MINUIES OF MEETING HEID JUNE 27, 1972
Mayor Gottfried called the meeting to order at 7:36 P. M.
PRESENT: Mayor Gottfried, Aldermen DeBack, Dumke, Foldy, Pord, Knudsen,
Sapp and Schaumberg. Also present were City Clerk Bette Bowyer and
City Attorney John-Buckley.
APPROVAL OF MINUTES: Ald. Sapp moved for the approval of minutes of
the previous meeting held on June 13, 1972. Seconded by Ald. Foldy,

COMMITTEE REPORTS
on Ald. Sapp presented the report of the Finance Committee meeting held
June 21, 1972, and moved that it be accepted and plS.Ced on file. Ald.
Dumke seconded the motion, motion carried. Ald. Sapp then presented
the Finance Committee report of June 27, 1972, and moved that it be
accepted and QlaCed on file. Seconded by Ald. Dum.ke, motion carried.

Ald. Ford presented the report of the Public Works Committee meeting held
on June 22, 1972, and moved that it be accepted and placed on file.

Ald. DeBack presented the report of the Public Safety Committee meeting
held on June 15, 1972, and moved that it be accepted and placed on file.
Seconded by Ald. Sapp, motion carried.
Ald. Ford presented the report of the Rules, Laws & Ordinance Committee meeting held on June 21, 1972, and moved that the report be accepted
and placed on file. Seconded by Ald. Foldy, motion carried.
Ald. SaQQ presented the report of the Public Welfare Committee meeting
held on June 15, 1972, and moved that the report be accepted and placed
on file. Seconded by Ald. Dumke, motion carried.
Ald. Knudsen presented the report of the Public Sewer Committee meeting
held on June 19, 1972, and moved that the report be aCCepted and placed
on file. Seconded by Ald. Schaumberg, motion carried.
The minutes of the Plan Commission meeting held on June 20, 1972, were
received and placed on file.
UNFINISHED BUSINESS
Ordinance #216 - An Ordinance to Amend Certain Provisions of Ch. 17 of
the Municipal Code (Re: Fencing of Permanent Pools). Ald. Foldy moved
to table Ordinance #216. Ald. Knudsen seconded the motion, motion
carried unanimously upon a roll call vote.
Ordinance #217 - An Ordinance to Amend Certain Provisions of Ch. 17 of
the Municipal Code (Re: Accessory Buildings). Ald. Foldy moved to defer
action on same for two weeks. Seconded by Ald. Ford, motion carried.
Resolution #lo&72 - Indicating the City's Intent to Permit Connection
zto its Municipal Sewer System (Pioneer Centre). Ald. Foldy Spoke in
favor of the adoption of Resolution #108-72. Upon a roll call vote
Aldermen Dumke, Foldy, Sapp and Schaumberg voted "aye" and Aldermen
DeBack, Ford and Knudsen voted "nay" and the motionin adopt carried.
Resolution #118-72 - Denying Request for Municipal Sewers to Serve the Lazynski-Beck Property. Ald. Sapp moved to defer action for two weeks
pending legal opinion from city attorney. Ald. Schaumberg seconded the
motion, motion carried.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried advised that it appears that the new city hall will be
ready for occupancy around August 1st. that Ed Subel has agreed to work
with the aldermen in preparation for the dedication ceremonies which
should be held the latter part of September or first part of October.
City Clerk Bowyer volunteered to work on the program.

Resolution #120-72 - The Clerk read same entitled Approving of Disbandment
of Muskego Auxiliary Police and the Creation of Emergency Police Unit.
Ald. Sapp moved for adoption, seconded by Ald. Ford. Upon a roll call
vote the motion to adopt carried unanimously.
Resolution #121-72 - A Resolution Relating to Final Determination of Special Assessments Northwest Dist. H-8 - Projects MSS-1-72 and MSS-2-72.
In accordance with agreement of the council members, the Clerk read
Resolution #121-72 by title only. Ald. Foldy moved for adoption, seconded
by Ald. Schaumberg. There was discussion and clarification of the 8%
per annum interest charge on the ten year installment plan for sewer
payment. Upon a roll call vote, the motion to adopt carried unanimously.
Resolution #122-72 - A Resolution Levying Special Assessments (Northwest
District - H-8 - Projects MSS-1-72 & MSS-2-72. The Clerk read Resolution
#122-72 by title only. Ald. Schaumberg. Ald. Knudsen moved for adoption? seconded by Upon a roll call vote the motion carried unanimously.
Resolution #123-72 - Resolution Directing Notice of Final Determination. The Clerk read Resolution #123-72. Ald. Schaumberg moved for adoption,
seconded by Ald. Dumke. Upon a roll call vote, the motion carried
unanimously.
Mayor Gottfried declared recess at 8:18 P. M. and the meeting reconvened
at 8:22 P. M.
Resolution #124-72 - A Resolution Deferring Special Assessments Against
Farm Lands (NW District - James & Joan Kohne). The Clerk read Resolution
#124-72 by title only. Ald. Schaumberg moved for adoption, seconded by
Ald. Dumke. Aid. Schaumberg moved to defer action for two weeks. Aid.
Knudsen seconded the motion, motion carried.
Resolution #125-72 - The Clerk read Resolution #125-72 entitled Acceptance
of Rid for Municipal Sewer District Project MSS-1-72 (NW District H-8). Ald. Schaumberg moved for adoption, seconded by Knudsen. Upon a roll call
vote the motion carried unanimously.
Resolution $126-72 - The Clerk read Resolution n"126-72 entitled Acceptance
of Bid for Municipal Sewer District Project rMSS-2-72 (NW District H-8).
Ald. Schaumberg moved for adoption! seconded by Ald. Dumke. Upon a roll
call vote, the motion carried unanimously.
Resolution #127-72 - The Clerk read Resolution #127-72 entitled Partici- pating in the League of Municipalities Labor Realtions Communications
Program. Ald. Foldy moved for adoption, seconded by Ald. Sapp. Upon
a roll call vote Alermen Dumke, Foldy, Ford, Knudsen and Sapp voted "aye",
Aldermen DeBack and Schaumberg voted "nay" and the motion carried.
Resolution $128-72 - The Clerk read Resolution #128-72 entitled Transfer
of Funds from Con,tingencv Fund to Emergency Police Fund. Ald. Foldv moved for adoption, seconded by Ald. Sapp.. Ald. Sapp moved to amend
Resolution #128-72 by deletion of the words "Emergency Police Fund, Act.
#520.0115" in the first and third paragraphs to be replaced with "Capital
Budget, Act. #275". Ald. Foldy seconded the motion and the motion to
amend carried. Upon a roll call vote the motion to adopt Resolution #128-72 As Amended carried unanimously.
Resolution #129-72 - The Clerk read Resolution X129-72 entitled Authorizing
Eansfer of Funds from Contingency Fund to Emergency Police Fund. Ald. Sapp moved for adoption, seconded by Aid. DeBack. Upon a roll call vote the motion to adopt carried unanimously.
Resolution #130-72 - The Clerk read Resolution #130-72 entitled Approval of Extractive Permit for Wauer Fur Foods, Inc. Ald. Schaumberg moved for adoption, seconded by Ald. DeBack. The Common Council reviewed the map which indicated the area of the extractive operation which had been
displayed at the public hearing before the Plan Commission June 20th.
It was noted by the Council that approximately 58.8 acres of a total
134 acres were included in the request for extractive permit. Ald. Knudsen expressed opposition at the restoration for this operation being
by the landfill method. Attorney Buckley advised that the agreement
between the city and Wauer Landfill, Inc., should be prepared for review by the next Common Council meeting. Aid. Foldy moved to defer action on Resolution #130-72 for four weeks, seconded by Ald. Knudsen, motion carried.

Resolution #131-72 - The Clerk read Resolution #131-72 entitled
Establishing Traffic Regulations (Stop sign at intersection of Longfellow

Lane & Somerset Drive.) Ald. Sapp moved for adoption, seconded by Ald.
DeBack, motion carried.
Resolution #132-72 - The Clerk read Resolution #132-72 entitled Initiating
Petition to Amend the Zoning Ordinance (Change in the basic regulations
of the I-l District). Ald. DeBack moved for adoption, seconded by
Ald. Foldy. Mayor Gottfried explained reasons for this zoning change.
The motion carried.
Ordinance #226 - The Clerk gave the first reading of Ordinance #226
entitled An Ordinance to Rezone Certain Property and to Amend the
Zoning Map of the City of Muskego (Pioneer Centre). Ald. Foldy moved
to suspend the rules in order to permit the second reading of Ordinance
#226. Ald. Schaumberg seconded the motion. Upon a roll call vote
Aldermen Dumke, Foldy, Sapp and Schaumberg voted "aye" and Ald. DeBack,
Ford and Knudsen voted "nay". As suspension requires a 2/3 vote, the
motion lost.
Ordinance #228 - The Clerk gave the first reading of Ordinance #228
entitled An Ordinance to Amend Certain Provisions of Ch. 12 of the Municipal Code of the City of Muskego (Proration of license fees). a VOUCHER APPROVAL - Ald. Sapp moved for approval of payment of general
vouchers in the amount of $310.753.93. Seconded bv Ald. Dumke. Uoon
a roll call vote the motion carried unanimously. ' . I
Ald. Sapp moved for approval of payment of sewer construction vouchers
in the amount of $74,170.02. Seconded by Ald. Foldy. Upon a roll call
vote the motion carried unanimously.
LICENSE APPROVAL
Ald. Sapp moved for approval of Swimming Beach Permit and Waterway Marker
Permit for Henry Czarnecki. Ald. Foldy seconded the motion. Ald.
Schaumberg advised the Council that there is a problem with picnicers
throwing trash and garbage over a fence on the property which ultimately
washes into the channel. Ald. Foldy moved to amend the motion to include "contingent upon satisfactory method of controlling the trash."
Ald. Sapp seconded the motion and the motion carried. Upon a roll call vote on the motion as amended,
"aye" and Aldermen Dumke, Ford, Ald. DeBack, Foldy and Sapp voted Knudsen and Schaumberg voted "nayt' and
the motion lost. Ald. Schaumberg moved for reconsideration, Ald. DeBack seconded the motion and upon a roll call vote the motion carried unanimouslp
Ald. Sapp moved for approval of a Swimming Beach Permit and Waterway
Marker Permit for Henry Czarnecki subject to the stipulation that he
install before July 1st additional footage of fence which will prohibit
the dumping of refuse and garbage into the creek as well as installation
of adequate facilities for collection of garbage and refuse, same to be
approved by Zoning Officer Lee. considerable discussion, Ald. Foldy seconded the motion. After Ald. Sapp withdrew the motion with the consent
of her second Ald. Foldy.
In accordance with recommendation from City Attorney Buckley, Ald. Sapp moved to approve a Swimming Beach Permit and Waterway Marker
Permit for Henry Czarnecki subject to the condition that the licensee
be responsible for all collection anddisposition of all trash and waste materials on the premises.

Ald. Foldy moved for approval of Operators Licenses for Michael Mueller,
Michael Hoffmeier, Robert Austin and Dennis Beres subject to receipt of
favorable medical and fingerprint reports. Ald. Dumke seconded the
motion and the motion carried.
l Ald. Sapp moved for approval of Operators Licenses for Kenneth Clark,
Gregory Gabrys, James Keeler, James Delisle and Roy Mueller subject to
receipt of favorable fingerprint report. Ald. Foldy seconded the motion
and the motion carried.
Ald. Dumke moved for denial of Class "A" Fermented Malt Beverage and
Intoxicating Liquor License for Wayne Hansen. Ald. Foldy seconded the
motion and the motion carried.

Ald. Sapp moved to approve Operators Licenses for Harland Knoff and
Mitchell Penovich. Ald. Dumke seconded the motion and the motion carried.
Mayor Gottfried declared recess at 9:28 P. at 9~40 P. M. M. and the meeting reconvened
Resolution #133-72 - Ald. Schaumberg moved to suspend the rules in order % permit the introduction of Resolution #133-72. Ald. Knudsen seconded the motion and upon a roll call vote the motion carried unanimously.
Mayor Gottfried read Resolution #133-72 entitled Resolution Relating to
the City of Muskego's Determination not to Participate with the City
of Franklin in Construction of Forced Main. Ald. Schaumberg moved to
adopt Resolution #133-72. Ald. Dumke seconded the motion. After
considerable discussion Ald. Foldy moved to defer action until the
next meeting. Ald. Knudsen seconded the motion and the motion carried.
COMMUNICATIONS & MISCELLANEOUS BUSINESS
The Clerk read a communication directed to the Council from the Plan Comm. dated June 22, 1972, requesting determination if sewers will be
available for development of the Farnsworth & Kuether properties, same
referred to Sewer Committee.
The Clerk read a communication dated June 19, 1972, directed to the
Mayor, Common Council, Plan Commission and Sewer Committee from
Alvin C. Basse regarding his intention to develop a portion of his
property, same referred to Sewer Committee.
The Clerk read a communication dated June 21, 1972, directed to the
Mayor and Council from Kenneth J. Dunlap requesting legal status for
Lot 15, Tess Corners Subdivision, same referred to Plan Commission.
The Clerk read a communication dated June 21, 1972, directed to the
Mayor and Council from Raymond and Jean Wallner requesting legal
status for Lots 4 and 15,

The Clerk read a communication dated June 22, 1972, directed to the

Ald. Foldy discussed Mr. Wachtel's request and expressed concern -that because of the July 4th holiday falling on the regular meeting date
the Plan Commission would not meet until July 18th.
