ccm19720711COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD JULY 11, 1972 Mayor Gottfried called the meeting to order at 7~52 P.M. a PRESENT: Mayor Gottfried, Aldermen DeBack, Dumke, Foldy, Knudsen, Sapp and Schaumberg. Also present were City Clerk Bette Bowyer and City Attorney John Buckley. Ald. Ford arrived at 8:16 P.M. APPROVAL OF MINUTES: Ald. Sapp moved for the approval of minutes of the a previous meeting held on 6127172. Seconded by Ald. Dumke, motion carried. COMMITTEE REPORTS Ald. Sapp presented the report of the Finance Committee meeting held on July 5, 1972, and moved that it be accepted and placed on file. Seconded by Ald. Dumke, motion carried. Ald. Schaumberg presented the report of the Public Works Committee meeting held on July 6, 1972, and moved that it be accepted and placed on file. Seconded by Ald. DeBack, motion carried. Ald. Sapp presented the report of the Public Welfare Committee meeting l held on July 15, 1972, and moved that the report be accepted and placed on file. Seconded by Ald. Knudsen, motion carried. Ald. Knudsen presented the report of the Public Sewer Committee meeting held on July 6, 1972, and moved that the report be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. UNFINISHED BUSINESS Ordinance 11217 - An Ordinance to Amend Certain Provisions of Ch. 17 of the Municipal Code (Re: Accessory Buildings). Ald. Foldy moved to defer action on same for two weeks. Seconded by Ald. Knudsen, motion carried. Resolution #118-72 - Denying Request for Municipal Sewers to Serve the Lazynski-Beck property. Ald. Schaumberg moved to defer action on same pending written legal opinion. Seconded by Ald. Dumke, motion carried. Resolution #124-72 - A Resolution Deferring Special Assessments Against Farm Lands (NW Dist., James & Joan Kohne) Ald. Schaumberg moved to defer a action for two weeks on same pending unfinished easement negotiations. Seconded by Ald. Foldy. The motion to defer carried. Ordinance #226 - The Clerk gave the second reading of Ordinance #226, entitled, An Ordinance to Rezone Certain Property and to Amend the Zoning Map of the City of Muskego (Pioneer Centre) Ald. Foldy moved for adoption, seconded by Ald. Schaumberg. Upon a roll call vote, Aldermen Dumke, Knudsen, Foldy, Sapp and Schaumberg voted "aye". Ald. DeBack voted "nay". The motion to adopt Ordinance 11226 carried. Ordinance 11228 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Certain Provisions of Ch. 12 of the Municipal Code a of the City of Muskego (Re: Proration of License Fees). Ald. Foldy moved for adoption, seconded by Ald. Sapp. Ald. Foldy moved to defer action on Ordinance #228 for two weeks pending recommendation by the Rules, Laws and Ordinance Committee. Seconded by Ald. Knudsen. The motion to defer carried. l Resolution f/133-72 - Resolution Relating to the City of Muskego's Deter- mination Not to Participate with the City of Franklin in Construction of Forced Main. (This resolution on the floor from previous meeting) Common Council-City of Muskego l/11/72 - Page 2. Ald. Foldy spoke in favor of amending Resolution i/133-72 to read as follows: "BE IT RESOLVED, that the Common Council of the City of Muskego, upon recommendation of the Public Sewer Committee, does hereby determine a that the City of Muskego participate with the City of Franklin in the con- struction of a forced and gravity sewer main in the City of Franklin. BE IT FURTHER RESOLVED that the cost to the City of Muskego not exceed $15,000.00" Motion seconded by Ald. DeBack. Following discussion, Ald. Foldy moved to amend the amendment by eliminating the words "upon the recommendation of the Sewer Committee". 0 Motion seconded by Ald. DeBack. Upon a roll call vote to amend the amendment, Aldermen DeBack, Foldy, Knudsen, Sapp and Schaumberg voted "aye". Aldermen Dumke and Ford voted "nay". The motion to amend the amendment carried. At this time Ald. Schaumberg requested permission of his fellow aldermen to have Attorney Russell Stepke, Attorney for landowners in the area, speak. As there were no objections, Attorney Stepke spoke in favor of Alderman Foldy's amendment. Considerable discussion followed and upon a roll call vote to amend Resolution i/133-72, as proposed by Ald. Foldy, Aldermen DeBack, Foldy and Schaumberg voted "aye". Aldermen Dumke, Ford,Knudsen and Sapp voted "nay". The motion to amend Resolution #133-72 did not carry. Upon a roll call vote to adopt Resolution i/133-72 as origina~lly presented, Aldermen Dumke, Ford, Knudsen and Sapp voted "aye". Aldermen DeBack, Foldy and Schaumberg voted "nay". The motion to adopt Resolution #133-72 l carried. At 9:ll P.M. Mayor Gottfried declared a recess and at 9:22 P.M. the meeting reconvened. COMMUNICATIONS FROM THE MAYOR'S OFFICE Mayor Gottfried advised that it was his hope that the new city hall would be ready for occupancy by August lst, however, grading and parking area needed to be accomplished. NEW BUSINESS Resolution #134-72 - The Clerk read same, entitled, Directing the City Attorney to Draft the Necessary Ordinance to Amend the Zoning Ordinance (Re: Permitting Rendering Plants as Conditional Use in I-l Dist.) Ald. Foldy moved for adoption, seconded by Ald. Sapp. In answer to a question from Ald. Dumke, Mayor Gottfried advised that the proposed amendment to e the Zoning Ordinance would permit rendering plants in industrial districts as a conditional use grant subject to a public hearing ardPlan Commission approvals. Upon a roll call vote to adopt Resolution j/134-72, Aldermen Sapp, Dumke, Foldy, Ford, Knudsen and Schaumberg voted "aye". Ald. DeBack voted "nay". The motion to adopt carried. Resolution f/135-72 - The Clerk read same, entitled, Authorizing the Dredging Committee to Discuss Dredging Project with Consulting Engineers. Ald. Dumke moved for adoption, seconded by Ald. Ford. Upon a roll call vote, the motion to adopt carried unanimously. Resolution #136-72 - The Clerk read same entitled, Declaration of Intent a to Levy Special Assessments and Designating Durham Meadows Subdivision as the Special Assessment District. Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon a roll call vote, the motion to adopt carried unanimously Resolution f/137-72 - The Clerk read same, entitled, Setting the Public Hearing Date With Respect to Respect to Special Assessments (Durham Meadows l Subdivision) Ald. Sapp moved for adoption, seconded by Ald. Foldy. Upon a roll call vote, the motion to adopt carried unanimously. New Business - Cont'd. Common Council J/11/72 - Page 3. Resolution #138-72 - The Clerk read same, entitled, Authorizing Publication a of Advertisement of Bids and Setting the Time for Receiving Bids (Durham Meadows Subdivision) Ald DeBack moved for adoption, seconded by Ald. Saw. Upon a roll call vote, the motion to adopt carried unanimously. Resolution.#l39-72 - The Clerk read same, entitled, Appointment to Library a Board (Joan Dibb, Donna Lenz and Elaine Modlinski - Term to expire July 1, 1975) Ald. DeBack moved for adoption, seconded by Ald. Sapp. Upon a roll call vote, the motion to adopt carried unanimously. At 10:00 P.M. Ald. DeBack requested to be excused from the meeting. VOUCHER APPROVAL - Ald. Sapp moved for the approval of payment of general vouchers in the Amount of $12,670.25. Seconded by Ald. Foldy, motion carried. Ald. Sapp moved for payment of sewer construction vouchers in the amount of $96,395.28, seconded by Ald. Foldy, motion carried. LICENSE APPROVAL - Ald. Sapp moved for the approval of Operators License e for LeAnne Giesgh and for the approval of Operators Licenses for Mary Kuske, Robert Russom and Susan Markofski, subject to receipt of favorable Finger- print Reports and for the approval of Operators Licenses for Carol Ruege and Alyce Bemowski, subject to receipt of favorable Medical and Fingerprint Reports. Seconded by Ald. Dumke, motion carried. Ald. Sapp moved for the approval of Class "B" Fermented Malt Beverage and Intoxicating Liquor License for John Budish. Seconded by Ald. Dumke, motion carried. Ald. Foldy moved for the approval of "Gathering" License for VFW for July 14, 15 & 16, 1972. Ald. Sapp moved for the approval of a Refuse Hauler Permit for Town & Country Disposal and Rel Sanitation. Seconded by Ald. Foldy, motion carried. CITY OFFICIAL'S REPORTS - The Clerk gave the Building Report for the month * of June, 1972, showing eight new dwelling permits have been issued.
