ccm19730724COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD JULY 24, 1973 Mayor Gottfried called the meeting to order at 8:06 P. M. PRESENT: Mayor Jerome Gottfried, Aldermen Al Czarnecki, Ed Dumke, Charles Foldy, Ron Ford, Richard Knudsen, Paul Schaumberg and Ray Wallner. Also present were Deputy Clerk June Elger and City Attorney John Buckley. APPROVAL OF MINUTES: Ald. Foldy moved for the approval of minutes of the previous meeting held on July 10, 1973, and of the special meeting held on July 16, 1973, as mailed. Seconded by Ald. Dumke, motion carried. COMMITTEE REPORTS Ald. Schaumberg presented the report of the Finance Committee meeting held on 7/18/73, and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. Ald. Ford presented the report of the Public Works Committee meeting held on 7/19/73 and moved that it-be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. Ald. Czarnecki presented the report of the Public Safety Committee meeting held on 7/12/73 and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. Ald. Knudsen presented the report of the Public Welfare Committee meeting held on 7/19/73 and moved that it be accepted and placed on file. Seconded by Ald. Ford, motion carried. Ald. Knudsen presented the report of the Rules, Laws % Ordinance Committee meeting held on 7/12/73 and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. The minutes of the Plan Commission meeting held on 7/17/73 were received and placed on file. UNFINISHED BUSINESS Ordinance #255 - An Ordinance to Repeal and RecreateCh. 18 of the kunlcapal Code (Subdivision Control Ordinance). This ordinance is on the floor and was deferred at the last meeting for two weeks. Ald. Foldy moved to amend Ordinance #255 as indicated in the minutes of the Rules, Laws % Ordinance Committee meeting of July 12, 1973. Ald. Knudsen seconded the motion. Ald. Knudsen moved to amend the amendments in Section 2.3, second paragraph, to replace 10 years with 5 years. Ald. Czarnecki seconded the motion. After discussion, upon a roll call vote, Ald. Knudsen and Wallner voted "aye", Aldermen Czarnecki, Dumke, Foldy, Ford and Schaumberg voted "nay" and the motion did not carry. Upon a roll call,vote to amend Ordinance #255, Ald. Czarnecki, Dumke, Foldy, Ford, Knudsen and Schaumberg voted "aye", Ald. Wallner voted "nay" and the motion carried. Upon a roll call vote to adopt Ordinance #255 As Amended, Aid. Czarnecki, Dumke, Foldy, Ford, Knudsen and Schaumberg voted "aye", Ald. Wallner voted “nay” and the motion carried. NEW BUSINESS Resolution #114-73 - The Deputy Clerk read Resolution #114-73 entitled Authorizang the Development of a Proposal to the Wisconsin Council of Criminal Justice. Ald. Foldy moved for adoption. Ald. Czarnecki seconded the motion. Ald. Schaumberg moved to amend Resolution #114-73 by adding: "Be it further resolved that final review of the proposed reorganization will be made by the Common Council upon the receipt of aindication of acceptance by the Wisconsin Council of Criminal Justice." Ald. Foldy seconded the motion and upon a voice vote the motion carried. Upon a roll call vote, the motion to adopt Resolution #114-73 As Amended carried unanimously. l a l l 1 Page 2 - Common Council July 24, 1973 Resolution #115-73 - The Deputy Clerk read Resolution #115-73 entitled Bhola to Attend the F.B.1 Adademy in Washington D. C. Ald. Poldy moved for adoption. Ald. Dumke seconded the motion. Ald. Knudsen moved to amend Resolution #115-73 to include at the end of the first and third paragraphs $3375." "....plus wages of approximately Ald. Schaumberg seconded the motion and the motion carried upon a voice vote. Mayor Gottfried relinquished the Chair to Council President Foldy in order to speak in opposition to the adoption of Resolution #115-73. resolution. Ald. Resolution #116-73 - The Deputy Clerk read Resolution #116-73 entitled Authorizing the Execution of Agreement and Easement for Installation of Storm Sewer at St. Paul's Lutheran Church. for adoption, seconded by Ald. Ford. Ald. Schaumberg moved Upon a roll call vote the motion carried unanimously. Resolution #117-73 - The Deputy Clerk read Resolution #117-73 entitled Approving Renewal of Conditional Use Grant for Wauer Pur Foods, Inc. Ald. Schaumberg moved for adoption, seconded by Ald. Cxarnecki. Ald. Knudsen spoke in opposition to the resolution. Upon a roll call vote, Ald. Czarnecki, Dumke, Poldy, Pord, Schaumberg and Wallner voted "aye", Ald. Knudsen voted "nay" and the motion carried. Resolution #118-73 - The Deputy Clerk read Resolution #118-73 entitled Authorizing Contract Between Wisconsin Council of County and Municipal Employees and City of Muskego (City Hall and Library Employees). Ald- Foldy moved for adoption. Ald. Schaumberg seconded the motion. Ald. Knudsen advised that it is his intention to vote “no” on this resolution because he had been banned from the Finance Committee negotiations. Upon a roll call vote, Ald. Czarnecki, Dumke, Foldy, Ford and Schaumberg voted "aye", Ald. Knudsen and Wallner voted %ay" and the motion carried. Mayor Gottfried declared recess at 9:40 P. M. and the meeting reconvened at 9:46 P. M. Resolution #119-73 - The Deputy Clerk read Resolution #119-73 entitled Authorizing the Exoenditure of Funds for Advertising the Industrial Park. AldT Foldy moved for adoption, seconded by Aid. Knudsen. Upon a roll call vote, the motion carried unanimously. Resolution #120-73 - The Deputy Clerk read Resolution #120-73 entitled Authorizing the Finance Committee to Advertise City-Owned Lots in Fountainwood Area. Ald. Schaumberg moved for adoption. Seconded by Ald. Dumke. Mayor Gottfried advised that adequate easements are being prepared by Attorney Buckley to provide for the creek maintenance. Ald. Knudsen suggested that the money from the sale of these lots be used for the development of Schmidt Park. carried unanimously. Upon a roll call vote, the motion Resolution #121-73 - The Deputy Clerk read Resolution #121-73 entitled Acceotance of Low Quotation for Fuel Storage Tanks. Ald. Schaumbery! moved for adoption.. Ald. Ford seconded th; motion. Upon a roll tail vote, the motion carried unanimously. Resolution #122-73 - The Recording Secretary read Resolution #122-73 entitled Accepting the Low Bid for the Installation of Storm Sewer at St. Paul's Church. Ald. Schaumberg moved for adoption. Seconded by Ald. Dumke. Upon a roll call vote, the motion carried unanimously. Resolution #123-73 - Ald. Foldy moved to suspend the rules that would interfere with the adoption of Resolution #123-73. The Deputy Clerk read Resolution #123-73 entitled Authorizing the Advertising of Bids for the Installation of Concrete Invert in the Fountainwood Area. Ald. Schaumberg moved for adoption. Ald. Page 3 - Common Council July 24, 1973 Ordinance #261 - The Deputy Clerk gave the first readin 3261 entitled An Ordinance to Repeal Section 12.01 (5) I! of Ordinance referred to Rules, Laws & Ordinance Committee. a) & ,(b), same Mavor Gottfried declared recess at lo:12 P. M. and the meeting reconvened at-lo:34 P. M. LICENSE APPROVAL Ald. Foldy moved Krueger, Timothy for the approval of Operators Licenses for William Parsons, John Karides and Gerald Reichert. Ald. _ . Scnaumberg seconded the motion and the motion carried, Ald. Knudsen moved for the approval of an Operators License for Edward Carroll. l Aid. Czarnecki seconded the motion. Upon a roll call vote, Ald. Czarnecki, Dumke, Knudsen, Schaumberg and Wallner voted "aye", Ald. Poldy and Ford voted "nay" and the motion carried. Aid. Foldy moved for the approval of Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Fred Graves. Aid. Schaumberg seconded the motion and the motion carried. Ald. Foldy moved for the approval of Junk (auto salvage) licenses for James Kohne and Jack Glockner. Ald. Schaumberg seconded the motion and the motion carried. Ald. Schaumberg moved for the approval of a Gathering License for the Icetronauts Snowmobile Club to be held August 5th, 1973. Ald. Poldy seconded the motion and the motion carried. VOUCHER APPROVAL Ald. Foldy moved for the approval of general wiuchers in the amount of $157.302.10 payable July 24th. 1973. Ald. Schaumberg seconded the ,motion and upon a roll call vote the motion carried unanimously. e Ald. Foldy moved for the approval of sewer construction vouchers in the amount of $9,773.23 payable July 24th. 1973. Ald. Czarnecki seconded the motion. Upon a roll call vote, Ald. Czarnecki, Dumke, Foldy, Ford, Schaumberg and Wallner voted "aye" and Ald. Knudsen voted "nay" and the motion carried. Ald. Foldy moved for the approval of sanitary sewer utility vouohers in the amount of $2.147.45 payable July 24th, 1973. Ald. Schaumberg seconded the motion and upon a roll call vote, the motion carried unanimously. COMMUNICATIONS & MTSCELLANEOUS BUSINESS 0 The Deputy Clerk read a petition from Jack A. Radtke requesting rezoning of property on McShane Road in Section 12 from RS-2 to RSA with an OPD overlay, same referred to the Plan Commission. Ald. Knudsen moved to schedule a public hearing to consider this request for 7:15 P. M. on August 28th, 1973. Ald. Wallner seconded the motion and the motion carried. The Deputy Clerk read a Protest Petition dated the 17th of July, 1973, l from Muskego Industrial Park, Inc., opposing the rezoning of their property in Section 16 from B-2 to l&2, same referred to the city attorney. Page 4 - Common Council July 24, 1973 e Ald. Wallner requested that all communications directed to the Mayor and Common Council be read at the Common Council meetings. e Ald. Knudsen and Wallner requested that there be a 24 hour notice of any change in date and time of committee meetings issued to all alder- men. Ald. Knudsen suggested that the city attorney submit a written report of pending legal actions. ADJOURNMENT: Ald. Knudsen moved for adjournment at 10:JO P. H.
