ccm19730508COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD MAY 8, 1973 The meeting was called to order at 7~50 P.M. by Mayor Jerome Gottfried. l PRESENT: Mayor Gottfried, Aldermen Al Czarnecki, Ed Dumke, Charles Foldy, Ronald Ford, Richard M. Knudsen, Paul Schaumberg and Raymond Wallner. Also e present were City Attorney John Buckley and City Clerk Bette J. Bowyer. APPROVAL OF MINUTES: Ald. Foldy moved for the approval of the minutes of the previous meetimg held on April 24, 1973, as mailed. Seconded by Ald. Czarnecki, motion carried. COMMITTEE REPORTS Ald. Foldy presented the report of the Finance Committee meeting held on 5/a/73, and moved that it be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. Ald. Dumke presented the report of the Public Works Committee and moved that it be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. (Meeting of 513173) l Ald. Czarnecki presented the report of the Public Safety Committee meeting held on 4126173 and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. He also presented the report of the Safety Committee meeting held on 513173 and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. Ald. Knudsen presented the report of the Rules, Laws & OrdinancerCommittee meeting held on 4126173 and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. Ald. Knudsen presented the report of the Public Welfare Committee of meeting held on 513173 and moved that it be accepted and placed on file, seconded by Ald. Ford, motion carried. Ald. Knudsen presented the report of the Public Sewer Committee meeting held on 517173 and moved that it be accepted and placed on file. Seconded by Ald. Czarnecki, motion carried. The minutes of the Plan Commission meeting held on 5/l/73 were received and a placed on file. UNFINISHED BUSINESS Resolution #4S-73- Establishing the City's Intent to Change the Personnel Structure of the Muskego Police Dept. Ald. Foldy moved to again defer action on same until after the next Safety Committee meeting. Seconded by Ald. Czarnecki, motion carried. Ordinance 11251 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Sec. l 12.01,,6f the Municipal Code by Adding Section (j) (Re: Lewd and Obscene Performance). Ald. Foldy moved for adoption, seconded by Ald. Schaumberg. Ald. Knudsen moved to defer action on Ordinance #251 until the next Council meeting. Seconded by Ald. Foldy. Upon a voice vote, the motion carried. Ordinance #252 - The Clerk gave the second reading of same, entitled, An Ordinance to Repeal Sec. 12.01(5) (a) & (b) of the Municipal Code (Re: Class l "A" Licenses). Ald. Foldy moved for adoption, seconded by Ald. Czarnecki. Ald. Ford moved to defer action on Ordinance #252 until the next Council meeting. Seconded by Ald. Knudsen. Upon a voice vote the motion carried. Ordinance #248 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Section 9.22 of the Municipal Code of the City of Muskego. (Re: Regulations for open fires). Ald. Foldy moved for adoption, seconded by Ald. Dumke. Ald. Foldy moved to defer action on Ordinance 11248 until the next Council meeting and same is reviewed with fire department officials. Seconded by Ald. Wallner. Upon a voice vote the motion carried. License Approval - The motion to grant Best Disposal Co. a Refuse Hauling Permit was on the floor from the previous meeting and upon a roll call vote, Aldermen Czarnecki, Dumke, Foldy, Ford, Schaumberg,and Wallner voted "aye". Ald. Knudsen voted"Nay". The motion to grant the permit carried. COMMUNICATIONS FROM THE MAYOR'S OFFICE The Clerk read the Mayor's Proclamation proclaiming the week of May 20th to May 2Jth, 1973, as "AMERICAN LEGION POPPY WEEK". The Clerk also read Mayor Gottfried's Proclamation of the VFW urging all patriotic citizens to wear a Buddy Poppy in country who have risked or lost their lives as American citizens. recognition of the men of this in fulfilling their obligations NEW BUSINESS Resolution #76-73 - The Clerk read same, entitled, Appointment of Citizen Member to Park and Recreation Board (Richard Arrowood). Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Upon a roll call vote the motion carried unanimously. Resolution #JJ-73 - The Clerk read same, entitled, Acceptance of Community Newspapers, Inc. (The Sun) as Official Newspaper for the City of Muskego. Ald. Foldy moved for adoption, seconded by Ald. Schaumberg. Upon roll call the motion carried unanimously. Resolution #J8-73 - The Clerk read same, Authorizing Application for Federal Disaster Aid. Ald. Ald. Foldy moved for adoption, seconded by Ald. Wallner. Upon roll call the motion carried unanimously. Resolution #J9-73 - The Clerk read same, entitled, Authorizing the Instal- lation of Street Lights (On S.T.H. 24 from Lannon Dr. east to Bay Lane) Ald. Czarnecki moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried unanimously. Resolution #O-J3 - The Clerk read same, entitled, Authorizing Emergency Repai Repair to Dike on Little Muskego Lake (Linnan Const. Co.) Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Resolution i/81-73- The Clerk read same, entitled, Authorizing Agreement Between City of Muskego and Wis. Dept. of Agriculture (Weights & Measures) Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Ordinance i/253 - The Clerk gave the first reading of same, entitled, An Ordinance to Amend Sec. 7.16(3) of the Municipal Code (Re: Amendment to Junked Car Ordinance) Ald. Knudsen moved to suspend the rules in order the this ordinance could be acted upon at this meeting. Seconded by Ald. Ford. Upon roll call the motion to suspend the rules carried unanimously. The Clerk gave the second reading of Ordinance l/253. Alderman Foldy moved for adoption of same and Ald. Knudsen seconded the motion. Common Council 518173 - Page 3. New Business - Cont'd. Ald. Wallner spoke in opposition of the proposed ordinance and upon a roll call vote on the motion to adopt same, Aldermen Czarnecki, Foldy, Ford, Knudsen and Dumke voted "aye". Aldermen Wallner and Schaumberg voted "nay". The motion to adopt Ordinance #253 carried. Ordinance #254 - The Clerk gave the first reading of same, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego. Resolution $182-73 - Ald. Knudsen moved to suspend the rules in order that this resolution could be acted upon at this meeting. Seconded by Ald. Ford. Upon roll call the motion to suspend the rules carried unanimously. The Clerk read the resolution, entitled, Authorizing the Replacement of Main Entrance Doors of New City Hall. Ald. Knudsen moved for adoption, seconded by Ald. Ford. Discussion followed and Ald. Knudsen moved to defer action on Resolution 1182-73 for two weeks until costs involving the matter could be reviewed. Seconded by Ald. Schaumberg. Upon a. voice vote the motion to defer carried. Resolution #83-73 - Ald. Foldy moved to suspend the rules that would interefere with the adoption of the resolution, seconded by Ald. DumKe. Upon a roll call vote the motion to suspend the rules carried unanimously. The Clerk read the resolution, entitled, Accepting Low Quotation of A..I@* fol Ind.Park Pq.Ald. Foldy moved for adoption, seconded by Ald. Ford. Following discussion, upon a roll call vote, Aldermen Czarnecki, Dumke, Foldy, Ford, Schaumberg and Knudsen voted "aye". Ald. Wallner voted "nay". The motion to adopt carried. LICENSE APPROVAL - Ald. Foldy moved for the approval of an Operators License for Robert Hering, seconded by Ald. Dumke. Motion carried. CITY OFFICIAL'S REPORTS - The Clerk presented the Building Report for the month of April indicating total constnuction in the amount of $687,368.00 (32 dwelling units). COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a petition from Leonard Blattner requesting rezoning in Sec. 24 from B-4 (Highway Business) to R-3 (Country Home). Ald. Dumke I) moved to set the public hearing date for June 12, at 7:15 P.M. Seconded by Ald. Schaumberg, motion carried. Petition referred to Plan Commission. The Clerk read a petition requesting legal lot status for Hans Keiser Subdivision. Same referred to Plan Commission. Ald. Ford invited his fellow aldermen to meet:with Mr. Hugh Dega of Madison, Wis. and the Park and Recreation Board on Wed., May 9, 1973 at 7~30 P.M. Mr. Dega has been recently retained as a consultant for the Park and Rec- creation Dept. 0 Ald. Knudsen thanked everyone for their cooperation during the recent "Clean and Green Week" project.
