CITY OF MUSKEGO
MINUTES OF MEETING HELD SEPTEMBER 24, 1974
The meeting was called to order at 7~36 P.M. by Mayor Gottfried. Also
present were Aldermen Dumke, Colbum, Foldy, Ford, Knudsen, Schaumberg
and Wallner, City Clerk Bette Bowyer and City Attorney John Buckley.
Ald. Schaumberg moved for the approval of minutes of meeting held 9/10/74
and that they be placed on file. Seconded by Ald. Knudsen, motion carried.
Ald. Foldy presented the report of the Finance Committee meeting held on
g/19/74 and moved that it be accepted and placed on file. Seconded by Ald.
Dumke, motion carried. Ald. Schaumberg presented the brief report of the
Finance Committee meeting held on g/24/74 and moved that it be accepted and
placed on file. Seconded by Ald. Dumke, motion carried.
Ald. Dumke presented the report of the Public Works Committee meeting held
on g/19/74 and moved that it be accepted and placed on file. Seconded by
Ald. Schaumberg, motion carried.
Ald. Colbum presented the report of the Rules, Laws & Ordinance Committee
meeting held on g/12/74 and moved that it be accepted and placed on file.
Seconded by Ald. Wallner, motion carried.
Ald. Foldy presented the report of the Public Welfare Committee meeting
held on g/12/74 and moved that it be accepted and placed on file. Seconded
by Ald. Knudsen, motion carried.
The minutes of the Plan Commission meeting held on g/17/74 were received
and placed on file.
UNFINISHED BUSINESS

Resolution $1203-74 - Authorizing Advertising of City-owned Farm Land for
Rent. (This resolution was on the floor) Upon the advice of the industria
broker, Ald. Schaumberg moved to table Resolution i/203-74, seconded by Ald.
Knudsen. Upon roll call the motion carried unanimously.
Ordinance #288 - The Clerk gave the seconded reading of same, entitled, An
Ordinance to Repeal and to Amend Certain Provisionsof Ch. 17 of the Municipal
Code (Re: Duplexes). Ald. Foldy moved for adoption, seconded by Ald. Colbum.
Upon roll call the motion carried with Ald. Wallner casting a dissenting vote.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried advised that during the course of this evening's meeting
the Council would hold the organizational meeting of the Little Muskego
Lake Protection and Rehabilitation District.
NEW BUSINESS
Resolution f/216-74 - The Clerk read same, entitled, Authorizing Additional
Soil Tests for Industrial Park. Ald. Foldy moved for adoption, seconded
by Ald. Schaumberg. Mayor Gottfried advised that the boringswould take
place to the north and west of the presently platted area of the park. Upon
roll call the motion to adopt carried unanimously.
Resolution l/217-74 - The Clerk read same, entitled, Acceptance of Offer to
Purchase Parcel of Land in Industrial Park ( M. F. Burazin Corp.) Ald.
Foldy moved for adoption, seconded by Ald. Knudsen. Upon roll call the
motion carried unanimously.

Ald. Schaumberg moved for adoption, seconded by Aid. Dumke. UpOn roll
call the motion carried unanimously.
l Resolution $1219-74 - The Clerk read same, entitled, Authorizing Placement of "SLOW-NO WAKE" Buoys in Little Muskego Lake. Ald. Ford moved for adoption, seconded by Ald. Colbum. Upon roll call the motion carried
unanimously.
Resolution i/220-74 - The Clerk read same, entitled, Authorizing Ruekert & Mielke to Advertise for Bids for Sewer Installation in S.T.H. 24 West of
Racine Avenue. Ald. Dumke moved for adoption, seconded by Ald. Schaumberg. Upon roll call the motion carried unanimously.
Resolution $1221-74 - The Clerk read same, entitled, A Resolution Relating
to Final Determination of Special Assessments (NW District - I-9). Ald.
Foldy moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously.
l Resolution $1222-74 - The Clerk read same, entitled, Resolution Levying
Special Assessments (NW Dist I-9)(The I-9 District being on S.T.H. 24
west of Racine Ave.) Ald. Colbum moved for adoption, seconded by Ald.
Wallner. Upon roll call the motion carried unanimously.
Resolution j/223-74 - The Clerk read same, entitled, Resolution Directing
Notice of Final Determination (NW Dist. I-9). Ald. Schaumberg moved for
adoption, seconded by Ald. Foldy. Upon roll call the motion carried
unanimously.
Resolution i/224-74 - The Clerk read same, entitled, Authorizing Purchase
of Lassa Lot. Aid.-Foldy moved for adoption, seconded by Ald. Wallner.
Upon roll call the motion carried unanimously.
Resolution i/225-74 - The Clerk read same, entitled, Authorizing Street
Name Change of Hi-Y Drive, East of Racine Avenue, to "Maple Ct." Ald.
Ford moved for adoption, seconded by Ald. Knudsen. Upon roll call the
motion carried unanimously.
Resolution j/226-74 - The Clerk read same, entitled, Authorizing Street
Name Change of Tower Drive to Westwood Drive. Ald. Ford moved for
adoption, seconded by Ald. Knudsen. Following discussion, Ald. Schaumberg
moved to amend this resolution by adding the following "BE IT FURTHER
RESOLVED that the effective date of this resolution shall be June 1, 1975."
Seconded by Ald. Ford. Upon a voice vote the motion to amend carried.
Upon a roll call vote to adopt Resolution i/226-74, As Amended, the motion
carried with Ald. Wallner casting a dissenting vote.
Resolution #227-74 - The Clerk read same, entitled, Dedicating Gemini Ct.
as a Public Highway. Ald. Schaumberg moved for adoption, seconded by
Aid. Dumke. Upon roll call the motion carried unanimously.
Resolution #228-74 - The Clerk read same, entitled, Directing the City
Attorney and City Clerk to Make Provisions for a Referendum Regarding
Industrial Bonds. Ald. Schaumberg moved for adoption, seconded by Ald.
Dumke. Aid. Colbum moved to amend the resolution by adding the following
to the proposed referendum question "at no cost to the citizens of Muskego."
Seconded by Ald. Dumke. Upon a roll call vote to amend Resolution j/228-74
Aldermen Colbum, Dumke, Foldy, Schaumberg and Wallner voted "aye". Alder-
men Ford and Knudsen voted "no". The motion to amend Resolution j/228-74
carried. Discussion took place with Aldermen Ford and Knudsen speaking as
being opposed to the referendum question as contained in the resolution. "f;tiozdsen moved to.amend the resolution by having the question leas as : "Shall the City of Muskego use industrial revenue bonds?" Seconded
by Ald. Ford. Following further discussion, Ald. Ford moved to defer action

on Resolution #228 until such time that more acceptable wording could be
worked out. Seconded by Ald. Knudsen. Upon a roll call vote to defer
Aldermen Colburn, Dumke, Foldy, Ford and Schaumberg voted "no". Aldermen
a- Knudsen and Wallner voted "aye". The motion to defer did not carry.
During further discussion, in answer to a question from Ald. Wallner,
City Attorney Buckley advised that it was his opinion that the referendum

question was in proper order. Upon roll call on Ald. Knudsen's amendment,
Aldermen Colburn, Dumke, Foldy and Schaumberg voted "no". Aldermen Ford,
Knudsen and Wallner voted "'aye". The motion did not carry. Upon roll call
to adopt Res. $1228-74. As Amended, Ald. Colburn, Dumke, Foldy, Schaumberg
and Wallner voted "aye". Ald. Knudsen and Ford voted "no". The motion
carried.
&esolution #229-74 - The Clerk read same, entitled, Authorizing Transfer of
Funds. Ald. Dumke moved for adoption, seconded by Ald. Schaumberg. Upon
roll call the motion to adopt carried unanimously.
Resolution #230-74 - The Clerk read same, entitled, Authorizing Transfer
of Funds. ($40,000.00) Ald. Knudsen moved for adoption, seconded by
Ald. Colburn. Mayor Gottfried advised that transfer was necessary because
of tremendous increase in cost of road oil and asphalt, etc. Upon roll
l call the motion to adopt carried unanimously.
Resolution i/231-74 - The Clerk read same, entitled, Accepting Tower Drive
as a Public Right-of-Way. Ald. Schaumberg moved for adoption, seconded
by Aid. Dumke. Following a short discussion, upon a roll call vote the
motion to adopt Resolution #231-74 carried with Ald. Wallner casting the only
dissenting vote.
Resolution j/232-74 - The Clerk read same, entitled, Authorizing the City to
Lend Funds Temporarily to Little Muskego Lake Protection and Rehabilitation
District. Ald. Ford moved for adoption, seconded by Ald. Dumke. Upon roll
call vote the motion carried unanimously.
Resolution #233-74 - Acceptance of Low Bid for Park Site Development
(Schmidt Park and Idle Isle) (A. T. Forseth Co.) Ald. Ford moved to
suspend.,the rules in order that this resolution could be acted upon at
this meeting. Seconded by Ald. Knudsen. Upon roll call vote the motion
carried unanimously. The Clerk read the resolution. Ald. Ford moved
for adoption, seconded by Ald. Knudsen. Upon a roll call vote the
l motion to adopt Resolution i/233-74 carried unanimously.
Ordinance #289 - The Clerk gave the first reading of same, entitled,
An Ordinance to Amend Section 12.01 (5) (c) of the Municipal Code of
the City of Muskego (Re: Raising of Class "B" Fermented Malt Beverage
Licenses from 38 to 39).
VOUCHER APPROVAL - Ald. Schaumberg moved to approve payment of the
general vouchers in the amount of $256,837.38 payable g/24/74. Seconded
by Ald. Foldy. Upon roll call the motion carried unanimously.

Ald. Schaumberg moved to pay sewer vouchers in the amount of $57,745.32,
payable 9124174. Seconded by Ald. Ford. Upon roll call the motion
carried unanimously.

LICENSE APPROVAL - Ald. Foldy moved for the approval of a Dump Refuse
Hauling Permit for S. Zizzo (1 truck). Seconded by Ald. Schaumberg,
motion carried.
Ald. Schaumberg moved for the approval of Operators Licenses for Karen
Anderson and Sandra Falkowski. Seconded by Ald. Foldy, motion carried.
Ald. Schaumberg moved for the approval of Operators License for Gary
Grievall subject to receipt of favorable Medical Report. Seconded by
Ald. Foldy, motion carried.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
The Clerk read a communication from V. F. Demshar, Waukesha County
Highway Commissioner, advising of a public information meeting regarding
the proposed 1990 Master Highway Plan to be held at the County Exposition
Building on Tuesday, October 15, 1974 at 7:30 P.M. Communication placed
on file.
The Clerk read a claim from Steve Kotschi, College Ave., dated g/12/74
against the city regarding an auto accident on Richdorf Dr. Same referred
to insurance carrier and City Attorney.
The Clerk acknowledged receipt of a petition containing 41 signatures
dated g/13/74, opposing the city issuing industrial revenue bonds for
Muskego Rendering Co. Same placed on file.
ADJOURNMENI - Ald. Ford moved to adjourn, seconded by Ald. Knudsen.
Motion carried. The meeting adjourned at 10:00 P.M.
