ccm19731113COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD NOVEMBER 13, 1973 The meeting was called to order at 7~56 P.M. by Mayor Gottfried. PRESENT - Mayor Gottfried, Aldermen Czarnecki, Dumke, Foldy, Knudsen, Ford and Wallner. Also present were City Clerk Bette Bowyer and City Attorney John Buckley. ABSENT - Ald. Paul Schaumberg. APPROVAL OF MINUTES - Ald. Foldy moved for the approval of minutes of meeting held on 10 23173 and that they be placed on file. Seconded by Ald. Czarnecki, motion carried. COMMITTEE REPORTS Ald. Dumke presented the report of the Finance Committee meeting held on 1117173 and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. Ald. Dumke presented the report of the Public Works Committee meeting held on 11/S/73 and moved that it be accepted and placed on file. Seconded by Ald. Ford, motion carried. Ald. Czarnecki presented the report of the Public Safety Committee meeting held on 11/l/73 and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. Ald. Knudsen presented the report of the Sewer Committee meeting held on 10/29/73 and moved that it be accepted and placed on file. Seconded by Wallner, motion carried. The minutes of the Plan Commission meeting held on 11/6/73 were received and placed on file. At approximately 8:Ol P.M. Mayor Gottfried declared a recess for the purpose of opening bids for the sale of $740,000.00 promissory notes to be used for a two year capital improvement program for the city. Ten bids were submitted, the low bidder being Dain, Kalman & Quail of Minneapolis Minnesota. UNFINISHED BUSINESS Resolution #143-73 - Approval of Preliminary Plat - The Ridges. This resolution is on the floor and Ald. Foldy moved to defer action on same until the Plan Commission has an opportunity to review a revised layout. Seconded by Ald. Ford, motion carried. Ordinance #227 - An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Lakeview Hills - Frank Narlock property) This ordinance was on the floor. Upon a roll call vote the motion to adopt carried unanimously. Ordinance #263 - An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (The Lake - Schober & Radtke). Because of certain changes in the developer's agreement Ald. Ford moved to again defer action on same, seconded by Ald. Czarnecki. Following discussion, upon a voice vote the motion to defer carried. Ordinance #264 - An Ordinance to Amend Sec. 3.10 of the Municipal Code of the City of Muskego, by Adding Thereto, Sec. 5(g) (Re: Non-profit organ- a izations providing recreational facilities). Ordinance l/264, seconded by Ald. Knudsen. Ald. Foldy moved to table Upon a roll call vote the motion to table carried unanimously. 8 COMMUNICATIONS FROM TBE MAYOR'S OFFICE Mayor Gottfried advised that he was in receipt of a communication from E.M. Boerke, Inc. indicating their willingness to meet with the Council to discuss the possibility of their becoming brokers for the development of the industrial park. NEW BUSINESS Resolution #191-73 - Acceptance of Low Bid for Five New Squad Cars (E. J. Salentime). Ald. Foldy moved to suspend the rules that would allow Resolu- tion #191-73 to be acted upon at this time. Seconded by Ald. Wallner. Upon roll call the motion to suspend the rules carried unanimously. The Clerk read the resolution. Ald. Foldy moved for adoption, seconded by Ald. Dumke. Police Chief Kraus was present at the meeting and as there were no objections from any of the aldermen, Chief Kraus answered several of their questions regarding bidding procedures, specifications, etc. Upon a roll call vote the motion to adopt Resolution f/191-73 carried unanimously. Because the net cost in the amount of $13,635.20 for the five new Pontiac LeMans:did not provide for cost of necessary equipment for squad cars, Ald. Knudsen moved to reconsider Resolution i/191-73. Seconded by Ald. Wallner. Upon roll call the motion to reconsider carried unanimously. Ald. Knudsen moved to amend Resolution #191-73 by adding $350.50 to the net cost of the five Pontiac LeMans. Seconded by Ald. Czarnecki. Upon a voice vote the motion to amend carried. Upon a roll call vote the motion to adopt Res- olution #191-73, As Amended, carried unanimously. Resolution #182-73 - The Clerk read same, entitled, Establishing Traffic Regulations (vicinity of Janesville Rd. and Tess Corners Dr.) Ald. Foldy moved for adoption, seconded by Ald. Czarnecki. Ald. Ford moved to amend same by adding the words "to corner" after the words "Janesville Road". Seconded by Ald. Czarnecki. Upon a voice vote the motion to amend carried. Upon a roll call vote the motion to adopt Resolution f/182-73 carried l unanimously. Resolution i/184-73 - The Clerk read same, entitled, Approval of Final Plat - Lakeview Hills. Ald. Knudsen moved for adoption, seconded by Ald. Czarnecki. Ald. Ford moved to amend the resolution by adding the following paragraph: BE IT FURTHER RESOLVED that this approval is subject to an addition to the deed restrictions which would provide that any home built on Lots 1, 2 & 3 of the subdivision be reviewed by the Plan Commission." Seconded by Ald. Foldy. Upon a voice vote the motion carried. Following further discussion regarding the possibility of installing concrete inverts in some of the steeper ditches, upon a roll call vote the motion to adopt Resolution #184-73, As Amended, the motion carried unanimously. Resolution i/185-73 - The Clerk read same, entitled, Approval of Certified Survey Map for Steve Schuler. Ald. Foldy moved for adoption, seconded by Ald. Wallner. Resolution i/186-73 - The Clerk read same, entitled, Denial of Legal Status (F. Moritz) Ald. Foldy moved for adoption, seconded by Ald. Knudsen. Upon l a roll call vote to adopt Aldermen Dumke, Foldy, Ford and Knudsen voted "aye". Aldermen Czarnecki and Wallner voted "nay". The motion to adopt carried. 8 Resolution f/188-73 - The Clerk read same, entitled, Waiving of Rescue Fees Not Collectible. Ald. Dumke moved for adoption, seconded by Ald. Foldy. Upon a roll call vote the motion to adopt carried unanimously. Resolution j/189-73 - The Clerk read same, entitled, Approval of Lease Between Muskego Fine Arts, Inc. and the City of Muskego for Old City Hall. Ald. Ford moved for adoption, seconded by Ald. Foldy. Upon a roll call vote, Aldermen Czarnecki, Dumke, Foldy, Ford and Knudsen voted "aye". Ald. Wallner voted "nay". The motion carried. Resolution i/190-73 - Ald. Knudsen moved to suspend the rules in order that this resolution could be acted upon at this meeting. Seconded by Ald. Czarnecki. Upon a roll call vote the motion to suspend the rules carried unanimously. The Clerk read the resolution, entitled, Acceptance l of Low Bid for the Issue of $740,000.00 Promissory Notes (Dain, Kalman & Quail). Ald. Foldy moved to adopt same, seconded by Ald. Knudsen. Upon a roll call vote the motion carried unanimously. Resolution #192-73 - Ald. Knudsen moved to suspend the rules in order that this resolution could be acted upon at this meeting. Seconded by Ald. Wallner. Upon a roll call vote, the motion carried unanimously. As there were no objections the reading of the entire resolution was waived and the Clerk read the resolution by title only, A resolution authorizing the City of Muskego to Borrow the Sum of $740,000.00 Pursuant to Sec. 67.12 (12) of the Wisconsin Statutes for Various Corporate Purposes. Ald. Foldy moved for adoption, seconded by Ald. Knudsen. Upon a roll call vote the motion carried unanimously. VOUCHER APPROVAL - Ald. Foldy moved for the approval of payment of sewer construction voucher in the amount of $5,000.00. Seconded by Ald. Czarnecki. Upon a roll call vote the motion carried with Ald. Knudsen casting a dis- senting vote. 0 CITY OFFICIAL'S REPORTS - The Clerk gave the October, 1973, Building Report which showed 21 dwelling units and total construction in the amount of $624,869.00. COMMUNICATIONS AND MISCELLANEOUS BUSINESS Communications from Harold DeBack, Chairman of the Muskego Property Owners Association, dated 1115173 and from Frank DeAngelis, Treasurer of Muskego Property Owners Association, dated 11/5/73, regarding the proposed zoning district map were read by the City Clerk and placed on file. l ADJOURNMENT - Ald.
