ccm19721212COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD DECEMBER 12, 1972 Mayor Gottfried called the meeting to order at 7:55 P.M. l PRESENT: Mayor Jerome Gottfried, Aldermen Lois Cole, Edwin Dumke, Charles Foldy, Ronald Ford, Richard Knudsen and Paul Schaumberg. Also present were Deputy Clerk June Elger and City Attorney John P. Buckley. * ABSENT: Alderman Harold DeBack. APPROVAL OF MINUTES: Ald. Cole moved for the approval of minutes of the previous meeting held on November 28, 1972, as mailed. Seconded by Ald. Dumke. Motion carried. COMMITTEE REPORTS Ald. Cole presented the report of the Finance Committee meeting held on December 6, 1972, and moved that the report be accepted and placed on file. Seconded by Ald. Foldy, motion carried. Ald. Cole presented the report of the Public Welfare Committee meeting held on 1216172 and moved that it be accepted and placed on file. Seconded 0 by Ald. Dumke, motion carried. Ald. Ford presented the report of the Rules, Laws & Ordinance Committee meeting held on 11/30/72 and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. Ald. Knudsen presented the report of the Public Sewer Committee meeting held on 12111172 and moved that it be accepted and placed on file. Seconded by Ald. Foldy, motion carried. The minutes of the Plan Commission meeting held on 12/5/72 were received and placed on file, UNFINISHED BUSINESS Resolution i/204-72 - Returning a Portion of Woods Road Back to its Original Right-of-Way (Frank DeAngelis) This resolution was on the floor and had been deferred from the previous meeting. Following considerable discussion regard- @ ing the matter, upon a roll call vote to adopt Resolution 11204-72 Aldermen Cole, Dumke, Foldy, Ford and Schaumberg voted "nay". Ald. Knudsen voted "aye". The motion to adopt Resolution #204-72 did not carry. NEW BUSINESS Resolution 8224-72 - The Deputy Clerk read same, entitled, Authorizing the Renewal of Contract Between Associated Hospital Services and the City of Muskego for the Year 1973 (Blue Cross-Blue Shield) Ald. Cole moved for adoption, seconded by Ald. Dumke. Upon roll call the motion carried unan- imously. e= Resolution i/225-72 - The Deputy Clerk read same, entitled, Extending Deadline Date for Partial Payment of 1972 Real Estate Taxes. Ald. Cole moved for adoption, seconded by Ald. Knudsen. Upon a voice vote, motion carried. Resolution #226-72 - The Deputy Clerk read same, entitled, Establishing Traffic Regulations ("Yield" sign on Coleridge Ct.) Ald. Cole moved for a adoption, seconded by Ald. Ford, Upon a voice vote the motion carried. New Business - Cont'd. Common Council 12112172 - Page 2 Resolution #227-72 - The Deputy Clerk read same, entitled, Authorizing the Advertising of Bids for New Squad Cars. Ald. Foldy moved for the adoption of same, seconded by Ald. Cole. Upon a roll call vote the l motion to adopt same carried. Resolution #228-72 - The Deputy Clerk read same, entitled, Authorizing Tax Researchers, Inc. to Investigate Income Tax Allocations. Ald. Cole * moved for adoption, seconded by Ald. Foldy. Upon a roll call vote the motion to adopt carried unanimously. Resolution #229-72 - The Deputy Clerk read same, entitled, Denial of Request for Wisconsin Council of County and Municipal Employees to Act as Bargaining Agent for City Hall - Library Employees. Ald. Foldy moved for adoption, seconded by Ald. Cole. Upon roll call the motion carried unanimously. Resolution #231-72 - The Deputy Clerk read same, entitled, Appointment of Member to Park and Recreation Board (Wayne Haglund) Ald. Ford moved for adoption, seconded by Ald. Schaumberg. Ald. Foldy moved to defer action on Resolution i/231-72 in order to personally contact Mr. Haglund. Seconded by Ald. Knudsen. Upon voice vote the motion to defer carried. e Resolution #232-72 - The Deputy Clerk read same, entitled, Denial of Legal Lot Status (Lot 3 Block 3, Hillview Farm Plat - Salla). Ald. Schaumberg moved for adoption, seconded by Ald. Knudsen. Upon roll call the motion carried unanimously. Resolution #233-72 - The Deputy Clerk read same, entitled, Authorizing the Advertising of Bids for Fuel Oil and Gasoline for City Purposes. Aid. Cole moved for adoption, seconded by Ald. Foldy. Upon roll call the motion to adopt carried unanimously. Resolution #217-72 - Ald. Knudsen moved for the reconsideration of same, entitled, Denial of Legal Lot Status for Lot 1135, Mill Valley Heights Subdivision (Preston) Seconded by Ald. Foldy. Ald. Knudsen requested permission of his fellow Aldermen to have Mr. Frank Preston speak. As there were no objections, Mr. Preston briefly reviewed previous legal transactions of Lot 35 and the adjoining lots in Mill Valley Heights Subdivision. Following discussion and upon the advice of City Attorney Buckley, Ald. Knudsen moved to defer action on Resolution f/217-72 for two weeks in order to give Attorney Buckley an opportunity to review the legal transactions regarding the lots in 1 uestion. Seconded by Ald. Schaumberg. Upon a voice vote, motion Carrie . Resolution #234-72 - The Deputy Clerk read same, entitled, Authorizing the Placement of Street Lights (City Hall entrances and Briargate and Lannon) Ald. Cole moved for adoption, seconded by Ald. Ford. Upon roll call the motion to adopt carried unanimously. Resolution #235-72 - The Deputy Clerk read same, entitled, Denial of Claim of Walter Vesbach. Ald. Cole moved for adoption, seconded by Ald. Foldy. Ald. Knudsen reviewed a communication dated January, 1962, from Lawrence Graves of Continental Appraisal Co. indicating that the land in question was suitable for the growing of crops. Following considerable discussion regarding~ the,matter, upon a roll call vote to adopt Resolution 1~235-72, Aldermen Cole, Dumke, Foldy, Ford and Schaumberg voted "aye". Ald. Knudsen voted "nay". The motion to adopt Resolution #235-72 carried. Resolution 11236-72 - The Deputy Clerk read same, entitled, Renewal of l Maintenance Agreement for Savin Copy Machine at Police Dept. Ald. Resolution 1~237-72 - The Deputy Clerk read same, entitled, Termination of Conditional Use Grant #45 (Bentley - kennel on Tans Drive) Ald. l Schaumberg moved for adoption, seconded by Ald. Dumke. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #238-72 - The Deputy Clerk read same, entitled, Denial of l Request for Variance for Lot in Meadowdale Subdivision (Heikkenin) Ald. Schaumberg moved for adoption, seconded by Ald. Knudsen. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #239-72 - Approving Lease Between City of Muskego and Thode Estate. Ald. Foldy moved to suspend the rules that would interfered with the adoption of same. Seconded by Ald. Schaumberg. Upon roll call the motion to suspend the rules carried unanimously. Ald. Schaumberg moved for adoption, seconded by Ald. Ford. Upon a roll call vote the motion to adopt Resolution 8239-72 carried unanimously.(Said lease to cover storage space for highway equipment) Ordinance #241 - The Deputy Clerk gave the first reading of same, entitled, An Ordinance to Create Sec. 12.16 of the Municipal Code of the City of l Muskego Regulating Swimming Pools. Ordinance #244 - The Deputy Clerk gave the first reading of same, entitled, Appropriating the Necessary Funds for the Operation of Government and Administration of the City of Muskego for 1973. Ald. Foldy moved to suspend the rules in order that the second reading could be given. Seconded by Ald. Cole. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Deputy Clerk gave the second reading of Ordinance #244. Ald. Foldy moved for adoption, seconded by Ald. Cole. Upon roll call the motion to adopt Ordinance #244 carried unanimously. Ordinance 1~245 - The Deputy Clerk gave the first reading of same, entitled, An Ordinance to Create Section 7.14(4) of the Municipal Code (Re: Traffic Code) At 9:35 P.M. Mayor Gottfried declared a recess and at 9:43 P.-M.. the meeting reconvened. VOUCHER APPROVAL - Ald. Cole moved for the approval of payment of sewer .* construction vouchers in the amount of $61,170.77 payable 12112172. Seconded by Ald. Dumke. Upon roll call onthe motion to pay the vouchers Aldei-mdn,COle, Dumke, Ford, Foldy and Schaumberg voted "aye". Ald. Knudsen voted "nay." The motion to pay the sewer construction vouchers carried. LICENSE-APPROVAL - Ald. Cole moved for the approval of a Class "B" Fermented Malt Beverage and Intoxicating Liquor License for Clarence Treptow (The Reef). Seconded by Ald. Dumke. Motion carried. Ald. Cole moved for the approval of Operator's Licenses for Delores Fenney and Sherry Schneider. Seconded by Ald. Foldy, motion carried. e- CITY OFFICIAL'S REPORTS - The Deputy Clerk gave the Building Report for the month of November, 1972, indicating permits for five single family units and four duplexes (8 units). Report placed on file. Ald. Ford advised that the Park and Recreation Board has approved a Comprehensive Park Plan for the City of Muskego prepared by the Waukesha County Park and Plan Commission. He urged his fellow aldermen to review l the plan prior to the next Council meeting. ADJOURNMENT - Ald. Knudsen moved to adjourn the meeting, seconded by Ald. Dumke. Motion carried.
