Dam Dr.) This resolution is on the floor. A discussion took place regarding the placement of the signs and Ald. Knudsen moved to amend the resolution by changing the word "south- east" to "northeast". Seconded by Ald. Colbum. Following further dis- cussion regarding the location of the signs, Ald. Schaumberg moved to table Resolution j/152-75. Seconded by Ald. Colbum. Upon roll call the motion to table carried unanimously. Common Council June 10, 1975 P. 2 NEW BUSINESS Resolution 11149-75 - Authorizing Release of Cash Bond for Holding Tank (Chmiel). Ald. Schaumberg moved for the reconsideration of same. Seconded by Ald. Ford. Upon roll call the motion to reconsider carried unanimously. Ald. Schaumberg moved to amend Resolution #149-75 by having the 4th paragraph read, “BE IT FURTHER RESOLVED that the Connnon Council of the City of Muskego does hereby rescind its action of April 8, 1975, adopteding Resolution #96-75 which granted approval of a holding tank agreement be- tween the City of Muskego and Walter Cbmiel." Also, by adding a 6th paragraph as follows: "BE IT FURTHER RESOLVED that this action in no way relieves the responsibility of Mr. and Mrs. Chmiel to meet the Waukesha County Health Code as it relates to having a proper sewage disposal system for their residence." Motion seconded by Ald. Dumke. Upon roll call the motion to amend carried unanimously. Upon a roll call vote the motion to adopt Resolution #149-75, As Amended, carried unanimously. Resolution #158-75 - The Deputy Clerk read same, entitled, Accepting Offer to Purchase a Portion of City-owned Lot (former Lassa Lot). Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Ald. Knudsen moved to defer action on Resolution j/158-75, seconded by Ald. Wallner. Ald. Knudsen requested permission of his fellow aldermen to have Mrs. Vemette Peasley, W191 S7312 Shore Lane, speak. As there were no objections, Mrs. Peasley expressed concern over the close praximity of the proposed road to her home. Upon a roll call vote to defer action on Resolution $1158-75 the motion carried with Ald. Foldy casting a dis- senting vote. Resolution j/159-75 - The Deputy Clerk read same, entitled, Accepting Offer to Purchase a Parcel of Land in the Muskego Business/Industrial Park (Burazin). Ald. Ford moved for adoption, seconded by Ald. Wallner. Parcel to be used for expansion of present facility. Upon roll call the motion carried unanimously. Resolution #160-75 - The Deputy Clerk read same, entitled, Approval of Certified Survey Map (R. Klenz). Ald. Ford moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution i/161-75 - The Deputy Clerk read same, entitled, Resolution Levying Special Assessment (Harding & Lufkin). Ald. Colbum moved for adoption, seconded by Ald. Dumke. Ald. Colbum moved that this resolution be effective subject to the signing of the necessary waivers. Seconded by Ald. Wallner, motion carried. Upon a roll call vote the motion to adopt Resolution $1161-75 carried unanimously. Resolution j/162-75 - The Deputy Clerk read same, entitled, Continuation of Re-monumentation Program. Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried unanimously, Resolution #163-75 - The Deputy Clerk read same, entitled, Approval of Preliminary Plat (Kristin Downs). Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Ald. Ford expressed opposition as to the layout of the proposed development. Upon a roll call vote to adopt Resolution #163-75 the motion carried with Ald. Ford casting a dissenting vote. Resolution #164-75 - The Deputy Clerk read same, entitled, Approval of Maintenance Agreement for New Typewriter in City Hall. Ald. Dumke moved for adoption, seconded by Ald. Wallner. Resolution #166-75 - The Deputy Clerk read same, entitled, Authorizing the Sale of City-owned Lots (Lot 1 Blk 27,, Hale Park Highlands & Lot 12 Blk 15, Fountainwood 3rd Add.) Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Resolution j/167-75 - The Deputy Clerk read same, entitled, Applying for Federal Grant-Inland Lake Demonstration Project. Ald. Ford moved for adoption, seconded by Ald. Knudsen. (Re: application for federal aids for purchase of Schwefel property). Upon a roll call vote the motion carried unanimously. Resolution i/168-75 - The Deputy Clerk read same, entitled, Establishing Traffic Regulations. Ald. Schaumberg moved for adoption, seconded by Ald. Knudsen. Ald. Ford moved to defer action on this resolution to have the Public Safety Cormnittee study further. Seconded by Ald. Schaum- berg. Upon a voice vote the motion carried. Ordinance #304 - The Deputy Clerk gave the first reading of same, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Kristin Downs, RS3 to RS3-OPD). Ordinance if305 - The Clerk gave the first reading of same, entitled, An Ordinance Repealing and Recreating Sec. 16.26 of the Municipal Code Re- garding Regulations for Holding Tanks. LICENSE APPROVAL - Ald. Foldy moved for the approval of Operators Licenses for Michael Sommers, Adeline Fehrman and for Kenneth Fehrman, subject to receipt of favorable Fingerprint and Medical Reports, Seconded by Ald. Schaumberg, motion carried. Ald. Foldy moved for the approval of Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Clifford's Catering, T. Glynn, Agt., Doris Thew and Ann Gehrke and Kenneth Lepinski, as partners. Seconded by Ald. Dumke, motion carried. Ald. Foldy moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Donald Miller, subject to the review of the premises when completed. Seconded by Ald. Knudsen, motion carried. Ald. Schaumberg moved for the approval of Swinnning Beach Permits and Waterway Marker Permits for Martin Oschmann, Willard Masterson, Donald Dixon, Daniel P. Amann and Robert Klenz. Seconded by Ald. Colbum, motion carried. Ald. Dumke moved for the approval of Trap Permit for Julius Caesar, Richard Bennett and Robert Schaack, seconded by Ald. Wallner, motion carried. Ald. Schaumberg moved for the approval of Dump Refuse Hauling Permit for Rel Sanitation. Seconded by Ald. Colbum, motion carried. VOUCHER APPROVAL - Ald. Schaumberg moved for the approval of sewer construct- ion voucher in the amount of $9,000.00 (Industrial Park). Seconded by Ald. Knudsen, Upon a roll call vote the motion carried unanimously. l CITY OFFICIAL'S REPORT - The Deputy Clerk read the Building Report for the month of May, indicating total construction in the amount of $914,640.00 and 29 dwelling units. COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Deputy Clerk read a commun- ication from Representative Rutkowski regarding the Conta Plan. Placed on file. ADJOURNMENT - Ald.
