ccm197406110 e 0 a I) COMMON COUNCIL CITY OF MUSKEG0 MINUTES OF MEETING HELD JUNE 11, 1974 The meeting was called to order at 8:O P.M. by Mayor Gottfried. PRESENT - Mayor Jerome Gottfried, Aldermen Dumke, Foldy, Ford, Knudsen, Schaumberg and Wallner, City Clerk Bette Bowyer and City Attorney Buckley. APPROVAL OF MINUTES - Ald. Schaumberg moved for the approval of minutes of meeting held on 5/28/74, as mailed. Seconded by Ald. Dumke, motion carried. COMMITTEE REPORTS Ald. Schaumberg presented the report of the Finance Committee meeting held on June 5, 1974, and moved that it be accepted and placed on file. by Ald. Foldy, motion carried. Ald. Dumke presented the report of the Public Works Committee meeting held on 5130174 and moved that it be accepted and placed on file. Ald. Wallner, motion carried. Ald. Foldy presented the report of the Public Works Committee meeting held on 6/6/74 and moved that it be accepted and placed on file. by Ald. Wallner, motion carried. Ald. Schaumberg presented the report of the Public Sewer Committee meeting held on 5120174 and moved that it be accepted and placed on file. by Ald. Dumke, motion carried. The minutes of the Plan Commission meeting held 6/4/74 were received and placed on file. At this time Ald. Foldy moved to suspend the rules in order that Resolution 1,115-74, entitled, Honoring Muskego's AFS Student - Henri Mertens, could be acted upon. Seconded by Ald. Knudsen. Upon a roll call vote the motion to suspend the rules carried unanimously. The Clerk read the resolution. Ald. Foldy moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion to adopt carried unanimously. Mayor Gottfried then presented Henri Mertens with a signed copy of Resolution 1/115-74 and Mr. Mertens gave a brief statement regarding his stay with the Schweitzer family in Muskego. Seconded Seconded by Seconded Seconded UNFINISHED BUSINESS Resolution 1/41-74 - The Clerk read same, entitled, Authorizing Ruekert & Mielke to Develop a Drainage Plan for a Portion of the City. This resolution was on the floor and upon a roll call vote the motion to adopt carried unanimously. Resolution #98-74 - Acceptance of Low Bid for Reconstruction of a Portion of Kelsey Drive (Don DeBack). As this resolution was on the floor upon a roll call vote the motion to adopt carried unanimously. Resolution 1/99-74 - Approval of Solid Non-combustible Landfill Permit (Norm Thomas). This resolution is on the floor and was referred back to Welfare Committee for further review. A lengthy discussion took place between several of the aldermen and the Mayor and Ald. Knudsen urged his fellow aldermen to once again defer action for two weeks. He therefore moved to again defer action for two weeks and his motion was seconded by Ald. Wallner. Upon a roll call vote on the motion to defer the motion carried with Ald. Schaumberg casting a dissenting vote. Common Council 6/11/74 - P. 2 Unfinished Business - Cont'd. i .. Ordinance #277 - An ordinance Creating Ch. 26 of the Municipal Code to Regulate Conduct in Public Places. same. Ald. Foldy moved for adoption, seconded by Ald. Wallner. Ald. Foldy moved to amend Ordinance #277, Section (10) Behavior (1) Intoxicating Beverages (a) Prohibition, as follows: "No alcoholic beverage other than the fermented malt beverages through a permit granted by the Common Council shall be used by any person within the park". Upon a voice vote the motion to amend carried. Upon a roll call vote the motion to adopt Ordinance #277, As Amended, carried unanimously. Resolution #104-74 - Authorizing Lease Agreement Between Xerox and City of Muskego. Ald. Schaumberg moved for the reconsideration of same. Seconded by Ald. Dumke. Upon a voice vote the motion carried. Ald. Foldy moved to amend Resolution #104-74 by changing the word Xerox to IBM wherever contained in the resolution, b removing the number 2400 from the second last line and by changing the amount contained in the last line of the resolution to $168.00. Motion seconded by Ald. Schaumberg. The motion to amend carried. Upon a roll call vote the motion to adopt Resolution #104-74, As Amended, carried unanimously. The Clerk gave the second reading of Seconded by Ald. Wallner. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried advised that the new brochure to be used for the promotion of the Muskego IndustrialfBusiness Park will soon be ready for review by the aldermen and that approximately seven parcels of land have been sold. Mayor Gottfried advised that due to the death of Ald. Albert F. Czarnecki of the Fourth Aldermanic District applications for a successor will be accepted from that District until 5:OO P.M. June 19th, 1974. A successor to Ald. Czarnecki to be appointed by the aldermen. City Attorney Buckley advised that new state legislation prohibits voting by secret ballot. NEW BUSINESS Resolution #88-74 - The Clerk read same, entitled, Acceptance of Community Newspapers (The Sun) to be Official Newspaper of the City. Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried. Resolution #107-74 - The Clerk read same, entitled, Appointment of Citizen Member to Park and Recreation Board (Joyce Krygier - to fill unexpired term of Gloria Bartz) Ald. Schaumberg moved for adoption, seconded by Ald. Ford. Upon roll call the motion carried unanimously. Resolution #108-74 - The Clerk read same, entitled, Acceptance of Low Bid for Storm Sewer in Center Drive (Garsky Construction Co.) Ald. Schaumberg moved for adoption, seconded by Ald. Ford. Upon roll call the motion carried unanimously. Resolution lI109-74 - The Clerk read same, entitled, Directing City Attorney to Draft an Amendmenb! to Ordinances /I128 and #260 Relating to Depreciation on Sewer Collection System (75 years to 125 years). Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon roll ca 1 the motion carried unanimously. Resolution #110-74 - The Clerk read same, entitled, Declaring Intent to bve Tower Dr. Become a Public Right-of-way. Ald. Schaumberg moved for adotoption, seconded by Ald. Wallner. Ald. Ford moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion carried unanimously. Resolution #112-74 - The Clerk read same, entitled, Appointment of School District Representative to Park and Recreation Board. (Mr. Arnit Beske) Ald. Ford moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution #113-74 - The Clerk read same, entitled, Directing City Attorney to Draft an Ordinance to Amend the Zoning District Map of the City of Muskego (1-2 to RS2 - Sections 2, 3, 10 & 11). Ald. Ford moved for adoption, seconded by Ald. Wallner, motion carried. Resolution #114-74 - The Clerk read same, entitled, Authorizing the Preparation of a Bi-monthly Newsletter. Ald. Dumke moved for adoption, seconded by Ald. Schaumberg. Upon roll call the motion to adopt carried unanimously. Resolution #116-74 - The Clerk read same, entitled, Approval of Revised Plan for Mus-Kee-Quac Planned Unit Development. Ald. Schaumberg moved to suspend the rules that would interfere with the adoption of Resolution #116-74, seconded by Ald. Dumke. Upon a roll call vote on the motion to suspend the rules, Aldermen Dumke and Schaumberg voted "aye". Foldy, Ford and Knudsen voted "nay". The motion to suspend the rules did not carry. LICENSE APPROVAL License for Roland Lundin for the operation of a popcorn wagon within the city. Seconded by Ald. Schaumberg, motion carried. Ald. Schaumberg moved for the approval of a Trap License for Schultz Rod and Gun Club, Richard Bennett, Robert Schaack and Julius Caesar. Seconded by Ald. Dumke, motion carried. Ald. Foldy moved for the approval of a Rifle Range License for Schultz Rod and Gun Club. Seconded by Ald. Schaumberg, motion carried. Ald. Schaumberg moved for the approval of Class "B" Fermented Malt Beverage and Intoxicating Liquor Licenses for the fiscal year 1974-75 for Mary Jane Walberts, Cliffords Catering, Inc., Kenneth Christensen, Richard Straws, Wayne Hansen & Audrey Simon. Seconded by Ald. Dumke, motion carried. Ald. Schaumberg moved for the approval of a Class "A" Fermented Malt Beverage and Intoxicating Liquor License for Rose Wannebo, seconded by Ald. Knudsen, motion carried. Ald. Ford moved to defer action on the application of a Class "A" License for John Kapsos until the Finance Committee can meet with Thomas Felton, owner of the property. roll call vote. Ald. Schaumberg moved for the approval of a Swimming Beach Permit and Waterway Marker Permit for Robert & Judith Klenz, Daniel P. Amann, Steven Schuler, L. Martin Oshmann and Willard Mastertion. Seconded by Ald. Foldy. Motion carried. Aldermen Ald. Wallner abstained from voting. Ald. Foldy moved for the approval of a Transient Merchant's ,I I L -5 Seconded by Ald. Boerke Co., Inc. Seconded by Ald. Ford. Upon roll call the motion carried unanimously. CITY OFFICIAL'S REPORTS - The Clerk gave the Building Report for the month of May indicating 29 units and total construction in the amount 0.f of $1,006,565.00 for that month. Report placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Mayor acknowledged receipt of a communication directed to the Council and himself from the Little Muskego Lake Association, dated 6/10/74, regarding lake reclamation. Communication placed on file. Mayor Gottfried acknowledged receipt of the minutes of the Industrial Coordinating Committee meeting held 6/20/74. ADJOURNMENT - Ald.
