ccm19720613COMMON COUNCIL CITY OF MUSKEGO MINUTES OF MEETING HELD JUNE 13, 1972 Mayor Gottfried called the meeting to order at 7:50 P.M. a PRESENT: Mayor Gottfried, Aldermen DeBack, Dumke, Foldy, Ford, Knudsen, Sapp and Schaumberg. Also present were City Clerk Bette Bowyer and City Attorney John Buckley. APPROVAL OF MINUTES: * Ald. Sapp moved for the approval of minutes of the previous meeting held on May 23, 1972, and of the special meeting held on June 1, 1972. Seconded by Ald. Schaumberg, motion carried. COMMITTEE REPORTS Ald. Sapp presented the report of the Finance Committee meeting held on June 7, 1972, and moved that it be accepted and placed on file. Seconded by Ald. Dumke, motion carried. Ald. Ford presented the report of the Public Works Committee meeting held on June 12, 1972, and moved that it be accepted and placed on file. Seconded by Ald. DeBack, motion carried. l Ald. Ford presented the report of the Public Safety Committee meeting held on May 24, 1972, and moved that it be accepted and placed on file. Seconded by Ald. Sapp, motion carried. Ald. Ford presented the report of the Rules, Laws & Ordinance Conrmittee meeting held on June 7, 1972, and moved that the report be accepted and placed on file, Seconded by Ald. Foldy, motion carried. Ald. Sapp presented the report of the Public Welfare Committee meeting held on May 24, 1972, and moved that the report be accepted and placed on file. Seconded by Ald. Dumke, motion carried. Ald. Knudsen presented the report of the Public Sewer Committee meeting held on June 5, 1972, and moved that the report be accepted and placed on file. Seconded by Ald. Schaumberg, motion carried. The minutes of the Plan Commission meeting held on June 6, 1972, were received and placed on file. a UNFINISHED BUSINESS Ordinance #216 - An Ordinance to Amend Certain Provisions of Ch. 17 of the Municipal Code (Re: Fencing of Permanent Pools) Ald. Foldy moved to defer action until the Council meeting of 6/27/72. Seconded by Ald. Ford, motion carried. Ordinance #217 - An Ordinance to Amend Certain Provisions of Ch. 17 of the Municipal Code (Re: Accessory Buildings) Ald. Foldy moved to defer action on same for two weeks. Seconded by Ald. Knudsen, motion carried. l Ordinance #225 - The Clerk gave the second reading of same, entitled, An Ordinance to Amend Ch. 1.05 of the Municipal Code (Re: Plan Commission Membership) Ald. Foldy moved for adoption, seconded by Ald. Dumke. Upon a roll call vote the motion to adopt carried unanimously. Resolution #72-72 - Accepting 1972 Contract with Wis. Council of County and Municipal Employees, Local 1365-B (Dispatchers) Mayor Gottfried advised that a the city and the representative of the Wis. Council of County and Municipals Employees, Local 1365-B were now in agreement with all articles of the contract and the resolution could now be adopted. As it was already on the floor, upon a roll call vote to adopt Resolution #72-72, the motion carried unanimously. a a Unfinished Business - Cont'd. Common Council Meeting 6/13/73 - Page 2. Resolution #108-72 - Indicating the City's Intent to Permit Connection Into Its Municipal Sewer System (Pioneer Centre) This resolution had been deferred from meeting of 5123172. Ald. DeBack requested that at this time the Clerk read a communication from Raymond Wallner of Greater Milwaukee Realty, Inc., directed to the Mayor, Common Council, Plan Commission and Sewer Committee, dated 6113172, indicating his intent to develop lands known as the former Loomis Farm in the near future. Dis- cussion followed between the Mayor and Aldermen regarding the number of lots and open land in the northwest district that have been assessed for sewers and could be developed and the probable capacity of the treatment plant in that district. Ald. Sapp moved to defer action on Resolution 1~108-72 until the meeting of June 27, 1972, seconded by Ald. Knudsen. Upon a roll call vote to defer action on Resolution l/108-72, Aldermen DeBack, Dumke, Foldy, Ford, Knudsen and Sapp voted "aye". Ald. Schaumberg voted "nay". The motion to defer carried. NEW BUSINESS Resolution #116-72 - The Clerk read same, entitled, Accepting Community Newspaper, Inc. as the Official Newspaper of the City of Muskego. Ald. Sapp moved for adoption, seconded by Ald. Dumke. Upon a roll call vote, the motion to adopt carried unanimously. Resolution i/117-72 - The Clerk read same, entitled, Acceptance of Offer to Purchase a Parcel of Land in the Industrial Park (L & L Litho Service, Mr. Ladd Marek). Ald. Foldy moved for adoption, seconded by Ald. Sapp. The Clerk read a communication from Mr. Marek reviewing his proposal. Upon a roll call vote, the motion to adopt Resolution j/117-72 carried unanimously. Resolution i/118-72 - The Clerk read same, entitled, Denying Request for Municipal Sewers to Serve the Lazynski Beck Property. Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Ald. Schaumberg moved to defer action on Resolution i/118-72 for two weeks pending legal counsel. The Clerk read a letter from Herbert Puetzer, directed to the Mayor and Council, dated 6/13/72, requesting that the Lazynski Beck proposed development be permitted to connect into the city's sewer system. Upon a roll call vote, the motion to defer action on Resolution l/118-72 carried unanimously. Resolution i/119-72 - The Clerk read same, entitled, Directing the City Attorney to Prepare the Ordinance for the Rezoning of the Frank Narlock property. Ald. Schaumberg moved for adoption, seconded by Ald. Knudsen. Upon a roll call vote, Aldermen DeBack, Foldy, Knudsen, Sapp,Sc~haumberg h Dinake voted "aye". Ald. Ford voted "nayl'. The motion to adopt Resolution i/119-72 carried unanimously. Resolution 1~7-72 - Ald. Foldy moved to suspend the rules in order that this resolution could be acted upon this evening. Seconded by Ald. Schaum- berg. Upon a roll call vote, the motion to suspend the rules carried unanimously. The Clerk read same, entitled, Proceedings by the Common Council of the City of Muskego to Discontinue and Vacate a Portion of the 124th Street Right-of-way. Ald. Foldy moved for adoption, seconded by Ald. Schaumberg. Upon a roll call vote, the motion to adopt carried unanimously. VOUCHER APPROVAL - Ald. Sapp moved for the approval of payment of Sewer Utility vouchers in the amount of $4,825.97. Seconded by Ald. Dumke. a Upon roll call the motion carried unanimously. Voucher Approval - Cont'd. Common Council Meeting 6113172 - Page 3. Ald. Sapp moved for the approval of payment of general vouchers in the amount of $199,107.20. Seconded by Ald. Dumke. Upon roll call unanimously carried. Ald. Sapp moved for the approval of payment of sewer construction vouchers in the amount of $73,796.92. Seconded by Ald. Foldy. Upon roll call the motion carried unanimously. LICENSE APPROVAL Ald. Sapp moved for the approval of Class "A" and Class "B" Fermented Malt Beverage and Intoxicating Liquor Licenses and Class "A" Fermented Malt Beverage Licenses as per the submitted list. Seconded by Ald. Dumke, motion carried. Ald. Foldy moved for the approval of Swimming Beach Permits and Waterway Marker Permits for Daniel P. Amann, L. Martin Oschmann and Denoon Beach, Inc. Seconded by Ald. Sapp, motion carried. Ald. Dumke moved for approval of Operators License for Gilbert Nick, subject to receipt of favorable Fingerprint Report. Seconded by Ald. Foldy, motion carried. Ald. Dumke moved for the approval of Operators License for Howard Mattes and Robert Rammel, subject to receipt of favorable Medical and Fingerprint Reports. Seconded by Ald. Sapp, motion carried. Ald. Sapp moved for the approval of Trap and Skeet Shooting Galleries for Richard Bennett, Robert Schaack, Alvin Simon and Julius Caesar, subject to review by Zoning Officer Lee of the Caesar location. Seconded by Ald. Foldy, motion carried. CITY OFFICIAL'S REPORTS The Clerk read the Building Report for the month of May, 1972, showing 19 new dwellings and total construction for that month in the amount of $608,705.00. Report placed on file. COMMUNICATIONS AND MISCELLANEOUS BUSINESS The Clerk read a petition from John Groh, Agent for Mary Preston, re- questing determination of legal lot status for Lots 31, 32, 33, 34, 35 and 37, Mill Valley Heights, Unrecorded Subdivision. Petition referred to Plan Commission. The Clerk read a communication directed to Mayor and Council from City Plan Commission, dated 6/g/72, regarding the Wauer Landfill Permit. Re- ferred to Welfare Committee. The Clerk read a communication from Frank DeAngelis regarding the road right-of-way on Woods Road. Communication referred to City Attorney. ADJOURNMENT - Ald.
