MINUTES OF MEETING HELD OCTOBER 23, 1973
The meeting was called to order at 7~40 P.M. by Mayor Gottfried.
0 PRESENT - Mayor Gottfried, Aldermen Czarnecki, Dumke, Foldy, Knudsen,
Schaumberg and Wallner. Ald. Ford arrived at 7~47 P.M. Also present
were City Clerk Bette Bowyer and City Attorney John Buckley.
* APPROVAL OF MINUTES - Ald. Foldy moved for the approval of minutes of
meeting held on 10/g/73, seconded by Ald. Schaumberg, motion carried.
COMMITTEE REPORTS
Ald. Schaumberg presented the report of the Finance Committee meeting held
on 10/17/73 and moved that it be accepted and placed on file. Seconded by
Ald. Dumke, motion carried.
Ald. Czamecki presented the report of the Public Safety Committee meeting
held on 10/11/73 and moved that it be accepted and placed on file. Seconded
by Ald. Wallner, motion carried.
Ald. Ford presented the report of the Public Works Committee meeting held
l on 10/18/73 and moved that it be accepted and placed on file. Seconded
by Ald. Schaumberg, motion carried.
Ald. Knudsen presented the report of the Public Welfare Committee meeting
held on 10/18/73 and moved that it be accepted and placed on file. Seconded
by Ald. Ford, motion carried.
Ald. Knudsen presented the report of the Rules, Laws & Ordinance Committee
meeting held on 10111173 and moved that it be accpeted and placed on file.
Seconded by Ald. Foldy, motion carried.
Ald. Knudsen presented the report of the Sewer Committee meeting held on
10/8/73 and moved that it be accepted and placed on file. Seconded by
Ald. Czamecki, motion carried.
The minutes of the Plan Commission meeting held on 10/16/73 were received
and placed on file.
UNFINISHED BUSINESS l Resolution #143-73 - Approval of Preliminary Plat - The Ridges. As a revised
plat has not been received, Ald. Knudsen again moved to defer action on the
resolution until the next meeting. Seconded by Ald. Schaumberg. Upon a voice
vote the motion carried.
Resolution #149-73 - Renewal of Extractive Permit for State Sand and Gravel,
Inc. As this resolution was on the floor, Ald. Ford moved to amend same
by adding the following paragraph: VBE IT FURTHER RESOLVED, that this
approval is given with the understanding that truck loading operations at
State Sand & Gravel pit be limited to the hours between 7:00 A.M. and 7:00 P.M!'
0 Seconded by Ald. Knudsen. Upon a voice vote the motion carried. Upon a
roll call vote the motion to adopt Resolution #149, As Amended, carried
unanimously.
Ordinance #227 - An Ordinance to Rezone Certain Property and to Amend the
Zoning Map of the City of Muskego (Lakeview Hills - Frank Narlock Property)
As this ordinance is still in the hands of the Plan Commission Ald. Knudsen

moved to defer action until the next meeting, seconded by Ald. Wallner.
Upon a voice vote the motion carried.

Unfinished Business - Cont'd.
Ordinance 1~263 - An Ordinance to Rezone Certain Property and to Amend the
Zoning Map of the City of Muskego (Schober & Radtke - The Lake). This
ordinance is on the floor, however, Ald. Foldy moved to defer action on
same until the next Council meeting to give the aldermen an opportunity
to review the developer's agreement. Seconded by Ald. Ford. Upon a voice
vote the motion carried.
Ordinance #264 - An Ordinance to Amend Sec. 3.10 of the Municipal Code
of the City of Muskego, Wisconsin, by Adding Thereto, Sec. 5 (g) (Re:
Non-profit organizations providing recreational facilities). This ordinance
is on the floor however, Ald. Foldy moved to defer action on same until
such time that the Sewer Committee can review that portion of the ordinance
referred to by the Rules, Laws & Ordinance Committee. Seconded by Ald.
Czarnecki. Upon a voice vote the motion to defer carried.
Ordinance #265 - The Clerk gave the second reading of same, entitled,
An ordinance to Amend Ch. 8 of the Municipal Code of the City of Muskego
(Re: culvert installation). Ald. Foldy moved for adoption, seconded by
Ald. Knudsen. Upon a roll call vote the motion to adopt carried unanimously.
Ordinance #266 - The Clerk gave the second reading of same, entitled, An
Ordinance Repealing and Recreating Ch. 15 of the Municipal Code of the
City of Muskego (Electrical Code). Ald. Foldy moved for adoption, seconded
by Ald. Schaumberg. .Upon a roll call vote the motion carried unanimously.
Ordinance #267 - The Clerk gave the second reading of same, entitled, An
Ordinance to Repeal and Recreate Ch. 15 of the Municipal Code of the City
of Muskego (Be: Advising that the Electrical Code is incorporated into the
Municipal Code and shall be published in pamphlet form.) Ald. Foldy moved
for adoption, seconded by Ald. Schaumberg. Upon roll call the motion carried
unanimously.
Ordinance #268 - The Clerk gave the second reading of same, entitled, An
Ordinance to Repeal and Recreate Sec. 9.22 of the Municipal Code (Re:
Burning Ordinance) AM. Foldy moved for adoption, seconded by Ald. Knudsen.
Ald. Wallner moved to defer action on Ordinance #268 to make certain that
the two fire chiefs had no objection to the proposed ordinance. Seconded
by Ald. Knudsen. Aldermen Foldy and Ford advised that the two fire chiefs
were in attendance at the Rules, Laws & Ordinance Committee meeting and had
agreed to the rewording. Upon a roll call vote to defer action on Ordinance
#268, Aldermen Czarnecki, Dumke, Foldy and Ford voted "nay". Aldermen
Knudsen, Schaumberg and Wallner voted "aye". The motion to defer did not
carry. Upon a roll call vote to adopt Ordinance #268, Aldermen Czarnecki,
Dumke, Foldy, Ford and Knudsen voted "aye". Aldermen Schaumberg and Wallner
voted "nay". The motion to adopt Ordinance #268 carried.
Ordinance #269 - The Clerk gave the second reading of same, entitled, An
Ordinance to Repeal and Recreate Ch. 16.27 and Create Ch. 16.28 of the
Municipal Code (Re: Discharge of Clear Water Sump). Ald. Foldy moved for
adoption, seconded by Ald. Knudsen. Upon a roll call vote the motion
to adopt carried unanimously.
At 8:40 P.M. Mayor Gottfried declared a recess and the meeting reconvened
at 8:55 P.M.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried advised that the proposed lease between the City of Muskego
and Fine Arts, Inc. for the use of old city hall has now been approved by
that organization, however, they have requested an extension to one year
for the completion of the exterior of the building.

NEW BUSINESS
Resolution l/175-73 - The Clerk read same, entitled, Designating Halloween
Trick or Treat Hours (5:00 P.M. to ?:30 P.M., Tuesday, October 30th) Ald-
Schaumberg moved for adoption, seconded by Ald. Czarnecki. Upon a roll
call vote the motion to adopt carried unanimously.
Resolution #1?6-73 - The Clerk read same, entitled, Resolution Relating to
the Financing of an Industrial Project for Muskego Rendering CO., Inc. Ald.
Schaumberg moved for adoption, seconded by Ald. Knudsen. Mr. Carl Wauer, Attorney Richard Weiss, representing Muskego Rendering Co., Inc. and Mr.
Errol Hohmann of the First Wisconsin National Bank of Brookfield, appeared
at the meeting to answer several questions from the aldermen regarding
industrial revenue bonding and following a lengthy discussion, Alderman
Ford moved to defer action on Resolution #1?6-73 for three weeks to give
the Council an opportunity to prepare guidelines for future industrial
revenue bonding. Seconded by Ald. Wallner. Following further discussion,
Ald. Ford moved to call for the question. Seconded by Ald. Dumke. Upon a
roll call vote to call for the question, Aldermen Czarnecki, Dumke, Foldy,
Ford and Schaumberg voted "aye". Aldermen Knudsen and Wallner voted "nayll.
The motion carried. On the motion to defer Resolution #1?6-73 until the
next meeting (3 weeks) Aldermen Ford and Wallner voted "aye". Aldermen
Czarnecki, Dumke, Foldy, Knudsen and Schaumberg voted "nay". The motion to
defer did not carry. Following more discussion, Alderman Schaumberg called
for the question (to adopt). Seconded by Ald. Ford. Upon a roll call vote
to call for the question, Aldermen Czarnecki, Dumke, Foldy, Ford and Schaum-
berg voted "aye". Aldermen Knudsen and Wallner voted "nay". The motion to
call for the question carried. On the motion to adopt Resolution #1?6-73,
Aldermen Czarnecki, Dumke, Foldy, Ford, Knudsen and Schaumberg voted "aye".
Ald. Wallner voted 'r'nay". The motion to adopt Resolution #1?6-73 carried.
Resolution #lJJ-73 - The Clerk read same, entitled, Resolution to Officially
Change the Name of Briargate Ct. to Briargate Lane. Ald. Foldy moved for
adoption, seconded by Ald. Czarnecki. Upon a roll call vote the motion
carried unanimously.
Resolution #1?9-73 - The Clerk read same, entitled, Authorizing the Public
Works Committee to Advertise for a Back Hoe. Ald. Schaumberg moved for
adoption, seconded by Ald. Ford. Upon a roll call vote the motion carried.

Resolution #MO-J3 - The Clerk read same, entitled, Authorizing Expenditure
of $600.00 for a Moody Rating. Ald. Foldy moved for adoption, seconded by
Ald. Schaumberg. Ald. Ford moved to amend the resolution by adding the
following paragraph "BE IT FURTHER RESOLVED that the money needed for this
shall be taken from the Contingency Fund". Seconded by Ald. Foldy. Motion
carried. Upon a roll call vote to adopt the motion carried unanimously.
Resolution #Ml-J3 - Ald. Foldy moved to suspend the rules in order that
this resolution could be acted upon this evening. Seconded by Ald. Foldy.
Upon roll call the motion carried unanimously. The Clerk read the resolution,
entitled, Authorizing the Advertising of Bids for the City's Insurance
Program. Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon a
roll call vote the motion carried unanimously.
VOUCHER APPROVAL - Ald. Foldy moved for the approval of payment of general
vouchers in the amount of $108,133.93. Seconded by Ald. Dumke. Upon roll
call the motion carried unanimously.

LICENSE APPROVAL
Ald. Foldy moved for the approval of an Operators License for Fred
Christensen, seconded by Ald. Schaumberg. Upon a voice vote the motion l carrried.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
* The Clerk read a communication from the Waukesha Blood Donor Club, directed
to Mayor Gottfried, dated 10/12/73 expressing appreciation for contributions
to the blood mobile. Placed on file.
Ald. Ford requested that the Finance Committee consider preparing some
guidelines for future financing with industrial revenue bonds.
A discussion took place regarding the development of Muskego's Industrial
Park.
Ald. Ford moved to adjourn, seconded by Ald. Knudsen, motion carried. The
meeting adjourned at lo:31 P.M.
