MINUTES OF MEETING HELD NOVEMBER 28, 1972
Mayor Gottfried called the meeting to order at 8:09 P.M.
l PRESENT: Mayor Jerome Gottfried, Aldermen Lois Cole, Edwin Dumke, Charles
Foldy, Richard Knudsen and Paul Schaumberg. Also present were City Attorney
John Buckley and City Clerk Bette Bowyer.
0 ABSENT: Aldermen Harold DeBack and Ronald Ford
APPROVAL OF MINUTES - Ald. Cole moved for the approval of minutes of the
previous meeting held on November 14, 1972, as mailed. Seconded by Ald.
Foldy, motion carried.
COMMITTEE REPORTS
Ald. Cole presented the report of the Finance Committee meeting held on
11122172 and moved that the report be accepted and placed on file. Sec-
onded by Ald. Dumke, motion carried.
Ald. Cole presented the report of the Public Safety Couanittee meeting held
on 11/16/72 and moved that it be accepted and placed on file. Seconded
a by Ald. Knudsen, motion carried.
Ald. Foldy presented the report of the Rules, Laws & Ordinance Committee
meeting held on 11/16/72 and moved that it be accepted and placed on file.
Seconded by Ald. Dumke, motion carried.
The minutes of the Plan Commission meeting held on 11/21/72 were received
and placed on file.
UNFINISHED BUSINESS
Resolution i/204-72 - Returning a Portion of Woods Road Back to its Original
Right-of-Way (Frank DeAngelis) Ald. Foldy moved to defer action on the
resolution until the Council meeting immediately following the next Public
Works meeting. Seconded by Ald. Knudsen. Upon a voice vote the motion
carried.
Ordinance 11240 - An Ordinance Creating Sec. 12.17 of the Municipal Code
Regulating Parades and Other Similar Uses of Public Places. This ordinance with a proposed amendment was on the floor from the meeting
of November 14, 1972. Ald. Foldy moved to amend the proposed amendment
by deleting paragraph (b) completely. Also, by deleting the words
"the assemblage or the meetings" in paragraph (c) which would now be
renumbered paragraph (b) and also, paragraph (d) would be renumbered
paragraph (c). The motion was seconded by Ald. Knudsen. Upon a voice
vote, the motion to amend the amendment carried. Upon a voice vote,
the motion to adopt the amendment, as amended, carried. Upon a roll
call vote, the motion to adopt Ordinance 8240, As Amended, carried.

Mayor Gottfried reminded the aldermen of the meeting on pulverization
to be held at the Waukesha City Hall on Thursday, December 7, 1972,
at 7:00 P.M.

Mayor Gottfried reminded the aldermen of the dedication of new city hall
and library on Sunday, December 3, 1972, between the hours of 12:00 Noon
and 4:OO P.M. The formal dedication ceremony to be at 2:00 P.M.
NEW BUSINESS
Resolution #215-72 - The Clerk read same, entitled, Approval of Schultz
Sav-0 Stores (Piggly Wiggly) to Connect Into the City Sewer System. Ald.
Schaumberg moved for adoption, seconded by Ald. Knudsen. Upon a roll
call vote the motion to adopt carried unanimously.
Resolution i/216-72 - The Clerk read same, entitled, Approval of Permit for
Payne 6 Dolan to Operate Portable Asphalt Plant. Ald. Schaumberg moved
for adoption. Seconded by Ald. Dumke. Upon a roll call vote, the motion
to adopt carried unanimously.
Resolution i/217-72 - The Clerk read same, entitled, Denial of Legal Lot
Status for Lot 1135, Mill Valley Heights Subdivision (Preston) Ald.
Schaumberg moved for adoption, seconded by Ald. Knudsen. Following
discussion, upon a roll call vote to adopt Resolution #217-72, Aldermen
Dumke, Knudsen and Schaumberg voted "aye". Aldermen Cole and Foldy
voted "nay". The motion to adopt Resolution i/217-72 carried.
Resolution #218-72 - The Clerk read same, entitled, Denial of Legal Lot
Status for Lots 1 & 2, Blk 5, Bay Shore Hills Subdivision. Aid. Schaum-
berg moved for adoption, seconded by Ald. Knudsen. Upon a roll call vote
the motion to adopt Resolution 1~218-72 carried unanimously.
Resolution #219-72 - The Clerk read same, entitled, Deferral of Special
Assessments Payable in Installments and Redesignation of Special Assess-
ment B Bonds to be Issued in Anticipation Thereof (Durham Meadows). Ald.
Foldy moved for adoption, seconded by Ald. Dumke. Upon a roll call vote
the motion to adopt carried unanimously.
At 9:05 P.M. Mayor Gottfried declared a recess and the meeting reconvened
at 9:37 P.M.
Resolution #220-72 - The Clerk read same, entitled, Acceptance of Low
Bid for Forced Hook-ups (F District) (Ed Zidar Plbg. Co.) Ald. Schaum-
berg moved for adoption, seconded by Ald. Dumke. Ald. Knudsen requested
permission of his fellow aldermen to abstain from voting. Upon roll call
the motion to adopt carried unanimously.
Resolution #221-72 - Ald. Foldy moved to suspend the rules in order that
this resolution could be brought to the floor. Seconded by Ald. Dumke.
Upon a roll call vote the motion to suspend the rules carried unanimously.
The Clerk read Resolution Y/221-72, entitled, Authorizing Release of Land
Covenant (Gerald R. Wichman) Ald. Foldy moved for adoption, seconded by
Ald. Knudsen. Ald. Cole requested permission of her fellow aldermen to
abstain from voting. Upon roll call the motion to adopt carried unanim-
ously.

VOUCHER APPROVAL - Ald. Cole moved for the approval of payment of
general vouchers in the amount of $184,229.13 payable 11128172. Sec-
onded by Ald. Dumke. Motion carried.upon a roll call vote.
Ald. Cole moved for the approval of payment of sewer construction vouchers
in the amount of $210,442.25. Seconded by Ald. Foldy. Upon a roll call
vote to pay the sewer construction vouchers Aldermen Cole, Dumke, Foldy
and Schaumberg voted "aye". Ald. Knudsen voted "nay". The motion to
pay the vouchers carried.
LICENSE APPRGVAL - Ald. Cole moved for the approval of payment of
Operators Licenses for Robert Budish, James Gleason, John Gardner and
Robert Grove. Seconded by Ald. Dumke, motion carried.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
Ald. Dumke requested that the City Attorney submit a written opinion
to the Council relative to the provisions of Chapter 18.28 and 18.30
of the Subdivision Control Ordinance.

In answer to a question from Ald. Knudsen, City Attorney Buckley
reported briefly on pending city affairs.
ADJOURNMENT - Ald. Knudsen moved to adjourn. Seconded by Ald. Cole.
Motion carried. The meeting adjourned at 9:55 P.M.
