ccm19750527COMMON COUNCIL CITYOFMIJSREGO MINUTES OF MEETING HELD MAY 27, 1975 The meeting was called to order at 7:45 P.M. by Mayor Gottfried. Also present were Aldermen Colbum, Dumke Foldy, Knudsen, Schaumberg and Wallner, City Clerk Bette Bowyer and City Attorney John Buckley. Ald. Ford was absent. l Ald. Foldy moved to approve the minutes of the previous meeting held on May 13, 1975, rpd that they be placed on file. Seconded by Ald. Colbum, motion carried. Ald. Dumke presented the report of the Finance Committee meeting held on May 21, 1975, and moved that it be accepted and placed on file, Seconded by Ald. Foldy, motion carried. Ald. Dumke presented the report of the Public Works Committee of meeting held May 22, 1975, and moved that it be accepted and placed on file. Seconded by Ald. Colbum, motion carried. Ald. Knudsen presented the report of the Rules, Laws & Ordinance Committee a meeting held May 15, 1975, and moved that it be accepted and placed on file. Seconded by Ald. Colburn, motion carried. Ald. Colbum presented the report of the Public Safety Committee meeting held on 5/22/75 and moved that it be accepted and placed on file. Seconded by Ald. Wallner, motion carried. The minutes of the Plan Cormnission meeting held on May 20, 1975, were received and placed on file. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried advised the aldermen that he has met with the Chairman and Co-chairman (Mrs. Papke and Mr. Damaske) of the city's Bi-centennial Connnittee regarding their progress and material would be distributed to them shortly. Mayor Gottfried advised that the newly appointed Citizens Committee would @ be holding their organizational meeting on Tuesday, June 3, 1975, in the city hall. UNFINISHED BUSINESS Ordinance #301 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Section 3.10 of the Municipal Code (Re: Sewer Service Charges). Ald. Colbum moved for adoption, seconded by Ald. Foldy. Ald. Foldy moved to amend Section 1 of the ordinance by adding "Fountainwood Pool - 2 units per mo. ($24.00 per season)". Seconded by Ald. Knudsen. Upon a roll call vote the motion carried with Ald. Wallner casting a dissenting vote. The motion to amend Ordinance #301 carried. Ald. Colbum moved to further amend Ordinance i/301, Section 2, by adding the following to Section 3.10 (6): "Whenever a home or building becomes occupied or given an Occupancy Permit during the calendar year and is l therefore liable for sewer service charge on a pro rata basis, the sewer service charge for the pro rata share of the first year's occupancy shall be submitted to the owner or occupant. If not paid prior to November 1 of the year of occupancy, the same shall be placed on the real estate tax a bill as a special charge together with interest and the annual charge thereafter assessed. Notice of this ordinance shall be submitted with the invoice for the pro rata charge." Motion seconded by Ald. Schaumberg. Common Council Meeting May 27, 1975 - P. 2 Unfinished business - cont'd. i) Upon a roll call vote to further amend Ordinance #301 the motion carried with Aldermen Wallner and Knudsen voting "No". Upon a roll call vote to adopt Ordinance #301, As Amended, the motion carried with Ald. Wallner casting a dissenting vote. l Ordinance $1302 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend, Repeal and Recreate Certain Sections of Ch. 30 (Building Code) of the Municipal Code. Ald. Colbum moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried unanimously. Ordinance #303 - The Clerk read same, entitled, An Ordinance Establishing West Tower Drive Assessment District and Levying Special Assessments for Permanent Improvements Thereon (Second reading). Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon a roll call vote the motion carried with Aid. Wallner casting a dissenting vote. Resolution #131-75 - Approval of Preliminary Plat for Guernsey Meadows. (This resolution is on the floor and was referred to Public Works Committee for l review). Considerable discussion took place between the Mayor, several of the aldermen, Mr. Ray Gray, representing Rite Realty and Mr. Stephen Surridge, Attorney for the developer, regarding submission and final approval of proper drainage plans, ditches, road grades, etc. Upon a roll call vote the motion to adopt Resolution $1131-75 carried unanimously. NEW BUSINESS Resolution #132-75 - The Clerk read same, entitled, Approval of Subdivider's Agreement and Deed Restrictions for Guernsey Meadows. Ald. Schaumberg moved for adoption. Seconded by Ald. Foldy. Upon a roll call vote the motion carried unanimously. Resolution i/136-75 - The Clerk read same, entitled, Authorizing the Adver- tising of Bids for Public Works Improvements for Guernsey Meadows ("B" Bonds) Ald. Schaumberg.moved for adoption. Seconded by Ald. Foldy. Upon roll call the motion carried unanimously. Resolution $1137-75 - The Clerk read same, entitled, Approval of Installation of Holding Tank for Scott Krause (at the end of Groveway Lane on property of Muskego Lakes Country Club). Ald. Knudsen moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution #138-75 - The Clerk read same, entitled, Acceptance of Offer to Purchase Lot in Fountainwood Subdivision (Olenjik) (Lot 12 Blk. 16 Fountainwood) Ald. Foldy moved .for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Resolution #141-75 - The Clerk read same, entitled, Declaring City of Muskego's Intent Not to Participate in Waukesha County Library System Plan. Ald. Colbum moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. l Resolution j/139-75 - The Clerk read same, entitled, Acceptance of Offer to Purchase Lot in Fountainwood Subdivision (K. Wysocki - Lot 18 Block 26) Fountainwood Subdivision). Ald. Foldy moued for adoption, seconded by Schaumberg. Ald. Knudsen moved to amend Resolution i/139-75, 1st and 3rd e aragraph, by changing the lot and block to read "Lot 18 Block 26". Seconded y Ald. Foldy. Upon a roll call vote the motion to amend carried. Upon a roll call vote the motion to adopt Resolution $1139-75, As Amended, carried unanimously. Coaunon Council meeting May 27, 1975 - P. 3 New business - Cont'd. e Resolution 8140-75 - The Clerk read same, entitled, Directing the Attorney to Draft the Necessary Ordinance to Amend the Zoning District Map (I-I. Puetzer) Aid. Foldy moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. l Resolution j/142-75 - The Clerk read same, entitled, Approving Lease Agreement Between R. Schaumberg and City of Muskego Park & Recreation Board. Ald. Knudsen moved for adoption, seconded by Ald. Colburn. Upon roll call the motion carried unanimously. l Resolution #143-75 - The Clerk read same, entitled, Approving Lease Agree- ment Between City of Muskego and Alfred Badertscher. Ald. Knudsen moved for adoption, seconded by Ald. Colburn. Ald. Schaumberg moved to amend the agreement by adding the following: "Lessee shall by whatever means necessary (f ence, etc.) protect the stream and several large springs from damage by livestock". Seconded by Ald. Dumke. Upon a voice vote the motion carried. Ald. Foldy moved to further amend the agreement by re-wording the 1st para. under, Conditions, to read, "Any fences or other equipment used by the Lessee during the term of the lease or a renewal thereof shall at the option of the city be removed by him at the expiration thereof." Seconded by Ald. Colbum. Motion carried. Upon a roll call vote the motion to adopt Resolution j/143-75 carried unanimously. Resolution i/144-75 - The Clerk read same, entitled, Approval of Preliminary Plat for Heather Ridges Estates (Town of Vernon). Ald. Knudsen moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried unan- imously. Resolution #145-75 - The Clerk read same, entitled, Approval of Extractive Permit (Carl & Lydia Wauer). Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried with Aldermen Knudsen and Wallner voting "no". __/ Resolution 11146-75 - The Clerk read same, entitled, Resolution for Recreation Aids, Ald. Knudsen moved for adoption, seconded by Ald. l Schaumberg. Mayor Gottfried explained the aid request was to help off- set the purchase of the Schwefel property on Little Muskego Lake. Upon a roll call vote the motion carried unanimously. Resolution $1147-75 - The Clerk read same, entitled, Clarifying Resolution $1125-68 Regarding Pay to City Employees While at Military Summer Camp. Ald. Schaumberg moved for adoption, seconded by Ald. Knudsen, Upon roll call the motion carried unanimously. Resolution j/148-75 - The Clerk read same, entitled, Appointment of Citizens Members to Library Board (Joan Dibb and Loretta Steingraeber). Ald. Colburn moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution $1149-75 - The Clerk read same, entitled, Authorizing Release of e Cash Bond for Holding Tank (D. Chmiel). Ald. Schaumberg moved for adoption, seconded by Ald. Knudsen. Ald. Foldy moved to amend the resolution, 2nd and 4th paragraph, by deleting the words "to him"'. Seconded by Ald. Knudsen. Motion carried. Common Council May 27, 1975 P. 4 New business - cont'd. 0 Resolution f/150-75 - The Clerk read same, entitled, Resolution Urging Legislature Defeat of Conta Plan. Ald. Knudsen moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution #151-75 - The Clerk read same, entitled, Acceptance of Low Bid for l Sewer and Water in the Industrial Park. Ald. Knudsen moved for adoption, seconded by Ald. Schaumberg (low bid awarded to Reesman Excavating in the amount of $101,038.75). Upon roll call the motion carried unanimously. Resolution #152-75 - The Clerk read same, entitled, Establishing Traffic Regulations ("Stop" signs at the intersection of Kelsey and Muskego Dam Drives).Ald:nSchaunizerg moved for adoption, seconded by Ald. Wallnerr; ,Ald. Knudsen moved to refer this resolution back to the Public Safety Cornnittee for further study. Seconded by Ald. Wallner. Upon a roll call vote to defer action on this resolution and refer it back to Safety Committee the motion carried with Ald. Dumke casting a dissenting vote. Resolution 11153-75 - The Clerk read same, entitled, Establishing Positions l of Receptionist-Typist I and II. Ald. Schaumberg moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution i/154-75 - The Clerk read same, entitled, Appointment of Members to Board of Appeals (H. Smet, E. Ellery, R. Rutzen and D. Axtmann, 1st Alt.) Ald. Knudsen moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried unanimously. Resolution j/155-75 - The Clerk read same, entitled, Requesting that all Residents of the City of Muskego be Served by the Muskego Post Office. Ald. Foldy moved for adoption, seconded by Ald. Schaumberg. Upon roll call the motion carried unanimously. Resolution #156-75 - The Clerk read same, entitled, Directing the Attorney to Draft the Necessary Ordinance to Amend the Zoning District Map (Luedtke, Diekfuss and Schaefer Properties from RS-3 to RS-2). Ald. Colbum moved for adoption, seconded by Ald. Dumke. Upon a roll call vote to adopt, Aldermen Foldy, Knudsen, Schaumberg and Wallner voted "no". Aldermen Colbum 0 and Dumke voted "aye". The motion to adopt Resolution #156-75 did not carry. LICENSE APPROVAL - Ald. Colbum moved to approve an Operator's License for Mary Beth Ziegler, seconded by Ald. Foldy, motion carried. Ald. Foldy moved to approve an Operator's License for Joy Sands subject to favorable Fingerprint and Medical Report. Seconded by Ald. Wallner, motion carried. VOUCHER APPROVAL - Ald. Schaumberg moved for the approval of payment of general vouchers in the amount of $502,409.96. Seconded by Ald. Foldy, motion carried upon roll call. Ald. Schaumberg moved for the approval of payment of sewer utility vouchers in the amount of $8,560.68. Seconded by Ald. Dumke, motion carried upon roll call. COMMUNICATIONS AND MISCELLANEOUS BUSINESS 0 Ald. Foldy moved to reconsider Resolution $1142-75, entitled, Approving Lease Agreement Between R. Schaumberg and City of Muskego Park & Rec. Board. Sec- onded by Ald. Schaumberg. Upon roll call motion carried unanimously. Ald. l Foldy moved to amend the resolution by adding the following words to the agreement; last line of 1st para., under Conditions, "Any fences or other equipment used by the Lessee during the term of the lease or a renewal thereof shall at the option of the city be removed by him at the expiration thereof". Seconded by Ald. Schaumberg, motion carried. Upon a roll call vote the motion to adopt Resolution i/142-75, As Amended, carried unanimously. ADJOURNMENT - Ald.
