MINUTES OF MEETING HELD MAY 14, 1974
The meeting was called to order at 8:00 P.M. by Mayor Gottfried.
0 PRESENT - Mayor Jerome Gottfried, Aldermen Dumke, Foldy, Ford, Knudsen,
Schaumberg and Wallner, City Clerk Bette Bowyer and City Attorney Buckley.

APPROVAL OF MINUTES - Ald. Ford moved for the approval of minutes of meeting
held on 4123174, seconded by Ald. Schaumberg, motion carried.
COMMITTEE REPORTS
Ald. Dumke presented the report of the Finance Committee meeting held on
May 8, 1974, and moved that it be accepted and placed on file. Seconded
by Ald. Wallner, motion carried.
Ald. Dumke presented the report of the Public Works Committee meeting held
on 519174 and moved that it be accepted and placed on file. Seconded by
Ald. Wallner, motion carried.
l Ald. Foldy presented the report of the Public Welfare Committee meeting held
on 517174 and moved that it be accepted and placed on file. Seconded by
Ald. Knudsen, motion carried.
Ald. Schaumberg presented the report of the Public Sewer Committee meeting
held 4129174 and moved that it be accepted and placed on file. Seconded
by Ald. Dumke, motion carried.
The minutes of the Plan Commission meeting held 517174 were received and
placed on file.
UNFINISHED BUSINESS
Resolution #41-74 - Authorizing Ruekert & Mielke to Develop a Drainage
Plan for a Portion of the City. This resolution is on the floor. Ald.
Ford moved to again defer action on same because the Public Works Committee
agreed to request the cost estimates from the engineering firms involved
for additional study. Seconded by Ald. Knudsen. Upon roll call the motion
to defer carried unanimously.
0 Ordinance #276 - The Clerk gave the second reading of same, entitled, An
Ordinance to Amend Ch. 1 of the Municipal Code by Adding Section 1.12
(Prohibiting receipt of gifts and gratutities by any city employee or
Public Official). Ald. Wallner moved for adoption, seconded by Ald. Foldy.
Ald. Wallner moved to amend Ordinance #276 by adding the following two
paragraphs after Section (2) "This ordinance shall not apply to the
receiving of beverages or luncheon valued at less than $5.00, given as a
social act of a friend and not related to item l-A-B-C, 2, and other
governmental bu&ness." and 'Any person who violates these sections of
this ordinance are guilty of a misdemeanor, and shall be fined not less
l than $50.00 per violation but not more than $200.00 or imprisonment not
more than 6 months or both." Motion seconded by Ald. Foldy. Upon a roll
call vote to amend Ordinance #276, Aldermen Dumke, Foldy, Ford and Schaum-
berg voted "nay". Aldermen Knudsen and Wallner voted "aye". The motion
to amend did not carry. Following further discussion, upon a roll a roll
call vote to adopt Ordinance 8276, Aldermen Dumke, Foldy, Ford, Knudsen
and Schaumberg voted "nay". Ald. Wallner voted "aye". The motion to adopt
l Ordinance #276 did not carry.

COMMUNICATIONS FROM TRE MAYOR'S OFFICE
The Clerk read a proclamation by Mayor Gottfried declaring the month of
May, 1974, as Poppy Month and May 20th to May 27th as Poppy Week in our
community. (Proclamation presented by the American Legion Auxiliary)
Mayor Gottfried also declared the month of May, 1974, as "Bicycle Safety
l Week".
Mayor Gottfried advised that he would be attending the Governor's Conference
in Madison on May 28, 1974, and invited all of the aldermen to attend with
him.
NEW BUSINESS
Resolution 865-74 - The Clerk read same, entitled, Appointment of Member
to Plan Commission (Kenneth Czaplewski). Ald. Foldy moved for adoption,
seconded by Ald. Knudsen. Upon roll call 'the motion to adopt carried
unanimously.
Resolution #86-74 - The Clerk read same, entitled, Authorizing Agreement
Between City of Muskego and Wisconsin Dept. of Agriculture (Weights and
l Measures) Ald. Schaumberg moved for adoption, seconded by Ald. Knudsen.
Upon roll call the motion carried unanimously.
Resolution #87-74 - The Clerk read same, entitled, Requiring the Payment
of Delinquent Withholding Taxes and State Sales Tax Prior to the Issuance
of Intoxicating Liquor and Fermented Malt Beverage Licenses. Ald. Schaum-
berg moved for adoption, seconded by Ald. Foldy. Ald. Schaumberg moved to
defer action for two weeks and the Finance Committee could further study
the proposed resolution. Seconded by Ald. Knudsen. Upon roll call the
motion to defer carried unanimously.
Resolution #89-74 - The Clerk read same, entitled, Establishing Salaries
for Certain Elected Officials of the City of Muskego. Ald. Schaumberg
moved for adoption, seconded by Ald. Ford. Upon roll call the motion to
adopt carried unanimously.

Resolution 1~90-74 - The Clerk read same, entitled, Amending Salary Resolution
1183-74 ,(Ch&ging Park Building Custodian from $2.00.to $2.25); :Ald; Schaum-
berg moved for adoption, seconded by Ald. Foldy. Upon roll call the motion
carried unanimously.
Resolution #91-74 - The Clerk read same, entitled, Rejection of Bids for
City-Owned Fountainwood Lots). Ald. Foldy moved for adoption, seconded by
Ald. Schaumberg. Discussion took place whereby it was suggested that the
Finance Committee might want to consider establishing a specific value for
each lot rather than bidding. Upon a roll call vote the motion to adopt
Resolution 891-74 carried unanimously.
Resolution #92-74 - The Clerk read same, entitled, Accepting Low Bid for
Culvert Installation in Private Driveways Within the City of Muskego. Ald.
l Schaumberg moved for adoption, seconded by Ald. Ford. Upon roll call the
motion carried unanimously. (Brookfield Culvert Co. being the low bidder)
Resolution #93-74 - The Clerk read same, entitled, Approval of Final Plat
of Sunset Farms (A subdivision in the Town of Vernon). Ald. Ford moved for
adoption, seconded by Ald. Dumke. Upon roll call the motion carried
unanimously.

Resolution #94-74 - The Clerk read same, entitled, Approval of Certified S
Survey Map (Industrial Park - Konieczka). Ald. Foldy moved for adoption,
seconded by Ald. Knudsen. Upon roll call the motion carried unanimously.
Resolution 895-74 - The Clerk read same, entitled, Setting Public Hearing
Date for Proposed Amendments to the Mus-Kee-Guac Planned Unit Development
(Covenant Living Centers, Inc) (June 11, 1974, 7:00 P.M.). Ald. Ford
moved for adoption, seconded by Ald. Knudsen. Motion carried.
Resolution #96-74 - Ald.TFoldy moved to suspend the rules in order that
this resolution could be acted upon at this meeting. Seconded by Ald.
Schaumberg. Upon roll call the motion carried unanimously. The Clerk
read the resolution, entitled "Supporting Federal Aid System Realignment?
Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon a roll
call vote the motion carried with Ald. Knudsen casting a dissenting vote.
Resolution #97-74 - Ald. Foldy moved to suspend the rules that would
interfere with the adoption of this resolution, seconded by Ald. Schaumberg.
Upon a roll call vote the motion carried unanimously. The Clerk read
the resolution, entitled, Designating "The Sun" (Community Newspapers) As
The Official Newspaper for the City of Muskego For A Temporary Period,
Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon roll
call the motion carried unanimously.
LICENSE APPROVAL - Ald. Schaumberg moved for approval of Class "B"
Fermented Malt Beverage and Intoxicating Liquor Licensesas per list
submitted. Seconded by Ald. Dumke, motion carried.
Ald. Schaumberg moved for the approval of Class "A" Fermented Malt Beverage
and Intoxicating Liquor Licenses as per list submitted. Seconded by Ald.
Dumke, motion carried.
Ald. Dumke moved for the approval of Operators Licenses for Kevin Bush-
berger, Kevin Clark, Donald Wood, Linda Miller, Michael Maass, Richard
Gaffney and David Palubicki. Seconded by Ald Schaumberg, motion carried.
Ald. Foldy moved for the approval of Operators License for Richard Strauss.
Seconded by Ald. Dumke, motion carried.
Ald Schaumberg moved for the approval of Operators License for Genevieve
Strauss subject to receipt of favorable Fingerprint Report. Seconded by
Ald. Dumke, motion carried.
Ald. Foldy moved for the approval of a "Gathering License" for St. Leonard's
Parish for May 18, 1974. Seconded by Ald. Schaumberg, motion carried.
VOUCHER APPROVAL - Ald. Schaumberg moved for the approval of general voucher
payments in the amount of $394.61, payable 5114174. Seconded by Ald. Foldy.
Upon a roll call vote the motion carried unanimously.
CITY OFFICIAL'S REPORTS - The Clerk presented the Building Report for the
month of April which indicated 40 dwelling units and total construction in
the amount of $1,075,460.00 for that month. Report placed on file.
City Attorney Buckley reviewed plending legal matters within the city.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS - Ald. Schaumberg moved to set
public hearing date for proposed amendments to Zoning Ordinance (Removing
duplexes as conditional use grants from RSM, RSA and Business Districts)
for June 11, 1974 at 7:15 P.M.
ADJOURNMENT - Ald. Ford moved to adjourn, seconded by Ald. Knudsen, motion
carried. The meeting adjourned at 9:50 P.M.
