ccm19740910COMMON COUNCIL CITY OFMUSKEGO MINUTES OF MEETING HELD SEPTEMBER 10, 1974 The meeting was called to order at 7:44 P.M. by Mayor Gottfried. Also present were Aldermen Dumke, Colburn, Foldy, Ford, Knudsen, Schaumberg and Wallner, Deputy Clerk June Elger and City Attorney John Buckley. Ald. Schaumberg moved for the approval of minutes of meeting held 8/27/74 and that they be placed on file. Seconded by Ald. Dumke, motion carried. Ald. Foldy presented the report of the Finance Committee meeting held g/4/74 and moved that it be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. Ald. Dumke presented the report of the Public Works Committee meeting held on g/5/74 and moved that it be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. Ald. Colbum presented the report of the Rules, Laws & Ordinance Committee meeting held on 8/29/74 and moved that it be accepted and placed on file. Seconded by Ald. Knudsen, motion carried. Ald. Foldy presented the report of the Public Welfare Committee meeting held on B/29/74 and moved that it be accepted and placed on file. Seconded by Ald. Knudsen, motion carried. Ald. Colburn presented the report of the Public Sewer Committee meeting held on g/5/74 and moved that it be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. The minutes of the Plan Cammission meeting held g/3/74 were received and placed on file. UNFINISHED BUSINESS Resolution #178-74 - Approval of Highway Systems Map (This resolution is on the floor and had been referred to Plan Commission.) Ald. Ford moved to amend the resolution by adding the following paragraph: "BE IT RESOLVED that this approval is subject to Sunny Slope Road terminating at S.T.H. 24". Seconded by Ald. Foldy. Upon roll call the motion carried unanimously. Upon roll call to adopt Resolution #178-74, As Amended, motion carried unanimously. Resolution $1174-74 - Establishing Little Muskego Lake Protection and Rehab- ilitation District (This resolution was on the floor from the previous meeting). Ald. Ford moved to amend same as follows: By adding (g) in Section 2 (g) Aquatic plant harvesting. In Section 3, 2nd line, by removing the words "all of" and in Section 6 (3) by deleting (a) Elect one or more commissioners to fill vacancies in the district board. Therefore (b) would become (a), etc. Motion was seconded‘by Ald. Schaumberg. Upon a voice vote the motion to amend carried. Upon a roll call vote the motion to adopt Resolution j/174-74, As Amended, carried with Ald. Wallner casting a dissenting vote. Resolution #190-74 - Directing City Attorney to Draft the Necessary Implementing Ordinance to Raise Quota for Class "B" Fermented Malt Beverage License from 38 to 39 (This resolution is on the floor) Following dis- cussion, Ald. Knudsen moved to defer action on Resolution #190-74 for ~ two weeks. Motion seconded by Ald. Schaumberg. Upon a roll call vote to defer, Aldermen Ford, Knudsen and Wallner voted "aye"/ Aldermen Colbum, Dumke, Foldy and Schaumberg voted "no". The motion to defer did not carry. Upon a roll call vote to adopt Resolution #190-74, Aldermen Colbum, Foldy, Ford and Knudsen voted "aye". Aldermen Dumke, Schaumberg and Wallnaer voted "no". The motion to adopt carried. Common Council 9/10/74 - P. 2 Unfinished business - Cont'd. Ordinance #287 - The Deputy Clerk gave the second reading of same, entitled, An Ordinance to Amend Ch. 30 of the Municipal Code (Re: Amendments to the l Building Code) Ald. Foldy moved for adoption, seconded by Ald. Colburn. Upon roll call the motion to adopt carried unanimously. * COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried advised that the Muskego Jaycees will be sponsoring a Halloween Spook Night on October 27th and he urged the aldermen to discuss with people in their area as to whether or not Halloween should be cele- brated any other time than that. Mayor Gottfried reviewed to the aldermen the latest activities of the Industrial Coordinating Committee. Mayor Gottfried read a communication from City Clerk Bowyer relative to the recent petition filed with the city requesting a referendum on the issuance of Industrial Revenue Bonds for Muskego Rendering Co. NEW BUSINESS l Resolution #2OO-74 - The Deputy Clerk read same, entitled, Authorizing Installation of Street Light (Intersection of Muskego Dr. and Hardtke Dr.) Ald. Ford moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion carried unanimously. Resolution #201-74 - The Deputy Clerk read same, entitled, Establishing Traffic Regulations (35 mph on Tess Corners Dr. from Sherwood Circle to east city limits). Ald. Ford moved for adoption, seconded by Ald. Knudsen. Upon a voice vote the motion carried. Resolution f/203-74 - The Deputy Clerk read same, entitled, Authorizing Advertising of City-owned Farm Land for Rent (Industrial Park area). Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Ald. Knudsen moved to defer action on the resolution until soil boring tests are received from the industrial park. Seconded by Ald. Foldy. Upon a voice vote the motion carried. Resolution j/204-74 - The Deputy Clerk read same, entitled, Establishing l Salaries for Police Chief and Lieutenants. Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unan- imously. Resolution f/205-74 - The Deputy Clerk read same, entitled, Approval of Agreement Between City of New Berlin and City of Muskego for Installation of Sewers in Linnie Lac Area. Ald. Dumke moved for adoption, seconded by Ald. Ford. Upon roll call the motion carried unanimously. Resolution #206-74 - The Deputy Clerk read same, entitled, Termination of Conditional Use Grant $143 (Texaco Station on Janesville Road). Ald. Ford 0 moved for adoption, seconded by Ald. Schaumberg. Upon roll call the motion carried unanimously. Resolution j/207-74 - The Deputy Clerk read same, entitled, Setting Public Hearing Date for Kristin Downs (10-22-74 7:00 P.M.). Ald. Foldy moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion to adopt carried unanimously. Common Council 9/m/74 - P. 3 New Business - Cont'd. Resolution i/208-74 - The Deputy Clerk read same, entitled, Approval of c Certified Survey Map (John and Margaret Paul). Ald. Ford moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Resolution $1209-74 - The Deputy Clerk read same, entitled, Directing City Attorney to Draft the Implementing Ordinance to Rezone Property in Section 16 from B2 to RS2 (Muskego Industrial Park, Inc.) Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Considerable discussion took place with Mayor Gottfried reviewing the history of the various zoning proposals and the reasons why the Plan Commission made the reconmendation for the rezoning. Ald. Foldy requested permission for Ald. Wallner to be heard and as there were no objections Ald. Wallner relinquished his chair as an aHerman in order that he could discuss the matter. Upon a roll call vote to adopt Resolution #209-74, Aldermen Colbum, Dumke, Foldy, Ford, Knudsen and Schaumberg voted "no". Ald. Wallner abstained from the voting. The motion to adopt the resolution did not carry. In accord- ance with Chapter 17 of the Muskego Zoning Ordinance (Sec. 3.06(2)F 3) ' Resolution $1209-74 was referred back to the Plan Commission for recon- _I sideration. Resolution $1210-74 - The Deputy Clerk read same, entitled, Directing City Attorney to Draft the Implementing Ordinance to Rezone Property in Sec. 4 (B2 to RS2 - Triangle bounded by Martin Dr. and College Ave,) Ald. Schaum- berg moved for adoption, seconded by Ald. Ford. Ald. Knudsen spoke in opposition to this resolution and upon a roll call vote to adopt same, Aldermen Colbum, Foldy, Knudsen and Wallner voted "no". Aldermen Dumke, Ford and Schaumberg voted "aye". The motion to adopt did not carry, therefore, in accordance with Sec. 3.06 (2) F. 3 of the Muskego Zoning Ordinance this resolution was referred back to Plan Commission for re- consideration. Resolution #211-74 - The Deputy Clerk read same, entitled, Authorizing Finance Committee to Initiate Procedures for Borrowing Monies for Additional Sewer Work. Ald. Dumke moved for adoption, seconded by Ald. Colbum. Upon roll call the motion carried unanimously. Resolution $1212-74 - The Deputy Clerk read same, entitled, Resolution to Incorporate Sewer Usage Charge Into Real Estate Tax Bill. Ald. Dumke moved for adoption, seconded by Ald. Schaumberg. Several of the aldermen reported that the majority of the people who had contacted them were in accordance with this resolution, Upon a roll call vote the motion to adopt this resolution carried unanimously. Drdinance7#288 - The Deputy Clerk gave the first reading.of same, en,titled, ,An,Ordinance to ,Repeati and to %mend.Certain Provisions of Ch. 17.(Zpning Ordinance) of the Municipal Code (Re: Duplexes) Resolution 11213-74 - Ald. Knudsen moved to suspend the rnles. that would interfere with the adoption of this resolution, entitled, Resolution to Change the Name of Hi-Y Drive From Racine Avenue to Tomar Lane to Williams Drive. The Deputy Clerk read the resolution. Aid.-Knudsen moved for adoption, seconded by Ald. Ford. Upon a voice vote the motion carried. ~_ Resolution f/214-74 - Authorizing the Hiring of Roger Walsh as Labor Contract Negotiator for the City. Ald. Foldy moved to suspend the rules that wou!. interfere with the adoption of same, seconded by Ald. Knudsen. Upon roll call the motion carried unanimously. The Deputy Clerk read the resolution. Aid; Schaumberg moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion to adopt carried unanimously. Common Council 9/10/74 - P. 4 New Business - Cont'd. Resolution #215-74 - Waiving of Direct Notice for Rezoning (Removal of Wetland Floodplain in Certain Areas) - Muskego Business/Industrial Park, Lincolnshire Subdivision and Parkland Plaza. Ald. Foldy moved to suspend the rules that would interfere with the adoption of this resolution. Seconded by Ald. Schaumberg. Upon roll call the motion to suspend carried unanimously. The Deputy Clerk read the resolution. Ald. Schaumberg moved for adoption. Seconded by Ald. Colbum. Upon roll call the motion carried with Ald~. Knudsen casting a dissenting vote. LICENSE APPROVAL Ald. Schaumberg moved for the approval of Operators License for Mildred Olson and Gerald Meyer. Seconded by Ald. Foldy, motion carried. Ald. Schaumberg moved for the approval of Operators License for Vincent Gireffre subject to the receipt of favorable fingerprint report. Seconded by Ald. Foldy, motion carried. Ald. Foldy moved for the approval of a "Gathering" Permit for Terry Buss for 9115174. Seconded by Ald. Knudsen, motion carried. Ald. Schaumberg moved for the approval of a permit to hold an auction for Bernard Lindner on 1016174. Seconded by Ald. Dumke, motion carried. VOUCHER APPROVAL Ald. Foldy moved for the approval of sewer vouchers in the amount of $39,744.48. Seconded by Ald. Schaumberg, motion carried unanimously upon roll call. CITY OFEICIAL!S.REPORTS _ __~_. -_ -.The-Deput~y Clerk gave the Building Report for August, 1974, indicating 15 single dwelling units and total construction in the amount of $482,165.00 for that month. Report placed on file. ' COMMUNICATIONS AND MISCELLAN'EOUS BUSINESS - City Attorney Buckley reported that the problem of the water-filled excavated basement in Parkland Subdivision has now been rectified.
