MINUTES OF MEETING HELD APRIL 25, 1972
Mayor Gottfried called the meeting to order at 7~35 P.M.
PRESENT: Mayor Gottfried, Aldermen DeBack, Dumke, Foldy, Ford, Knudsen,
Sapp and Schaumberg. Also present were City Clerk Bette J. Bowyer and
City Attorney John P. Buckley.
APPROVAL OF MINUTES - Ald. Sapp moved for the approval of minutes of
organizational meeting held on April 18, 1972 and regular meeting held
on April 11, 1972, as mailed, and that they be placed on file. Seconded
by Ald. Dumke, motion carried.
COMMITTEE REPORTS
Ald. Dumke presented the report of the Public Safety Committee meeting
held on April 13, 1972, and moved that the report be accepted and placed
on file. Seconded by Ald. Sa,pp, motion carried.
Ald. Foldy presented the report of the Building Committee meeting held
on April 13, and moved that the report be accepted and placed on file.
Seconded by Ald. DeBack, motion carried.
The minutes of the Plan Commission meeting held on April 12, 1972, were
received and placed on file.
UNFINISHED BUSINESS
Ordinance i/216 - An Ordinance to Amend Certain Provisions of Ch. 17 of
the Municipal Code (Re: Fencing of Permanent Pools) Ald. Foldy moved to
defer action on Ordinance #216 pending further review by the Rules, Laws
and Ordinance Committee. Seconded by Ald. DeBack. Upon a voice vote the
motion carried.
Election of Council Representative to Plan Commission - Because Ald.
Schaumberg wars not elected by a two-thirds majority vote at the organization-
al meeting held on 4118172, it was necessary to hold another election.
Reporters Jim Stessman and Vi Joy acted as ballot clerks. On the nominating
ballot Ald. Schaumberg received four votes and Ald. Ford received three
votes. On the election ballot Ald. Schaumberg received four votes and
Ald. Ford received three votes. On the second election ballot, Ald. Schaum-
berg received five votes and Ald. Ford received two votes. Ald. Schaumberg
was elected to represent the Council on the Plan Commission.
COMMUNICATIONS FROM THE MAYOR'S OFFICE
Mayor Gottfried advised that it is his intention to attend the State of
Wisconsin Industrial Conference to be held at Green Lake, Wisconsin on
May 17 and 18, 1972, and he invited the aldermen and Plan Commission members
to attend with him.
Ald. Schaumberg explained how "Clean and Green Day" to be held on April 29,
1972, will be conducted.
Mayor Gottfried reminded the aldermen of the meeting to be held on 4126172
at the Little Theater of the Intermediate School regarding Little Muskego
Lake.
The Clerk read Mayor Gottfried's Proclamation designating May 1, 1972, as

At this time Mayor Gottfried announced the following appointments to
the standing committees of the Common Council: Finance Committee
Lois Sapp, Charles Foldy and Edwin Dumke. Public Works Committee,
Harold DeBack, Chairman, Paul Schaumberg and Ronald Ford. Rules, Laws
& Ordinance Committee: Charles Foldy, Chairman, Ronald Ford and Paul
Schaumberg. Public Safety Committee: Lois Sapp, Chairman, Ronald
Ford and Harold DeBack. Public Sewer Committee: Paul Schaumberg,
Cha~irman, Edwin Dumke and Richard Knudsen. Public Welfare Committee:
Edwin Dumke, Chairman, Lois Sapp and Richard Knudsen. Building
Committee: Harold DeBack, Chairman, Charles Foldy and Richard Knudsen.
NEW BUSINESS
Resolution j/71-72 - The Clerk read same, entitled, Recognition of
Muskego Professional Police Staff Officers Association (MPPSOA).
Ald. Sapp moved for adoption, seeconded by Ald. Schaumberg. Following
discussion by several of the aldermen, Attorney Buckley advised that
if this resolution were defeated the MPPSOA would have the alternative
to hold an election with a representative of the WERB to determine
which bargaining organization they would choose to be affiliated with.
Upon a roll call vote, the motion to adopt Resolution #71-72 was
unanimously defeated
Resolution 872-72 - The Clerk read same, entitled, Accepting 1972
Contract with Wis. Council of County and Municipal Employees, Local
1365-B (Dispatchers) Ald. DeBack moved for adoption, seconded by Ald.
Saw. Ald. Foldy moved to defer action on Resolution i/72-72 until
the next Council meeting (5/g/72). Seconded by Ald. DeBack. Upon a
voice vote, motion carried.
Resolution 873-72 - The Clerk rea~d same, entitled, Declaring Certain
Weeds to be Noxious. Ald. Sapp moved for adoption, seconded by Ald.
Schaumberg, motion carried.
Resolution #74-72 - The Clerk read same, entitled, Appointment of Weed
Commissioner (Willard Bertram) Ald. DeBack moved for adoption, seconded
by Ald. Foldy. Upon roll call the motion carried unanimously.
Resolution 1175-72 - The Clerk read same, entitled, Authorizing the
Advertising of Bids for Official Newspaper. Ald. Schaumberg moved for
adoption, seconded by Ald. Sapp. Upon a voice vote, the motion carried.
Resolution #76-72 - The Clerk read same, entitled, Appointment of Member
to Police and Fire Commission (Warren Moser) Ald. Foldy moved for
adoption, seconded by Ald. Schaumberg. Upon roll call the motion carried
unanimously.
Resolution i/77-72 - The Clerk read same, entitled, Appointment of Alder-
man to Library Board (H. DeBack). Ald. Schaumberg moved for adoption,
seconded by Ald. Dumke. Upon roll call the motion carried unanimously.
Resolution #7S-72 - The Clerk read same, entitled, Appointment of Citizen
Member to Plan Commission. Ald. DeBack moved for adoption, seconded by
Ald. Schaumberg. Upon roll call the motion carried unanimously.
Resolution #79-72 - The Clerk read same, entitled, Appointment of Member
to Board of Appeals (G. Boehm) Ald. Schaumberg moved for adoption,
seconded by Ald. Foldy. Upon roll call the motion carried unanimously.

Resolution #O-J2 - The Clerk read same, entitled, Appointment of Citizen
Member to Park & Recreation Board (James White). Ald. Sapp moved for
l adoption, seconded by Ald. Schaumberg. Ald. Sapp and Ald. Knudsen spoke
in favor of this appointment. Upon a roll call vote, the motion to adopt
Resolution #30-72 carried unanimously.
Resolution j/81-72 - The Clerk read same, entitled, Appointment of School
District Representative to Park & Recreation Board (Don Yahr). Ald.

Foldy moved for adoption, seconded by Ald. Schaumberg. Upon roll call
the motion carried unanimously.
Resolution #63-72 - The Clerk read same, entitled, Acceptance of Low Bid
for Construction of Municipal Garage. Ald. DeBack moved for adoption,
seconded by Ald. Schaumberg. Ald. Foldy moved to defer action on Resolut-
ion #63-72 for two weeks. Seconded by Ald. DeBack. Ma~yor Gottfried
advised that all of the aldermen would be invited to attend the meeting
of the Finance Committee to be held on May 3, 1972, with Seegar Swanson,
Financial Consultant. Upon a voice vote, the motion to defer action
on Resolution j/63-72 carried.
Resolution #64-72 - The Clerk read same, en'titled, Acceptance of Low Bid
l for Grading of a Portion of Industrial Park. Ald. DeBack moved for
adoption, seconded by Ald. Dumke. Ald. DeBack moved to defer action on
Resolution 864-72, for two weeks. Seconded by Ald. Foldy. Upon a voice
vcte the motion to defer carried.
Resolution i/65-72 - The Clerk read same, entitled, Acceptance of Low
Bid for Installation of Sewer and Water Mains in a Portion of Industrial
Park. Ald. DeBack moved for adoption, seconded by Ald. Schaumberg. Ald.
DeBack moved to defer action on this resolution for two weeks, seconded by
Ald. Schaumberg. Upon a voice vote the motion to defer carried.
Resolution i/82-72 - The Clerk read.same, entitled, Approval of Subdivision
Staking Surety Bond (Durham Meadows and Hale Park Meadows) Ald. Foldy
moved for adoption, seconded by Ald. DeBack. Mr. Ray Gray, representing
Rite Realty Co. eppeared at the meeting to explain the reason for his
request to waive the placing of iron stake at this time in order to ex-
pedite the developments. Upon a roll call vote the motion to adopt Res-
olution #Z-J2 carried unanimously.
Resolution #S3-72 - The Clerk read same, entitled, Determination of Legal
Lot (T. Campbell) Lot 14 Oak Ridge Unrecorded Subdivision. Ald. DeBack
moved for the adoption of the resolution, seconded by Ald. Ford. Con-
siderable discussion followed with Aldermen Knudsen and Ford speaking in
opposition to the adoption of the resolution. Ald. DeBack felt the right
to use the lot could not be denied. Ald. Schaumberg moved to defer action
on this resolution for two weeks to provide an opportunity to personally
view the lot. Seconded by Ald. Foldy. Upon a voice vote motion carried.
Resolution #84-72 - Ald. Foldy moved to suspend the rules that would
interfere with the adoption of Resolution #84-72, seconded by Ald.
Schaumberg. The Clerk read same, entitled, Waiving of Building Permits
l for Buildings in City Parks. Ald. Foldy moved for adoption, seconded by
Ald. Schaumberg. Ald. Foldy moved to amend Resolution 884-72 by adding
the word "fees" to the title and following the word"pennit"in the context
of the resolution. Seconded by Ald. DeBack. Upon a voice vote, the
motion to amend carried. Upon a roll call vote, the motion to adopt
Resolution #84-72, As Amended, carried unanimously.

Ordinance #221 - The Clerk gave the first reading of same, entitled,
An Ordinance to Amend the Zoning Map of the City of Muskego (Durham
Meadows T Wollman farm)
Ordinance #222 - The Clerk gave the first reading of same, entitled,
An Ordinance to Amend the Zoning Map of the City of Muskego (Hale Park
Meadows - Schmidt farm).
VOUCHER APPROVAL - Ald. Sapp moved for the approval of payment of
vouchers in the amount of $41,859.73, payable 4125172. Seconded by
Ald. Foldy. Upon a roll call vote the motion carried unanimously.
Ald. Sapp moved for the approval of payment of sewer utility vouchers
in the amount of $10,718.23, payable 4125172. Seconded by Ald. Foldy.
Upon a roll call vote the motion to pay the sewer utility vouchers
carried unanimously.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
The Clerk read a communication directed to the Mayor and Council,
dated 4125172, from Frank DeAngelis, regarding Woods Road. Same
referred to Public Works Committee.
The Clerk read a communication from the City Plan Commission, directed
to the Mayor and Council, dated 4/19/72, recommending denial of the
Pioneer Centre planned development.
The Clerk read a communication from James M. Heling of Unitized Homes,
Inc. directed to the Mayor and Council, dated 4124172, requesting re-
discussion of density, ratio of bedroom units, etc. of Pioneer Centre
by the Plan Commis$ion. Communication referred to Plan Comrrission.
The Clerk read communications directed to the Mayor and Council from
the Muskego Yacht Club and Mr. Don Axtmann, Pres. of the Jaycees,
indicating their desire to keep the water level of Little Muskego Lake
lowered. Communications referred to the Public Welfare Committee.
Ald. Foldy moved to set the public hearing date for a zoning change
from RS-2 to RSM with a OPD to permit the dsvelopment of Pionexcentre.
for May 23, 1972, at 7:00 P.M. Seconded by Ald. Schaumberg, motion
carried.

Ald. Sapp moved to adjourn, seconded by Ald. DeBack. Motion carried.
