MINUTES OF MEETING HELD AUGUST 13, 1974
The meeting was called to order at 8:32 P.M. by Mayor Gottfried. Also
a
present were Aldermen Dumke, Colbum, Foldy, Knudsen, Schaumberg, Ford
and Wallner, City Clerk Bowyer and City Attorney Buckley.
Ald. Schaumberg moved for the approval of minutes of meeting held 7123174
l and moved that they be accepted and placed on file. Second~ed by Ald. Dumke,
motion carried.
Ald. Schaumberg presented the reports of the Finance Committee meetings held
817174 and. 8113174 and moved that the reports be accepted, and, placed on
file. Seconded by Ald. Ford, motion carried.
Ald. Dumke presented the reports of the Public Works Committee meeting held
on 7118174 and moved that it be accepted and placed on file. Seconded by
Ald. Wallner, motion carried.
Ald. Colbum presented the report of the Rules, Laws & Ordinance Committee
meeting held 7125174 and moved that it be accepted and placed on file.
Seconded by Ald. Foldy, motion carried.
0 Ald. Foldy presented the report of the Public Welfare Committee meeting held
on 7125174 and moved that it be accepted and placed on file. Seconded by
Ald. Wallner, motion carried.
Ald. Schaumberg presented the report of the Public 'Sewer Committee meeting
held 7131174 and moved that it be accepted and placed on file. Seconded by
Ald. Colburn, motion carried.
The minutes of the Plan Commission meeting held 816174 were received and f
placed on file.
UNFINISHED BUSINESS
Resolution j/136-74 - Re-naming Bedford Dr. to Bristlecone Lane. Ald. Ford,
Chairman of the Safety Committee, spoke in favor of the proposed street name
change in spite of the fact that all of the residents had appeared at their
meeting in opposition of the name change. Upon a roll call vote the motion
to adopt Resolution #136 carried unanimously.
0 Resolution $1151-74 - Authorizing Industrial Development Revenue Bond Issue
(Interstate Tool & Engineering Co.) At the request of the aldermen at their
last meeting Mr. Otto H. Wirth, President of the Cudahy Marine Bank, appeared
to explain that his bank will make financing available to Interstate Tool &
Engineering Co. Upon a roll call vote the motion to adopt Resolution j/151-74
carried with Ald. Wallner casting a dissenting vote.
Resolution j/157-74 r$ - Creating Position of Additio Patrolman. This resolu-
tion was on the floor and upon a roll call vote the motion to adopt carried
unanimously.
l Ordinance i/279 - The Clerk gave the second reading of same, entitled,
An Ordinance to Amend Ordinance #118 Providing for the Issuance and Sale
of $320,000.00 Sewerage System Mortgage Revenue Bonds. Ald. Schaumberg
moved for adoption, seconded by Ald. Foldy. Upon roll call the motion
carried unanimously.

Ordinance #280 - The Clerk gave the second reading of same, entitled,
An Ordinance to Amends Ordinance #260 Providing for Issuance and Sale of
$915,000 Sewerage Mortgage Revenue Bonds. Ald. Foldy moved for adoption,
Seconded by Ald. Schaumberg. Upon roll call the motion carried unanimously.

Ordinance $1281 - The Clerk gave the second reading of same, entitled,
An Ordinance to Amend Ch. 7 of the Municipal Code (Re: Traffic Code)
Ald. Foldy moved for adoption, seconded by Ald. Colbum. Upon roll call
the motion carried unanimously.
Ordinance #282 - The Clerk gave the second reading of same, entitled,
An Ordinance to Amend Sec. 12.01(5)(C) of the Municipal Code (Re: Removing
quota for Class "Bn Fermented~ Malt Beverage Licenses). Ald. Foldy moved
for adoption, seconded by Ald. Knudsen. Discussion followed with Aldermen
Schaumberg, Dumke and Colbum speaking as being opposed to the lifting of
the quota. Aldermen Foldy and Knudsen spoke in favor of the ordinance.
Upon a roll call vote, Aldermen Colbum, Dumke, Ford, Schaumberg and
Wallner voted "no". Aldermen Foldy and Knudsen voted "aye". The motion
to adopt Ordinance #282 did not carry.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried advised that aldermen will be notified of any changes in
time and dates of committee meetings.
Mayor Gottfried urged the aldermen to view the progress being made by Fine
Arts, Inc. regarding painting, etc. of old city hall.
Mayor Gottfried requested that any corrections in committee minutes be
made at committee meetings and not at the Council table.
NEW BUSINESS
Resolution #160-74 - The Clerk read same entitled, Urging Construction of
Shadow Passing Lane on Certain Area of Highway "24". Ald. Ford moved for
adoption, seconded by Ald. Knudsen. Upon roll call the motion carried
unanimously.
Resolution i/161-74 - The Clerk read same, entitled, Denial of Grievance
Filed by Police Dispatchers. Aid. Schaumberg moved for adoption, seconded
by Ald. Dumke. Ald. Schaumberg moved to table Resolution j/161-74. Seconded
by Ald. Dumke. Upon a roll call vote to table,the motion carried unanimously.
Resolution l/162-74 - The Clerk read same, entitled, Requesting 30-Inch Bicycle
Lane on Highway 24 and "Y". Ald. Ford moved for adoption, seconded by Ald.
Rnud,sen. Upon roll call the motion carried unanimously.
Resolution j/163-74 - The Clerk read same, entitled, Authorizing Installation
of Street Light (Intersection of Gold and School Drives). Ald. Ford moved
for adoption, seconded by Ald. Knudsen. Upon a roll call vote, Aldermen
Colburn, Dumke, Ford, Knudsen and Wallner voted "aye". Aldermen Foldy and
Schaumberg voted. "no". The motion to adopt carried.
Resolution j/164-74 - The Clerk read same, entitled, Affidavit of Correction
(The Ridges). Ald. Knudsen moved for adoption, seconded by Ald. Wallner.
Upon a voice vote the motion carried.
Resolution j/165-74 - The Clerk read same, entitled, Waiving of Permit Fees
for Tess Corners Fire Dept. Sub-station. Ald. Foldy moved for adoption,
seconded by Ald~. Colbum. Motion carried.
Resolution j/166-74 - Clerk read same, entitled, Authorizing the Monitoring
of Sewer System by Ruekert & Mielke. Ald. Dumke moved for adoption, seconded~
by Ald. Colbum. Upon roll call the motion carried unanimously.

Resolution $1167-74 - The Clerk read same, entitled, Approving an Amendment
to Subdivision Agreement with Hale Park Meadows. Ald. Dumke moved for
a
adoption, seconded by Ald. Schaumberg. Ald. Wallner moved to defer
action on Resolution i/167-74, second.ed, by Aid,. Schaumberg. Considerable
discussion took place between several of the aldermen and the Mayor and
Ald. Foldy requested permission for Attorney Stephan Surridge to speak. l As there were no objections, Attorney Surridge spoke in behalf of Rite
Realty Co. to explain their position. Upon a roll call vote on the motion
to defer, Aldermen Foldy, Ford, Knudsen, Schaumberg and Wallner voted "aye".
Aldermen Colbum and Dumke voted "no". The motion to defer action on Res-
olution i/167-74 until the next meeting carried.
Resolution #168-74 - The Clerk read same, entitled, Authorizing Expenditure
of Funds for Letter to Residents of Sewer Utility Districts. Ald. Dumke
moved for adoption, seconded by Ald. Schaumberg. Upon roll call the motion
carried unanimously.
Resolution j/169-74 - The Clerk read same, entitled, Approval of Legal Lot
Status for Les Sorenson. Ald. Ford moved for adoption, seconded by Ald.
Colbum. Upon roll call the motion carried~ unanimously.
l Resolution i/170-74- The Clerk read same, entitled, Approval of Certified
Survey Map for Harold~ DeBack. Ald. Ford moved for adoption, seconded by
Ald. Wallner. Upon a voice vote the motion carried.
Resolution i/171-74 - The Clerk read same, entitled, Initiating Petition to
Amend Zoning District Map (Removing Wetland-Floodplain in Selected Areas)
Ald. Schaumberg moved for adoption, seconded ,by' Ald. Dumke. Upon a
roll call vote, Aldermen Colbum, Dumke, Foldy and Schaumberg voted "aye".
Aldermen Ford, Knudsen and, Wallner voted "no". The motion to adopt carried.
Resolution i/172-74 - The Clerk read same, entitled, Granting Additional 60
Days for Connection to Sewer System ("G" and "H" Districts). Ald. Dumke
moved for adoppion, seconded by Ald. Schaumberg. Upon a voice vote the
motion carried. (Deadline date for connection now 60 days from this date)
Resolution #173-74 - The Clerk read same, entitled, Approval of Certified
Survey Map (Hilda Zache) Ald. Ford moved for adoption, seconded by Ald.
Schaumberg. Upon a voice vote the motion carried.
l Resolution $1175-74 - The Clerk read same, entitled, Establishing Salary
for Public Works Foreman. Ald. Schaumberg moved for adoption, seconded by
Ald. Wallner (Salary to be $5.41 Per Hr.) Upon roll call the motion carried
unanimously.
Resolution 8176-74 - The Clerk read same, entitled, Approval of Holding
Tank for William Ritzman. Ald. Knudsen moved for adoption, seconded by
Ald. Dumke. Ald. Knudsen moved to defer action on the resolution for two
weeks. Seconded by Ald. Ford. Upon a voice vote the motion to defer carried.
Resolution $1177-74 - The Clerk read, same, entitled, Granting of Variance for

Resolution i/179-74 - The Clerk read same, entitled, Acceptance of Offer
for Fountainwood Lot from William Schultz. Ald. Schaumberg moved for a@ adoption, seconded by Ald. Dumke. Upon roll call the motion carried unan-
imously.
Resolution i/180-74 - Establishing Salary for Jean Sanders (Clerical Work
* - for Assessor:parttime) Ald. Schaumberg moved for adoption, seconded by
Ald~. Dumke. Upon roll call the motion carried unanimously.
Resolution i/181-74 - The Clerk read same, entitled, Modifying the
Application of Louis Rozman to Rezone Certain Parcel of Land in Sec. 10.
(Introduced by Ald. Wallner) Ald. Wallner moved for adoption, seconded
by Ald. Schaumberg. At this time the Clerk acknowledged receipt of a
petition signed by persons representing 20% of the property abutting the
land proposed to be rezoned. She also read a letter from Sam N. Lawent,
directed to the Common Council, dated 8/l/74, in opposition to the pro-
posed rezoning. Following a short discussion, upon a roll call vote to
adopt Resolution i/181-74, Aldermen Dumke, Foldy, Knudsen, Schaumberg and
Wallner voted "aye". Aldermen Colburn and Ford voted "no". The motion
to adopt carried.
l Resolution 11182-74 - The Clerk read same, entitled, Urging Consideration
for Traffic Control in Vicinity of "00" and Highway "36". (Introduced
by Ald. Dumke) Ald. Dumke moved for adoption, seconded by Ald. Knudsen.
Upon a voice vote the motion carried.
Resolution #184-74 - The Clerk read same, entitled, Authorizing Offer to
Purchase Lassa Property. Ald. Knudsen moved for adoption, second,ed by
Ald. Schaumberg. A discussion regarding the offer took place and Ald.
Ford moved to amend the resolution by changing the$lO,OOO.OO offer to
$9,000.00. Seconded by Ald. Schaumberg. Following further discussion,
Ald. Knudsen moved to defer action on this resolution until the next
meeting. Seconded by Ald. Wallner. Upon a voice vote the motion carried.
Ordinance #283 - The Clerk gave the first reading of same, entitled, An
Ordinance to Amend the Zoning Ordinance of the City of Muskego (Re: Solar
Heating Systems). Ald. Schaumberg moved to suspend,~the rules in order that
the this ordinance could be acted upon at this meeting. Seconded by‘Ald.

Disposal, Waste Management of Wisconsin, United Waste System, Best
Disposal and Town and Country Disposal Co. Seconded by Ald. Schaumberg,
motion carried.
Ald. Foldy moved for the approval of "Gathering" Permit for Icetronauts
for October 6th, for VFW Post #8171 (Country Fair Days) August 23, 24
and 25th and for St. Leonard's Holy Name Society for August 18, 1974.
Seconded by Ald. Knudsen, motion carried.
VOUCHER APPROVAL
Ald. Schaumberg moved for the approval of payment of voucher in the amount
of $27,436.03 to Garsky Construction for Center Dr. storm sewer. Second,ed,
by Ald. Dumke, motion carried.
CITY OFFICIAL'S REPORTS
The Clerk gave the Building Report for the month of July, 1974, indicating
17 dwelling units and total construction in the amount of $574,450.00 for
the month. Report placed on file.

Ald. Wallner moved to adjourn, seconded by Ald. Schaumberg, motion
carried. The meeting adjourned at 11:25 P.M.
