MINUTES OF MEETING HELD APRIL 24, 1973
The meeting was called to order at 7:46 P. M. by Mayor Jerome Gottfried.
PRESENT: Mayor Jerome Gottfried, Aldermen Al Czarnecki, Ed Dumke, Charles Foldy, Richard M. Knudsen, Paul Schaumberg and Raymond Wallner. 'Also present were City Attorney John Buckley and Deputy Clerk June Elger.
ABSENT: Alderman Ronald Ford and City Clerk Bette Bowyer
APPROVAL OF MINUTES: Ald. Foldy moved for the approval of minutes of the previous meeting held on April 10, 1973, and the minutes of the organizational meeting held April 17, 1973, as mailed. Seconded by Ald. Czarnecki, motion carried.
COMMITTEE REPORTS
Ald. Schaumberg presented the report of the Finance Committee meeting held on April 18, 1973, and moved that they be accepted and placed on file. Seconded by Ald. Dumke. Ald. Knudsen requested that the last paragraph on the first page be removed for the purpose of
having it discussed as a separate issue. The motion to accept the report excluding the last paragraph on the first page carried. After discussion, Ald. Foldy moved to amend the last paragraph on the first page to read in part: "Dan Nowak's request for leave of absence from June 25th through July 13th, 1973, for the purpose of a honeymoon was considered. Ald. Dumke moved to grant the leave since the subject of his marriage and honeymoon was reviewed during his employment interview and later discussed with Building Inspector Lee and Mayor Gottfried........." Ald. Schaumberg seconded the motion. Ald. Dumke concurred and the motion to amend carried. The motion,to accept the last paragraph of the first page of the Finance Committee report carried.
Ald. Dumke presented the report of the Public Works Committee meeting held on April 19, 1973, and moved that it be accepted and placed on file. Seconded by Ald. Schaumberg. Ald. Foldy advised that a portion of the minutes was missing inasmuch as it had been that Committee's decision that l'a strong letter be sent to Gebhard & Nell regarding the construction of the city garage", same to be corrected at the next Committee meeting. The motion to accept the report carried.
Ald. Knudsen presented the report of the Public Safety Committee meeting held on April 12, 1973, and moved that it be accepted and placed on file. Seconded by Ald. Foldy. Ald. Knudsen pointed out that, although he was not a member of that Committee at that time, the minutes indicated that he had seconded a motion, same to be corrected at the next Committee meeting. The motion to accept the report carried.
Ald. Wallner presented the report of the Public Welfare Committee meeting held on April 19, 1973, and moved that it be accepted and placed on f:ile. Seconded by Ald. Knudsen. Ald. Foldy corrected the fourth paragraph to read in part: I'........ It also was agreed that the area
for dumping in 1973 be staked out and the number of trucks and the amount of tonnage of fill be filed monthly with the city........." The motion to accept the report carried.
The Plan Commission minutes of April 3, 1973, were accepted and placed on file.

UNFINISHED BUSINESS
Resolution #48-73 - Establishing the City's Intent to Change the Personnel Structure of the Muskego Police Dept. This resolution is on the floor and was deferred from the meeting of April 17. 1973. Ald. Foldy moved to defer action on Resolution e&3-73 for two-weeks for further review. Ald. Schaumberg seconded the motion and upon a voice vote the motion carried.
Ordinance #250 - An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Re: Mus-Kee-Guac Planned Development and McShane Road areas>. This ordinance is on the floor and was deferred from the meeting of 3/27/73. Ald. Foldy moved to amend the original Ordinance #250 to conform with Amended Ordinance #250. Ald. Dumke seconded the motion. Mayor Gottfried advised the aldermen that the original Ordinance #250 had provisions that the agreement was based on approval of a preliminary plat and the ordinance could not be adopted until the preliminary plat had been filed. He advised that in accordance with the developers and Attorney Buckley it had been agreed that the provisions for the preliminary plat be removed and that further amendments had been made establishing conditions which must conform to plat review, Section 18 of the Subdivision Control Ordinance and Section 6.02 of the Zoning Ordinance; that the rezoning will now take place, however, if the developers fail to comply with the conditions, the ordinance will become void. Upon a roll call vote the motion to amend carried unanimously with Ald. Wallner abstaining. Upon a roll call vote the motion to adopt Ordinance #250 As Amended carried unanimously with Ald. Wallner abstaining.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried expressed on behalf of himself and the Common Council appreciation to those citizens and organizations who had participated in the sandbagging of the dike. He advised that he has requested documented statements from Ruekert and Mielke concerning construction of the dam as well as from the Department of Natural Resources who had approved plans prior to construction; that he had requested Ald. Schaumberg to spearhead this report and make a written report to the Common Council and press. He pointed out that the purpose of this report is to determine facts as well as to determine if this was an unusual situation as the U. S. Soil Conservation Dept. had indicated that this was very close to a 100 year storm.
Mayor Gottfried declared recess at 8:34 P. M. and the meeting reconvened at 8:44 P. M.

Mayor Gottfried then advised that he and Mr. Bertram, Highway Superin- tendent, had toured the area with state and federal government representatives to determine the damage done by the storm to city property. He pointed out that if President Nixon does declare this area a disaster area, the city would receive some aid to repair the damage by the flood and, if so, the homeowner and businessman would

also have an opportunity to file for aid under the federal disaster fund. He also discussed the federal flood insurance program.

Ordinance #252 - The Deputy Clerk gave the first reading of. Ordinance
2252 entitled An Ordinance to Repeal Section 12.01 (5) (a) & Cb) of
the Municipal Code (Re: Class "A" Licenses).
Resolution #75-73 - Ald. Dumke moved to suspend the rules in order to
present Resolution #75-73 entitled Denial of Grievance Filed by Mary
Bursek. Ald. Foldy seconded the motion and upon a roll call vote,
Ald. Czarnecki and Dumke voted "no", Aldermen Foldy, Knudsen,
Schaumberg and Wallner voted "yes" and the motion carried. Ald. Dumke
then read Resolution #75-73 and moved for adoption. Ald. Wallner
seconded the motion. After discussion (see separate minutes), upon
a roll call vote, Ald. Czarnecki, Dumke, Foldy, Knudsen and Schaumberg
voted "yes", Ald. Wallner voted "no" and the motion carried.
LICENSE APPROVAL
Ald. Foldy moved for approval of Operators License for Margaret Treptow,
James Sarchet, Judy Schultz and Jacqueline Chapman. Ald. Schaumberg
l seconded the motion and the motion carried upon a voice vote.
Ald. Foldy moved to approve a Class B Fermented Malt Beverage and
Intoxicating Liquor License for Richard Strauss. Ald. Schaumberg
seconded the motion and the motion carried upon a voice vote.
Ald. Dumke moved for approval of a "Gathering" License for St.
Leonard?s Home and School for May 5, 1973. Ald. Czarnecki seconded the
motion and the motion carried upon a voice vote.
Ald. Foldy moved for approval of a Refuse Hauling Permit for ,Best
Disposal Co. Ald. Schaumberg seconded the motion. Ald. Knudsen moved
to defer action on this permit for two weeks. Ald. Wallner seconded
the motion. Upon a roll call vote, Ald. Czarnecki, Foldy, Knudsen,
Schaumberg and Wallner voted "yes", Ald. Dumke voted "no" and the
motion carried.
VOUCHER APPROVAL
Ald. Foldy moved to approve payment of general vouchers in the amount of $477,410.69 payable April 24, 1973. Aid. Wallner seconded the

motion and upon a roll call vote the motion carried unanimously.
Ald. Foldy moved to approve payment of sewer utility vouchers in the
amount of $20.209.38 payable April 24, 1973. Ald. Czarnecki seconded
the motion and upon a roll call vote the motion carried unanimously.
COMMUNICATIONS & MISCELLANEOUS BUSINESS
Ald. Foldy moved to schedule a public hearing for May 22, 1973, at
7:lS P. M. to consider Alvin Schaefer's petition to rezone property from B-2 to RS-2. Ald. Knudsen seconded the motion and the motion
carried.
Ald. Knudsen reminded the aldermen of Muskego Clean & Green Week
and of Clean Up Day to be held Saturday, April 28, between 8:30 A. M.
and 1:00 P. M.
