MINUTES OF MEETING HELD NOVEMBER 27, 1973
The meeting was called to order at 7:58 P.M. by Mayor Gottfried.
l PRESENT - Mayor Gottfried, Aldermen Czarnecki, Dumke, Foldy, Knudsen, Ford,
Schaumberg and Wallner. City Attorney Buckley and City Clerk Bowyer were also present.

APPROVAL OF MINUTES - Ald. Foldy moved for the approval of minutes of
meeting held on 11/13/73 and that they be accepted and placed on file.
Seconded by Ald. Knudsen, motion carried.
COMMITTEE REPORTS

Ald. Schaumberg presented the report of the Finance Committee held on
11/21/73 and moved that it be accepted and placed on file. Seconded by
Ald. Dumke. A lengthy discussion took place relating to procedures used
in obtaining legal opinions from the city attorney. Ald. Knudsen moved
to delete that paragraph of the Finance Committee minutes relating to
the procedures and act upon it separately. Seconded by Ald. Wallner.
Uoon a roll call vote Aldermen Czarnecki, Dumke, Knudsen and Wallner
voted "aye". Ald. Foldy, Ford and Schaumberg voted "nay". The motion
to act separately on the paragraph carried. Upon a voice vote the motion
to accept the balance of the minutes carried. Following further dis-
cussion to approve the matter relating to use of the city attorney by
department heads and elected officials, Aldermen Czarnecki, Dumke, Foldy,
Ford and Schaumberg voted "aye". Aldermen Knudsen and Wallner voted
"nay". The motion to accept the minutes in their entirety carried.
Ald. Dumke presented the report of the Public Works Committee meeting
held on November 21, 1973, and moved that it be accepted and placed on
file. Seconded by Ald. Schaumberg, motion carried.
The minutes of the Plan Commission meeting held on 11/20/73 were received
and placed on file.
UNFINISHED BUSINESS
Ordinance #263 - An Ordinance to Rezone Certain Property and to Amend the
Zoning Map of the City of Muskego (The Lake - Schober & Radtke). This
ordinance was the floor and upon a roll call vote the motion to adopt
carried unanimously. a NEW BUSINESS
Resolution i/187-73 - The Clerk read same, entitled, Creating Position of
Deputy Inspector. Ald. Foldy moved for adoption, seconded by Ald.
Schaumberg. Upon a roll call vote the motion carried unanimously.
Resolution #192-73 - The Clerk read same, entitled, Approval of Preliminary
Plat - Oleinik Subdivision (Town of Vernon). Ald. Schaumberg moved for
adoption, seconded by Ald. Czarnecki. Upon a roll call vote the motion
carried unanimously.

Resolution 8194-73 - The Clerk read same, entitled, Approval of Certified
Survey Map (Ada Butcher). Ald. Schaumberg moved for adoption, seconded
a by Ald. Dumke. Upon roll call the motion carried unanimously.

Resolution #195-73 - The Clerk read same, entitled, Authorizing a Pilot
Study on Use of Open Space and Environmental Corridor. Ald. Schaumberg
moved for adoption, seconded by Ald. Foldy. Discussion took place and
Ald. Wallner requested permission of his fellow aldermen to have Mr.
Harold DeBack, President of the Muskego Landowners Association, speak.
As there were no objections, Mr. DeBack spoke in opposition of the
proposed resolution. Ald. Ford urged his fellow aldermen to vote in
favor of the resolution and both Aldermen Wallner and Knudsen spoke as
being opposed to same. Ald. Wallner moved to defer action on Resolution
#195-73. Seconded by Ald. Knudsen. Upon a roll call vote to defer,
Aldermen Czarnecki, Dumke, Foldy, Ford and Schaumberg voted "nay". Alder-
men Wallner and Knudsen voted "aye". The motion to defer did not carry.
Upon a roll call vote to adopt Resolution i/195-73, Aldermen Czarnecki,
Dumke, Foldy, Ford and Schaumberg voted "aye". Aldermen Knudsen and
Wallner voted "nay". The motion carried.
l Resolution i/196-73 - The Clerk read same, entitled, Acceptance of Low Bid
for Forced Hookups (Zidar Plbg. Co.) Ald. Foldy moved for adoption,
seconded by Ald. Czamecki. Ald. Knudsen moved to defer action on this
resolution until recommendation is made by Sewer Committee. Seconded by
Ald. Ford. Upon a roll call vote the motion to defer carried unanimously.
Resolution i/197-73 - The Clerk read same, entitled, Acceptance of Low Bid
for Backhoe/Loader ( O-C Equipment Co.) Ald. Schaumberg moved for
adoption, seconded by Ald. Ford. At 9:40 P.M. Mayor Gottfried declared a
recess and the meeting reconvened at lo:55 P.M. Ald. Knudsen moved to
defer action on Resolution i/197-73 for two weeks. Seconded by Ald. Foldy.
Upon a roll call vote to defer, Aldermen Czarnecki, Dumke, Foldy and
Schaumberg voted "nay". Aldermen Ford, Knudsen and Wallner voted "aye".
The motion to defer did not carry. On the motion to adopt Resolution j/197-73
it carried unanimously.
Resolution f/198-73 - The Clerk read same, entitled, Denial of Legal Status
(Lillie Rapp). Ald. Schaumberg moved for adoption, seconded by Ald. Foldy.
Ald. Ford requested permission of his fellow aldermen to have Mr. John
Boyd, Realtor representing Lillie Rapp, speak. Mr. Boyd urged that the
aldermen give consideration to the granting of legal status to the lot in
question (Lot 1 Block 8, Muskego Shores Subdivision). Following further
discussion by several of the aldermen and the Mayor, upon a roll call vote
to adopt Resolution j/198-73, Aldermen Foldy, Ford, Knudsen and Schaumberg
voted "aye". Aldermen Czarnecki, Dumke,and Wallner.voted "nay". The-motion
to adopt carried.
Resolution #199-73 - The Clerk read same, entitled, Authorizing the Renewal
of Contract Between Associated Hospital Services and City of Muskego (Blue-
Cross-Blue Shield). Ald. Foldy moved for adoption, seconded by Ald. Schaum-
l berg. Upon roll call the motion carried unanimously.
Resolution #200-73 - The Clerk read same, entitled, Resolution to Retain
the Master Plan, Zoning Maps and Zoning Ordinance and the Rejection of
Plan Commission Recommendation Regarding Same (Introduced by Ald. Wallner)
Ald. Wallner moved for adoption, seconded by Ald. Schaumberg. Ald. Wallner requested permission of his fellow aldermen to have Mr. Harold DeBack and Mr.

Tim Burns speak. As there were no objections, Mr. DeBack, President
of the Muskego Property Owners Association, spoke in behalf of his
organization in favor of the resolution. Mr. Tim Burns, Hillside Dr.,
a spoke in behalf of the Muskego Icetronauts Snowmobile Club, in support
of the Property Owners Association. Ald. Knudsen moved to refer
Resolution #200-73 to the Public Welfare Committee. Seconded by Ald.
* Czarnecki. Mayor Gottfried relinquished the Chair to Council President
Foldy to remind the aldermen of the illegality of the proposed resolution.
Upon a roll call vote to refer the resolution to the Welfare Committee,
Aldermen Czarnecki, Dumke, Knudsen and Wallner voted "aye". Aldermen
Foldy, Ford and Schaumberg voted "nay". The motion carried.
VOUCHER APPROVAL - Ald. Foldy moved for the approval of payment of
general vouchers in the amount of $165,048.69, the approval of payment
of sewer construction vouchers in the amount of $15,288.25 and the
approval of payment of sewer utility vouchers in the amount of $41,050.85.
Seconded by Ald. Schaumberg. Upon a roll call vote the motion to pay
all of the vouchers carried unanimously.
LICENSE APPROVAL - Ald. Foldy moved for the approval of Operators Licenses
for William Krueger, Richard Tobianski and Wayne K. Jaeshke. Seconded
e by Ald. Czarnecki. Motion carried.
Ald. Dumke moved for the revocation of the Operators License for Robert
Hering. Seconded by Ald. Schaumberg. Upon roll call the motion carried
unanimously.
ADJOURNMENT - Ald. Ford moved to adjourn, seconded by Ald. Schaumberg.
Motion carried. The meeting adjourned at lo:41 P.M.
