CITY OF MUSKEGO
MINUTES OF MEETING HELD MAY 9, 1972
Mayor Gottfried called the meeting to order at 7:59 P.M.
PRESENT: Mayor Gottfried, Aldermen DeBack, Dumke, Foldy, Ford, Knudsen,
Sapp and Schaumberg. Also present were City Clerk Bette J. Bowyer and
City Attorney John P. Buckley.
APPROVAL OF MINUTES - Ald. Sapp moved for the approval of minutes of
previous meeting held on April 25, 1972, and moved that they be approved
and placed on file. Seconded by Ald. Foldy, motion carried.
COMMITTEE REPORTS
Ald. Sapp presented the report of the Finance Committee meeting held
May 3, 1972, and moved that they be accepted and placed on file. Con-
siderable discussion took place relative to the hauling of garbage and
refuse to the city dump with unlicensed vehicles. All trucks have now
made application as per Ordinance 8195. The motion to accept the minutes
was seconded by Ald. Dumke and carried.
Ald. Ford presented the report of the Public Works Committee meeting held
on May 4, 1972, and moved that the report be accepted and placed on file.
Seconded by Ald. DeBack. Ald. Foldy advised that the advisory traffic
sign in the vicinity of Longfellow La and Somerset Dr. would again be
reviewed. The motion to accept the repo rtcarried.
Ald. Knudsen presented the report of the Public Sewer Committee meeting
held on May 8, 1972, and moved that it be accepted and placed on file. Sec- onded by Ald. Dumke, motion carried.
The minutes of the Plan Commission meeting held on May 2, 1972, were re-
ceived and placed on file.
UNFINISHED BUSINESS
Ordinance #216 - An Ordinance to Amend Certain Provisions of Ch. 17 of
the Municipal Code (Re: Fencing of Permanent Pools) Ald. Foldy moved to
defer action on same until further reviewed by the Rules, Laws & Ordinance
Committee. Seconded by Ald. Sapp, motion carried.
Resolution 872-72 - Accepting 1972 Contract with Wis. Council of County
and Municipal Employees, Local 1365-B (Dispatchers) Ald. Sapp moved to
defer action on same. Seconded by Ald. Foldy, motion carried.
Resolutions #63-72, i/64-72, and 865-72, re: Industrial Park and Municipal
Garage to be considered following action on Resolution i/92-72, entitled,
Authorizing the Borrowing of Funds for Municipal Purposes.
Resolution #83-72 - Determination of Legal Lot (T. Campbell) This resolution
was on the floor and upon a roll call vote to adopt same, Aldermen DeBack,
Foldy and Schaumberg voted "aye". Aldermen Dumke, Ford, Knudsen and
Sapp voted "nay". The motion to adopt Resolution #83-72 did not carry.
Ordinance #221 - An Ordinance to Amend the Zoning Map of the City of Muskego
(Durham Meadows). Ald. DeBack moved for adoption, seconded by Ald. Foldy.
Upon a roll call vote, the motion to adopt carried unanimously. (2nd rdg.)
Ordinance #222 - The Clerk gave the second reading of same, entitled,
An Ordinance to Amend the Zoning Map of the City of Muskego (Hale Park
Meadows) Ald. Foldy moved for adoption of same, seconded by Ald. Schaum-
berg. Upon a roll call vote, the motion carried unanimously.

The Clerk read a proclama~tion by Mayor Gottfried proclaiming the month
of May, 1972, as Poppy Month and the week of May 21st thru May 30th as
* AMERICAN LEGION POPPY WEEK in the City of Muskego.
NEW BUSINESS
Resolution l/85-72 - The Clerk read same, entitled, Acceptance of Radio Main-
0 tenance Contract (Ken Corn). Ald. Schaumberg moved for adoption, seconded
by Ald. Sapp. Chairman Sapp of the Public Safety Committee advised that
her committee has had no complaints from either the police or fire depts.
regarding Ken Corn's service. Upon a roll call vote, the motion to adopt
same carried unanimously.
Resolution 1186-72 - The Clerk read same, entitled, Denial of Wieselmann
claim. Ald. Foldy moved for adoption, seconded by Ald. Sapp. Upon a roll
call vote, the motion to adopt carried unanimously.
Resolution #S7-72 - The Clerk read same, entitled, Requiring the Payment
of Delinquent Withholding Taxes and State Sales Tax Prior to the Issuance
of Class "A" and Class "B" Fermented Malt Beverage and Intoxicating Liquor
l Licenses. Ald. Sapp moved for adoption, seconded by Ald. Dumke. Upon a
roll call votei. the motion to adopt carried unanimously.
Resolution #90-72 - The Clerk read same, entitled, Appointment of Members
to Watershed Commission (Ald. Dumke and Ald. Ford, Roy Henrichs, Walter
Koehn, Walter Spann, Donald Schaefer and Phil Iglinski - Term to expire
May 1, 1974). Ald. Sapp moved for adoption, seconded by Ald. DeBack.
Upon a roll call vote, the motion to adopt carried unanimously.
Resolution f/91-72 - Appointment of Alternate Member to Board of Appeals
(Donald Axtmann - Term to expire May 1, 1975). Ald. Foldy moved for
adoption, seconded by Ald. Schaumberg. Upon a roll call vote, the motion
carried unanimously.
Resolution #92-72 - The Clerk read same,~ entitled, A Resolution Authorizing
and Providing for the Borrowing of $800,000.00 by the City of Muskego, Wis.,
and for the Issuance of Promissory Notes to Evidence said borrowing. Ald.
Foldy moved for adoption, seconded by Ald. Sapp. At this time Financial
Consultant Seegar Swanson of Ehlers & Associates appeared at the meeting
to review his firm's summary relating to promissory notes and Resolution
j/92-72. Ald. Sapp moved to amend paragraph 3 by changing the wording
"regular meeting" to "special meeting". Second:ed by Ald. Foldy (bids rec'd.
for promissory notes to be on June 1, 1972.) The motion to amend-carried.
Upon a roll call vote, the motion to adopt Resolution 892-72, As Amended,
carried unanimously.
Resolution i/63-72 - Acceptance of Low Bid for Construction of Municipal
Garage. Ald. Sapp moved to defer action on same until June 1, 1972.
Seconded by Ald. Schaumberg, motion carried.
Resolution i/64-72 - Acceptance of Low Bid for Grading of a Portion of

Industrial Park. Ald. Foldy moved to defer action on same until June 1,
1972. Seconded by Ald. Dumke, motion carried.
Resolution i/65-72 - Acceptance of Low Bid for Installation of Sewer and
Water Mains in a Portion of Industrial Park. Ald. DeBack moved to defer
action on same until June 1, 1972, motion seconded by Ald. Schaumberg and l carried.

Resolution 893-72 - The Clerk read same, entitled, Approving the decision
of the Park & Recreation Board to Build Shelters in Lions and Kurth Park.
Ald. Foldy moved for adoption, seconded by Ald. Dumke. Ald. Foldy moved

to amend Resolution $193-72 by changing the amount of the total cost to
$13,458.90 in the third and fifth paragraph. Seconded by Ald. Dumke.
Upon a voice vote, the motion to amend carried. Upon a roll call vote,
the motion to adopt Resolution $193-72, As Amended, carried unanimously.
Resolution l/94-72 - The Clerk read same, entitled, Urging the County to
a Continue Tax Settlements as Presently Provided For. Ald. Foldy moved
for adoption, seconded by Ald. Sapp. Upon a roll call vote, the motion
to adopt carried unanimously.
Resolution j/95-72 - The Clerk read same, entitled, Authorizing the Advertis-
ing of Bids for Concrete Inverts. Ald. DeBack moved for adoption, Seconded
by Ald. Ford. Upon a roll call vote the motion to adopt carried unanimously.
Resolution j/96-72 - The Clerk read same, entitled, Accepting the Low Bid
for Liquid Asphalt and Bituminous Asphalt for 1972 Road Improvement
Program (Rupert Construction and Payne & Dolan) Ald. DeBack moved for
adoption, seconded by Ald. Schaumberg. Upon a roll call vote the motion
carried unanimously. l Resolution $197-72 - The Clerk read same, entitled, Urging the Construction
of Moorland Road to S.T.H. 24. Ald. DeBack moved for adoption of same.
Seconded by Ald. Schaumberg. Upon a roll call vote, the motion to adopt
carried unanimously.
Resolution #98-72 - Approval of Addition to Muskego Dam Construction
Project. Ald. Foldy moved to suspend the rules in order that this res-
olution could be acted upon this evening. Seconded by Ald. Schaumberg.
Upon a roll call vote, the motion to suspend the rules carried unanimously.
The Clerk read same. Ald. De Back moved for adoption, seconded by
Ald. Ford. Upon a roll call vote the motion to adopt carried unanimously.
Resolution #99-72 - Requesting a Thirty Day Extension for Recommendation
of Rezoning of the Narlock Property. Ald. Foldy moved to suspend the
rules that would interfere with the adoption of Resolution $199-72. Seconded
by Ald. Schaumberg. Upon a roll call vote the motion to suspend the rules
carried unanimously. The Clerk read same. Ald. Schaumberg moved for
l adoption. Seconded by Ald. Sapp. Upon a voice vote the motion carried.
The resolution will be referred to the Public Sewer Committee.
Resolution $1100-72 - Accepting the Low Quotation for Installation of Sewer
Connection (Zidar Plbg. Co.) Ald. Foldy moved to suspend the rules in
order that same could be acted on at this meeting. Seconded by Ald. Schaum-
berg. Upon roll call the motion to suspend the rules carried unanimously.
The Clerk read the resolution. Ald. Schaumberg moved for adoption. Sec-
onded by Ald. Dumke. Ald. Knudsen moved to amend Resolution 11100-72 by
adding the following para~graph "BE IT FURTHER RESOLVED that this acceptance
is predicated upon the completion of the project within thirty days."
Seconded by Ald. Schaumberg. Upon a voice vote the motion to amend carried.

carried unanimously. Ordinance $1223 -The Clerk gave the 1st rdg., entitled An Ord. to Amend Ch. 1

amount of $73,3X.26 payable 519172. Seconded by Ald. Dumke. Upon a
roll call vote the motion carried unanimously.
LICENSE APPROVAL - Ald. Sapp moved for the approval of Operators License
for Harold Ziemba pending receipt of favorable Medical and Fingerprint
Reports. Seconded by Ald. Foldy, motion carried.
Ald. Foldy moved for the approval of Operators License for Stephen Kuhs,
Jr. and Benjamin Da,vis pending receipt of favorable Fingerprint Reports.
Seconded by Ald. Dumke, motion carried.
Ald. Foldy moved for approval of Operators License for Christine Durnil
and Linda Sulla, seconded by Ald. Sapp, motion carried.
Ald. Sapp moved for the approval of Class "B" Fermented Malt Beverage
and Intoxicating LiquorLicense for Bristol Oaks Corporation, Eugene
Reigel, Agent. Seconded by Ald. Dumke. Upon a voice vote the motion
carried.
Ald. Sapp moved for the approval of the licensing of garbage and refuse
trucks for Robert Moeller, Rel Sanitation, Town & Country Disposal,
Milwaukee Insulation and Charles Waddell. Seconded by Ald. Foldy. Upon
a voice vote the motion carried.
CITY OFFICIAL'S REPORTS - The Clerk read the Building Report for the
month of April which indicated 14 new dwellings for that month. Report
placed on file.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
The Clerk read a communication directed to Mayor and Council, dated May 9,
1972, from the City Plan Commission requesting advisement as to whether
or not sewers would be available for the proposed St. Leonard's Subdivision.
Communication referred to Public Sewer Committee.
Ald. Foldy moved to set the public hearing date for June 27, 1972, 7:OO PM
for petition filed by Carl Wauer, President of Muskego Rendering Co., Inc.
requesting amendment to the Zoning Ordinance to permit rendering plants in
industrial districts as a conditional use grant. Referred to Plan Commis-
sion.
