MINUTES OF MEETING HELD MAY23, 1972
Mayor Gottfried called the meeting to order at 7~58 P.M.
l PRESENT: Mayor Gottfried, Aldermen DeBack, Dumke, Foldy, Ford, Knudsen,
Sapp and Schaumberg. Also present were City Clerk Bette 3. Bowyer and . City Attorney John P. Buckley.
APPROVAL OF MINUTES - Ald. Sapp moved for the approval of minutes of

the previous meeting held on May 9, 1972, and moved that they be approved
and placed on file. Seconded by Ald. Schaumberg, motion carried.
COMMITTEE REPORTS
Ald. Sapp presented the report of the Finance Committee meeting held
May 17, 1972, and moved that they be accepted and placed on file.
Seconded by Ald. Dumke, motion carried.
Ald. Ford presented the report of the Public Works Committee meeting held
on May 18, 1972, and moved that the report be accepted and placed on file.
Seconded by Ald. DeBack, motion carried.

Ald. Ford presented the report of the Public Safety Committee meeting

file, seconded by Ald. Sapp and the motion carried.
Ald. Ford presented the report of the Rules, Laws & Ordinance Committee
meeting held on May 13, 1972, and moved that the report be accepted and
placed on file. Seconded by Ald. Foldy, motion carried.
Ald. Sapp presented the reports of the Public Welfare Committee meetings
held on May 13, 1972, and moved that the reports be accepted and placed
on file. Seconded by Ald. Dumke, motion carried.
Ald. Knudsen presented the report of the Building Committee meeting held
on May 22, 1972, and moved that the report be accepted and placed on file.

received and placed on file.

Ordinance #217 - The Clerk read same, entitled, An Ordinance to Amend
Certain Provisions of Ch. 17 of the Municipal Code (Re: Accessory Buildings)
Ald. Foldy moved for adoption, seconded by Ald. Knudsen. Ald. Foldy moved
to defer action on Ordinance #217 to give the Rules, Laws& Ordinance
Committee an opportunity to clarify the verb&age in paragraph G. Seconded
by Ald. DeBack. Motion to defer carried.

Ald. Foldy moved for adoption, seconded by Ald. Ford. Upon a roll call
vote, the motion to adopt Ordinance #223 carried unanimously.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
-e The Clerk read a proclamation by Mayor Gottfried declaring the City of
Muskego a Third Class City.
NEW BUSINESS
Resolution #S-72 - The Clerk read same, entitled, Appointment of Council
Member to Park and Recreation Board (Ronald Ford) Ald. Foldy moved for
adoption, seconded by Ald. Dumke. Upon roll call, motion carried unanim-
ously.
Resolution 889-72 - The Clerk read same, entitled, Appointment of Citizen
Member to Park & Recreation Board (Robert Gumieny). Ald. DeBack moved l for adoption, seconded by Ald. Schaumberg. Upon a roll call vote, motion
carried unanimously.
Resolution #lOl-72 - The Clerk read same, entitled, Establishing Salaries
for Sewer Inspectors. Ald. Sapp moved for adoption, seconded by Ald. Dumke.
Ald. Sapp moved to amend the resolution by changing the Hiring Rate from
$3.75 to $3.50. Seconded by Ald. DeBack. Upon a voice vote, the motion
to amend carried. The motion to adopt Resolution #lOl-72, As Amended, carried unanimously.
Resolution #102-72 - The Clerk read same, entitled, A Resolution to Amend
Resolution #32-72, As Amended, Establishing Salaries for City of Muskego
Employees (Lieutenants and Police Chief) Ald. Sapp moved for adoption,
seconded by Ald. Foldy. Ald. Knudsen and DeBack spoke in opposition of
the resolution. Upon..a roll call vote to adopt the resolution, Aldermen
Dumke, Foldy, Ford, Sapp and Schaumberg voted "aye". Aldermen DeBack and
Knudsen voted "nay". The motion to adopt Resolution 8102-72 carried.
l Resolution #103-72 - The Clerk read same, entitled, Denial of Claim of
Jack Principati. Ald. Foldy moved for adoption, seconded by Ald. Sapp.
Upon a roll call vote, the motion to adopt carried unanimously.
Resolution #lo44 The Clerk read same, entitled, Appointment of Members
to Capital Budget Committee (Harold DeBack, Bette Bowyer, Alvin Basse,
Betty Teisl, James White, Lois Sapp, Walter Koehn, William Chase and
Gerald Faber) Ald. Schaumberg moved for adoption, seconded by Ald. Ford.
Upon a roll call vote, the motion to adopt carried unanimously.
Resolution $1106-72 - The Clerk read same, entitled, Indicating the City's
Intent to Permit Connection Into Its Municipal Sewage System (F. Narlock)

Resolution #108-72 - The Clerk read same,, entitled, Indicating the City's
Intent to Permit Connection Into Its Municipal Sewer System (Pioneer
Centre) Ald. Schaumberg moved for adoption, seconded by Ald. Knudsen.
Ald. Schaumberg moved to defer action on Resolution 8108-72 because a
recommendation had not been made by the Public Sewer Committee. Seconded
by Ald. Knudsen. Upon a voice vote, the motion carried.
Resolution #109-72 - The Clerk read same, entitled, Authorizing the
Advertising of Bids for Installation of Sanitary Sewers (Project MSS-l-72
and MSS-2-72 Hillendale Heights and Hi-Y Ranches Subdivision area)
Ald. Schaumberg moved for adoption, seconded by Ald. Dumke. Ald. Ford
moved to defer action on Resolution 8109-72 in an attempt to alleviate
previous problems resulting from improper restoration by sewer contractors
and the possible tightening up of specifications by the Sewer Committee.
Mayor Gottfried urged that the aldermen not defer action on this resolu-
tion as construction could be delayed until September and time is of the
essence regarding the rising costs to the property owner. Upon a roll
call vote to defer action on Resolution #109-72 the motion was defeated
unanimously. Upon a roll call vote to adopt Resolution #109-72, the
motion carried unanimously.
Resolution allO- -The Clerk read same, entitled, Denying the Request
to Amend the T:.xt of the Zoning Ordinance of the City of Muskego (Camping
facilities in OLR Districts) Ald. Schaumberg moved for adoption, seconded
by Ald. :Dumke. Upon a roll call vote, the motion to adopt carried unan-
imously.
Resolution #ill-72 - The Clerk read same, entitled, Directing the City
Attorney to Draft an Ordinance to Amend the Zoning Ordinance of the City
of Muskego (Kilps-Pioneer Centre). Ald. Schaumberg moved for adoption,
seconded by Ald. Foldy. Ald. DeBack advised that he had received calls
questioning whether or not the sale of this city-owned land had ever
been recommended by the Plan Commission and also, whether or not the
proposed development would affect the wells in the area. Ald. Sapp moved
to amend Resolution by adding the following to the last paragraph "subject
to action by the Plan Commission on the sale of the land." Seconded by
Ald. Schaumberg. Upon a voice vote, the motion to amend carried. Upon
a roll call vote, the motion to adopt Resolution #ill-72, As Amended,
carried unanimously.
Ordinance i/225 - The Clerk gave the first reading of same, entitled,
An Ordinance to Amend Ch. 1.05 of the Municipal Code of the City of
Muskego (Plan Commission Membership)
Resolution 11112-72 - Approving of the Awarding by the Park and Recreation
Board for Pump Installation in Kurth and Lions Park and Drilling of Well
in Lions Park. Ald. Foldy moved to suspend the rules that would interfere
with the adoption of Resolution #112-72. Seconded by Ald. Schaumberg.
Upon roll call the motion to suspend the rules carried unanimously.
The Clerk read the resolution. Ald. Schaumberg moved for adoption,
seconded by Ald. DeBack. Upon roll call the motion to adopt carried
unanimously.
Resolution #113-72 - Authorizing Additions to the City Hall-Library
Contract. Ald. DeBack moved to suspend the rules in order that this
resolution could be acted upon this evening. Seconded by Ald. Foldy.
Upon roll call the motion to suspend the rules carried unanimously. The
Clerk read the resolution. Ald. DeBack moved for adoption, seconded by
Ald. Foldy. Following discussion, Ald. Sapp moved to amend the resolution
by deleting the words "an estimated" in the 4th paragraph. Seconded by
Ald. Knudsen. Ald. DeBack and Mayor Gottfried spoke in opposition to the
amendment. Upon a roll call vote to amend, Aldermen DeBack, Dumke, Foldy
and Schaumberg voted "nay". Aldermen Ford, Knudsen and Sapp voted "aye".

The motion to amend did not carry. Ald. DeBack moved to have the last line of paragraph 4 read "at a cost not to exceed $3DCD.CC. Seconded by Ald. Dumke. Upon a roll call vote, Aldermen DeBack, Foldy, Ford
and Sapp voted "aye" Aldermen Knudsen and Schaumberg voted "nay". The motion to amend Resolution #113-72 carried. Ald. Knudsen moved
to further amend Resolution #113-72 by removing all wording pertaining
to the rough grading of the city hall-library site from the resolution.
The motion lost for lack of a second.. Upon a roll call vote the motion
to adopt Resolution #113-72, As Amended carried unanimously.
At 10:00 P.M. Mayor Gottfried ddclared a recess and the meeting reconvened
at 1O:lC P.M.
Resolution #105-72 - The Clerk read same, entitled, Declaring the City's
Intent to Approve the Use of Assessment "B" Bonds for Private Developers. Ald. Sapp moved for adoption, seconded by Ald. DeBack. At this time
Mr. Seegar Swanson appeared at the meeting, along with Mr. Robert Ehlers,
of the Financial Consulting Firm of Ehlers & Associates, to explain the
benefits of city participation in the use of Assessment "B" Bonds for
private developers.
Clemons,
Mr. Neal Madison of the Firm of Quarles, Herriott,
Teschner &.Noelke who was also present at the meeting, advised
of the possible increases of the city's allotment of state shared taxes.
Ald. Sapp moved to amend the fifth paragraph, second line, by adding
the words "and financial consultants Ehlers & Associates". Seconded
by Ald. Dumke. Upon a voice vote, the motion to amend carried. Upon a roll call vote, the motion to adopt Resolution #105-72, As Amended,
carried unanimously.
VOUCHER APPROVAL - Ald. Sapp moved to approve payment of vouchers in
the amount of $147,386.98, payable 5123172. Seconded by Ald. Dumke.
Upon roll call the motion to pay the vouchers carried unanimously.
LICENSE APPROVAL - Ald. Sapp moved for the approval of Operators Licenses
for Bruce Kaltenbrun and James White. Seconded by Ald. Dumke, motion
carried.
Ald. Foldy moved for the approval of Operators License for David Hense and
Ronald Kelber, subject to receipt of a favorable Fingerprint Report.
Seconded by Ald. Sapp, motion carried.
Ald. Dumke moved for the approval of Operators License for Henry Harter
subject to receipt of favorable Medical and Fingerprint Report. Seconded
by Ald. Foldy, motion carried.
Ald. Sapp moved for the approval of a Gathering License for St. Paul's Ev.
Lutheran Church for August 5, 1972. Seconded by Foldy, motion carried.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
The Clerk read a letter from the Plan Commission, dated 5/H/72 directed to
the Council requesting recommendation as to whether or not Mus-kee-guac
would be permitted to connect into the municipal sewer. Referred to Sewer
Committee.
The Clerk read a letter from the Plan Commission, dated 5/H/72, directed
to the Council, requesting whether or not the Lazynski-Beck Subdivision
would be permitted to connect into the municipal sewer. Referred to Sewer Committee.
The Clerk read a communication from the Plan Commission, dated 5118172,
directed to the Council, recommending denial of the request to amend the
Zoning Ordinance by permitting camping facilities as a conditional use
in an OLR District. Same placed on file.
