ccm19721226COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD DECEMBER 26, 1972 Mayor Gottfried called the meeting to order at 7~53 P.M. l PRESENT: Mayor Jerome Gottfried, Alderman Lois Cole, Edwin Dumke, Charles Foldy, RFord, Richard Knudsen and Paul Schaumberg. Also present were Deputy Clerk June Elger and City Attorney John P. Buckley. 0 ABSENT: Ald. Harold DeBack. APPROVAL OF MINUTES: Ald. Cole moved for the approval of minutes of the previous meeting held on December 12, 1972, as mailed. Seconded by Ald. Foldy. Motion carried. COMMITTEE REPORTS Ald. Cole presented the report of the Finance Committee meeting held on December 20, 1972. Ald. Foldy moved that the report be accepted and placed on File. Seconded by Ald. Cole, motion carried. Ald. Ford presented the report of the Public Works Committee meeting held on 12121172 and moved that it be accepted and placed on file. Seconded by l Ald. Schaumberg, motion carried. Ald. Ford presented the report of the Rules, Laws & Ordinance Committee meeting held on 12114172 and moved-that it be accepted and placed on file. Seconded by Ald. Foldy,, motion carried. The minutes of the Plan Commission meeting held on 12/19/72 were received and placed on file. UNFINISHED BUSINESS Resolution 1~231-72 - Appointment of Member to Park and Recreation Board (Wayne Haglund) As this resolution was on the floor from the previous meeting the motion to adopt same carried unanimously upon roll call. Resolution f/217-72 - Denial of Legal Lot Status for Lot i/35, Mill Valley Heights Subdivision (Preston) Aid. Schaumberg moved to again defer action an same for two weeks. Seconded by Ald. Knudsen. Upon a voice vote the motion carried. Ordinance $1241 - An Ordinance to Create Sec. 12.16 of the Municipal Code of the City of Muskego Regulating Swimming Pools. The Deputy Clerk gave the second reading of same. Ald. Foldy moved for adoption, seconded by Ald. Ford. Upon roll call the motion to adopt carried unanimously. Ordinance #245 - The Deputy Clerk gave the second reading of same, entitled An Ordinance to Create Section 7.14(4) of the Municipal Code of the City of Muskego (Re: Traffic Code) Ald. Foldy moved for adoption, seconded by Ald. Ford. Upon roll call the motion to adopt carried unanimously. e- NEW BUSINESS Resolution #240-72 - The Deputy Clerk read same, entitled, Approval of Maple Hills Estates Subdivision (Located in the Town of Vernon) Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Ald. Schaumberg moved to defer action on Resolution $1240-72, seconded by Ald. Foldy. Upon a voice vote the motion to defer carried. a Common Council City of Muskego 12126172 - Page 2. New Business - Cont'd. Resolution l/241-72 - The Deputy Clerk read same, entitled, Joining the 0 Wisconsin League of Municipalities. Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon a roll call vote the motion carried unanimously Resolution 1~242-72 - The Deputy Clerk read same, entitled, Approval of * Contract Between Muskego Volunteer Fire Co. and the City of Muskego. Ald. Cole moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried unanimously. Resolution 11243-72 - The Deputy Clerk read same, entitled, Approval of Contract Between Tess Corners Fire Dept. and the City of Muskego. Ald. Cole moved for adoption, seconded by Ald. Foldy. Upon roll call the motion carried unanimously. Resolution #244-72 - The Deputy Clerk read same, entitled, Transfer of Monies from Contingency Fund to Police Dept., Acct. 520.011 and 520.0112, Salaries. Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon roll call the motion to adopt carried unanimously. Resolution $1245-72 l - The Deputy Clerk read same, entitled, Transfer of Funds from Unappropriated Surplus to Account 520.050, Juvenile Program. Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. Resolution #246-72 - The Deputy Clerk read same, entitled, Approving the Agreement Between Acme Disposal, Wauer and the City of Muskego. Ald. Cole moved for adoption, seconded by Ald. Dumke. Ald. Knudsen moved to defer action on Resolution l/246-72 for two weeks due to the absence of one of his colleagues. The motion lost for lack of a second. Ald. Ford moved to amend Resolution l/246-72 by adding the following sentence to Point 2 con- tained in the resolution, "Any profits made from this program (recycling) shall be used for lake reclamation.". Seconded by Ald. Knudsen. Upon a roll call vote the motion to amend the resolution carried unanimously. Ald. Ford moved to further amend Resolution #246-72, Point 4, Hours of Operation, 4th line to read "7~30 A.M. to 5:30 P.M. Saturday." Seconded by Ald. Foldy. Following discussion, upon a roll call vote the motion to further amend the resolution carried unanimously. Ald. Foldy moved to amend Sec. 3.11 of the proposed agreement to read, "the maximum load to be deposited at the site shall not exceed a daily load of 600 tons per day delivered to the site six days a week." Seconded by Ald. Knudsen. Follow- ing further discussion, upon a roll call vote, Aldermen Cole, Dumke and Schaumberg voted "nay". Aldermen Foldy, Ford and Knudsen voted "aye". In order to break the tie, Mayor Gottfried voted "nay". The motion to amend the agreement as presented by Ald. Foldy did not carry. Ald. Knudsen moved to amend Point 3 of the resolution, Article 3, Sec. 3.1 of the agree- ment which would specify that Waste Management, Inc. will pay $26,000.00 back to the city at the signing of the contract on January, 1973. Seconded by Ald. Ford. Upon a roll call vote on the motion as presented by Ald. Knudsen, Aldermen Ford and Knudsen voted "aye". Aldermen Co,le, Dumke, Foldy and Schaumberg voted "nay". The motion did not carry. Upon a roll call vote to adopt Resolution 11246-72, As Amended, Aldermen Foldy, Ford and Knudsen voted "nay". Aldermen Cole, Dumke and Schaumberg voted "aye". In order to break the tie, Mayor Gottfried voted "aye". The motion to adopt Resolution l/246-72, As Amended, carried. Resolution 11247-72 - The Deputy Clerk read same, entitled, Authorizing 0 the Finance Committee to Hire a Parttime Maintenance Man for City Hall, Library and Police Department. Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon a roll call vote,%Aldermen Cole,'Dumke, Ford.,.Foldy and Knudsen voted "aye". Ald. Schaumberg voted "nay". The motion carried. Resolution #248-72 - The Deputy Clerk read same, entitled, Authorizing the 0 Finance Committee to Fill the Position of Assistant Inspector. Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unanimously. * Resolution i/249-72 - The Deputy Clerk read same, entitled, Declaring its Intent to Enter Into an Agreement With Developers of Mus-Kee-Quac (Roads) Ald. Schaumberg moved for adoption, seconded by Ald. Foldy. Ald. Foldy moved to amend the resolution by changing the word "park" to read "municipal" in Point 7, 3rd line of the resolution. Seconded by Ald. Schaumberg. Upon roll call the motion to amend carried unanimously. Upon a roll call vote to adopt Resolution i/249-72, As Amended, the motion carried unanimously. Resolution #250-72 - The Deputy Clerk read same, entitled, Authorizing Payment of Sewer Contractors in the Northeast District. Ald. Foldy moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion carried unanimously. Resolution f/251-72 - The Deputy Clerk read same, entitled, Adopting Com- e prehensive Park Plan for the City of Muskego. Ald. Ford moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion carried unanimously. Reconsideration of Resolution #240-72 - Ald. Schaumberg moved for the re- consideration of same, entitled, Approval of Maple Hills Estates Subdivision (Town of Vernon) Ald. Dumke seconded the motion. Upon roll call the motion carried unanimously. Ald. Schaumberg reviewed the June, 1972, minutes of the Plan Commission regarding the proposed subdivision. The Deputy Clerk read a cormnunication from SEWPRC directed to the City of Muskego recommending denial of the proposed subdivisions in the Town of Vernon which, in their opinion, are creating urban sprawl. Discussion followed and upon a roll call vote to adopt Resolution 11240-72, Aldermen Cole, Knudsen and Schaumberg voted "aye". Aldermen Dumke, Foldy and Ford voted "nay". In order to break the tie, Mayor Gottfried voted "nay". The motion to adopt Resolution i/240-72 did not carry. VOUCHER APPROVAL - Ald. Cole moved for the approval of payment of general vouchers in the amount of $170,195.83, payable 12/26/72. Seconded by Ald. Dumke. Upon roll call the motion carried unanimously. l Ald. Cole moved for the approval of payment of sewer utility vouchers in the amount of $27,703.63, payable 12126172. Seconded by Ald. Dumke. Upon roll call, Aldermen Cole, Dumke, Ford, Foldy and Schaumberg voted "aye". Ald. Knudsen voted "nay!'. The motion carried. Aid. Cole moved for the approval of payment of sewer construction vouchers in the amount of $37,398.00 payable 12/26/72. Seconded by Ald. Foldy. Upon a roll call vote, Aldermen Cole, Dumke, Ford, Foldy and Schaumberg voted "aye". Ald. Knudsen voted "nay". The motion carried. COMMUNICATIONS AND MISCELLANEOUS BUSINESS - The Deputy Clerk read a petition * for determination of status of Lot 6 Blk A, Hi-Y Ranches Subdivision, submitted by Mrs. William Thomka. Same referred to Plan Commission. The Deputy Clerk read a communication from Mrs. Mildred Burcalew, Sec'y. of the Country-side Theatre, dated 12116172, requesting the Colon Council to consider the preservation of old city hall building as the city's official Muskego Museum. Same referred to Finance Committee. l Ald. Knudsen recommended that the appointment of a committee for the promotion of the city's industrial park be considered. ADJOURNMENT - Ald.
